Council met at 4:30 p. m.
Present —City Manager Carr, May-
or Alderson, Councilmen Brede, Gab-
riel, Melchior.
Absent — Councilman Schrempf.
Mayor Alderson in the chair.
Mayor Alderson stated that this is
the regular monthly meeting of the
Council, for the transaction of such
business as may regularly come be-
fore it.
Petition of Pier Bros., stating that
they are the owners of City lot 333,
that this lot is connected with sewer,
water and gas, that during the con-
struction of the storm sewer in White
street the gas connection was brok-
en, that the Gds Co. repaired this
leak and the city now has a claim
against this lot for $16.81 for this
work.
They hereby ask that the assess-
ment against them be cancelled and
bill be sent to the contractor who
was responsible for this damage.
Councilman Brede moved that the
prayer of the petition be • granted,
that the assessment against this lot
be cancelled and the bill for the or-
iginal amount of this work be sent
to Uhlrich, Paley Co., contractors.
Seconded by Councilman Melchior.

Councilman Schrempf entered and
took his seat at 4:40 p. in.
Petition of property owners abut-
ting on Harold street, presented, ask-
ing that a sanitary sewer be con-
structed, and water mains laid on
said street. Signed by Mrs. Anna
Duscher, Augusta Beyer, Hilda Diet-
rich, and Mr. and Mrs. J. D. Har-
rington.
Councilman Brede moved that the
petition be referred to the City Man-
ager. Seconded by Councilman Mel -
choir. Carried by the following vote:

Petition of Carr, Ryder, Adams Co.
asking that they be allowed to arch
the alley between Jackson and Wash-
ington street, to construct two bridg-
es across Tenth street, and to tun-
nel under the street in order to con-
nect their present factory buildings
with the new building which they
are about to erect, presented.
Councilman Gabriel moved that
the rules be suspended to allow any
one present to address the Council.

Mr. C. W. Coleman, representing
the above Carr, Ryder, Adams Co.,
addressed the Council and submitted
the plans of contemplated improve-
ment.
Councilman Melchior moved that
the prayer of the petition be granted,
and the City Solicitor be instructed
to draft an ordinance covering same.
Seconded by Councilman Brede. Car-
ried by the following vote:

Petition of Henry Novbck, stating
that an error had been made in the
assessment as levied against his
property for the improvement of Shir-
as Avenue. The assessment as lev-
ied is as follows. Sub. 3 and 1 of
3 A. M. in lot 310 lot 1 $624.00, Sub.
2 of 2 of A. M. in lot 310 lot 2, $549.00
making a total of $1,173.00; he here-
by asks the Council to rectify this
mistake so that he can take advant-
age of the 1 -10 payment plan.
Councilman Gabriel moved that
the petition be received and filed.

Petition of Oscar• Herrmann, stat-
ing that he is owner of lot 2 of 1 of
Geo. D. Wood's Sub. facing Lowell
Street. He purchased the lot in 1921.
The abstract failed to show that
there was a special assessment lev-
ied Jan. 2nd, 1920, for $171.03.
Amount levied by mistake as in Voel-
ker's Add. and was sold at tax sale
also under an erroneous description,
he hereby offers to Settle this assess-
ment for $50.00, stating that this
would be on a basis of 25 per cent of
the value of the property.
Councilman Brede moved that the
petition be referred to the City Man-
ager for investigation. Seconded by
Councilman Schrempf. Carried by
the following vote:

Peition of C. B. Trewin, stating
that he has been owner of the S. 50
feet of lot 9 outlot 667 in the city
of Dubuque, and has recently sold
the lot to M. C. Williams, who is de-
sirous of building a home, but it is
found that there is no city water on
street in front of the lot.

Works, City Treasurer and City Aud-
itor for the month of December, 1923,
presented.
Councilman Brede moved that the
reports be received and placed on
file. Seconded by Councilman Gab-

Resolution of Necessity for Street
Improvement
Be it resolved by the City Council
of the City of Dubuque, on its own
motion, that it be deemed necessary
and advisable to build, construct and
put in place certain street improve-
ments as hereinafter described, in,
upon and along the following street,
to wit:
West Sixteenth street from the
west line Of Montrose Terrace to the
west line of Cornell street.
Said street improvement to consist'
of grading, paving, and curb and
gutter the curb and gutter to be con-
structed of concrete and the pave-
ment to be constructed of one or
more of the following materials and
methods, to wit:
Sheet asphalt, warrenite bitulithic
or asphaltic concrete on the present
macadam foundation. Sewer, water
and gas connections to be laid to
each lot prior to the improvement
of the street.
All of the work herein proposed
to be constructed shall be done in
accordance with the plans and speci-
fications to be prepared by the City
Engineer and approved by the City
Council and City Manager.
That the cost and expense of mak-
ing and constructing said improve-
ments shall be assessed upon and
against all privately owned property
whether abutting or not, but lying
within the assessable distance pre-
scribed by law, according to the area
thereof.
Be it further resolved that the
above and foregoing street improve-
ment hereby proposed to be made
and constructed as set forth and that
this proposed resolution, except this
paragraph be, and the same is here-
by set down for further and final
hearing, consideration, and determin-
ation, at a meeting of said Council
to be held on the 29th day of Janu-
ary, 1924, at 4:30 p. m. in the Coun-
cil Chamber in the City Hall of said
City, and that the City Clerk be and
he is hereby instructed to cause no-
tice of the pendency of the above
resolution and of the time and place,
when and where said proposed reso-

lution shall be considered for pass-
age and objections to the passage
thereof and to the construction of
said proposed improvement heard, to
be given by publication in the offic-
ial newspapers of the City in the
manner and for the time prescribed
by law.
The above resolution was approved
and ordered placed on file for final
action and notice of the pendency
thereof ordered given this 7th day
of January, 1924.

of this lot, but to reach it, it would
be necessary to cross private prop-
erty, the owners of which refuse to
negotiate with the owner of this lot.
It is also found that there is no fire
plug on Pickett street or Montrose
terrace, to protect property in this
locality. The petitioner hereby asks
that the Water Dept. be instructed
to make such provision for water
service to this lot and also for fire
protection.
Councilman Brede moved that the
petition be referred to the City Wat-
er Department to arrange to put a
water plug at said location next sea-
son. Seconded by Councilman Gab-
riel. Carried by the following vote:

Acceptance of terms of the ordin-
ance requiring the Dubuque Electric
Company, its successors and assigns
to construct, maintain and operate
a single track of Street railway over,
along and upon Jones street from
South Locust street to Main street
and prescribing the condition under
which said railway shall be operated.
The Dubuque Electric Company
does hereby accept the provisions
and terms of the above special Ordin-
ance in accordance with a resolu-
tion adopted by the officers of said
Company on the 5th day of January,
1924.

Petition of the Dubuque Poster Ad-
vertising Co., relative to the proposed
ordinance, regulating the construc-
tion and location of bill- boards, pre-
sented, action deferred. This matter
will be taken care of in the Building
Code.
Petition of Pauline Danzer, stating
that she was assessed $94.81 for the
construction of a sanitary sewer in
West Sixteenth streett. That she
has paid the first installment of $9.48
as assessed against lot 11 Morgan's
Sub. She finds that this property
was already assessed for a sanitary
sewer constructed in 1900, and here-
by asks that this $9.48 be returned
to her.
Councilman Brede moved that the
prayer of the petition be granted
and the City Auditor be instructed
to draw a warrant for this amount
on the Treasurer in favor of Mrs.
Danzer. Seconded by Councilman
Schrempf. Carried by the following
vote:

A resolution authorizing that a
contract be entered into for the sale
of $20,000 sewer bonds to Emery,
Peck and Rockwood of Chicago, hav-
ing been adopted at a session of the
City Council held December 27th,
1923, and placed on file in the office
of the City Clerk for not less than
one week, for public inspection, and
no objections having been made or
filed, the resolution was presented
and approved as adopted, on motion
of Councilman Melchior, and second-
ed by Councilman Brede. Carried by
the following vote:

ment is hereby proposed to be made
and constructed as set forth and that
this proposed resolution, except this

Chambers in the City Hall of said

Be it resolved by the City Council
of the City of Dubuque that it be
deemed necessary and advisable to
extend and construct a storm sewer
from Merz street to Sutter street,
said sewer to be built according to
plans and specifications relating to
the construction of the storm water
sewer now being laid in East Twen-
ty- fourth street and Windsor avenue,
now on 'file with the Engineer, hav-
ing been duly approved by the City
Council, except as to such charges
as to size and dimensions as may
be found adequate; and
Be it further resolved that a con-
tract for the construction of said
sewer be entered into between the
City of Dubuque and Uhlrich, Paley
Company for the amount stated in
the proposal submitted by said Com-
pany and duly approved by the City
Council, and that said Company exe-
cute a bond in an amount equal to
75 per cent Of the contract price
for the faithful performance of said
work; and
Be it further resolved that this
resolution and contract be placed on
file for a period of one week for pub-
lic inspection and that thereafter the
resolution and contract be taken up
for final action and adoption, and
that the Mayor be and he is hereby
authorized to execute said contract
on behalf of said City of Dubuque.

inclusive of Stouts Dubuque Addition,

To the Honorable Mayor and Council
of the City of Dubuque:
Gentlemen: Some time ago I
brought an action on behalf of the
City against L. M. Warren for un-
paid personal property taxes for the
years 1919 and 1920 amounting to
$15.50 together with interest there-
on amounting to $3.10. I have been
able to get Mr. Warren to pay the
City the sum of $18.60 and the costs
of the action and thereupon the case
has been dismissed. Attached here-
to you will find my check in the
sum of $18.60 which should be ac-
cepted in full settlement of personal
property taxes due from L. M. War-
ren for the years 1919 and 1920.

To the Honorable Mayor and Council
of the City of Dubuque:
Gentlemen: Mrs. Anna Cota fell
at the corner of Third and Bluff
streets on February 19, 1923 and
broke her hip. As a result of such
injury she was laid up a long time
and incured a great deal of expense

by way of doctor bills, hospital bills
and care and attention. A claim for
$5,000.00 was filed by her through
her attorneys, Frantzen, Bonson and
Gilloon.
I made an investigation of this
claim just as soon as I heard of the
same and find that the sidewalk was
in a very dangerous condition and
had been in that condition for quite
a while clue to accumulation of snow
and ice thereon. All of the persons
whom I have •enterviewed on this
claim were united in the one con-
tention that the walk was and had
been in an icy condition for quite
a while and I am convinced that
this was the situation at the time
that she fell. For that reason it is
my opinion it would be wise to af-
fect a settlement in this case rather
than to have the matter go to trial
and with that thought in mind I
have talked with Mrs. Cota and her
attorneys and they have made a
proposition of $750.00 as a basis of
settlement. In view of all the cir-
cumstances and the expense to which
she was put I believe that a settle-
ment in such an amount would be
fair and for that reason I recom-
mend that a warrant be drawn in
favor of Frantzen, Bonson and Gil -
loon as attorneys for Anna Cota in
the sum of $750.00.

owner of said property, to pay for the
above described property. Seconded

Council met at 7:30 p. m.

Mayor Alderson in the Chair.
Mayor Alderson read the call and
stated that this meeting is called
for the purpose of discussing the
proposed Building Code for the City
of Dubuque and acting on any other
business that may come before the
meeting.
City Manager Carr then presented
and read the following report of the
Building Code Committee.
City Council,
Dubuque, Iowa.
Gentlemen: Your Committee on
the Building Code has put in con-
siderable time . since the suggested
code was submitted to the Council
some weeks ago, with various organ-
izations including the Contractor's
Assn., the Lumberman's Assn., the
Real Estate Men, Hot Air Furnace
Men, and Men interested in Theatres,
and after talking with these various
interested parties, we wish to rec-
ommend for your favorable consider-
ation certain changes in the suggest-
ed code.
The Code itself, we believe, will
be much improved, being more prac-
tical, easier of enforcement and per-
haps less of a btirden on the public
on account of the changes which we
suggest. These changes are not
quite all that all the interested par-
ties might ask for, and probably
other requests will be made to your
honarable body. They do, however,
cover all the recommendations made
which we felt willing and able to
recommend.
We feel that considerable thanks
are due to these organizations and
individual parties, particularly to
the Lumbermen's Assn., and the
Real Estate Board for the time and
study given to the provisions of the
code. Our recommended changes
are herewith attached.

Gentlemen: The Misses Genevieve
and Rose Cummins were assessed on
August 1st, 1923, on account of the
improvement of Rose street, the sum
of $1,822.69. This is on account of
the ownership of Sub. 1 of Lot 7 of
Min. Lot 88 and part of 87. This
tract of ground contains a litt'e over
two and one -half acres and has a

street.
Much of this property lies consid-
erably below the elevation of Rose
street and is unimproved except for
a small home in which the Cum-
mins sisters live. I believe this prop-
erty is assessed for taxation purposes
at $3,000.
My recommendation would be that
the value be fixed for assessment
purposes at $5,000, which would make
the assessment for this street im-
provement $1,250 as against $1,822.69
as levied. This would mean a re-
duction of $572.69. In case this rec-
ommendation meets with the approv-
al of the City Council a warrant
should be drawn from the general
fund in favor of the special improve-
ment fund to make up for the
shortage.

A Resolution
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a sanitary
sewer in the Linwood district, here-
inafter described, has been com-
pleted and the City Engineer has
computed the cost and expense of
said improvement amounts to
$8,729.05.
Therefore, be it resolved by the
City Council of the City of Dubuque,
that to provide for the cost of con-
structing a sanitary sewer in the
Linwood District there be issued
Sewer Bonds to the amount of
$8,729.05. Said bonds shall be is-
sued under the provisions of Chapter
8, Title V of the Code of Iowa, and
the amendments thereto; shall bear
date as of the 15th day of February,
A. D. 1924; shall be in the denomin-
ations of $300.00 each, except that
there shall be one bond to the
amount of $29.05; they shall be num-
bered from 9542 to 9571 inclusive,
and shall be divided into ten series
of which the bonds numbered 9542
to 9544 shall constitute the first se-
ries; and shall be payable on the
first day of April, A. D. 1925; the
bonds numbered 9545 to 9547 shall
constitute the second series and
shall be payable on the first day of
April, A. D. 1926; the bonds num-
bered 9548 to 9550 shall constitute
the third series and shall be payable
on the first day of April, A. D. 1927;
the bonds numbered 9551 to 9553
shall constitute the fourth series and
shall be payable on the first day of

Said bonds shall bear interest at
the rate of 5 per cent per annum,
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment levied for said improve-
ment. Both principal and interest
shall be payable at the office of the
City Treasurer in the City of Du-
buque. Said bonds shall be substan-

The City of Dubuque, in the State
of Iowa, promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 or at any time before that
date, at the option of the City, the
sum of Three Hundred Dollars, with
interest thereon at the rate of 5 per
cent per annum, payable on the pre-
sentation and surrender of the in-
terest coupons hereto attached. Both
principal and interest are payable at
Special Session, January 15th, 1924
the office of the City Treasurer in
the City of Dubuque in the State of
Iowa. This bond is issued by the
City of Dubuque pursuant to and by
virtue of Chapter 8, Title V of the
Code of Iowa and amendments there-
to, and in accordance with a resolu-
tion of the City Council of said city.

6 -inch sanitary sewer in Buena
Vistia street from above mentioned
sewer north to Lawther.
6 -inch sanitary sewer in alley be-
tween Davis and Euclid street west
to Sheridan street.
6 -inch sanitary sewer in alley be-
tween Harlan and Euclid streets
west to Sheridan street.
6 -inch sanitary sewer in alley be-
tween Harlan and Goethe streets
west to Sheridan street.
6 -inch sanitary sewer in alley be-
tween Goethe and Lawther streets
west to Sheridan street, and de-
scribed in said resolution; which
cost is assessable and levied along
said improvement, and is made by
law a lien on all abutting or adja-
cent property, and payable in ten
annual installments, with interest on
all deferred payments at the rate
of five per cent per annum, and this
bond is payable only out of the
money derived from the collection of
said special tax, and said money can
be used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment here-
on of said special tax, the faith and
diligence of said City of Dubuque
are hereby irrevocably pledged.
In witness whereof the City of Du-
buque by its City Council, has caused
this bond to be signed by its May-

Clerk, with the seal of said City af-
fixed this 15th day of February A.

Be it resolved by the City Council
of the City of Dubuque that it be
deemed necessary and advisable to
extend and construct a storm sewer
from Merz street to Sutter street,
said sewer to be built according to
plans and specifications relating to
the construction of the storm water
sewer now being laid in East Twenty -
fourth street and Windsor avenue,
now on file with the Engineer, hav-
ing been duly approved by the City
Council, except as to such changes
as to size and dimensions as may
be found adequate; and
Be it further resolved that a con-
tract for the construction of said
sewer be entered into between the
City of Dubuque and Uhlrich, Paley
Company for the amount stated in
the proposal submitted by said Com-
pany and duly approved by the City
Council, and that said Company exe-
cute a bond in an amount equal to
75 per cent of the contract price

for the faithful performance of said
work; and
Be it further resolved that this
resolution and contract be placed
on file for a period of one week for
public inspection and that thereafter
the resolution and contract be taken
up for final action and adoption,

sum of $10.50 per foot for a four (4)
foot for a storm sewer from Merz
street to Sutter Street in accord-

nor is there any demand or need of

that he is the owner of lot two (2)
of the Sub. of lot ten (10) in Kling -
enberg's 4th Subdivision, also of lot
forty -three (43) in Marsh's Add., in
the City of Dubuque. That he re-
cently had the property surveyed,
and finds that the City has taken
four (4) feet off of lot 43 and al-
most the entire part of lot 2 of lot
10 when they built the street on
Klingenberg Terrace, and he here-
by asks the City Council to investi-
gate the matter and reimburse him
for the damage done to his property.
Councilman Gabriel moved that the
petition be referred to the City So-
licitor and the City Engineer to in-
vestigate and report back to the
Council. Seconded by Councilman
Brede. Carried by the following

Petition of property owners locat-
ed between Rush street and Mount
Loretta avenue, and adjacent to both
streets, asking that the City Council
install a sewerage system with out-
lets in said district, that the own-
ers can make proper sewerage con-
nections to their property. Stating
further that this district is being
rapidly built up, and they feel that
as tax payers they are entitled to
the benefits of such improvement.

stated that service thereof had been
duly made and that this meeting
is called for the purpose of levying
special assessments as provided by
law to pay for the construction of
a sanitary sewer in Ashton street
from Delaware street to a point 100
feet south of Decorah street, for the
making of sewer and water connec-
tions on the improvements of West
Locust street from Hodgdon street
to Seminary street, on the improve-
ment of Seminary street from May
place to Main street. For the cutting
of weeds in various parts of the City
during the summer of 1923. Con-
sidering for adoption resolutions of
necessity for the improvement of
West Sixteenth street from Mont-
rose terrace to Cornell street, Fair-
view place from West Sixteenth
street to Cornell street, and acting
on any other business that may come
before the meeting.

amount of the assessment for these
connections amounts to $1,128.02, this
is far in excess of 25 per cent of
the value of these lots, and he here-
by asks that the assessment be made
on a basis of one connection for

Resolution for the Construction of a
Street Improvement.
Be it resolved by the City Council
of the City of Dubuque, upon its
own motion, that pursuant to a res-
olution of necessity proposed at a
meeting of the Council on the 7th
day of January, 1924, and duly pass-
ed and adopted and approved on
the 29th day of January, 1924, it is
hereby ordered that the improvement
described in said resolution of neces-
sity providing for the improvement
of Fairview place, as amended. from
the south line of West Sixteenth
street, south to the end of street, by
curb.] g with new cement and con-
crete curb where required, or by re-
setting old stone curb where re•
quired, and by making sewer, water
and gas connections to property not
already connected with the same, as
provided for in a resolution hereto -
for eadopted and approved, and by
paving said street with either sheet
asphalt, warrenite bitulithic, asphal-
tic concrete or bituminous macadam
on the present macadam foundation,
and by constructing concrete gutter
where provided for in the type of
pavement to be selected as shown
upon the plans and specifications, be
laid, built and constructed.
Be it further resolved that the
City Clerk be and he is hereby in-
structed to advertise for proposals
for the construction of the improve-
ments above described, said improve-
ments to be constructed in strict
accordance with the plans and speci-
fications thereof duly prepared by the
City Engineer, which plans and speci-
fications have been approved by the
City Manager and are hereby ap-
proved by the City Council, the same
being on file in the office of the City
Clerk for public inspection, all of
said work to be completed on or be-
fore the 1st day of Oct., 1924.
The cost and expense of said work
will be paid by the levying of spec-
ial assessment against the privately
owned property abutting upon said
improvement and also against prop-
erty which does not abutt upon said
improvement but which lies within
the assessable distance as provided
by law, and payment to the contract-
or will be made out of funds real-
ized from the sale of Improvement
Bonds to be issued in anticipation
of the collections of said assessments
under the provisions of Chapter 8
Title V of the Code of Iowa and
amendments thereto; and any defic-
iency between the amount of the
contract price and the amount which
can be legally assessable against
private property will be paid either
from the proceeds of a special tax to
be levied under the provisions of
Section 831 of the Code of Iowa, in
anticipation of which bonds will be
issued under the provisions of Sec-
tion 912 of the Code of Iowa and
912A of the Code Supplement, or out
of the general fund..
This resolution being deemed ur-
gent and of immediate necessity,
shall be in • force and effect after its
passage and adoption by the City
Council.

Resolution of Necessity for Street
Improvement.
Be it resolved by the Cty Coun-
cil of the City of Dubuque, on its
own motion, that it be deemed nec-
essary and advisable to build, con-
struct and put in place certain street
improvements as hereinafter de-
scribed, in, upon and along the fol-
lowing street, to wit:
Fair View place, (as amended)
from the south line of West Six-
teenth street, south, to the end of
the street.
Said street improvement to con-
sist of grading, paving, and curb and
gutter the curb and gutter to be con-
structed of concrete and the pave-
ment to be constructed of one or
more of the following materials and
methods, to wit:
Sheet asphalt, warrenite bitulithic,
concrete, or bituminous macadam on
the present macadam foundation,
sewer, water and gas connections to
be laid to each lot prior to the im-
provement of the street.
All of thhe work herein proposed
to be constructed shall be done in
accordance with the plans and speci-
fications to be prepared by the City
Engineer and approved by the City
Council and City Manager.
That the cost and expense of mak-
ing and constructing said improve-
ments shall be assessed upon and
against all privately owned property
whether abutting or not but lying
within the assessable distance, pre-
scribed by law, according to the area
thereof.
Be it further resolved that the
above and foregoing street improve-
ment is hereby proposed to be made
and constructed as set forth and
that this proposed resolution, except
this paragraph be, and the same is
hereby set down for further and final
hearing, consideration, and determin-
ation, at a meeting of said Council
to be held on the 29th day of Janu-
ary, 1924, at 4:30 p. m. in the Coun-
cil Chambers in the City Hall of said
City, and that the City Clerk be and
he is hereby instructed to canoe
notice of the pendency of the above
resolution and of the time and place,
when and where said proposed res-
olution shall be considered for pass-
age and objections to the passage

The cost and expense of said - Work
will be paid by the levying of spec-

that he just learned of some old de-
linquent taxes against his place, lot

ment of street in 1892 and sold at
tax sale to the City August 20th.
1921. The amount of the assessment
with interest is $5.5.14. He states
that he bought this property in 1906
and was given a clear abstract of
title, however in order to clear up
this matter he offers to settle for
one -half of this amount.

the Treasurer be notified to accept

Be it resolved by the City Council
of the City of Dubuque, on its own
motion, that it be deemed necessary
and advisable to build, construct and
put in place certain street improve-
ments as hereinafter described, in,
upon and along the following streets,
to -wit:
West Sixteenth street from the
west line of Montrose terrace to the
west line of Cornell street.
Said street improvement to con-

Resolution for the Construction of a
Street Improvement
Be it resolved by the City Council
of the City of Dubuque, upon its own
motion, that pursuant to a resolution
of necessity proposed at a meeting
of the Council on the 7th day of Jan-
uary, 1924, and duly passed and ad-
opted and approved on the 29th day
of January, 1924, it is hereby ordered
that the improvement described in
said resolution of necessity provid-
ing for the improvement of West
Sixteenth street from the west line
of Montrose terrace to the west line
of Cornell street, by curbing with
new cement and concrete curb where
required, or by resetting old stone
curb where required, and by making
sewer, water and gas connections to
property not already connected with
the same, as provided for in a reso-
lution heretofore adopted and ap-
proved, and by paving said street
with either sheet asphalt, warrenite
bitulithic or asphaltic concrete on
the present macadam foundation, and
by constructing concrete gutter
where provided for in the type of

Also, some time ago arrangements
were made to sell to Mr. C. A. Spenc-
er, 1015 Glen Oak street, an unused

complete the purchase and wishes to
be given a deed to this piece of
ground. I would recommend that the
Mayor be authorized to execute a
deed in behalf of the City,' covering
this corner of property.

To the Honorable Mayor and Council
of the City of Dubuque :
Gentlemen: I beg to recommend
for settlement the following cases
which are now pending against the
City of Dubuque and arising out of
accidents which occurred on the side-
walks during the winter of 1922 and
1923:
Agnes Callahan vs City of Du-
buque, Law 21461. This accident oc-
curred on February 19, 1923, by fall-
ing upon a sidewalk at the north east
corner of Third and Bluff streets.
In this fall the plaintiff struck her
head against a water hydrant which
is located at that place and she suf-
fered very severe bruises and sus-
tained a nervous shock to her entire
system which incapacitated her for
quite a while. Suit was brought for
$5,000.00. I recommend a settlement
of $300.00 in this case.
Anna Ratterman vs City of Du-
buque, Law 21342. Miss Ratterman
fell on January 29, 1923 at the north
west corner of Sixteenth and White
streets. The extent of her injuries
are a fracture of the bones of the
right leg near the ankle. The ice
which was formed at this place was
caused from a water spout on a
building abutting upon said sidewalk.
Suit was brought in this case for
$5,000.00. I recommend a settlement
in the sum of $200.00 and the City
pay for the costs.
Ellen McCoy vs City of Dubuque,
Law 21391. This lady fell on a side-
walk located near the rear end at
the northerly side of premises known
at 1399 Jackson street and near the
alley at the rear of said premises be-
tween White and Jackson street. The
accident occurred on the 20th day of
March, 1923 and the icy condition
was caused by the fact that the side-
walk had not been cleaned of snow
and ice for a long time prior to the
accident and this condition was made
worse by the discharge of water from
a water spout at that point. This
was an old lady about seventy -two
(72) years of age and her fall has
rendered her a cripple. She is un-
able to get around without the aid
of a crutch at this time and her at-
tending physician advises me that
she sustained a very severe sprain
at or near the hip and the ligaments
of the back and legs were severely
strained. Suit was brought in this
case of $10,000.00. I recommend a
settlement in the sum of $450.00,
plaintiff to pay the costs.
Elizabeth Fischer vs City of Du-
buque, law 21394. This accident oc-
curred at or near the south westerly
corner of Fifteenth and White street
on the 27th day of March, 1923 at
about 6:30 a. m. The extent of the
injuries were a broken leg. In this
case, while there was some doubt
in my mind about the liability, yet
I believed that there was sufficient
evidence to take the case to the jury
and then it was merely a question
as to whether or not a recovery
might not be a good deal more than
what I have agreed to settle for.
Suit was brought in this case for
$2,000.00 and I recommended a set-
tlement in the sum of $75.00 and the
City pay the costs.
Lisette Krakow vs City of Du-
buque, Law 21467. This accident oc-
curred on the 2nd day of February,
1923 at the corner of West Third
and Edith street. The place where
it happened was at the curb abutting
the cross walk and as the plaintiff
stepped from the curb to the cross
walk she fell and sustained a dislo-
cation of the left wrist and a com-
plete fracture of the end of the radius
of the left arm and also severe con-
tusions on the face, head and body.
She has been permanently injured.
The walk at this place was in a
very bad condition and had been so
a long time prior to the accident.
Suit was brought on this case for
$3,000.00. enti the sum of $1,000.00.

In each of these cases my recom-
mendations are based upon the facts
as I have learned them from a thor-
ough investigation and I am con-
vinced that a much larger verdict
could be recovered than the amounts
for which settlements are recom-
mended. It will be noticed that sev-
eral of these cases were caused by
water spouts. At the time when
accidents occurred the law did not
give the City the right to call upon
the property owner to make a de-

Gentlemen: Some time ago the
petition of Magdalena Frommelt and
Joseph Frommelt was filed with the
City Council requesting a cancella -'
tion of a special assessment which
was levied in the year 1892 for the
improvement of Burden avenue in
the sum of $192.67. This petition
was referred to me and after re-
ceiving the same I have taken it up
with the parties and they have fin-
ally agreed to pay the sum ; of $25.00
in settlement of said assessment and
cancellation of the same. This be-
ing an old assessment I believe it
is advisable to take what we can get
out of it and although I have tried
earnestly to get a larger amount I
have been unable to do so. I would
therefore recommend that the assess-
ment against Lot 39 in O'Neil's River
View Subdivision for the improve-
ment of Burden avenue be cancelled
upon the payment by the owners
thereof of the sum of $25.00 and
thereupon the tax certificate which
the City holds be surrendered.

A Resolution.
Whereas, by an ordinance adopted
by the City Council of the City of
Dubuque on August 2, 1886, authority
was granted to the Dubuque Pontoon
Bridge Company to construct and
maintain a bridge adapted and suit-
able for the crossing of vehicles,
horsemen, footmen and animals and
the ordinary public uses and purposes
of highway bridges over and across
the Mississippi River from the City
of Dubuque, in Iowa, to the Town
of East Dubuque in the State of
Illinois and such authority and per-
mission was granted under certain
specified provisions; and
Whereas, for the purpose of aiding
and encouraging said Company in the
construction of said bridge, the City
of Dubuque contributed the sum of
$25,000.00, and, in consideration of
the sum thus contributed, said City
retained the right to fix the rate of
charges on said bridge from year to
year, and also the right to take said
bridge into its own possession and
control and to operate the same by
paying to said Company yearly at
the end of each year the net annual
interest of eight per cent on the
actual cost of constructing said
bridge and its approaches, less the
twenty -five thousand dollars ($25,-
000.00) contributed by it, and when-
ever said City exercised such right,
it could make said bridge free from
toll or partially so; and
Whereas, it is further expressly
provided in said ordinance that said
Company may, at any time, whether
before or after the City has deter-
mined to exercise this right, pay back
to said City the said Twenty -five
thousand dollars ($25,000.00) by it
contributed without interest and
thereafter it may hold, have and oper-
ate said bridge discharged of all right
on the part of said City to make it
a free bridge under the foregoing
option; and
Whereas, it is further provided
that the Mayor of said City shall be
ex- officio .a member of the Board of
Directors of said Bridge Company,
with the same powers and authority
as the other members thereof; and
Whereas, it is further provided
that, upon a resolution duly passed
by the City Council, said Company
shall be required to furnish said
Council with statements in writing,
duly sworn to, showing the actual
cost of the bridge, less the amount
contributed by the City and the
amount of the annual receipts of said
Company derived from operating

held January 29th, 1924, relative to
the repaying to the City of Dubuque,
by the Dubuque Bridge Co., of the

wards the construction of the bridge
in accordance with provisions of Sec-
tion 7 of the ordinance authorizing
the construction and maintenance of
a wagon and foot bridge across the
Mississippi River, presented.

the Clerk be instructed to notify said
Dubuque Bridge Co. to make pay-
ment at once to the City Treasurer
(Otto F. Puls), he to issue a proper
receipt for same, the money to be
credited to the Bonded Debt Fund.

$3,384.31 for the construction of a
sanitary sewer in the Linwood Dis-
trict. He states that the assessed
valuation of this property is $1,100.00
and asks that the assessment be re-
duced to 25 per cent of this valuation.

petition be referred to the City Man-
ager and City Solicitor for investi-

Petition of Charles E. H. Anthony,
owner of N. % of Lot 307. He states
that when he went to pay his taxes
he was informed that there is a bal-
ance of $6.02 long past due, amount-
ing with interest to date to $7.87,
and that the City holds a tax sale
certificate against the property. This
balance is the last installment due
for the improving of the alley be-
tween Maple and Cedar streets froni
18th to 19th streets. He hereby
asks that the City take $3.94, being
one -half of the whole balance, and
instruct the Treasurer to cancel the
assessment and surrender to him the
tax sale certificate on payment of
the $3.94.
Councilman Melchior moved that
the prayer of the petition be grant-
ed and the Treasurer be so in-

City Council of the City of Dubuque
at this time regarding the actual
cost of the construction of said
bridge and its approaches, together
with the annual operating expenses
and receipts of said bridge in order
that said Council may act intelligent-
ly thereon and in the interests of the
City of Dubuque;
Be it, therefore, resolved that said
Pontoon Bridge Company be and it
is hereby directed to furnish the City
Council of the City of Dubuque, with-
in thirty (30) days hereof, with state-
ments in writing, duly sworn to,
showing the actual cost of said
bridge, less the amount contributed
by the City, together with a detailed
statement showing the annual re-
ceipts and expenditures of said Com-
pany derived from and incident to
the operation of said bridge for the
years 1921, 1922 and 1923.
Be it further, resolved that the
City Clerk be and he is hereby, in-
structed to cause a copy of this Reso-
lution to be served upon the Presi-
dent or Secretary of said Company,
and make due return to the City
Council at its next meeting showing
such service to have been made.
