Council met at 4:30 P. M.
Present — City Manager Carr,

Mayor Alderson stated that this
is the regular monthly meeting of
the Council for the dispatch of such
business as may regularly come be -,
fore it.
petition of Rose ' K. Willging,
stating that she is owner of Lot 1
of Mineral Lot 358, comprising ap-
proximately 4 acres, and Lot 2 of
Mineral Lot 358, comprising 15.80
acres on the Millville Road and is
used for agricultural purposes only;
that the taxes on this property for
1923 was 57 mills and for 1924 the
tax levy was 56% mills; and she
hereby asks that the taxes be re-
duced and the tax levy be corrected
as provided for in Section 6210 of
the 1924 Code of the State of Iowa.
Councilman Brede moved that the
petition be referred to the City So-
licitor. Seconded by Councilman Ga-
briel. Carried by the following vote:

Milwaukee Street and 32nd Street,
objecting to the billboard erected in
the alley between Milwaukee and
32nd Streets, for the reason it ob-

Councilman Brede moved that the
petition be referred to the Building
Commissioner. Seconded by Coun-
cilman Melchior. Carried by the

Councilman Gabriel moved that
the rules be suspended to allow any-
one present to address the Council.

Wm. Kretschmer addressed the
Council in favor of said sidewalk,
stating that owing to the improve-
ments such as new dwellings that
were built lately that it is very nec-
essary that this sidewalk be con-
structed. Councilman Brede moved
that the prayer of the petition be
granted. Seconded by Councilman
Gabriel. Carried by the following
vote:

Petition of residents on Alta Street
asking permission to construct a ce-
ment sidewalk four feet wide on said
street, two feet in from the curb.
Councilman Gabriel moved that the
petition be received and filed. Sec-
onded by Councilman Brede. Car-
ried by the following vote:

men Brede, Gabriel, Melchior and
Schrempf.
Nays —None.
Petition of Beutin & Buehler Co.,
stating that they would like to ob-
tain permission to erect a storage
warehouse on the unused part of
Tower Street and possibly part of
Water 'Street, the same to be erected
easterly and near the old shot tow-
er, and they would also like to ac-
quire the right to use the Lots 17 _
to 22 and Lots 2 of Block 7
of Dubuque Harbor Improvement
Co.'s Add. for storage purposes.
That would cover the easterly 200
feet of the southerly half of said
Block 7, except where the shot tower
stands. They expect to pay a rea-
sonable rental for this property if
the petition is granted,

to view the grounds. Seconded by

recommend the acceptance of this
work by the city.

A Resolution.
Whereas, the contract for the in-
stallation of sewer and water con-
nections in Foye, Almond, Ellis,
West 23rd street, Francis, Queen,
Prince, Elm, Broadway Ext., White,
Wood, Irving, Seminary streets and
S. Grandview avenue have been corn -
pleted and the City Manager has ex-
amined the work and filed his cer-
tificate stating the same has been
completed according to the te_,ns
and stipulations of the contract and
recommends its acceptance, now
therefor
Be it resolved by the City Council
of the City of Dubuque, that the rec-
ommendation of the City Manager
be approved and said improvement
be and the same is hereby accepted
and the City Engineer be and he is
hereby in,etructed to prepare a plat
and schedule showing the lots or par-
cels of real estate subject to assess-
ment for said improvement and file
the same in the office of the City
Clerk i cubject to public inspection
and the City Clerk shall upon receipt
of such plat and .schedule publish
the notice of said assessments, as
required by law
Be it Further resolved that the City

ed to pay to the contractor from the
funds realized from the sale of im-
provement bonds issued upon the

amount equal to the amount of his
contract less any retained percentage
provided for therein.

Street.

Petition of the T. J. Mulgrew Co.,
stating that they desire to construct
a trestle extending out into the Du-
buque Harbor about 40 feet ivhich
brings it inside the piling now be-
ing driven. The wharf is to be con-
structed according to blue print at-
tached to petition.
Councilman Brede moved that the
prayer of the petition be granted to
remain at the pleasure of the Coun-
cil, providing the company obtain
permission from the Government and
that the blue print be filed for rec-
ord. Seconded by Councilman Mel-
chior. Carried by the following

Gentlemen: It is with the deepest
regret that I hereby tender my res-
ignation as City Manager of Du-
buque, to be effective not later than
June 1st.
It is hard for me to leave Dubuque.
I love the city and her people. It is
especially hard for me to sever my
connections with the City Council
here, —the best Council that I have
ever known.
At this time I wish to commend
the various city officials and em-
ployees, for their unfailing co- opera-
tion and loyalty, which in a large
measure has been responsible for the
success of our administration here.

tions work; and filed his certificate
stating the same has been complet
ed according to the terms and stip-
ulations of the contract and reconr
ments its acceptance, now therefor

recommendation of the City Man-
ager be approved and said improve-
ment be and the same is hereby ac-
cepted and the City Engineer be
and he is hereby instructed to pre-
pare a plat and schedule showing
the lots or parcels of real estate sub-
ject to assessment for said improve-
ment and file the same in the office
of the City Clerk subject to public
inspection and the City Clerk shall

CONSTRUCTION OF SEWER
WHEREAS, a plat and schedule
has been duly prepared by the City
Council of the City of Dubuque and

thereof, showing the boundaries of
the district, the streets and alleys
and other places along which the
sewers are to be constructed, the
terminal points of the same, each
lot proposed to be assessed there-
for, an estimate of the cost of the
same for each different type of con-
struction and the kind of materials
to be used and in each the amount
thereof which it is estimated will
be assessed against each lot
BE IT THEREFORE RESOLVED
by the City Council of said City, on
its own motion
That it is deemed necessary and
advisable to construct, lay and put
in place 6 -inch sanitary sewer in
Foye street from Lowell street to
Napier street and in Napier street
from Foye to the west line of Lot
142 Mechanic's Add., and along
right of way from Napier street to
Kaufmann avenue.
Said sewer shall be provided with
manholes and any other appurten-
ances that may be necessary. Said
sewer shall be constructed in ac-
cordance with the plans and speci-
fications prepared by the City Engi-
neer, having been duly approved by
the City Council and Manager and
State Board of Health and now on
file in the office of the City Clerk.
That the cost and expense of
making and constructing said sewer
shall be assessed against the pri-
vately owned property abutting
thereon not to exceed the amount
provided by law and upon adjacent
property as might be benefited
thereby and in proportion to such
benefits, and any defiiciency shall
be paid out of the general fund or
sewer fund, or partly from each of
said funds and bonds shall be issued
and sold in anticipation of deferred
payment of assessments and the
proceeds thereof used to pay the con-
tractor.
Be it further resolved that the
above and foregoing sewers are
hereby proposed to be constructed
as hereinbefore set forth, and that
this proposed resolution, except this
paragraph, be and the same is here-
by set down for further and final
hearing, consideration and determ-
ination, at meeting of this Council
to be held on the 27th day of May,
1925, at 4:30 o'clock P. M. in the
Council chamber of the City Hall of
this city, and the City Clerk be and
he is hereby instructed to cause no-
tice of the pendency of the above
resolution, and the time and place
when and where said proposed reso-
lution will be considered for pass-
age, to be given by publication in
the official newspapers of said city,
May 4th, 1925
in the manner and for the time pre-
scribed by law. at which time the
owners of property subject to as-
sessment for said proposed sewer
may appear and make , objection to
the boundaries of the proposed dis-
trict, if any, to the cost of the pro-
posed sewers, to the amount pro-
posed to be assessed against any
lot, and to the passage of the pro-
posed resolution, and unless prop-
erty owners at the time of the final
consideration of said resolution
have on file with the Clerk objec-
tions to the amount of the proposed
assessments, they shall be deemed
to have waived all objections there-
to.

The City Solicitor reported on the
petition of Oscar C. Papin.
The petition read as follows: Os-
car Papin states that he is owner
of M. L. 301 -301a and 302, all within
the corporate limits of the City of
Dubuque, and comprise about 91
acres, used for agricultural purposes
only. That they have been assessed
for $240, $225 and $775 respectively
for the 1924 taxes.
That a corporate levy of 57 mills
has been made against said prem-
ises for 1924 taxes, that he has paid
the full tax on M. L. 301 of which
$13.68 was for corporate purposes,
and the first half of the taxes on
lots M. L. 301a and 302 of which
$28.50 was for corporate purposes,
that under the provision of section
610 of 1924 Code of Iowa, these
premises are exempt from any cor-
porate levy except for road and
library purposes.
Therefore your petitioner asks
that your Honorable Body certify to
the County Auditor and Treasurer,
that said premises were subject to
levy for corporate purposes for the
year 1924 of 7 mills only.
Having paid $13.68 on lot 301 for
the year 1924 he asks for a refund
of $12.00 on this lot.
Having paid $28.50 on lots 301a
and 302 for the first half of 1924
taxes, he asks that the taxes for the
whole year be retained on these two
lots, amounting to $7.00, and the bal-
ance $21.50 be refunded to him. The
City Solicitor reported favorably on
this petition.
Councilman Schrempf moved that
the recommendation of the City So-
licitor be approved, the prayer of the
petition be granted and the County
Auditor and Treasurer be instructed
,accordingly. Seconded by Council-

Gentlemen: I have been endeavor-
ing for considerable time to work
out a definite proposition in con-
nection with the satisfactory turn-
around at the end of the improve-
ment of Grandview Avenue next to
the Mother House.
I have a proposition finally which
will provide a very satisfactory
place to turn around and at a com-
paratively reasonable cost. Our res-
olution provides for the improve-
ment to the east line of Quinlivan's
Sub. This line crosses Grandview
Avenue in a diagonal manner. Our
turn - around starts just before we
reach this line of the west side of
Grandview Avenue, going through
the property belonging to the Sis-
ters of Charity, coming back on the
east side of Grandview Avenue and
taking a little ground from property
belonging to George Beach, inas-
much as the outside of our roadway
is ten feet east of the east line of
Grandview Ave.
If the street was improved with-
out a turn and just to the subdivis-
ion line the estimated assessment
against the Sisters of Charity would
be $608.00. I have finally received
permission to use as much of their
ground as necessary to construct
this turnaround, provided the City
bears one -half of what the cost of
the improvement would be without
the turn- around and provided they
are not assessed for any part of the
extra cost on account of the turn-
around. This means that their as-
sessment will be in the neighbor-
hood of $300.00 instead of $600.00.
This improvement is of great
benefit to the Sisters of Charity.
The loop itself is of material ad-
vantage to them because it encour-
ages the stranger to turn at this
point instead of going in on their
ground. I think the improvement is
well worth much more to them than

the suggested compromise. On the
other hand, they were assessed last
year for the full share of the Sem-
inary and West Locust Street im-
provements and the year before
they were assesed for a large part
of the triangle at the intersection
of West Locust and Seminary Street.
In the last two years they have had
to pay assessments amounting to in
the neighborhood of $25,000.00 for
which they have not had any reduc-
tion. In view of all these circum-
stances, •I would recommend that
their proposal be accepted and that
one -half of what their assessment
would be without the turn - around,
be borne by the city in considera-
tion of their giving the land nec-
essary for the turn.
On the west side of the street,
the city will require for this turn-
around, some property belonging to
George Beach. Without entering in-
to the value of the property taken,
Mr. Beach has consented to permit
the use of his property from street
purposes in consideration of the
fact that the assessment line of his
property will stop at the short axis
of the ellipse which forms the cen-
ter of our turn. I would recommend
that the Council approve this ar-
rangement and that the same be
made a matter of record in the Coun-
cil Proceedings.

the improvement of Foye Street from
West Locust Street to Merchants
Lane, by paving the same with sheet
asphalt, Central Engineering Com-
pany,. contractors, has been com-
pleted. I therefore recommend the
acceptance of this work. The En-
gineer's estimate carried 65 cubic
yards of rock. The actual quantity
used was 177 cubic yards. This ex-
cess was due to the fact that at the
intersection of Merchants Lane and
Foye Street there was no macadam
suitable for the asphalt top. The
section had to be excavated and con-
siderable new macadam had to be
placed before the top could be laid
satisfactorily.

the improvement of West 14th Street
from Audubon Street to Alta Vista
Street, by paving the same with
sheet asphalt, . Central Engineering
Company, contractors, has been com-
pleted. I would therefore recom-
mend its acceptance by the City. At
the same time I wish to call atten-
tion to the fact that the cost of the
work was somewhat less than the
estimate except for the rock item.
The Engineer's estimate called for
1179 cubic yards of rock, but unfor-
tunately in carrying forward these
figures, the 1000 was left off and
only 175 cubic yards was carried in
the estimate. The actual quantity
required was 1119.31 yards. This
error makes no difference in the
comparison of the bids as the price
on rock as bid was the same by the
two lowest bidders.
Also on the flat portion of the
street the crown is about 14" as
against 10" standard. The extra
crown was left in the street rather
than to disturb too much of the old
macadam by cutting down the crown
to the required heighth. It would
have required a new foundtion for
the sheet asphalt pavement if the
macadam had been disturbed to cut
clown the crown.

Gentlemen: Mr. Hugh Skidmore,
of the. Chicago Paving Laboratory,
was in Dubuque on Thursday, May
14th, in connection with asphalt pav-
ing work on which the Chicago Pav-
ing Laboratory are inspectors. After
an examination of the Asphalt Plant
of J. F. Lee Paving Co., Mr. Skid-
more reports that this plant is in the
best condition that it has been for
six years and when repairs are com-
pleted there should be no reason
why a good pavement cannot be
turned out through this plant.
While the capacity is not large and
while the various units are not new
they have been repaired and altera-
tions made until the plant as a whole
is able, with proper operation, to
turn out a first class asphalt pave-
ment.

Gentlemen: Attached herewith is
a statement of account from Du-
buque County in connection with en-
gineering work on the construction
of Rockdale Road.
When this contract was let we had
an understanding with the County
Engineer's office that they would
look after the engineering work
within the city limits for the city
Special Session, May
and that we would pay for that serv-
ice either the actual cost or the pro-
rated cost, based ou the cost of the
work done by the engineers inside
the city limits and the cost of the
work done outside. This arrange-
ment continued through July, 1923,
when the county advised that they
could no longer handle the work for
the city and we put our own crew
on the job to take care of the work
from that time on.
After the work was completed I
had verbal assurance that there
would be no bill submitted to the
city for this work. The county later
became involved with the contractor
in some disagreement about claims
for interest on county warrants and
other things. The county while
they recognized the justice of_ the
claim of the contractor they were un-
able to legally pay without litigation,
the amount of the claim by the con-
tractor.
My understanding is that among
the' various 'claims that the county
has assigned to the contractor is this
claim which the city agreed to pay
when the work was started. I am
submitting' the matter to. the Coun-
cil prior to payment in order that it
may be made a matter of record and
that a full understanding of the prop-
osition may be had by all concerned.

Petition of property owners on
Cleveland avenue, condemning the
work done on the improvement of
Cleveland avenue, and asking that
the work be torn up and the street
be made over, that it is not con-
structed according to plans and spe-
cifications, and that they will not
stand for the patching of the street,
and further more will refuse to pay
for it if it is not done according to

ing Service, stating that at he re-
quest of Joe M.cGinnity of the Du-

being understood that when they
erect this fence, the fence is to re-
main their property for a period of
two years, and they are to pay no
rent for this period.

A Resolution
When the Manager Plan of gov-
ernment was adopted by the City
of Dubuque in 1920, the first import-
ant duty of the newly appointed
Council was to secure a, capable
Manager, one whose honesty, integ-
rity and general character would
qualify him for the important posi-
tion as administrative head of the
municipal government of the City of
Dubuque.
In the selection of Ossian E. Carr
time has proven the soundness of
the Council's judgment. He came
here at a time when it was gener-
ally recognized that the affairs of
the City needed thorough reorganiz-
ation. Upon his ability depended the
success of the new plan. Within the
comparitively short period of five
years under his administration Du-
buque has made marked progress.
Perhaps no other city in Iowa has
gone forward so rapidly. The many
notable improvements for which he
has been directly responsible stand
as monuments . to his courage, to his
ability and to his uniring determin-
ation. He has served this commun-
ity well
What he has accomplished in Du-
buque has attracted the attention of
other cities. Recently he has accept-

ed the offer of an appointment as
Manager of the City of Fort Worth,
Texas, and has submitted his resig-
nation to the City Council of the
City of Dubuque. This Council real-
izing that Mr. Carr will have amuch
greater opportunity for service in a
City of the size of Fort Worth than
he has had in Dubuque, felt that in
justice to him his resignation should
be accepted.
Be it therefore resolved by the
City Council of the City of of Du-
buque that the resignation tendered
by Ossian E. Carr as Manager of
the said City, be and the same is
hereby accepeted.
Be it further resolved that in ac-
cepting this resignation this Coun-
cil, both as a public body and as the
individual members comprising the
same and as expressing the united
sentiment of the people of this com-
munity thoroughly and sincerely re-
gret the severance of his connection
with the City Administration and
his loss as a citizen and resident
of Dubuque, and there is hereby ex-
tended to him felicitations and hope
of success in his new undertaking,
to which this Council looks with -
confidence.
Be it further resolved that this
Resolution be spread upon the per-
manent records of the City Council

ommend that the owner of this prop-
erty should be required to pay the

we see no reason why this property
should not pay its fair share of the

Wt reference to the special as-
sessments against these lots levied
in the year 1913 we beg to advise
you that the total amount that the
City paid when it purchased the
certificate was $437.74. We believe
that it would be fair to the property
owner to accept in full settlement
of said assessments the sum of
$125.00, which would be one - fourth
of a valuation of $500.00, and this
amount we consider a fair valuation
for these lots.
If the owner of the property is
satisfied with this adjustment the
City should return for cancellation
the certificate which it holds.

the purpose of carrying and support-
ing electric transmission lines from
its power plant over and across cer-
tain streets and private, property
within the City of Dubuque.
BE IT ORDAINED by the City
Council of the City of Dubuque:
Sec. 1. That the Interstate Power
Company, a corporation of Dela-
ware, its successors and assigns, be
and the same is hereby granted per-
mission to construct and maintain
an "A" Frame Steel Tower approxi-
mately 85 to 90 feet in height, to be
used for the purpose of supporting
electric transmission lines originat-
ing at the power plant of said Com-
pany and extending over and across
certain streets to a point north of
Prescott Street and then northerly
to the City limits and to maintain
in such transmission lines heretofore
referred to.
Sec. 2. That such permission is
expressely granted upon the follow-
ing conditions, to wit:
let. That in the construction and
maintenance of such transmission
lines said Company shall exercise
due care for the protection of, per-
sons and property to the end that
no damage or injury shall be done
to persons or property by reason of
the location and maintenance of
such transmission lines.
2nd. That said Company, its suc-
cessors and assigns agree to save
the City of Dubuque harmless from
any damage or injury which may be
sustained by persons or property by
reason of the permission herein
granted, to wit, the right to con-
struct and maintain said Tower and
carrying the transmission lines over
and across streets and private prop-
erty. In the event that damages or
injury should arise by reason of the
permission herein granted to per-
sons or property, said Company shall
defend any suits arising therefrom
which may be brought against the
City of Dubuque and assume re-
sponsibility for the payment of any
judgment • which may be secured
thereon.
3rd. That said Company, by its
authorized officers, accept the terms
of this ordinance within thirty (30)
days from its final passage and
adoption, but such time may be ex-
tended by the Council if requested

care of the drainage of the street
without taking out a large part of
the curb. In taking out a part of the
curb it was found that a large part
of the remaining curb was not fit to
leave inasmuch, as there was not, ap-
parently much cement used except-
ing the finishing coat and it could
be broken up with a pick without
difficulty. Then too, a large portion
of this curb was already broken
where the gutter joined it.
For this reason a very large por-
tion of the curb and gutter was re-
placed.
Some of the property owners feel
that it is unfair to ask that they pay
for a new curb and gutter again so
soon, in connection with the im-
provement of this stret.
I am rather inclined to agree with
them in their contention.
If the Council feels that they are
right in their contention and would
now instruct the Engineer that the
city will assume any cost for re-
placing curb and gutter on this im-
provement it would save an argu-
ment upon the completion and ac-
ceptance of this work.

Gentlemen: During the present
summer the four year guarantee
will expire on Jackson street from
Eighth to Eleventh' street, on Wash-
ington street from Seventh to Elev-
enth streets and on Eleventh street
from Central avenue to the C. G. W.
R: R. tracks.
May 18th, the Engineer and I ex-
amined these streets:
Washington and Jackson streets
seem to be is good condition.
Eleventh street needs considerable
attention. There are a number of
holes in this street between Wash-
ington street and the C. G. W. R. R.
tracks. There is an occasional
'crack across the street all the way
from Central avenue to the railroad
tracks. These cracks should be cut
out and filled with new material.
The pavement is chipped and broken
around a number of the water valve
boxes and sewer manholes. The
Council should take proper action
to instruct the contractor, J. F. Lee
Paving Co., to, repair this street at
once.
West Fifth street from Hill street
to Nevada street, which was put
down in 1922, has a number of
cracks which should be given atten-
tion. There are a number of places
chipped around boxes and man-
holes. There are a number of other
places that need repairing, notably
near South Alta Vista street. I call-
ed the matter to the attention of
the contractor last year but without
any results. I think the Council
should instruct the contractor, J. F.
Lee Paving Co., to make repairs on
this street at once.

A RESOLUTION
WHEREAS, the contract hereto-
fore entered into by the City of Du-
buque for the improvement of
Queen Street, hereinafter describ-
ed has been completed and the City
Engineer has computed the cost and
expense of said improvement
amounts to $8,220.63
Therefore, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of im-
provement of Queen Sereet from the
north line of East 22nd Street to the
north line of Edward Street. there
be issued Improvement Bonds to the
amount of $8,220.63. Said bonds
shall be issued under the provisions
of Chapter 6, Title V of the Code of
Iowa and the amendments thereof,
shall bear date as of the 27th day
of June A. D. 1925. shall be in de-
nominations of $500.00 each, except
that there be one bond to the
amount of $220.63; they shall be
numbered from 100 to 116 incl., and
shall be divided into series of which
the bonds 100 shall constitute the
first series and shall be payable
on the 1st day o fApril, A. D. 1926;
the bonds 101 shall be constitute
the second series and shall be pay-
able on the 1st day of April, A. D.
1927; the bonds numbered 102 to
103 shall constitute the third series
and shall be payable on the 1st day
of April, A. D. 1928; the bonds num-
bered 104 to 105 shall constitute the
fourth series and shall be payable
the first day of April, 1929; the
bonds numbered from 106 to 107
shal constitute the fifth series and
shall be payable the 1st day of Ap-
ril, 1930; the bonds numbered 108
to 109 shall constitute the sixth se-
ries and shall be payable the 1st
day of April, 1931; the bonds num-
bered from 110 to 111 shall consti-
tute the seventh series and shall be
payable the 1st day of April, 1932;
the bonds numbered 112 to 113 shall
constitute the eighth series and
shall be payable the 1st day of Ap-
ril, 1933; th ebonds numbered from
114 to 115 shall be payable the 1st
day of April 1934 and shall consti-
tute the ninth series; the bonds
numbered 116 shall constitute the
tenth series and shall be payable
the 1st day of April 1935.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable
semiiannualy, inaccordance with
the terms of the coupons thereto
attached; and said bonds shall be
payable out of the proceeds of the
sepecial assessment levied for said
improvement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City of
Dubuque. Said bonds shall be sub-
stantially in the following form:

presentation and surrender of the

Both interest and principal are pay-
able at the office of the City Treas-
urer in the City of Dubuque in the
State of Iowa, this bond is sued by
the City of Dubuque pursuant to
and by virtue of Chapter 8, Title V
of the Code of Iowa, and amend-
ments thereto, and in accordance
with a resolution of the City Coun-
cil of said city, duly passed on the
27th day of May, 1925. This bond is
one of a series of 17 bonds, 16 for
$500.00 numbred from 100 to 115 and
one for $220.63 numbered 116 all of
like tenor and date, and issued for
the purpose of improving Queen
Street from the north line of East
22nd Street to the north line of Ed-
ward Street, and described in said
resolution; which cost is assess-
able and levied along said improve-
ment, and is made by law a lien on
all abutting or adjacent property,
and payable in ten annual install-
ments, with interest on all deferred
payments at the rate of five per
cent per annum, and this bond is

and things required to be done pre-
cedent to an in the issuing of this
series of bonds, have been done,

To the Honorable Mayor and Coun-
cil of the City of Dubuque:
Gentlemen:
At the March term in the district
court, 1925, the case of Hugh, Kear-
ney vs. City 'of Dubuque was tried
and a jury returned a verdict in fav-
or of the plaintiff in the sum of
$6,000.000. The motion for a new
trial was made by the defendant
and the Court sustained the motion
about the 14th day of May, 1925.
Immediately thereafter the case was
again put on the calendar for trial
at the present May telm. I have
now negotiated a settlement in this
case with the plaintiff whereby the
city is to pay the sum of $1,750.00
and the costs in the action.
This case arose out of a claim
for personal inuries sustained by
the plaintiff in January, 1924, by
falling upon a walk located on the
south side of Rush street. The con-
dition of this walk has been known
to the City for many years and it
was permitted to remain in a dan-
gerous condition due to the fact that
it was constructed of cinders and
dirt and the water cut a trench
through the same making it uneven
for travel. At the time of the acci-
dent there were several inches of
snow on the walk which has been
permitted to remain until about a
week. Mr. Kearney in passing over
the walk fell and broke his leg. He
is an old man and his injuries are
permanent. There has never been
any question in my mind about the
liability of the city in the case and
I believe that under all of the cir-
cumstances the settlement proposed
is as favorable to the City as can be
expected.
I desire to recommend further
that the City proceed without delay
to construct a cement sidewalk at
th point in question because a great
deal of complaint has gone to the
City on account of the conditions
which prevail at this point.
There has been pending against
the City for the past two years an
action for damages on account of
personal injuries sustained by one
Elizatbeth Baston who fell and
broke her wrist on the east side of
Pine Street between 15th and 16th
streets. She brought suit against
the City in the sum of $5,000.00. At
the place where the accident occur-
red there is no sidewalk other than
some plank laid on stringers for a
distance of about fifty feet. These
plank have become more or less de-
cayed and uneven and at the time
of the accident sprung up when
walked upon, making this place a
rather dangerous condition. Mrs.
Baston, in passing over the walk
one night fell and broke her arm at
the wrist. Her wrist is deformed as
a result of the accident and she has
practically lost the use of her hand.
She is a poor woman who earned
her own living through work that
she did for others and at the time of
the accident I had made a very care-
ful examination of the condition
and recognized liability.
This case was called for trial at
the present term and I negotiated
a settlement with the plaintiff in
the sum of 550.00, she to pay the
costs. I believe that this settlement
is a very fair one and is consider-
able less than could be recovered
if the case went to trial,
Here also I would recommend
that a sidewalk be laid because
there is considerable travel over
this street although it is occupied
to a very large extent by railroad
tracks.
Special Session, May 27th, 1925
If your honorable body approves
these settlements I would recom-
mened that a warrant be drawn in
favor of Lyon and Wilging in the
sum of $1,750.000 as attorneys for
Hugh Kearney, that another war-
rant in the sum of $88.65 be drawn
in favor of Robert Marshall, Clerk
of the District Court as costs in this
case.
Iwould further recommend that a
warrant be drawn in favor of Frant-
zen, Bonson & Gilloon in the sum of _
$500 as attorneys for Elizabeth Bas -
