Members of the Commission shall serve with- out compensation except for actual expenses, which shall be subject to approval by the City Council. (Ord. 83-92, 11-2-1992) Sec. lfi-49. Dntles And ResponsibiHtles; General: The Commission shall have the following duties and responsibilities: (1) To conduct public hearings in accordance with the minimum standards established in the CDBG program's citizen participa- tion plan to ensure meaningful citizen input in the planning, implementation and assessment of the City's CDBG pro- gram; (2) To provide for and encourage the partici- pation of low and moderate income per- sons who reside in designated areas of slum and blight and residents of low and moderate income neighborhoods, as de- fined by the City Council, in the plan- ning, implementation and assessment of the CDBG program; (3) To identify community development needs, particularly the needs of persons of low and moderate income; (4) To serve in an advisory role upon the request of the City Council in policy decisions regarding funding priorities and program development and implemen- tation; (5) To monitor and evaluate program activi- ties to advise whether identified commu- nity development objectives have been met; (6) To undertake public information efforts to educate the citizenry of the availabili- ty of CDBG funded programs and to provide for a greater understanding of the City's community development ef* forts; and (7) To assist in the preparation of the state- ment of community development objec- tives and projected use of funds, amend- ments thereto and required reports in- cluding, but not limited to, the annual grantee performance report (GPR) and the annual comprehensive housing assis- tance strategy (CHAS); (8) To serve in an advisory role to the City Manager in the review of complaints and grievances received in accordance with the procedures established herein in Section 15-52; (9) To support, upon request, the efforts of the City Council and other City coraro~-- sions in the assessment of the general development needs of the community. The City Council shall have the authority to establish or revise the priorities of the Commi~- sion. (Ord. 83-92, 11-2-1992) Sec. 15-50. Duties And Responsib/lit/es;, Gr/evance Procedure; Review Standards; Appeal Process: The Commission shall participate in the fol- lowing described grievance procedure estab- lished by the City Council for the cot-munity development block grant program. (1) All complaints regarding the community development block grant (CDBG) pro- gram shall be handled in accordance with the following described grievance procedure. ao Any aggrieved person shall file a grievance with the City Manager. Grievances shall be filed in a timely ro~nuer and must be received by the City Manager within one year of the alleged occurrence. However, the regulation, restriction, or boanda~' shall not become effective until after a public hearing at which pa.~ies in interest and citizens shall have an opporzunky to be heard. The notice of the time and place of the hearing shall be published as provided in section 352.3. except that at least seven days notice must be given and in no case shall :he public hearing be held earlier than the next regularly scheduled city council meeting following the published notice. The regulations, restrictions, and boundaries may, from time to time, be amended, supplemented, changed, modified, or repealed. Notwithstanding section 414.2, as a parc of an ordinance changing land from one zoning district to another zoning dis- trict or an ordinance approving a site development plan, a council may impose conditions on a proper~y owner which are in addition to existing regulations if the additional conditions have been agreed to in writing b~: the proper:y owner before the public hear- lng required under this section or any adjournment of the hearing. The conditions must be reasonable and imposed to satisfy public needs which are direct- ly caused by the requested change. In case, however, of a written protest against a change or repeal which is filed with the city clerk and signed by the owners of twenty percent or more of the area of the lots in- cluded in the proposed change or repeal, or by the owners of twenty percent or moro of the property which is located within two hundred feet of the exte- rior boundaries of the property for which the change or repeal is proposed, the change or repeal shall not become effective except by the favorable vote of at least three-fourths of ali the members of the council. The protest, if filed, must be filed before or at the public hearing. The provisions of section 414.4 rela- tive tn public hearings and official notice apply equally to all changes or amendments. In order to avail itself of the powers conferred by this chapter, the council shall appoint a commission, to be known as the zoning com~ssion, to recom- mend the boundaries of the various original districts, and appropriate regulations and resr~ctione to be enforced therein. Such commission shall, with due diligence, prepare a preliminary repot; and hold public hear- ings thereon before submitting its final report; and such council shall not hold its public hearings or take action until it has received the final report of such commission. The board shall adopt rules in accordance with the provisions of any ordinance adopted pursuant to this chapter. Meetings of the beard shall be held at the call of the chairperson and at such other times as the beard may determine. Such chalrper- son, or in the chairperson's absence, the acting chairperson, may administer oaths and compel the attendance of witnesses. All meetings of the board shall be open to the public. The board shall keep minutes of its proceedings, showing the vote of each member upon each question, or if absent or f~ll.g to vote, indicating such fact, and shall keep records of its ex~mluatious and other official ac- tious, all of which shall be ira rn ediatety filed in the office of the board and shall be a public record. Appeals to the beard of adjustment may be taken by any pereon aggrieved or by any officer, dspart- meat, beard, or bureau of the municipality affected by any decision of the edmi,i~trative officer. Such appeal shall be taken within a reasonable time as provided by the rules of the beard by filing with the officer from whom the appealis to~en and with the beard of adjustment a notice of appeal specifying the grounds thereof. The officer from whom the ap- peal is taken shall forthwith transmit to the board all the papers constituting the record upon which the action appealed from was taken. [C24, 27, 31, 35, 39, §6461; C46, 50, 54, 58, 62, 66, 7I, 73, 75, 77, 79, 81, §414.10] 41411 Effect of appeaL An appeal stays all proceedings in furtherance of the action appealed from, unless the officer from whom the appeal is ~-~ken certifies to the board of adjustment a~er the notice of appeal shall have been filed with the officer that by r~ason of facts stated in the certificate a stay would in the officer's opinion cause imr.l.ant peril to life or property. In such case proceedings shall not be stayed other* wise than by a restr~inlng order which may be 3280 granted by the board of adjustment or by a court of record on application on notice to the officer from whom the appeal is taken and on due cause shown. [CPA, 27, 31, 35, 39, §6462; C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, 81, §414.111 414.12 Powers. The board of adjustmeat shall have the following powers: 1. To hear and decide appoais where it is al- leged there is error in any order, requirement, deci- sion, or determination made by an administrative official in the enforcement of this chapter or of any ordinance adopted pursuant thereto. 2. To hear and decide special exceptions to the terms of the ordinance upon which such board is required to pass under such ordinance. 3. To authorize upon appeal in specific cases such variance from the terms of the ordinance as will not bo contrary to the public interest, where owing to special conditions a literal enforcement of the provisions of the ordinance will result in unnec- essary hardship, and so that the sphdt of the ordi- nance shall be observed and substantial justice done. [CPA, 27, 31, 35, 39, §6463; C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, 81, §414.12] ' 414.13 Decision on appeal. In exercising the above-mentioned powers such board may, in conformity with the provisions of this chapter, reverse or ~ffirm, wholly or partly, or may modify the order, requirement, decision, or de- termination appealed from and may make such order requirement, decision, or determination as ought to be made, and to that end shall have ifil the powers o? the officer from whom the appeal is take~ [CPA, 27, 31, 35, 39, §6464; C46, ~0, 54, 58, 62, 66, 71, 73, 75, 77, 79, 81, §414.13] 414.14 Vote required. The concurring vote 6f three members of the board in the case ora five-member board, and four members in the case of a seven-member beard, shall be necessary to reverse any order, require- ment, decision, or determination of any such ad- m~ni~trative official, or to decide in favor of the ap- plicant on any matter upon which it is required to pass under any such ord;nnnce or to effect any variation in such ordinance.
