The folowing resolution was pre-
sented and adopted:

To John P. Buechele, 1042 Main St.
You are hereby notified that on the
16th day of October, 1925, the Local
Board of Health for the City of Du-
buque adopted a resolution ordering
you to abandon and remove the out-
side water closet, privy or privy
vault located upon the premises de-
scribed therein and to clean the
same; also to connect said premises
with the sanitary sewer and install
sanitary toilet and toilet facilities
and connect the same with said sew-
er, all of which to be done within
Thirty (30) days from the date of
said resolution, a copy of which is
herein set out and is as follows:
RESOLUTION OF THE BOARD OF
HEALTH
Be it resolved by the Board of
Health of the City of Dubuque, Iowa,
that it is deemed necessary that Lot
Number East Dub. Add., N. 31 ft.
6 in. of S. 63 ft. 6 in. of 16 and E.
11 of 17 owned by John P. Buechele,
be connected with sanitary sewer;
that the outside water closet, privy
or privy vault upon said premises
be abandoned and removed and said
vault cleaned and that a sanitary
toilet and toilet facilities be installed
and connections made with the san-
itary sewer.
Be it further resolved that said
John P. Buechele be notified to re-
move and abandon the outside water
closet, privy or privy vault located
upon the premises above described
and to clean said vault; that said
property be connected with the san-
itary sewer and that sanitary toilet
and toilet facilities be installed and
connections made with said sewer,
all of which to be done within Thir-
ty (30) days from the date hereof.
Be it further resolved that said
John P. Buechele be notified of the
action of this Board by the service
of a written notice together with a
copy of this resolution. Failure to
comply with the terms hereof with-
in the time stated shall be followed
by prosecution or such other action
as the Council or Board of Health
may determine.

Resolution Providing for the Issu-
ance of Public Improve-
ment Bonds.
Whereas, the contractor heretofore
entered into by the City of Dubuque
for the construction of a sewer
hereinafter described has been com-
pleted and said improvement has
been accepted by the City Council
of said City and the City Engineer
has computed the cost and expense
thereof to be $1974.58.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now therefore, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost of
constucting a sanitary sewer in Foye
98.43 street from Lowell street to Napier
street and in Napier street from
Foye street to the west line of Lot
142, Mechanic's Add. and along the
right of way there be issued Sewer
bonds to the amount of $1974.58.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1924, which bear date
as of the 2nd day of December,
A. D. 1925; shall be in the denomina-
tions of $100.00 each, except that
there shall be one bond to the
amount of $74:58; they shall be num-
bered from 1055 to 1074 inclusive
and shall be divided into 10 series
of which the bonds numbered from
1055 to 1056 shall constitute the
first series and shall be payable on
the 1st day of April, A. D. 1926;
the bonds numbered from 1057 to
1058 shall constitute the second ser-
ies and shall be payable on the 1st
day of April, 1927; the bonds num-
bered from 1059 to 1060 shall con-
stitute the third series and shall be
payable the 1st day of April, 1928;
the bonds numbered from 1061. to
1062 shall constitute the fourth ser-
ies and shall be payable the 1st
day of April, 1929; the bonds num-
bered from 1063 to 1064 shall con-
stitute the fifth series and shall be
payable the 1st day of April, 1930;
the bonds numbered from 1065 to
1066 shall constitute the sixth ser-
ies and shall be payable the 1st
day of April, 1931; the bonds num-
bered from 1067 to 1068 shall con-
stitute the seventh series and shall
be payable the 1st day of April,
1932; the bonds numbered from 1069
to 1070 shall constitute the eighth
series and shall be payable the 1st
day of April, 1933; the bonds num-
bered from 1071 to 1072 shall con-
stitute the ninth series and shall
be payable the 1st day of April,
1934; the bonds numbered from 1073
to 1074 shall constitute the tenth
series and shall be payable the 1st
day of April, 1935.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at
tached; and said bonds shall be pay -
able out of the proceeds of the spec
ial assessment levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City
of Dubuque. Said bonds shall be

SEWER BOND
The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 ; or any time before that date
at the option of the City the sum
of One Hundred Dollars with inter-
est at the rate of 5 per cent per an-
num, payable on the presentation and
surrender of the interest coupons
hereto attached, both interest and
principal are payable at the office
of the City Treasurer in the City of
Dubuque in the State of Iowa. This
bond is issued by the City of Du-
buque pursuant to and by virtue of
Chapter 311 of the Code of Iowa,
1924, and in accordance with •a reso-
lution of the City Council of said
city, duly passed on the 2nd day of
November, 1925.
This bond is one of a series of 20
bonds, 19 to $100.00 each and num-
bered from 1055 to 1073 inclusive,
and one for $74.58 numbered 1074,
all of like tenor and date, and issued
for the purpose of constructing a
sanitary sewer in Foye street from
Lowell street to Napier street and
in Napier street from Foye street to
the west line of Lot 142, Mechanic's
Add. and along the right of way, and
described in said resolution; which
cost is assesable and levied along
said improvement, and is made by
law a lien on all abutting or adja-
cent property, and payable in ten
annual installments, with interest
on all defered payments at the rate
of five per cent per annum, and this
bond is payable only out of the
money derived from the collection
of said special tax, and said money
can be used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in. the issuing of this
series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 2nd day of December,
1925, and has authorized the use of
November 2nd, 1925 685
their fac- simile signatures to the
interest coupons hereto attached.

Jacob Gantenbein addressed the
Council 'and stated that he objected
to the vacating of said alley, for
the reason that if he wanted to sell
his property which is an estate, left
by his parents and is for sale now,

an alley than with an alley, he has
no objections to Mr. Paley using
said alley for his garage as he is
doing at present, but he thinks it
would be unwise for the city to va-
cate and sell this alley.
The City took no further action
on this matter, the Manager stating
that he would see Mr. Paley and
make arrangements whereby he may
use the said alley; and pay the City
a small rental therefor.
Petition of Jas. A. Connors, asking
permission to excavate in street at
258 Bluff street 'for the purpose of
making gas connections to his new
building just completed. He has
made a deposit for same to allow
the City to surface the street in the
spring.

tion of Sewer
Whereas, a plat and schedule has
been duly prepared by the City Coun-
cil of the City of Dubuque and now
on file in the the .office of the Clerk
thereof ,showing the boundaries of
the district, the streets and alleys
and other places along which the
sewers are to be constructed, the
terminal points of the same, each
lot proposed to be assessed therefor,
an estimate of the cost of the same
for each different type of construc-
tion and the kind of materials to be
used and in each the amount thereof
which it is estimated will be as-
sessed against each lot.
Be it therefore, resolved by the
City Council of said City, on its own
motion,
That it is deemed necessary and

advisable to construct, lay and put
in place a 12 inch sanitary sewer in
South Locust street from the man-
hole in Railroad avenue and South
Locust street north 985 feet, thence
an 8 inch tile sewer north 547 feet
to end of present sewer.
Said sewer shall be provided with
manholes and any other appurten-
ances that may be necessary. Said
sewer shall be constructed in ac-
cordance with the plans and speci-
fications prepared by the City En-
gineer, having been duly approved
by the City Council and Manager and
State Board of Health and now on
file in the office of the City Clerk.
That the cost and expense of mak-
ing and constructing said sewer
shall be assessed against the pri
vately owned property abutting
thereon not to exceed the amount
provided by law and upon such ad-
jacent property as might be benefit-
ed thereby and in proportion to such
benefits, and any deficiency shall
be paid out of the general fund or
sewer fund, or partly from each of
said funds and bonds shall be issued
and sold- in anticipation of deferred
payment of assessments and the pro-
ceeds thereof used to pay the con -
tractor.
Be it further. resolved that the
above and foregoing sewers are
hereby set forth, and that this pro-
posed resolution, except this para-
graph, be and the same is hereby
set down for further and final hear-
ing, consideration and determination,
at a meeting of this Council to be
held on the 26th day of October, 1925,
at 4:30 o'clock P. M. in the Council
chamber of the City Hall of this city,
and the City Clerk be and he is here-
by instructed to cause notice of the
pendency of -the above resolution,
and the time and place, when and
where said proposed resolution will
be considered for passage, to be
given by publication in the official
newspapers of said city, in the man-
ner and for the time prescribed by
law, at which time the owners of
property subject to assessment for
said proposed sewer may appear and
make objection to -the boundaries of

Gentlemen: The undersigned,
Rudolph Jones, Emma Ilg, Roger B.
Buettell and J. F. Stampfer, Jr., be-
ing the owners of all of the property
subject to assessment, hereby peti-
tions your honorable body to lay and
construct in Overview Court a six
inch tile sanitary sewer extending
westerly from Gandview avenue to
the end of said Overview Court; also
a lateral from the main sewer in
said Overview Court southerly
across and on the division line be-
tween lots 12 and 13 in Rudolph
Jones Subdivision; into lot 10 of
Grandview Heights Subdivision;
thence a lateral westerly over and

In consideration of the construc-
tion of said sewer, which shall be
laid and constructed according to the
plans and specifications now pre-
pared by the City Engineer, the un-
dersigned expressly waive the prep-
aration of preliminary schedules,
passage of Resolution of Necessity,
publishing of notices of every kind
and description, and each and every
preliminary proceeding required to

be taken in order to levy a legal as-
sessment, except, only that the
Council shall cause to be advertised
for the doing of said work and let
the contract to the lowest bidder,
and when that has been done the
undersigned expressed agrees to
waive any question of legality, regu-
larity in any of the proceedings in-
cluding the levying of the assess-
ments, and agree to pay the whole
of the cost of said improvement af-
ter the same has been levied by
the City Council, reserving, howev-
er, to themselves the right to pay
the same in ten (10) annual equal
installments.
It is further agreed that the Coun-
cil may order this improvement con-
structed either on its own motion
or upon the petition of the under-
signed, and all questions of jurisdic-
tion or legality of proceedings are
expressly waived. The contractor
may be paid in cash upon completion
of the work or from the sale of sew-
er bonds or partly from each of
such methods. Any irregularity in
proceedings or notices which may be
given, as to form or time or in any
other manner are also expressly
waived. This sewer being desired
by the owners of the property re-
questing it is agreed to be paid for
in full without deductions of any
kind by the undersigned.

Earl Cook, superintendent of Play-
grounds, addressed the Council and
read a lengthy and interesting report
on what the Boys' Clubs and Play-
grounds are doing for the children
not only in the City, but all over the
United States; he also alluded to
the convention of the playgrounds
organizations which he attended this
summer, and the valuable experience
he derived therefrom. He was ask-
ed by the Council to furnish it a
copy of this report, to be filed for
record, which he promised to do.
Report of the City Solicitor rela-
tive to the petition and assessments
of Oliver Kringle's property on Cur-
tis Street and State Street, stating
that he had made arrangements with
Mr. Kringle that the City accept, for
Lot 1 of 2 of Bonson & Stewart's
Sub., and Lot 1 of 1 of Bonson &
Stewart's Sub., for improvement of
State Street in 1914. For improve-
ment of Curtis Street on Lot 1 of 1
in 1915, for Lot 3 of Bonson &
Stewart's Sub. for sewer in Curtis
Street, Lot 4 of Bonson & Stewart's
Sub. for sewer in Curtis Street in
1915, and on Lot 1 of 6 of Min. Lot
62 for improvement of State Street
in 1914, sold to City at tax sale in
1923. Under the settlement Mr.
Kringle will pay $300.00 in payment
of the above delinquent assessments,
and in addition to this will pay all
the Curtis Street assessments
against his property as reduced by
the Council together with penalties
and interest.

tion of sidewalks.
The following bids were received
for the construction of sidewalks on
various streets in the City of Du-
buque. The tabulation is as follows:
Albert Becker, 611 Kaufmann Ave-
nue— Sidewalks on Windsor Avenue
at 17c per sq. ft.
N. J. Staner, Dubuque, Iowa —All
sidewalks as advertised at 15c per
sq. ft.
N. J. Staner is low bidder on this
work. I would therefore recommend
the contract for the construction of
sidewalks be awarded to N. J. Sta-
ner at his price of 15c per sq. ft.

Whereas, proposals have been sub-
mitted by contractors for the con-
struction of sidewalks in the City of
Dubuque and N. J. Staner, contrac-
tor, has submitted the lowest bid for
the furnishing of all labor and ma-
terials and performing the work as
provided for in the places and spec-
ification; now therefore,
Be it resolved by the City Council
of the City of Dubuque that the con-
tract for the construction of side-
walks in the City of Dubuque as
shown by attached list be awarded
to N. J. Staner, and the Mayor and
Manager be and they are hereby di-
rected to execute a contract on be-
half of the City of Dubuque for the
complete performance of said work.
Be it further resolved that this
resolution being deemed urgent and
bf immediate necessity become effec-
tive from and after its passage and
adoption by the City Council.

158.
Mr. A. Kniestedt, owner of Lot 1
of 2 of 7 of Mineral Lot 158, is re-
questing an adjustment of a tax sale
certificate amounting to $30.13 plus
costs and penalties, which make a
total of $40.18.
Mr. Kniestedt is willing to pay the
original $30.13, but as he knew
nothing about this assessment at the
time he bought the lot he feels that
he should not pay the penalties.
This assessment was not on record
at the time his abstract was made,
therefor it did not show up as being
charged against the lot.
The City bought in this assessment
at a tax sale. I would recommend
that we settle with Mr. Kniestedt for
the original assessment of $30.13.

of a main concrete sewer located
in the open and unimproved ditch
known as "Bee Branch Sewer ";
providing for the letting of a con-
tract therefor; also for the issu-
ance of main sewer bonds of gen-
eral obligation to pay the cost
thereof, and the levy of a tax or
the payment of the bonds; also
directing the preparation of pro-
posed plans, specifications, form of
contract and an estimate of the
cost of such improvement.
Whereas, it is deemed necessary

construct and put in place a concrete
sewer of the size, style and dimen-
sions to be shown in the plans and
specifications to be prepared there-
for by the City Manager and Engi-
neer, said sewer to be located in the
open drainage ditch as it now exists
and which is commonly known as
"Bee Branch Sewer," the same to be
constructed between 28th and 29th
Streets; between 29th and 30th
Streets, in the block between 30th
and 32nd Streets extending westerly
from Jackson Street to White Street;
in the block between 30th and 32nd
Streets extending westerly from
White Street to Central Avenue; and
in the block between 30th Street and
32nd Street extending westerly from
the alley between Central Avenue
and Lemon Street to connect with
the present concrete sewer; that the
sewer hereby contemplated to be con-
structed shall be continuous from
28th Street northerly and westerly to
the terminus of the present sewer,
except where the same is already
constructed; now therefor
Be it resolved by the City Council
of the City of Dubuque that a con-
crete sewer as heretofore described
be and the same is hereby ordered
laid, constructed and put in place,
this action being taken upon the
Council's own motion, and the City
Manager and Engineer be and they
are hereby directed to prepare pro-
posed plans and specifications for
the construction of said improve-
ment and submit the same to the
City Council for its approval.
Be it further resolved that the con-
struction of said improvement be
done under a contract between the
City of Dubuque and the contractor
to whom a contract may be awarded
and a proposed form of such con-
tract is hereby directed to be pre-
pared and submitted to this Council
for its approval.
Be it further resolved that an esti-
mate of the probable expense of such
improvement be also prepared by the
Manager and Engineer and sub-
mitted to this Council for its inform-
ation and approval.
Be it further resolved that the in-
tention to issue main sewer bonds to
pay the cost of said improvement or
as much of such cost as may become
necessary be and the same is hereby
declared, which bonds shall be is-
sued in anticipation of the collection
of the tax authorized by Sections
6213 and 6261 of the Code of Iowa
1924, and said tax shall be levied
annually upon all of the taxable
property within the City of Dubuque
to pay the principal and interest in
the manner and form provided by
law, and the contractor shall be paid
out of the fund to be created from
the proceeds of the sale of main
sewer bonds to be issued as herein
provided for, or from any other fund
that may be available for that pur-
pose, or partly from each of all of
such funds, after the contract has
been complete?", and accepted by the
City Council, provided, however, that
at least 10% of the total contract
shall be retained for not less than
thirty (30) days to insure the pay-
ment of claim that may be filed for
labor and materials furnished and
done in the performance of said con-
tract, as provided by law.
Be it further resolved that this im-
provement is hereby declared to be
a public improvement, and being for
the preservation of the public health,
safety, comfort and convenience, the
same is urgent and of immediate
necessity, and this Resolution shall,
therefor be in force and effect from
and after its passage, adoption and
approval by the City Council.

The City Manager and City Engin-
eer having submitted plans and
prepared a form of contract for
specifications, estimate of the cost
the proposed Bee Branch Storm
Sewer, the following resolution was
presented and adopted:

Whereas, the City Council of the
City of Dubuque, heretofore passed
a Resolution ordering the construc-
tion of the sewer herein described
and directing the preparation of
plans and specifications, form of con-
tract and a estimate of the cost of
the improvement provided for; and
Whereas, plans and specifications
have been prepared by the Manager
and Engineer for the construction
of a concrete sewer of the type, size
and dimensions shown in such plans
and specificfiations, such concrete
main sewer to be located in the open
and unimproved ditch of what is
commonly known as the "Bee Branch
Sewer" in the City of Dubuque; and
Whereas such sewer is to be con-
structed in said open drainage ditch
as it now exists 'between 28th and
29th streets; between 29th and 30th
streets; in the block between 30th
and 32nd street extending westerly
from Jackson street to White
street; in the block between 30th
and 32nd street extending westerly
from the alley 'between Central av-
enue and Lemon street to connect
with the present concrete sewer,
said sewer to be continuous from 28th
street westerly and northely to the
terminus of the pesent sewer, except
where the same is already construct-
ed; and
Whereas, the estimated cost of the
construction of said sewer is $34,-
000.00; and
Whereas, a form of contract pro-
posed to be used for the construc-
tion of said sewer has been prepared,
submitted to this Council and con-
sidered by it; and
Whereas, this Council believes the
construction of said sewer to be nec-
essary for the promotion and pro-
tection of the public health, safety,
comfort and convenience, now there-
fore
Be it resolved by the City Coun-
cil of the City of Dubuque that the
plans and specifications and pro -
posed form of contract be and the
same are hereby adopted and ap-
proved and ordered placed on file
in the office of the City Clerk where
the same shall be preserved and
opened for public inspection.
Be it further resolved that when
said plans, specifications and form
of contract are filed in the office of
the City Clerk, said Clerk shall and
he is hereby directed to cause to be
published a notice in the Telegraph -
Herald and Times - Journal newspap-
ers, said newspapers being of general
circulation in the City of Dubuque,
stating that a public hearing will be
heard in the Council chamber at the
City Hall in the City of Dubuque at
4:30 o'clock P. M. on the 23rd day
of November, 1925, for the purpose
of hearing objections which may be
made by any interested parties to
the proposed plans, specifications or
contract for, or cost of such improve-
ment.
Be it further resolved that the
23rd day of November, 1925, at 4:30
o'clock P. M. in the Council Cham-
ber at the City Hall, be and the
same is hereby fixed as the time
and place, when and where the Coun-
cil will meet for the purpose of
hearing any and all objections which
may be filed by any interested part-
ies to the proposed plans, specifica-
tions, form of contract for and cost
of said improvement.
Be it further resolved that this
Council meet at such time and place
for the purpose of hearing such ob-
jections and any evidence for or
against the same, at which each
time or at a subsequent meeting to
be then determined, the Council will

Notices._
Whereas the contract for the im-
provement of Hempstead street from
Kaufmann avenue to lot 2 of sub. of
lot 1 of 150 and 150A, L. H. Lang -
worthy's Add., by constructing curb
and gutter and paving the same with
concrete, has been completed and
the City Engineer has examined the
work and filed his certificate stat-
ing that the same has been complet-
ed according to the terms of the
contract, plans and specifications
and recommends its acceptance,
now therefor
Be it resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Engin-
eer be approved and said improve-
ment be and the same is hereby ac-
cepted and the City Engineer be and
he is hereby instructed to prepare
a plat and schedule showing the
lots or parcels of real estate sub-
ject to assessment for said improve-
ments and file the same in the office
of the City Clerk subject to public
inspection and said City Clerk shall
upon receipt of such plat and sched-
ule publish the notice of the Council's
intention to levy special assess-
ments therefor, as required by law.
Be it further resolved that said
Clerk be and he is hereby directed
to publish a notice of the intention
of the City Council to issue public
improvement bonds to pay the cost
of said improvements and state
therein the time and place, when
and where objections thereto may be
filed by interested parties, the meet-
ing of the Council for said purpose
to be held on the same date that
the special assessments herein pro-
vided for are to be levied.
Be it further resolved that the
City Treasurer be and he is hereby
directed to pay to the contractor for
the funds to be realized from the
sale of improvement bonds issued
upon the above described improve-
ments an amount equal to the
amount of his contract, less any re-
tained percentage provided for
therein.

that the contract for the construc-

feet north, C. B. McNamara Con-
struction Co., contractors, has been
completed. I further certify that the
said improvement has been com-
pleted according to the terms and
stipulations of the contract, plans
and specifications and I do hereby
recommend its acceptance by the
City Council.

A Resolution Accepting Improve-

Whereas, the contract for the im-
provement of Quince street from
Rush street to a part 190 feet north
by the construction of a sanitary
sewer, has been completed and the
City Engineer has examined the
work and filed his certificate stat-
ing that the same has been com-
pleted according to the terms of the
contract, plans and specifications
and recommends its acceptance, now
therefor
Be it resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Engin-
eer be approved and said improve-
ment be and the same is hereby
accepted and the City Engineer be
and he is hereby instructed to pre-
pare a plat and schedule showing
the lots or parcels of real estate
subject to assessment for said im-
provements and file the same in the
office of the City Clerk subject to
public inspection and said City Clerk
shall upon receipt of such plat and
schedule publish the notice of the
Special Session, November 13th, 1925 699
Council's intention to levy special
assessments therefor, as required by
law.
Be it further resolved that said
Clerk be and he is hereby directed
to publish a notice of the intention
of the City Council to issue public
improvement bonds to pay the cost
of said improvements and state
therein the time and place, when
and where objections thereto may
be filed by interested parties, the
meeting of this Council for said pur-
pose to be held on the same date
that the special assessments herein
provided for are to be levied.
Be it further resolved that the
City Treasurer be and he is hereby -
directed to pay to the contractor
for the funds to be realized from the
sale of improvement bonds issued up-
on the above described improve-
ments, an amount equal to the
amount of his contract, less any re-
tained percentage provided for
therein.

as may be necessary, for the pur-
pose of paying the cost of con-
structing a concrete main sewer in
the open ditch known as Bee
Branch Sewer; directing the Clerk
to publish a notice of such inten-
tion, and fixing thetime for a. pub-
lic hearing.
Whereas, the City Council of the
City of Dubuque has, by Resolution,
ordered the construction of a con-
crete main sewer to be built in the
open ditch known as Bee Branch
Sewer and to be Iocated in the City
of Dubuque between 28th and 29th
Streets; between 29th and 30th
Streets; in the block between 30th
and 32nd Streets extending westerly

metn is to be paid from the proceeds
of the sale of main sewer bonds to
be issued in anticipation of the col-
lection of a tax to be levied by the
City Council upon all taxable prop-
erty within the City of Dubuque dur-
ing the years for which said bonds
are to be issued and wherein they
mature, the fund created by the col-
lection of such tax to be used for
the purpose of paying the principal
and interest of said bonds until the
same are fully paid and all bonds re-
deemed, excep that the amount of
interest upon said bonds for 1926
shall be paid out of the General Find
or such other fund as may be avail -
Be it resolved by the City Council
of the City of Dubuque that there be
and there is hereby declared the in-
tention of this Council to cause to be
issued and sold main sewer bonds
in the sum of $34,000.00, or so much
thereof as may be necessary, the
proceeds of the sale of such bonds
to be used to pay the cost of con-
structing the improvement hereto-
fore referred to in this Resolution
and in previous Resolutions adopted
by this Council, and the same, when
issued, to be payable from a fund to
be created by the collection of a tax
to be levied annually upon all the
taxable property within the City of
Dubuque, such tax to be provided for
in a resolution to be adopted by this
Council and levied in the manner
and form provided by law, and said
fund shall be used only for the pur-
pose of paying the principal and in-
terest of said bonds as the same re-
spectively mature; provided, how-
ever, that the interest which be-
comes due on the bonds in 1926 shall
be payable from the General Fund or
from such other fund as may be
available for that purpose.
Be it further Resolved, that such
bonds shall be issued serially, bear
interest at the rate of four and one -
fourth per cent, payable semi -annu-
ally, at the office of the Treasurer of
the City of Dubuque, Iowa, and shall
be in form as provided for in the
Resolution providing for the issu-
ance of such bonds, the first series
coming due in the year 1931 and
each subsequent series coming due
annually thereafter until the year
1940, each series being one -tenth of
the whole amount of bonds to be is-
sued and mature each year com-
mencing with the year 1931 and end-
ing with the year 1940, both years

Whereas, an error has been dis-
covered in the Resolution of Neces-
sity and subsequent procedeings pro-
viding for the construction of a sani-
tary sewer in South Locust Street
from the manhole at Railroad Ave-
nue and South Locust Street north
to the end of the present sewer and
bids have been received from con-
tractors; and
Whereas, it is deemed necessary
and advisable to rescind the resolu-
tion of necessity previously adopted
by this Council and subsequent pro-
ceedings in order to avoid technical
objections which may be made to
assessments;
Now therefore be it resolved by
the City Council of the City of Du-
buque, that the resolutions of neces-
sity and subsequent resolutions and
proceedings providing for the con-
struction of a sanitary sewer in
South Locust Street from the man-
hole at Railroad Avenue and South

rescinded.

Whereas, proposals have been sub-
mitted by contractors for the con-
struction of a sanitary sewer in
Overview Court and Uhlrich -Paley
Co., contractor, has submitted the
lowest bids for the furnishing of all
labor and materials and performing
the work as provided for in the
plans and specifications; now there-
fore,
Be it resolved by the City Council
of the City of Dubuque that the con-
tract for the construction of a sani,
tary sewer in Overview Court be
awarded to Uhlrich -Paley Co., and
the Mayor and Manager be and they
are hereby directed to execute a con-
tract on behalf of the City of Du-
buque for the complete performance
of said work.
Be it further resolved that this
resolution being deemed urgent and
of immediate necessity become effec-
tive from and after its passage and
adoption by the City Council.

ance of Public Improve-
ment Bonds.
Whereas, the contract hereto-
fore entered into by the City of Du-
buque for the improvement of Diag-
onal street hereinafter described has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the cost and
expense thereof to be $4040.33.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been 'held
pursuant thereto and all objections
filed thereto have been considered
and determined:
Now therefor, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of im-
proving, Diagonal street from the
west line of Central avenue to the
east line of Broadway, there be is-
sued improvement 'bonds to the
amount of $4040.33.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1924, which bear date
as of the 23d day of December, A. D.
1925, shall be in the denominations
of $300.00 each exce,pt that there
shall be one bond to the amount of
$140.33; they shall be numbered
from 1075 to 1088 inclusive, and shall
be divided into 10 series of which
the bonds numbered 1075 to 1076
shall constitute the first series and
shall be payable on the 1st day of
April, A. D. 1926; the bonds num-
bered from 1076 to 1078 shall con-
stitute the second series and shall
be payable on the 1st day of April,
1927; the bond numbered 1079 shall
constitute the third series and shall

The City of Dubuque in the State

at the option of the City the sum of
Three Hundred Dollars with interest
at the rate of 5 per cent per annum,
payable on the presentation and sur-
render of the interest coupons here-

buque in the State of Iowa. This
bond is issued by the City of Du-
buque pursuant to and by virtue of
Chapter 311 of the Code of Iowa,

This bond is one of a series of
14 bonds, 13 for $300.00 numbered
1075 to 1087 and one for $140.33
numbered 1088; all of like tenor
and date, and issued for the pur-
pose of improving Diagonal street
from the west line of Central aven-
ue to the east line of Broadway,
and described in said resolution;
which cost is assessable and levied
along said improvement, and is
made by law a lien on all abutting
or adjacent property, and payable
in ten annual installments, with in-
terest on all deferred payments at
the rate of five per cent per an-
num, and this bond is payable only
out of the money derived from the
collection of said special tax, and
said money can be used for no other
purpose.
And it is hereby certified and
recited that all the acts and condi-
tion and things required to be done
precedent to and in the issuing of
this series of bonds, have been done,

and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said specal tax, the faith
and diligence of said City of Du-

its Mayor and countersigned by its
City Clerk, with the seal of said
City affixed this 2,3rd day of De-
cember, 1925, and has authorized

City Solicitor stating that Nick
Biaun, owner of Lot 1 of Sub. 52 and

settle a delinquent street assessment
levied in 1894, amounting with in-
terest to about $65.00.' He offers to
settle this assessment for $15.00.

Treasurer be instructed to accept
this amount and upon receipt of
same to cancel the tax sale certif-

The City Solicitor reported on the
claim of Dr. Fosselman recommend-
ing that the City Settle this claim
for $750.00. Mr. Fosselman was in-
jured when he fell over an abandon-
ed guide wire left by the Telephone
company; this wire formed a loop in
which his foot was caught, causing
him to fall and injure himself. The
Solicitor stated that he had spoken
with the Superintendent of the Tele-
phone Company and the Telephone
Company agreed to reimburse the
City for this amount.
Councilman Brede moved that the
recommendation of the City Solicitor
be approved and the Auditor be in-
structed to draw a warrant in the
sum of $750.00 in favor of Frantzen,
Benson & Gilloon as settlemen in
full of this claim. Seconded by

satisfactorily and now awaits the of-
ficial acceptance by you and the
members of the City Council before
the same can be placed in service.
I wish to place this engine in service
as soon as possible and therefore re-

be given early consideration.

ance of Public Improve-
ment Bonds.
Whereas, the contract heretofore
entered into by the City of Dubuque
for improving Cornell Street, herein-
after described, has been completed
and said improvement has been ac-
cepted by the City Council of said
City, and the City Engineer has corn-

puted the cost and expense thereof
to be $2,462.47.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant therto, and all objections
filed thereto have been considered
and determined:
Now therefor, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of im-
proving Cornell Street from the
north line of West 14th Street to the
south line of May Place, there be is-
sued improvement bonds to the
amount of $2,462.47. Said bonds
shall be issued under the provisions
of Chapter 311 of the Code of Iowa,
1924, which bear date as of the 30th
day of December, A. D. 1925; shall
be in the denominations of $200.00
each, except that there shall be one
bond to the amount of $62.47; they
shall be numbered from 1089 to 1101
inclusive and shall be divided into 10
series, of which the bonds numbered
1089 to 1090 shall constitute the first
series and shall be payable on the
1st day of April, A. D. 1926; the
bonds numbered 1091 shall constitute
the second series and shall be pay-
able on the 1st day of April, 1927;
the bonds numbered 1092 shall con-
stitute the third series and shall be
payable the 1st day of April, 1928;
the bonds numbered 1093 shall con-
stitute the fourth series and shall be
payable the 1st day of April, 1929;
the bonds numbered 1094 shall con-
stitute the fifth series and shall be
payable the 1st day of April, 1930;
the bonds numbered 1095 shall con-
stitute the sixth series and shall be
payable the 1st day of April, 1931;
the bonds numbered 1096 shall con-
stitute the seventh series and shall
payable the 1st day of April, 1932:
the bonds numbered 1097 shall con-
stitute the eighth series and shall be
payable the 1st day of April, 1933;
the bonds numbered from 1098 to
1099 shall constitute the ninth series
and shall be payable the 1st day of
April, 1934; the bonds numbered
from 1100 to 1101 shall constitute the
tenth series and shall be payable the
1st day of April, 1933.
Said bonds shall bear interest at
the rate of 5 per cent per annum,
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessment levied for said' im-
provement. Both principal and in-
terest shall be payable at the office

The City of Dubuque, in the State
of Iowa, promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.

at the option of the City the sum of
Two Hundred Dollars wtih interest
thereon at the rate of 5 per cent per
annum, payable on the presentation
and surrender of the interest cou-
pons hereto attached, both interest
and principal are payable at the of-
fice of the City Treasurer in the City
of Dubuque in the State of Iowa.
This bond is issued by the City of
Dubuque pursuant to and by virtue
of Chapter 311 of the Code of Iowa,
1924, and in accordance with a reso-
lution of the City Council of said
city, duly passed on the 30th day of
November, 1925. This bond is one of
a series of 13 bonds, 12 for $200.00
each, numbered from 1089 to 1100 in-
clusive, and one for $62.47, numbered
1102, all of like tenor and date, and
issued for the purpose of improving
Cornell Street from the north line of
West 14th Street to the south line of
May Place and described in said
resolution; which cost is assessable
and levied along said improvement,
and is made by law a lien on all
abutting or adjacent property, and
payable in ten annual installments,
with interets on all deferred pay-
ments at the rate of five per cent per
annum, and this bond is payable only
out of the money derived from the
collection of said special tax, and
said money can be used for no other
purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done prec-
edent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment hree-
on of said special tax, the faith and
diligence of said City of Dubuque
are hereby irrevocably pledged.
In witness whereof the City of Du-
buque, by its City Council, has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 30th day of December,
1925, and has authorized the use of
their fac- simile signatures to the in-
terest coupons hereto attached.

ance of Public Improve-
ment Bonds
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improving of Air Hill street
pleted and said improvement has
hereinafter described has been com-
been accepted by the City Council
of said City and the City Engineer
has computed the cost and expense
thereof to be $1853.40.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now therefor, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of im-
proving Air Hill street from the
south line of Julien avenue to the
north line of West 8th street, there
be issued improvement bonds to the
amount of $1853.40.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1924, which bear date
as of the 30th day of December, A. D.
1925, shall be in the denominations
of $100.00 each, except that there
shall be one bond to the amount of
$53.40; they shall be numbered from
1102 to 1120 inclusive and shall be
divided into 10 series of which the
bonds numbered 1102 to 1103 shall
constitute the first series and shall
be payable on the 1st day of April
A. D. 1926; the bonds numbered from
1104 to 1105 shall constitute the sec-
ond series and shall be payable on
the 1st day of April, 1927; the bonds
numbered from 1106 to 1107 shall
constitute the third series and shall
be payable the 1st day of April,
1828; the bonds numbered from 1108
to 1109 shall constitute the fourth
series and shall be payable the 1st
clay of April, 1929; the bonds num-
bered from 1110 to 1111 shall con-
stitute the fifth series and shall be
payable the 1st day of April, 1930;
the bonds numbered from 1112 to
1113 shall constitute the sixth ser-
ies and shall be payable the 1st day
of April, 1931; the bonds numbered
from 1114 to 1115 shall constitute
the seventh series and shall be pay -
able the 1st day of April, 1932; the
bonds numbered from 1116 to 1117
shall constitute the eighth series and
shall be payable the 1st day of April,
1933; the bonds numbered from 1118
to 1119 shall constitute the ninth
series and shall be payable the 1st
day of April, 1934; the bond num-
bered 1120 shall constitute the tenth
series and shall be payable on the
1st day of April, 1935.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessment levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasuer in the City of
Dubuque. Said bonds shall be sub-
stantially in the following form:

cited that all the acts and condition

cedent to and in the issuing of this
series of bonds have been done, hap-

due form as required by said law

ments, collections and payment here-

diligence of said City of Dubuque
are hereby irevocably pledged.
In witness whereof the City of Du-
buque by its City Council has caused

ance of Public Improve-
ment Bonds
Whereas, the contract heretofore
entered into by the City of Du-
buque for the improvment of Julien
avenue hereinafter described has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the cost and
expense thereof to be $13,594.53.
And whereas, the public notice as
provided by law, has been published
by the City Clerk stating the in-
tention of the City Council td issue
bonds to pay the cost of said im-
provement and a public hearing has
been held pursuant thereto, and all
objections filed thereto have been
considered and determined:
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improving Julien avenue from the
north line of West 8th street to the
east line of Alta Vista street, there
be issued improvemen bonds to the
amount of $13,594.53.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1924, which bear date
as of the 30th day of December, A.
D. 1925; shall be in the denomina-
tions of $500.00 each, except that
there shall be one bond to the
amount of $94.53; they shall be num-
bered from 1121 to 1148 inclusive,
and shall be divided into 10 series
of which the bonds numbered 1121
to 1122 shall constitute the first ser-
ies and shall be payable on the 1st
day of April, A, D. 1926; the bonds
numbered from 1123 to 1125 shall
constitute the second series and
shall be payable on the 1st day of
April, 1927; the bonds numbered
from 1126 to 1128 shall constitute
the third series and shall be pay-
able the 1st day of April, 1928; the
bonds numbered from 1129 to 1131
shall constitute the fourth series and
shall be payable the 1st day of April,
1929; the bonds numbered from 1132
to 1134 shall constitute' the fifth ser-
ies and shall be payable the 1st
day of April, 1930; the bonds num-
bered from 1135 to 1137 shall con-

1140 shall constitute the seventh

the bonds numbered fom 1144 to
1146 shall constitute the ninth ser-
ies and shall be payable the 1st day
of April, 1934; the bonds numbered
from 1147 to 1148 shall constitute
the tenth series and shall be pay-
able the 1st day of April, 1935.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons attached; and
said bonds shall be payable out of
the proceeds of the special assess-
ment levied for said improvement.
Both principal and interest shall be
payable at the office of the City
Treasurer in the City of Dubuque.
Said bonds shall be substantially in

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 ; or any time before that date
at the option of the City the sum
of Five Hundred Dollars with in-
terets at the rate of 5 per cent per
annum, payable on the pesentation
and surrender of the interest coup-
ons hereto attached, both interest
and principal are payable at the
office of the City Treasurer in the
City of Dubuque in the State of Iowa.
This bond is issued by the City of
Dubuque pursuant to and by virtue
of Chapter 311 of the Code of Iowa,
1924, and in accordance with a reso-
lution of the City Council of said
city, duly passed on the 30th day of
November, 1925.
This bond is one of a series of 28
bonds, 27 for $500.00 each numbered
from 1121 to 1147 inclusive, and one
for $94.53 numbered 1148; all of like
tenor and date, and issued for the
purpose of improving Julien avenue
from the north line of West 8th
street to the east line of Alta Vista
street, and described in said reso-
lution; which cost is assessable and
levied, along said improvement, and
is made by law a lien on all abut-
ting or adjacent property, and pay-
able in ten annual installments, with
interest on. all deferred payments at
the rate of five per cent per annum,
and this bond is payable only out of
the money derived from the collec-
tion of said special tax, and said
money can be used for no other pur-
pose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 30th day of December,
1925, and has authorized the use of
their facsimile signatures to the in-
terest coupons hereto attached. '

gineer has examined the work and
filed his certificate stating that the
same has been completed according
to the terms of the contract, plans
and specifications and recommend
its acceptance, now therefor
Be it resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Engin-
eer be approved and said improve-
ment be and the same is hereby ac-
cepted and the City Engineer be and
he is hereby instructed to prepare
a plat and schedule showing the
lots or parcels of real estate sub-
ject to assessment for said improve-
ments and file the same in the office
of the City Clerk subject to public
inspection and said City Clerk shall
upon recept of such plat and sched-
ule publish the notice of the Coun-
cil's intention to levy special assess-
ments therefor, as required by law.

Whereas: It is of the greatest im-
portance to all Mississippi River cit-
ies and Dubuque in particular that
every effort be made to deepen the
channel of the Mississippi river in
order that its former greatness from
the standpoint of traffic shall again
be attained, and
Whereas: At the large and en-
thusiastic meeting of the Mississip-
pi Water Ways convention just held
in St. Louis, Mo., November 22nd
to 26th, 1925, it was decided unani-
mously by the six hundred and fifty
(650) delegates in attendance that
the time has come when a determ-
ined effort shall be made to impress
upon Congress the needs and wants
of the Mississippi River Valley, and
Whereas: In order that the many
advantages of the Mississippi Val-
ley and Dubuque in particular be
clearly set forth to the country, now

meeting most heartily endorse the
stand taken by the Mississippi River
Valley Association in convention as-
sembled in all the project that re-
ceived their endorsement, especially
for a nine (9) foot channel from
Minneapolis to New Orleans; the
maintainance of the Mississippi riv-
er as a rate breaking point and for
all other things that are for the
good of the Mississippi Valley in
geneal, and
Be it further resolved: That a
copy of these resolutions be spread
upon the minutes of this meeting,
also that a copy be sent to Con-
gressman T. J. B. Robinson 'from the
3rd Iowa district, Hon. Senator A.
B. Cummins and Hon. Senator S. W.
Brookhart, and also to our neigh-
boring cities in order that their sup-
port be enlisted.
