Sousa's Concert Band addressed the
Council and invited them to come

tickets.

To the Honorable Mayor and Coun-
cil of the City of Dubuque.
Gentlemen: On January 17th, 1926,
Mrs. Wm. Aird sustained serious in-
juries by falling upon an icy side-
walk at the corner of West Fifth
Street and Paulina Street. The re-
sult of this fall was to prevent Mrs.
Aird from attending to her ordinary
housework duties, as well as contin-
uing in her employment and required
her to procure the services of physic-
ians to attend to her injuries. Mrs.
Aird will accept the sum of $300.00
in settlement of her claim which is
approximately the amount of her ex-
pense. In view of the injury and
the condition of the place where it
occurred I would respectfully recom-
mend that this settlement be made.
Some time ago Peter Kunnen ad-
dressed the Council with reference
to injuries sustained by his daugh-
ter, Dolores Kunnen at 29th and Pin -
nard Streets, on January 26th, 1926.
She broke her left arm above the
wrist. The facts in this case are
familiar to the Council and upon
your advice I have secured an agree-
ment from Mr. Kunnen to settle the
claim for $100.00. If these settle-
ments are satisfactory to your Hon-
orable Body, I recommend that the
Auditor be instructed to draw war-
rants in favor of Mrs. W. F. Aird in
the sum of $300.00, and Peter A.
Kunnen in the sum of $100.00.

is the regular monthly meeting of
the City Council for the transaction
of such business as may regularly
come before the meeting, and that
this date is also set for the purpose
of levying special assessments and
the issuing of bonds to pay for the
improvement of the following
streets, to -wit:
Race Street, Heeb Street, Roland
Street„ and West 3rd Street, also
levying assessments for the con-
struction of a sidewalk in front of
Lot 210, Union Add., and the mak-
ing of gas connections on the im-
provement of McCormick Street.

1265 shall constitute the seventh se-
ries and shall be payable the lst
day of April, 1933; the bonds num-
bered 1266 to 1267 shall constitute
the eighth series and shall be pay-
able the lst day of April, 1934; the
bonds numbered 1268 shall consti-
tute the ninth series and shall be
payable the 1st day of April, 1935;
the bonds numbered 1269 shall con-
stitute the tenth series and shall be
payable the 1st day of April, 1936.
Said bonds shall bear interest at
the rate of 5% per annum, which
interest shall be payable semi-
annually, in accordance with the
terns of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment levied for said improve-
ment. Both principal and interest
shall be payable at the office of the
City Treasurer in the City of Du-

Improvement Bond.
The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 ; or any time before that date
at the option of the City the sum of
One Hundred Dollars with interest
thereon at the rate of 5 per cent per
annum, payable on the presentation
and surrender of the interest cou-
pons hereto attached, both interest
and principal are payable at the of-
fice of the City Treasurer in the City
of Dubuque in the State of Iowa.
This bond is issued by the City of
Dubuque pursuant to and by virtue
of Chapter 311 of the Code of Iowa,
1924, and in accordance with a reso-
lution of the City Council of said
City, duly passed on the 1st day of
November, 1926. This bond is one
of a series of 16 bonds, 15 for
$100.00, numbered 1254 to 1268, and
one for $94.33, numbered 1269, all
of like tenor and date, and issued
for the purpose of improving Race
Street and described in said resolu-
tion; which cost is assessable and
levied along said improvement, and
is made by law a lien on all abut-
ting or adjacent property, and pay-
able in ten annual installments, with
interest on all deferred payments at
the rate of five per cent per annum,
and this bond is payable only out of
the money derived from the collec-
tion of said special tax, and said
money can be used for no other
purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done prec-
edent to and in the issuing of this
series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness whereof the City of Du-
buque by its City Concil has caused
this bond to be signed by its Mayor
and countersigned by its City Clerk,
with the seal of said City affixed
this 1st day of December, 1926, and
has authorized the use of their fac-
simile signatures to the interest
coupons hereto attached.

Whereas, the contract heretofore '
entered into by the City of Dubuque
for the improvement of Race Street,
hereinafter described, has been com-
pleted and said improvement has
been accepted by the City Council of
said City, and the City Engineer has
computed the cost and expense
thereof to be $1,594.33.
And Whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improving Race Street from the
north line of West 11th Street to
the south line of Rose Street, there
be issued Improvement Bonds to the
amount of $1,594.33. Said bonds
shall be issued under the provision
of Chapter 311 of the Code of Iowa,

entered into by the City of Dubuque

Street hereinafter described has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the cost and
expense thereof to be $1238.83.
And whereas, public notice as
provided by law, has been published
by the City Clerk stating the inten-
tion of the City Council to issue
bonds to pay the cost of said im-
provement and a public hearing has
been considered and determined:
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost

AN ORDINANCE granting permis-
sion to Jake Rosenthal, his suc-
cessors and assigns to erect and
maintain a viaduct across the alley
connecting city lots 18 and 183 and
prescribing conditions for such
grant.
Whereas, Jake Rosenthal has peti-
tioned the City Council of the City
of Dubuque for permission to erect
and maintain an archway or viaduct
across the alley which extends from
5th to 6th Street between Main and
Iowa Streets so as to connect the-
ater buildings to be hereafter erect-
ed upon City Lot 18 and 183, said
viaduct to permit a clearance of at
least twelve feet from the alley un-
derneath; and
Whereas, this Council is ever anx-
ious to assist in the promotion of
Worthy enterprises which make for
the further progress and develop-
ment of the City, and, after having
made due investigations, find no
reason to object to the erection and
maintainence of the structure pro-
posed to be built; now therefor
Be it ordained by the City Coun-
cil of the City of Dubuque:
Section 1. That permission be
and it is hereby granted to Jake
Rosenthal, his successor and as-
signs to erect and maintain a viaduct
across the alley which extends from
5th Street to 6th Street and lies be-
tween Main and Iowa Streets so as
to connect the theater buildings
which are hereafter to be construct-
ed upon City Lots 18 and 183.
Section 2. That said viaduct shall
be constructed of fire proof mater-
ials and be of an elevation above the
alley of at least twelve feet so as to
permit the free passage of vehicles
underneath.
Section 3. That said viaduct shall
be built in conformity with all state
and local regulations and under the
direct supervision of the Building
Commissioner of the City of Du-
buque, to whom plans and specifica-
tions for said viaduct shall be sub-
mitted for approval.
Section 4. That this ordinance
shall be in force and effect ten days
from and after its final passage and
adoption by the City Council and
publication as provided by law.

Resolution Declaring the Result of
the Special City Election Held on
Nov. 2, 1926, to Authorize
the City Council to Create
a Department of Pub-
lic Docks.
Whereas, at a special city election
held in the City of Dubuque, Du-
buque County, Iowa, on the 2nd day I
of November, 1926, there was sub-
mitted to the electors of said City
the following question:
"S1dta11 the City Council of the City
of Dubuque, Iowa, be authorized to
create a department to be known as
the department of public docks ?"
And Whereas, pursuant to call,
this council has met in special ses-
sion on November 3, 1926, the same
being the next secular day following
said election for the purpose of can-
vassing the vote cast at said elec-
tion and declaring the result there-
of; and
Whereas, this Council has can-
vassed said vote and finds that a
majority of those voting at said
election voted in favor of the crea-
tion of the department of public
docks:
Now, therefor, be it resolved by
the City Council of the City of Du-
buque that the proposition as above
stated, be and the same is hereby
declared to have been carried by a
majority of those voting at said elec-
tion, and the result of said election
is hereby declared to be in favor of
authorizing this Council to create a
department to be known as a depart-
ment of public docks.

A property owner on Brunswick
Street addressed the Council and
asked to have a sanitary sewer ex-
tended to his home, he was informed
that he should circulate a petition
among other property owners on
said street and present it to the
Council. No further action taken
at this time.
News agent at the Majestic The-
atre addressed the Council and
asked permission to erect a news-
stand under the stens on the south
side of Fourth Street, southwest
corner of Main Street.
Councilman Schrempf moved that
the prayer of the petition be grant-
ed providing the owner of the build-
ing does not object. Seconded by
Councilman Yount. Carried by the
following vote:

Mr. C. C. McGregor addressed the
Council and stated that the retain-
ing wall on Race Street and West
Eleventh Street is in very poor con-
dition and that on account of this
condition his sidewalk is ruined,
that the water undermined the side-
walk and not only ruined the side-
walk but also damaged his property.
Councilman Schrempf moved that
the matter be referred to the City
Manager and Engineer for investi-
gation. Seconded by Councilman
Meuser. Carried by the following
vote:

Councilman Meuser stated that
the electric light and power rates
in the City are excessive, he pro-
duced letters and rates which he had
received from eight different cities
•in the state and expected to recieve
some more, and compared the rates
with those of Dubuque, and finds
that the rates here are much higher
than in any of the cities mentioned.
Councilman Meuser moved that
the City Manager be instructed to
arrange a conference with the offic-
ials of the Dubuque Electric Com-
pany and the City Council, the ob-
ject of the conference being to re-
adjust the present rates. Seconded
by Councilman Yount. Carried by
the following vote:

Joe Brake, a blind man, addressed
the Council asking that some sort
of signal be introduced whereby the
blind can cross the streets in safety,
stating that several have been hit
by automobiles, and one man had
his hip broken, some time ago. The
Mayor informed Mr. Brake that the
newspapers would give this matter
publicity. No action taken by the
Council.
Petition of Nicholas Manders, and
Ervan Manders, et al, minors, by
Lyon and Willging their attorneys,
stating that they are 'owners of lot
130 in Union Add. That on or about
July 12th, 1921, said property was
purchased by the City at a tax sale,
for special assessment for improve-
ment of Rush Street; levied Sept.
4th, 1894, amounting to $67.66; in
order to clear title to said lot they
offer an adjustment of $35.00 in full
of settlement.
Councilman Maclay moved that
the offer be accepted, and the Treas-
urer be instructed to accept $35.00
settlement in full, and upon payment
of which to cancel tax sale certifi-

Whereas, the City Council of the
City of Dubuque caused to be sub-
mitted to the electors of said City
at a special election called for that
purpose on November 2, 1926, the
following question: "Shall the City
Council of the City of Dubuque,
Iowa, be authorized to create a de-
partment to be known as the De-
partment of Public Docks ?"
And Whereas, a majority of those
voting at said election voted in
favor of the creation of such depart-
ment of public docks:
Nov, therefore, be it ordained by
the City Council of the City of Du-
buque:
Par. 901. Section 1. That, pur-
suant to the authority vested in this
Council by the electors of the City
of Dubuque, there be and there is
hereby created a department of the
City of Dubuque to be known as the
Department • of Public Docks.
Par. 902. Section 2. That said
Department of Public Docks shall be
administered by the Dock Board con-
sisting of three members to be
known as Commissioners of Public
Docks.
Par. 903. Section 3. That the
members of said Dock Board shall
be appointed by the Mayor of the
City of Dubuque with the approval
of the City Council of said City and
the qualifications of the Commis-
sioners constituting said Board shall
be that they have been residents of
the City of Dubuque for a period of
not less than five years and shall
not at the time of their appointment
or during their term of office be in-
terested in or be employed by any
common carrier. Said Board shall
act without compensation.
Par. 904. Section 4. The said
Commissioners when first appointed
shall hold office for a term of one,
two and three years respectively,
and shall determine by lot among
themselves which commissioners
shall hold the respective terms.
Thereafter, one Commissioner with
the said qualifications shall be ap-
pointed annually by the Mayor and
the term of office of such Commis-
sioner shall be three years.
Par. 905. Section 5. The mem-
bers of the Board shall qualify by
taking oath for the faithful perform-
ance of their duties.
Par. 906. Section 6. Within ten
days after their appointment the
Commissioners shall meet and or-
ganize the Dock Board by the elec-
tion from among their number of a
President and Secretary of said
Board, and from time to time shall
adopt rules and regulations for the
government of their department and
to govern their proceedings, which
shall be adopted by resolution, re-
corded in a book kept by the Board
and known as the Book of Rules and
Regulations, and said rules and regu-
lations shall be in force and effect
after publication in some newspaper
published and 'circulated in the City
of Dubuque.
Par. 907. Section 7. The Board
shall maintain an office in the City
Hall of the City of Dubuque and
keep a record of all its proceedings
and acts and books of account show-
'n e; all of its financial transactions
which records and books of accounts
shall at all times be open to public
inspection.
Par. 908. Section 8. If any com-
missioner shall at any time during
his encumbency cause to have the
qualifications required by this ordin-
ance for his appointment, or shall

A Resolution Accepting Improve-

Whereas, the contract for the im-
provement of East Twenty- seventh
Street from the east line of Central
Avenue to the west line of Jackson
Street, by constructing curb and
gutter and paving the same with
concrete, has been completed and
the City Engineer has examined the
work and filed his certificate stating
that the same has been completed
according to the terms of the con-
tract, plans and specifications and
recommends its acceptance, now
therefor
Be it resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Engin-
eer be approved and that said im-
provement be and the same is here-
by accepted and the City Engineer
be and he is hereby directed to
prepare a plat and schedule showing
the lots or parcels of real estate
subject to assessment for said im-
provements and file the same in the
office of the City Clerk subject to
public inspection and said Clerk
shall upon receipt of such plat and
schedule publish the notice of the
Council's intention to levy special
assessments therefor, as required by
law.
Be it further resolved that said
Clerk be and he is hereby directed
to publish a notice of the intention
of the City Council to issue public
improvement bonds to pay the cost
of said improvements and state
therein the time and place, when
and where objections thereto may
be filed by interested parties, the
meeting of this Council for said pur-
pose to be held on the same date
that the special assessments here-
in provided for are to be levied.
Be it further resolved that the
City Treasurer be and he is hereby
directed to pay to the contractor
from the funds to be realized from
the sale of improvement bonds is-
sued upon the above described im-
provements an amount equal to the
amount of his contract, less any re-

wilfully violate any of his duties un-
der the law, such Commissioner
shall be removed by the Mayor after
written charges have been preferred
against him and a due hearing of
such charges have been had by the
Mayor upon reasonable notice to
such Commissioner. Vacancies oc-
curring in the Board through resig-
nation or otherwise shall be filled
by the Mayor for the unexpired
term.
Par. 909. Section 9. That the
powers and duties of the Dock Board
shall be such as are prescribed by
Chapter 303 of the Code of Iowa,
1924, and all acts and laws that may
be passed amendatory or supplemen-
tary thereto.
Par. 910. Section 10. That this
ordinance shall be in force and ef-
fect ten days from and after its first
passage and adoption by the City
Council and publication as provided
by law.

level with the street, wherefore she
claims that her property was dam-
aged by these street improvements
in the amount of $2,000.00 and asks
that the City Council give this mat-
ter favorable consideration.

Gentlemen: As you recall, some
time ago, it was agreed that the
case of A. L. Rhomberg et al, vs. the
City of Dubuque, involving special
assessments for the Eagle Point
Sewer in the Eagle Point Sewer Dis-
trict be decided upon the question of
the actual value of the lots assessed.
This was done by the City ap-
pointing one appraiser, the plaintiff
appointing one appraiser and the
two appointing a third.
These appraisers were appointed
and made an examination of the
various lots involved in this action.
The appraisers filed their report
and based upon this report a decree
was entered by the District Court
of Dubuque County, Iowa, making
certain reductions in the assess-
ments and allowing other assess-
ments to remain as made by the
Council.
Hereto attached and made a part
of this report is a copy of the de-
cree which was entered by the
Court. This . decree shows the re-
ductions which were made and also
confirms the assessments where no
reductions were made. I would re-
spectfully recommend that this re-
port be approved and that the re-
ductions in the decree be made by
the City Treasurer upon the books
of the County Treasurer so that the
assessments will appear thereon as
corrected.
Kindly have a warrant drawn in
favor of R. P. Marshall, Clerk of the
District Court, in the sum of $100.25
to cover the City's share of Court
costs in this action.

O. A. Reynolds, Secretary of the
Dubuque Chamber of Commerce,
who represented the City of Du-
buque at the conference with Sec-
retary of War Davis at Washington,
D. C., ,relative to river traffic. Mr.
Reynolds made a lengthy report of
what transpired at this meeting,
parts of the report follow:
The importance of a larger barge
fleet for upper river freight handling
than that now being constructed in
Dubuque and Midland, Pa., was em-
phasized by O. A. Reynolds, secre-
tary of the Dubuque Chamber of
Commerce, when he appeared before
the City Council Monday afternoon
to submit his report on the meeting
of river shiping interests with Sec-
retary of War Davis last week, at
which he acted in the capacity of
official representative of the city.
The report which he submitted
contained in brief all of the argu-
ments submitted to the head of the
war department, and contained in a
brief which President Calvin Cool-
idge now is making a subject of
special study.
The early experience of the gov-
ernment in the operation of the Mis-
sissippi- Warrior barge service on the
lower Mississippi and Warrior riv-
ers was cited by the middle west-
ern committee as an argument in
favor of their plan for the construc-
tion of additional boats which will
increase the size of the proposed
upper river fleet to 60 barges and
four tow boats. Unless a larger
fleet than now contemplated is built,
the committee told the secretary of
war, there is danger that the first
year of operations may result in an
embarrassing deficit to the govern-
ment.
Additional equipment cannot be
leased or improvised, and at least a
year is necessary for the construe
tion of additional equipment. For
these reasons it was urged that the
Secretary of War authorize the
chairman and chief executive of the
Inland Waterways Service, General

Ashburn, to borrow from the banks,
$1,500,00 and with that loan, have
built forty -five additional barges and
one additional towboat. The com-
mittee stated further that should the
government not provide the addi-
tional barges and towboat, that it
will result in a very embarrassing
deficit next year.
"The committee pointed out to the
Secretary of War the sections of var-
ious laws that gives him the legel
authority to borrow the necessary
funds with which to construct the'
additional equipment.
"The Secretary was advised that
the transportation of sugar, coffee
and sisal from New Orleans to Up-
per river points, together with can-
ned goods and other commodities
now moving up the river would fur-
nish tonnage far in excess of the ca-
pacity of the fleet. While the grain,
mill stuffs and other commodities
will furnish tonnage for transpor-
tation down stream.
"The Twin Cities delegation in-
formed the secretary that grain for
export should be shipped direct
from the point where it is loaded
on to the barges, to the point where
it is unloaded into the ocean going
vessels for export. The question of
transferring grain at St. Louis or
Cairo was discussed and it was stat-
ed that grain shippers prefer not
to have their grain transferred after
it is once loaded at their point of
shipment. The opinion was express-
ed that should a transfer be neces-
sary between point of shipment and
New Orleans, that it would decrease
the volume of export grain moving
by the barge line.
"A number of very important ex-
hibits were presented to the secre-
tary and I am attaching hereto cop-
ies of these because they contain
information that should be studied
with a great deal of care by our dock
commission, as these exhibits con-
tain estimates as to the profit and
loss from operation on the upper
river.
"The question of the suitability of
the channel for the operation of the
barge fleet on the upper river, has
been raised from time to time, so
the committee thought it important
to advise the secretary fully regard-
ing this matter. It was stated that
improvements on the upper Missis-
sippi river have progressed so far
that there is now an unobstructed

Attorney Frank Gilloon addressed
the Council in the interest of the
Temple Securities Co., stating that
the company had filed a petition
with the Council some time ago ask-
ing for cancellation of the balance
of the assessment levied against
lots 1 of 8 and 2 of 8 Cooley's Sub.
This assessment was levied Oct. 20,
1924, for the improvement of Mont-
rose Terrace, the first installment
on these assessments have been
paid. The Company receives no ben-
efit from this street owing to its
situation, and owing to the fact that
the City owns adjoining property,
they are willing to deed to the City
the hillside parts of the lots for park
purposes providing the City cancels
the assessment.
Councilman Maclay moved that
the City accept this proposition.

I have viewed the ground for the
opening of Thomas Street from
Prescott Street to High Bluff Street.
1 find that the opening of this street
will pass through the lots which
abut on Lincoln Avenue and that the
street would primarily be of benefit
to these property owners. The cost
to the City for right -of -way and grad-
ing would be a considerable amount
and I can not see enough benefit to
the City to justify the expense.
Therefore, I recommend that this
street be not opened.

Subject: Alley between Prospect
Street and Needham Place.
Relative to a communication from
Mr. A. L. Rhomberg, regarding the
condition of the alley between Pros-
pect Street and Needham Place,
after the construction of the sani-
tary sewer, I wish to state that the
earth has been left high over this
sewer in order to take care of the
settlement that will occur during the
winter. Owing to the location of
this alley it is absolutely impossible
to ruh a city roller over this alley.
We had our small roller over the
alley, but found that it was exceed-
ingly dangerous to attempt to oper-
ate a roller therefore, we ordered it
off. There is an excess amount of
dirt there at present, but should we
take it away at this time it will be
necessary to replace it in the spring.
1 therefore recommend that this dirt
be allowed to remain until such a
time in the spring when we will be
able to level the alley.

Relative to the petition of the
property owners in the vicinity of
Garfield Avenue and Windsor Ave-
nue, asking for the installation of a
street light, I have inspected the
location and find that while there is
no light at this corner there is a
light within a block in all directions
and I believe when the trees are
properly trimmed this will be all
that is necessary for the proper
lighting of this corner.
As our appropriation for street
lighting is exhausted for this year,
I recommend that no light be placed
at this corner.

Reverend A. R. McLaughlin, repre-
senting the Dubuque Ministerial
Association, addressed the Council
protesting against Sunday dancing,
stating that the church -going people
in the city objected to this, and
furthermore there is a State law
prohibiting these dances, and hoped
that the Council will act accord-
ingly.
Mrs. Bessie Braun addressed the
Council relative to damage done to
her property on account of the city
street flusher running over the curb
on Heeb Street and damaging the
back part of her house. She claims
that if the curb had been a few in-
ches higher, as she requested the
City Engineer to make it at the time
the street was improved, this might
not have happened, and she also
asks that the fee she had to pay
tor a permit to repair this damage
be returned to her. The fee amounts
to $3.00. The City Manager and
Engineer will take care of this mat-
ter, no motion.
Petition of Mrs. Mary Vitzthum
stating that she is the owner of Lot
119, Mechanics Add.; that she
bought this property from Mrs. M.
J. Schmitt; that there was an as-
sessment, this for $27.20, levied in
189,6 which she knew nothing about,
and it was sold to the City at tax
sale October 9th, 1921. There is al-
so a delinquent assessment against
this property for the improvement
of Lowell Street, levied August 17th.
1923, amounting to $22.38; the prop-
erty was sold for this assessment
December 1st, 1924. She offers to
settle this matter and asks the
Council to make a reasonable re-
duction, she being a widow and has
a. small income.
Councilman. Meuser moved that
the City Treasurer be instructed to
accept $3.00 in full for the first as-
sessment, and $22.38 for the second
assessment, totaling $25.38, and up-
on receipt of this amount to cancel
the tax sale certificate. Seconded
by Councilman Schrempf. Carried
by the following vote:

The matter of the Canfield Hotel
was again brought to the attention
of the Council.
Councilman Schrempf stated that
the Canfields had not lived up to
their agreement to have metal
frames and Wire -glass windows
placed in the West wall of their new
addition to their hotel. Wm. Can-
field, Jr., denied that they had made
such an agrement.
The question as to whether or not
the City could under the building
code force the hotel proprietors to,
make the proposed changes in the
windows was unanswered at the end
of the council meeting. Likewise
the question of whether or not the
Canfields had agreed to this partic-
ular specification was also unans-
wered, councilmen and labor repre-
sentatives declaring that such an
agreement had been made, Mr. Can-
field denying it, and his attorney
expressing ignorance of the question
and asking the Council not to take
any action until he had an oppor-
tunity to learn from his partner,
Frank A. O'Connor, who had repre-
sented the Canfields at the time of
the settlement, whether or not such
an agreement had been made.
A report of the settlement of the
Special Session, November 22nd, 1926 409
controversy at the time the Council
had agreed to permit the hotel to
operate while the, changes outlined
by the Building Commissioner were
being made stated that the opera-
tors of the hotel "had agreed to
make any alterations or additions
that would be necessary to conform
to all requirements, both local and
state." It is the . contention of the
hotel operators that the building
code does not make this require-
ment.
When the question of the hotel
was brought before the meeting
Building Commissioner McInerny, at
the request of Councilman Yount,
declared that he,. had ordered the
windows changed, but that the
changes had not been made, the
Canfields declaring that the former
Building Commissioner had granted
tbem permission to install the pres-
ent windows. The Council then ask-
ed Mr. Canfield if he had agreed to
make these changes and he said that
there had been .no agreement; but
that he had been ordered by the
City to make the changes. Attorney
Smith then introduced the question
as to whether or not the building
code required the changes as
specified.
The Council went back to the
question of the agreement and
Building Commissioner McInerny
said that he had no agreement with
the Canfields regarding the changes,
but that it was an understood fact
that the changes would be made in
accordance with his specifications.
City Clerk John Stuber was dis-
patched to look through his files for
a copy of the report made to the
Council by City Solicitor Czizek and
Building Commissioner McInerny in
July when the changes were ordered
made to determine whether or not
this report included anything of the
legality of the changes was again
taken up with Mr. Smith declaring
again that the City had no legal
right to order the windows changed.
It was during the discussion that
followed that Councilman Schrempf
declared that the "Canfields agreed
they would do these things and
whether it is lawful or unlawful they
should carry it through."
After some further discussion as
to the legal right of the City to make
the hotel company change the win-
dows, which resulted with no deci-
sion as to whether or not it was
legal, the report of the settlement
was brought into the meeting by the
Clerk and read by the City Solicitor.
During the discussion that fol-
lowed John T. Quinn, East Dubuque,
representative of the Trades and
Labor Congress, took part.
lJp until this point J. C. Lewis,
president of the State Federation of
Labor, who had been sitting with
Mr. Quinn among the spectators, had
not joined the discussion. Mayor
Melchior asked the Federation Pres-
ident if he cared to make any re-
marks.
After charging that the hotel had
been operated in violation of the law
the State Federation, President made
the charge that influences were be-
ing brought to bear on the Governor
and Attorney General of the State to
prevent them from enforcing the law
in Dubuque.
At the conclusion of his remarks
the State Federation President, in
reply to , questions from Attorney
Smith, agreed that under the state
housing law that the question as to
whether or not the hotel should be
operated rested with the local build-
ing commissioner. When the attor-
ney then asked Mr. Lewis if it was
not true that under the building code
the Building Commissioner had the
same authority, the State Federation
President ignored the question and
declared that the city and state had
been deceived by the hotel company
Mr. Smith interrupted to bring back
the question of the building commis-
sioner's authority, but the Federa-
tion president continued and again
made the charge that the hotel is
being operated in violation of law.
For a time, at this point, the dis-
cussion became heated, with Mr.
Quinn giving a review of the entire
controversy and Mr. Smith declaring
that the hotel company had tried to
go by the law, had submitted plans
for approval and that 110 one had
been hurt but Mr. Quinn.
The general discussion was finally
brought to an end when Councilman
Schrempf made the motion that the
Building Commissioner be instruct-
ed to enforce the specifications re-
garding the windows. It was at this
point that Councilman Meuser ques-
tioned the regularity of the motion
because of the Council having taken
a similar action and because of the
Building Commissioner having re-
ported that he had repeatedly or-
dered the windows changed, but that
they still remained unchanged.
Councilman Yount had seconded Mr.
Schrempf's motion and after Coun-
cilman Maclay had declared that if
the Building Commissioner found
himself unable to have the changes
made that he should seek the advice
of the City Solicitor as to his next
move, the Council passed the
Schrempf motion.

ance of Public Improve-
ment Bonds.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of West 5th
Street, hereinafter dsecribed, has
been completed and said improve-
ment has been accepted by the City
Council of said City, and the City
Engineer has computed the cost and
expense thereof to be $4,397.48.
And Whereas, public notice as
provided by law has been published
by the City Clerk stating the inten-
tion of the City Council to issue
bonds to pay the cost of said im-
provement and a public hearing has
been held pursuant thereto, and all
objections filed thereto have been
considerd and determined:
Now, therefore, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improvement of West 5th Street,
from the South line of City Lot 615.
produced westerly to the end of the
concrete pavement at what was for-
merly John Street, there be issued
Improvement Bonds to the amount
of $4,397.48. Said bonds shall be
issued under the provision of Chap-
ter 311 of the Code of Iowa, 1924,
which bear date as of the 22nd day
of December, A. D. 1926; shall be
in the denominations of $300.00 each,
except that there shall be one bond
to the amount of $197.48; they shall
be numbered from 1298 to 1312 in-

out of the procedes of the special
assessment levied for said improve-
ment. Both principal and interest
shall be payable at the office of the
City Treasurer in the City of Du-

cited that all the acts and condition
and things required to be done prec-
edent to and in the issuing of this
series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.

ment Bonds.
Whereas, the contract heretofore
entered into by the City of Dubuque
9.01 for the improvement of West 16th
Street, hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council of said City, and the City

Engineer has computed the cost and
expense thereof to be $1,458.84.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improving West 16th Street from
the west line of Cornell Street to
the west line of Lot 28, Yates' Add.,
there be issued Improvement Bonds
to the amount of $1,458.84. Said
bonds shall be issued under the pro-
visions of Chapter 311 of the Code
of Iowa, 1924, which bear date as of
the 22nd clay of December, A. D.
1926; shall be in the denominations
of $100.00 each, except that there
sh:,ll be one bond to the amount of
$58.84; they shall be numbered from
1357 to 1351, inclusive, and shall be
divided into ten series, of which the
bond numbered 1337 shall constitute
the first series and shall be payable
on the 1st day of April, A. D. 1927;
the bond numbered 1338 shall con-
stitute the second series and shall
be payable on the 1st day of April,
1928; the bond numbered 1339 shall
constitute the third series and shall
be payable the 1st day of April,
1929; the bonds numbered from 1340
to 1341 shall constitute the fourth
series and shall be payable the 1st
day of April, 1930; the bonds num-
bered from 1342 to 1343 shall con-
stitute the fifth series and shall be
payable the 1st day of April, 1931;
the bonds numbered from 1344 to
1345 shall constitute the sixth series
and shall be payable the 1st day of
April, 1932; the bonds numbered
from 1346 to 1347 shall constitute
the seventh series and shall be pay-
able the 1st day of April, 1933; the
bonds numbered from 1348 to 1349
shall constitute the eighth series and
shall be payable the 1st day of
April, 1934; the bond numbered 1350
shall constitute the ninth series and
shall be payable the 1st day of
April, 1933; the bond numbered 1351
shall constitute the tenth series and
shall be payable the 1st day of
April, 1936.
Said bonds shall bear interest at
the rate of 5 per cent per annum,
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment levied for said improve-
ment. Both principal and interest
shall be payable at the office of the
City Treasurer in the City of Du-
buque. Said bonds shall be substan-
tially in the following form:

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 ; or any time before that date
at the option of the City the sum of
One Hundred Dollars with interest
thereon at the rate of 5 per cent per
annum, payable on the presentation
and surrender of the interest cou-
pons hereto attached, both interest
and principal are payable at the of-
fice of the City Treasurer in the City
of Dubuque in the State of Iowa.
This bond is issued by the City of
Dubuque pursuant to and by virtue
of Chapter 311 of the Code of Iowa,
1924, and in accordance with a reso-
lution of the City Council of said
City, duly passed on the 22nd day of
November, 1926. This bond is one
of a series of 15 bonds, fourteen for
8100.00, numbered 1337 to 1350, in-
clusive, and one for $58.84, number-
ed 1351, all of like tenor and date,
and issued for the purpose of im-
proving West 16th Street from the
West line of Cornell Street to the
vest line of Lot 28, Yates Sub., and
described in said resolution; which
cost is assessable and levied along
said improvement, and is made by
law a lien on all abutting or adja-
cent property, and payable in ten
annual installments, with interest
on all deferred payments at the rate
of five per cent per annum, and this
bond is payable only out of the
money derived from the collection of
said special tax, and said money can
be used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done prec-
edent to and in the issuing of this
sereis of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City of
fixed this 22nd day of December,
1926, and has authorized the use ot<

Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Henion
Street, hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council of said City, and the City
Engineer has computed the cost and
expense thereof to be $2,708.38.
And Whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost of
improving Henion Street from the
north line of West 14th Street to the
south line of the alley first south of
West 16th Street, there be issued
Improvement Bonds to the amount
of $2,708.38. Said bonds shall be is-
sued under the provisions of Chap-
ter 311 of the Code of Iowa, 1924,
which bear date as of the 22nd day
of December, A. D. 1926; shall be in
the denominations of $200.00 each,
except that there shall be one bond
to the amount of $108.38; they shall
be numbered from 1352 to 1365 in-

series of which the bond numbered
1352 shall constitute the first series
and shall be payable on the lst day

Said bonds shall bear interest at
the rate of 5 per cent per annum,
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessments levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City of
Dubuque. Said bonds shall be sub-

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 ; or any time before that date
at the option of the City the sum of
Two Hundred Dollars with interest
thereon at the rate of 5 per cent per
annum, payable on the presentation
and surrender of the interest cou-
pons hereto attached, both interest
and principal are payable at the of-
fice of the City Treasurer in the City
of Dubuque in the State of Iowa.
This bond is issued by the City of
Dubuque pursuant to and by virtue
of Chapter 311 of the Code of Iowa,
1924, and in accordance with a reso-
lution of the City Council of said
city, duly passed on the 22nd day
of November, 1926. This bond is
one of a series of 14 bonds, 13 for
$200.00, numbered 1352 to 1364, in-
clusive, and one for $108.38, num-
bered 1365, all of like tenor and date,
and issued for the purpose of im-
proving Henion Street from the
north line of West 14th Street to
the south line of the alley first south
of West 16th Street, and described
in said resolution; which cost is as-
sessable and levied along said im-
provement, and is made by law a
lien on all abutting or adjacent prop-
erty, and payable in ten annual in-
stallments, with interest on all de-
ferred payments at the rate of five
per cent per annum, and this bond
is payable only out of the money
derived from the collection of said
special tax, and said money can be
used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done prec-
edent to and in the issuing of this
series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City
affixed this 22nd day of December,
1926, and has authorized the use of
their fac - simile signatures to the in-
terest coupons hereto attached.

on which one payment of $8.15 was
made, leaving a balance of $48.87.
This lot was sold for both of these
assessments September 2nd, 1921.
Said Voelker Realty Co. is willing to
pay $75.00 for the surrender of the
tax sale certificate, now held by the
City. They are doing this to clear
up the title.

Add., asking for cancellation of in-

ing that he never got a notice of
these assessments.

the petition be referred to the City
Solicitor. Seconded by Councilman

F. Zemanek addressed the Council
and stated that the alley back of his
property on Avoca Street is in an
almost impassable condition and
therefore parties delivering coal and
ether merchandise in this alley drive
on his property and ruin his yard,
and he hereby asks that the City
grade this alley so that it can be
used instead of his lot.
Councilman Schrempf moved that
this matter be referred to the City
Manager and Engineer. Seconded
by Councilman Meuser. Carried by
the following vote:

men Maclay, Meuser, Schrempf.

Resolution.
Whereas, the earnings of the Du-
buque City Water Department at
this time warrant the transfer of
the sum of $30,000 from the general
fund of such department to the sink-
ing fund heretofore created for the
purpose of paying interest and prin-
cipal upon outstanding bonds; now,
therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque that the
Auditor be and he is hereby direct-
ed to draw a warrant upon the
Treasurer against the Water Depart-
ment general fund in the sum of
$30,000, and deposit such sum to the
credit of the sinking fund.

is hereby called a special meeting
of the City Council of the City of
Dubuque to be held in the City Hall
at 4:30 o'clock P. M., on November
26th, 1926. This meeting will be
held for the purpose of receiving the
recommendation of the Mayor rela-
tive to the appointment of members
of the Dock Board and for the trans-
action of such other business as
may properly come before a regular
meeting of the Council. Your at-

Message From the Mayor.
To the Honorable City Council of
the City of Dubuque, Iowa:
As evidenced by the records of
your Honorable Body, an election
was heretofore duly and legally call-
ed and held in the City of Dubuque,
Iowa, whereat there was submitted
to the electors of said City the ques-
tion of authorizing your Honorable
Body to create a department to be
known as the Department of Public
Docks, and at said election the ques-
tion was approved by a majority of
those voting at said election.
Pursuant to said election and by
virtue of authority vested in me by
the laws of the State of Iowa in
such case, I do hereby appoint, sub-
ject to the approval of your Honor-
able Body, the following persons to
be known as Commissioners of Pub-
lic Docks and to constitute the Dock
Board for said City, to -wit: Louis
H. Brede, Presley S. Fawkes, John
A. Kerper.
It is respectfully requested that
the appointment of the foregoing

persons be confirmed and approved
by your Honorable Body.

The City Council of the City of
Dubuque met in special session pur-
suant to law and the rules of said
Council at the Council Chamber in
the City Hall in said City. The
meetng was called to order and up-
on roll call there were present H.
G. Melchior, Mayor, in the Chair,
and the following named Council-
men: John Maclay, Wm. H. Meuser.
Absent —Ed. Schrempf, Earl Yount.
The Mayor liresened to the City
Council for approval his appoint-
ments of the persons to be known
as Commissioners of Public Docks
and to constitute the Dock Board of
said City. After due consideration
thereof by the Council, it was moved
by Councilman Maclay and second-
ed by Councilman Meuser that the
appointments as therein set forth be
approved, and that Louis H. Brede.
Presley S. Fawkes and John A. Ker-
per be and the same are hereby con-
stituted as the Dock Board of said
City.
The Mayor put the question on
the motion and upon the roll being
called the following Councilmen
voted:
Aye — Melchior, Maclay, Meuser.
Nays —None.
Absent — Schrempf, Yount.
Whereupon the Mayor declared
the motion duly carried.
On motion and vote the meeting
adjourned.

Louis H. Brede, Presley S. Fawkes
and John A. Kerper, constituting
the persons appointed as Commis-
sioners of Public Docks to constitute
the Dock Board for the City of Du-
buque, Iowa, after having taken and
subscribed to the oath of office, met
for the purpose of organizing them-
selves into said Dock Board.
It was thereupon determined by
lot amongst themselves that Presley
S. Fawkes should hold office for a
term of one year, Louis H. Brede
should hold office for a term of two
years, and John A. Kerper should
hold office for a term of three years,
each of said terms of office to con-
tinue until their successors in office
had been duly appointed and qual-
ified.
Thereupon it was determined to
elect officers of said Dock Board.
Commissioner Louis H. Brede was
elected as President, and Commis-
sioner John A. Kerper was eletced
as Secretary; the election of each
office having been unanimous.
It was determined that the office
of said Dock Board shall be main-
tained in the City Hall until changed
by order of said Board.

Mr. Owen E. Kennedy, Majestic
Cigar Store, located at 401 Main
Street, has made application for per-
mit to sell cigarettes at his place of
business. He has filed a bond for
your approval, together with the fee
of $100 and I would recommend that
he be granted a permit.

referred to the City Council by the
Board of Supervisors, asking for

Estate. She is 78 years old, has no
help of any kind, and the only in
come she has is $10.00 a month rent.

Claim of Mrs. Geo. E. Kirby
against the City of Dubuque in the
sum of $300.00 on account of the
City removing a fence which was
16 to 24 feet high and 50 feet long,
located at 572 Locust Street. This
fence was located on her property
and was taken down and the lumber
removed therefrom without her con-
sent about October 18th, 1924.
