Petition of Ernest Mueller, offer-
ing settlement for special assess-
ment against his property, levied for
the construction of a sanitary sewer
in King's Grove Addition.
Councilman Gabriel moved that
the Council view the grounds. Sec-
onded by Councilman Schrempf. Car-
ried by the following vote:

Petition of G. R. Kinney Co. Inc.,
presented to the Council at a meet-
ing held Jan. 14th for permission to
erect an electric sign, and referred
to the Building Commissioner for in-
vestigation and report. The Com-
missioner reports that Kinney Co.
have a contract with a Sign Co., for
all electric signs used by their
stores throughout the country, and
if they cannot use this standard sign
they will not be able to erect an elec-
tric sign. The sign with brackets
to fasten it will extend over the side-
walk 6 feet 6 inches.
Councilman Melchior moved that
the Kinney Co. be granted permis-
sion to erect this sign under the
proper stipulations. Seconded by
Councilman Gabriel. Carried by the
following vote:

Gentlemen: On April 1, 1924, I
addressed my last letter to the Coun-
cil with reference to the assessment
as levied against Geo. Sears on ac-
count of the improvement of Shiras
Road.
The assessment as levied amount-
ed to $1420. Our understanding was
that the other people who desired
the road would contribute one -half
of the assessment as levied against
Geo. Sears, which they agreed to do.
So far as I know contributions to
the amount of $61.00 have been
made.
I believe at the time of my letter
the matter was referred to the City
Solicitor to collect if possible, ad-
ditional money on the promises. Un-
less he has been successful in doing
this, I would._ recommend that the
assessment as levied against Lot 1
of the N. 1 /z of M. L. 309A, be re-
duced from $710 to $61.00.
In case this recommendation
meets with the approval of the Coun-
cil I would further recommend that
a warrant be drawn on the General
Fund in ft vor of the Special im-
provement Fund in the sum of $649
to make up for this reduction.

the City sell to the Quality Oil Co.

$4,508.25 and upon receipt of said
sum the Mayor and City Clerk be
authorized to execute a deed for
same. Seconded by Councilman Ga-
briel. Carried by the following vote:

Councilman Melchior moved that
the City Solicitor be instructed to
draft an ordinance creating an Ath-
letic Commission of five (5) mem-
bers, the City Solicitor, and one mem-
ber of the Council to be members of
said Board. Seconded by Council-
man Schrempf. Carried by the fol-
lowing vote:

of about the same valuation.

Communication from Mayor C. V.
Findlay, of Fort Dodge, Ia., relative
to the Gasoline Tax Bill which will
be presented to the State Legisla-
ture at this session, urging that ac-
tion be taken that the Cities in the
state get their proportion of this
tax, for the reason that more gaso-
line is used in the Cities than in the
rural districts.
Councilman Brede moved that the -
Mayor be authorized to inform Mr.
Finlay that the City Council of Du-
buque is strongly in favor of the
Cities in the State getting their just
share of this tax, and that the Clerk
instruct our State Senator and Rep-
resentatives of that fact. Seconded
by Councilman Gabriel. Carried by
the following vote:

Proposition.

WHEREAS, a petition reading:
"Shall the City of Dubuque ac-
quire by purchase lands to be used
as Juvenile Playgruonds and con-
tract indebtedness for such purpose
not exceeding $50,000.00 and issue
bonds for such purpose not exceed-
ing $50,000.00 and levy tax annually
upon the taxable property in said
City, not exceeding one mill per an-
num for the payment of such bonds
and the interest thereon ?"
Has been presented to this Coun-
cil of the City of Dubuque, Iowa,
and this present Council meeting is
the first regular Council meeting
since filing of said petition; and
WHEREAS, said petition is signed
by. qualified electors of said City
equal in number to more than twen-
ty -five per cent of those who voted
at the last regular municipal elec-
tion; and
WHEREAS, said petition is suffic-
ient and complies with the provisions
of Section 6238 et seq. of the Code,
1924, and should be granted, and
this Council has jurisdiction there-
of; and
WHEREAS, the public conven-
ience and popular demand require
the establishment of a juvenile play-
ground for the children of the City
of Dubuque; and
WHEREAS, it is the opinion of
this Council that the establishment
of such a playground is a public nec-
essity and will promote the general
welfare and enure to the benefit of
the City as a whole; and
WHEREAS, this Council has here-
tofore adopted the provisions of
Chapter 43 of the Code of Iowa, 1924,
and has authorized and ordered the
use of voting machines at all elec-
tion's held in said City.
NOW, THEREFORE, BE IT RE-
SOLVED by the City Council of the
City of Dubuque as follows:
Section 1. That this Council, on
its own motion and pursuant to the
petition aforesaid, hereby calls a
special election to be held in said
City on the 7th day of March, 1925,
from seven o'clock A. M. until seven
o'clock P. M., at which election there
shall be submitted to the voters of
said City, to be by them voted upon,
the proposition of establishing one
or more juvenile playgrounds in said
City, and the proposition of acquir-
ing by purchase lands to be used
as juvenile playgrounds and con-
tracting indebtedness for such pur-
pose not exceeding $50,000.00 and is-
suing bonds for such purpose not
exceeding $50,000.00, and levying a
tax annually upon the taxable prop-
erty in said City not exceeding one
mill per annum for the payment of
such bonds and the interest thereon.
Section 2. That said election be
held in the several voting precincts
of said City, the boundaries of which

the respective voting precincts shall

possible and the ballots for the
aforesaid propositions shall be pre-
pared by the City Clerk on yellow
colored paper in substantially the
following forms, respectively:

such purpose not exceeding

per annum for the payment of
such bonds and the interest
thereon ?"
Said ballots shall be prepared in
such size as will permit the same
to be inserted in the proper place in
each voting machine.
If voting machines are not avail-
able at said election then a print-
ed ballot shall be used.
Section 4. That the Mayor is here-
by authorized, empowered and in-
structed to issue a proclamation of
notice of said election and to give
four weeks" notice thereof by pub-
lication of said proclamation once
each week for four consecutive
weeks in the Telegraph- Herald and ,

Times Journal, newspapers publish-
ed in the said city, the last of which
publications shall not he less than
five nor more than twenty days prior
to said election, all in strict com-
pliance with ection 6244 of the Code
of Iowa, 1924.

Company for the purchase of the

NOW THEREFORE, be it Resolv-
ed by the City Council of the City of
Dubvuque, that it is deemed advis-

be sold to the Quality Oil Company
for $4508.25, the same being con-
sidered by this Council a fair and
satisfactory offer for the same and
it will be to the interests of said
City that the same be sold for the

The following cases have been
either tried or disposed of at the
present January terns, 1925.
Law No. 21760. Gertrude Cor-
bett -vs -City of Dubuque. In this
case the plaintiff claims to have sus-
tained an injury by a fall upon an

icy sidewalk located on the east side
of Grove Terrace, Southerly from
11th Street and brought suit against
the City for $5,000.00. The Jury re-
turned a verdict in favor of plaintiff
foi $2500.(00. A motion for a new
trial will be filed in this case. The
accident occurred on February 17th
1924.
Law No. 21633 Tim Field -vs -City
of Dubuque, Plaintiff claims damages
for $5,000.00 on account of injuries
sustained due to a defective condi-
.ion of the street on Grandview Ave-
nue where the City had refilled a wa-
ter trench, I believe that the con-
dition existing in the street at the
point in question warranted an ad-
justment of the case and I settled
the same for $75.00 and the costs
and request that a warrant be drawn
for that amount in favor of Beckett
and Knoll, attorneys for plaintiff.
This accident occurred August 7th,
1923.
Law No. 21761, Elizabeth O'Brien -
vs -City of Dubuque, Plaintiff sustain-
ed an injury on February 14th, 1924
by calling upon an icy sidewalk on
Rush Street. The condition of the
walk as disclosed by our investiga-
tion made immediately following the
happening of the accident warrant-
ed a settlement and I settled the
same for $500.00. Kindly have a
warrant drawn in favor of E. E. Bow-
en attorney for plaintiff for $500.00.
Suit in this case was begun for
$2,500.00.
Law No. 21346. Ray Welu -vs -City
of Dubuque. Plaintiff c'.anned the
sum of $2269.00 on account of an ac-
cident occurring at the corner of
11th and Iowa Streets on March 21st
1923. In this case of the defenses
of the City was that the Notice of
claim was not filed within the prop-
er time nor was the suit commenced
within the time prescribed by law.
The Court sustained the position of
the City and plaintiff has served a
notice of appeal in said action.

Gentlemen:
The petition of Matilda Huber, ask-
ing for a reduction in the charge
bruary 2nd, 1925
for the redemption of the tax sale
certificate on account of special as-
sessment taxes levied against Lot 5
Fortunes Sub., was referred to the
City Manager at the meeting of the
Council held on January 26th, 1925.
I have investigated the matter and
find that this lot was assessed on
September 6, 1917 for $171.34 on ac-
count of the improvement of Third
Street from Bluff Street to Burch
Street. On February 7, 1918, a re-
duction of 30 percent was made by
the City Council, leaving the assess-
ment $119.94 which, with interest, is
the face of the tax sale certificate
as advertised in December 1920 and
later purchased by the city. I also
find that the assessed value of this
property in 1921 was $2,200.00.
My thought would be that the city
should at least have the interest on
this amount from the date of sale to
the date of redemption.

Gentlemen:
Complaint was made by Mr. L. J.
Wagner, on account of an assess-
ment of $2.00 for cutting weeds.
This assessment was levied
against the East 1 -2 of lot 1 of Sub
162 and 163 Glendale Add, on April
2nd 1923, and the weeds awing been
cut in 1922, This property was ad-
vertised for sale last fall and bought
in by the City.
I think the description is entirely
in error as I have investigated and
find that this property is entirely
fenced in and is completely occupied
by a house and garden, I would
therefore recommend that the tax
sale certificate be cancelled.

house Biscuit Co., Dewey Waller of

Co addressed the Council and stated
ed that the public use of the rail -
team tracks on Jackson street be-
tween 6th and 10th Streets, consti-
tutes a nuisance and a fire hazard.
The men claimed that the public
use of these sidetracks caused con-

gestion and prevented the free pas-
sage of vehicles, and fire trucks,,and
frequently resulted in the street be-
ing littered with refuse of all kinds.
The congestion seriously interferes
with the abutting Business houses
and factories on said street. It was
explained that there is now a City
Odinance which prohibits the dump-
ing of any refuse into the Streets
from the Freight cars, and anyone
practicing this can be arrested and
on conviction, fined.
Councilman Brede moved that the
Council investigate, this matter, sec-
onded by Councilman Melchior, Car-
ried by the following vote.

WHEREAS, there has been filed
with this City Council of the City of
Dn'buque, Iowa, a certified copy of a
resolution adopted by the Board of
Park Commissioners of said City
pursuant to which a special election
has been called to be held in said
City on Saturday, the Seventh day of
March, 1925, for the purpose of.sub-
imitting to the electors of said City
the proposition of authorizing the
Board. of Park Commisioners of said
City to levy an additional annual tax
of one and one -half mill on the dol-
lar, or so much thereof as may be
necessary, on all the taxable proper-
ty in the City for a period of twenty
years, commencing with the levy for
the year 1925, for the purpose of
purchasing and paying for real es-
tate and permanently improving the
same for park purposes; and
WHEREAS, by said resolution this
City Council is requested to take
such action as is necessary in the
conducting of said election; and
WHEREAS, this Council has here-
tofore adopted the provisions of
Chapter 43 of the Code of Iowa, 1924,
and has authorized and ordered the
use of voting machines whenever
possible at all elections held in said
City:
NOW, THEREFORE, Be It Resolv-
ed by the City Council of the City
of Dubuque, as follows:
Section 1. That pursuant to and
in compliance with the request of
the Board of Park Commissioners of
this City a special election be and
is hereby called to be held in said

Petition of W. J. Connolly, stating
that some time ago there were lev-
ied against property which he owns,
two assessments for the improve-
ments of Kirkwood street and West
Locust street, he found on examina-
tion that the assessments as levied
were wrong, he took up the matter
with the City Engineer and Treas-
urer, and had the errors corrected.
Inasmuch as this error in assess-
ment deprived him of the privilege
of paying these assessments on the
installment plan, He hereby asks the
Council to authorize the Treasurer
to accept the first installment on
these assessments and allow him to
pay the balance on the installment
plan.

50 Special Session, February 16th, 1925
petition of certain property owners
along Balke street, asking for a re-
duction in the. assessment against
their property for the construction
of a sanitar ysewer in Balke street,
have investigated and beg to report
as follows:
There were twelve signers of the
petition. We find that the 1922 real
estate valuation of these lots for as-
sessment purposes was from $100 to
$140 per lot. We believe that this
assessment was rather low and are
certain that there are no lots along
this street at the present time that
could be purchased for less than
$300. It would therefore seem that
the assessment of $67.56 which was
levied against each of these lots for
the Balke street sewer would be en-
tirely within reason. In any event
we are satisfied that the value of
the lots is enhanced more than the
amount of the assessment on account
of the construction of the sewer in
Balke street.
We would therefore, recommend
that the petition be received and
filed.

provement-of various streets in the
City of Dubuque, and acting on any
other business that may come before

Gentlemen: In accordance with
your instructions bids were received
on Friday, February 20th, 1925„ for
the improving of some forty -four
streets, involving about 65,000 yards
of paving.
The successful bidder of last year
and the year before, cut his price
2c a yard for the work this year.
This was done in spite of the higher
prices for both asphalt and cement.
This bidder, however, was fourth in
the bidding on soft top pavement.
The city is very fortunate indeed
on securing the keen competition
and the prices which they did. I
have made other reports covering
each individual street. The low price
on sheet asphalt this year is $1.18
compared to $1.25 last year and the
low price on vibrolithic is $2.15 as
compared with $2.19 last year.
In response to public advertise-
ment inviting bids conditioned on
being awarded a certain amount of
paving, the McCarthy Co., of Daven-
port stipulated a minimum yardage
of 50,000, the Kaw Const. Co., stipu-
lated 80,000 yards; J. Rasmussen &
Sons Co., stipulated 90,000 yards;
Central Engineering Co., stipulated
65,000 yards, and J. F. Lee ,Paving
Co., stipulated 45,000 yards. Also,
the letter of J. F. Lee Paving Co.,
contains the following clause, which
may or may not be without meaning.
"If awarded any contracts for vib-
rolithic we expect to purchase all
necessary materials to the best ad-
vantage on the open market and will
demand a supplementary contract
from the Granite Top Surfacing Co.,
for the laying of vibrolithic similar
to that which is offered to other con-
tractors laying vibrolithic over the
state of Iowa, including the Uhlrich-
Paley Co."

In detailed reports of bids, I am
making definite recommendations for
the award of approximately 65,000
yards of sheet asphalt to the Central
Engineering Company,
Iowa, which company is low on that
amount. I am also making definite
recommendations for the award of
some 20,000 yards of vibrolithic to
the Uhlrich -Paley Co., who are low
on those streets. The 1VIcCarthy
Imp- Co., of Davenport are low on a
few streets on Warrenite bitulithic,
but nothing like enough to bring up
the yardage to the amount stipulated.
J. F. Lee Paving Co.`, is low on some
80,000 yards, which streets are cov-
ering by separate reports on which
no recommendation is made regard-
ing the award.
The differences in bids between
the Central Engineering Co. and the
J. F. Lee Paving Co., are very slight,
only a matter of a few dollars in
many cases. The Central Engineer-
ing Co., is a company well estab-
lished, with a reputation throughout
the state for doing excellent work,
has a good organization and plenty
of good equipment. Without know-
ing more about the plans of the J. Fl
Lee Paving Co., I could not consci-
entiously recommend the award - to
that company. Before they are able
to run their asphalt plant to advant-
age, it will be necessary to make re-
pairs to the amount of $15,000 or
$20,000. Much of their other equip-
ment is in bad condition. Before
they could lay any vibrolithic pave-
ment it would be necessary to go
to a considerable expense in connec-
tion with the purchase of equipment,
which expense is not justified on the
bids as submittetd by them, as the
bids are indeed very low and give
to the contractor with a good organ-
ization and good equipment a very
little margin for profit.
In 1919 the Council awarded the
improvement of Grandview avenue to
the J. F. Lee Paving Co., part of
which work was done in 1919 and
the rest finished in August or Sep-
tember, 1920. This work involved
the laying of only 28,762 yards of
pavement. On the same basis, if this
entire 80,000 yards was awarded to
the same company and carried for-
ward in the same slip shod manner,
our streets would be tied up for at
least two years before the work
could be completed.
I am therefore, not able to make
any recommendations in regard to
this work unless it be for the read -
vertising for bids on those streets on
which the J. F. Lee Paving Co., is
low, until satisfactory assurance is
made regarding the plans and the
equipment
use.

eighth street north to Thirty -sec-
ond street and establishing said
street at a width of 40 feet.
Whereas, the City Council of the
City of Dubuque, by appropriate pro-
ceedings heretofore taken and adopt-
ed, provided for the widening of
White street from Twenty - eighth
street to Thirty- second street and all
necessary real estate was condemned
for such purpose and warrants drawn
in favor of the owners of all real
estate so condemned; and
Whereas, in some of the proceed-
ings heretofore taken said White
street was described as an alley ly-
ing between Couler avenue and Jack-
son street and extending from Twen-
ty- eighth street north to Purue road;
and
Whereas, subsequent to the taking
of such proceedings said alley, so
called, but actually plated as White
street, under an Ordinance of the
City of Dubuque the street there-
of were renamed and replated, what
was referred to in prior proceedings
as the alley has been called White
street and what was referred to as
Purue road has been called Thirty -
second street; and
Whereas, in order to avoid any
confusion as to the establishment of
said White street between Twenty -
eighth street north to Thirty- second
street, by widening the same as pro-
vided for in previous proceedings:
It is therefore, resolved, by the
City Council of the City of Dubuque
that White street from Twenty -
eighth street north to Thirty- second
street be and the same is hereby es-
tablished at a width of forty (40)
feet between property lines and, in
order to avoid confusion it is hereby
further resolved that said portion of
said street extending from Twenty -
eighth street north to Thirty- second
street, referred to in some proceed-
ing as an alley, be and the same is
hereby declared to be White street,
and that the reference in such pro-
ceedings made to Peru road, shall
be declared to be Thirty- second
street, as renamed in the Ordinance
heretofore referred to.

Chief of Police be and he is hereby
directed to cause said White street,
as hereby established to be opened
and all obstructions thereon removed
and that a notice be given to any
persons who are maintaining build-

Councilman Melchior moved that
the rules be suspended to allow any-
one present to address the Council.
The local manager of the National
Cash Register Co. addressed the
Council relative to their taxes, stat-
ing that they were taxed for $G,000,
whereas they carried only a few
samples in stock. He was informed
that the Council could do nothing
for him, and that he must take up
this matter with the Assessor, and if
he cannot get any satisfaction there
he can appeal to the District Court
for relief.
Attorney Frank G41loon addressed
the Council in behalf of the James
Lee Paving Co., stating that in re-
viewing the bids the Council failed
to give said company credit as being
low bidder on the following streets:
Atlantic street, Ardmore street, East
22nd street, Francis street, Wood
street, and South Grandview avenue
from Southern avenue to the end of
the street, and also stated that he
would like to address the Council
relative to the James F. Lee Co.,
their bids, etc., at the next meeting
of the Council.

is the regular monthly meeting of
the Council for the dispatch of such
business as may regularly come be-

A petition of property owners
on Cleveland avenue, claiming that
the surfacing of Cleveland avenue,
is in poor condition, after being
used only four months, and asking
that the Council look into this mat-
ter immediately. Signed by 46 sign-
ers.
Councilman Brede moved that the
petition be referred to the Council
to view the grounds. Seconded by
Councilman Gabriel. Carried by the
