Another great man has been called to his eternal reward, and with his passing every head is bowed and the world stands sorrowing. Ex- Presi- dent Woodrow Wilson is dead. Per- haps in all history there never was another single individual upon whom the eyes of mankind were centered, and to whom • the world turned for aid in its darkest hour. It is. there- fore, only fitting that we turn aside fora moment from our busy cares and stand in reverence for his memory. It is my privilege, then, to request that all business be suspended for a period of five minutes on Wednes- day at the time of Mr. Wilson's fun- eral so that we, too, may, in a small way, express our deep respect for him whose memory will never die, and that all flags be placed at half mast for the day. Notice to Dubuque Electric Co., relative to paving streets on which the company has street car tracks. February 2nd, 1924. Gentlemen: —You are hereby noti- fied that at a session of the City Council of the City of Dubuque, Iowa, held J'uly 23rd, 1923, there was presented a proposed resolution of necessity for the improvement of Special Session, February 13th, 1924 serve the west 50 feet of the East 1 /z of Lot 30, Mt. Pleasant Add., and which was referred to me, I beg to report that it will be necessary to lay about 237.6 lin. ft. to serve this vacant lot, This 50 -ft. strip frontage being the only frontage that could be assessed for this sewer, I wish to state that Mr. Bush has two connec- tions running into the remaining por- tion of this lot from ,Mt. Pleasant street and could easily connect this 50 -foot strip from one of those con- nections much cheaper than by ex- tending the sewer in Julien avenue or by joining with the property own- ers abutting on Wood street who have run laterals into their property. Either one of the two above men- tioned methods would be much cheaper for Mr. Bush. Very respectfully, W. H. CULLEN, City Engineer. Councilman Brede moved that the petition be received and filed. Sec- onded by Councilman Melchior. Car- ried by the following vote: Yeas —Mayor Alderson, Council- -ten Brede, Gabriel, Melchior, Schrempf. Nays —None. Councilman Melchior moved that the rules be suspended to give any one present an opportunity to ad- dress the Council. Seconded by Coun- cilman Gabriel. Carried by the fol- lowing vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior and Schrempf. Nays —None. Mr. Davis, representing the plumb- ers' interests, addressed the Council relative to the proposed Plumbers' Ordinance, stating that the plumbers did not have enough time to study the ordinance thoroughly and they hereby ask for more time. Councilman Gabriel moved that the time for hearing on the Plumbing Ordinance be set for February 26th, 1924. Seconded by Councilman Brede. Carried by the following vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior, Schrempf. Nays —None. John A. Cunningham, secretary of the Retail Food Distributors, pre- sented a petition and addressed the Council thereon, relative to the sale of food stuffs in the City, defining the City Market, stating that they have no objections to the real pro- ducer of fruits and vegetables being permitted by license to sell their products on the public market or streets of the City used for that pur- pose, but that a large number of persons selling wares are nothing 45 more nor less than peddlers, who buy merchandise, goods or wares for the purpose of seling same, in any place other than a regular place of business. They object to this condi- tion and cite numerous other rea- sons, and hereby petition the Coun- cil to examine into the matter and remedy same. Councilman Brede moved that the petition be referred to the City So- licitor, he to investigate and furnish each of the Councilmen with a copy of the petition that they can famil- iarize themselves with the contents and act intelligently on the petition when it comes before the meeting. Seconded by Councilman Gabriel. • Carried by the following vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior, Schrempf. Nays —None. February 13th, 1924. City Council, Dubuque, Iowa. Gentlemen: —At the meeting of the City Council held on February 4th, 1924, the petition of Al Keppler re- monstrating against the assessment as levied against Lots 12 and 13, Littleton & Sawyer's Sub., for the making of sewer and water connec- tions, was referred to the City Man- ager and City Solicitor for report. We have investigated the proposi- tion and would recommend that the assessment as levied against Lot 12 be reduced to $80.00 and the assess- ment as levied against Lot 13 be reduced to $40.00. Both of these lots are considerably below the grade of the street and will require con- siderable filling before they are of much value. - If this recommendation is ap- proved by the City Council, the Aud- itor should be instructed to transfer the sum of $77.04 from the General Fund to the Special Improvement Fund to ,take care of the reduction herein recommended. Respectfully submitted, O. E. CARR, City Manager. M. H. CZIZEK, City Solicitor. Councilman Gabriel moved that the recommendation of the City Manager and City Solicitor. be ap- proved and carried out as recom- mended and the Auditor be instruct- ed accordingly. Seconded by Coun- cilman Melchior. Carried by the fol- lowing vote: Yeas - -Mayor Alderson, Council- men Brede, Gabriel, Melchior, Schrempf. Carried by the following vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior, Schrempf. Nays —None. February 13th, 1924. To the Honorable Mayor and Board of Commissioners, City of Du- buque. Gentlemen: — Relative to the at- tached petition of Carl O. Bircher and Jos. Jaeggi, asking to have the westerly 5 feet of Lot 5 in Kleine & Klingenberg's Sub. vacated, which was referred to me for a report as to the amount paid by the City for the purchase of this strip. I find that a warranty deed was given by Frank Schweitering and wife to the City of Dubuque on the 19th day of Feb- ruary, 1889, for the above mentioned strip, the consideration being one dollar. Respectfully submitted, W. H. CULLEN, City Engineer. Councilman Brede moved that the prayer of the petition be granted, and the City Solicitor be authorized to draw up the proper documents. Seconded by Councilman Gabriel. Carried by the following vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior, Schrempf. Nays —None. February 13th, 1924. To the Honorable Mayor and Board of Commissioners, City of Du- buque. Gentlemen: — Relative to the at- tached petition of Chas. T. Bush, asking to have the sanitary sewer in Julien avenue, between Wood street and Mt. Pleasant street, extended to Special Session, February 13th, 1924 47 lots, more than is necessary now with a connection to each lot. In view of this situation, we would recommend as follows: that no re- duction be made in the assessment levied against Lots 18, 19, and 20 in Union avenue Sub., which sub. lies north of Kirkwood street and which lots are very desirable. Lots 81A, 80, 79, 78, 77 ,76, 75, 74, 51, 52, 53, 54 and 55 in Wood's Add. should be granted a reduction 33 per cent. The above reduction is recom- mnded in view of Mr. Rhomberg's original request and not on account of the value of the lots. We feel that by granting this reduction Mr. Rhomberg will be treatd fairly' by the City. If this recommendation is ap- proved by the Council the Auditor should be instructed to transfer the sum of $343.09 from the General Fund of the City to the Special Im- provement Fund in order to take care of the reduction herein recom- mended. Respectfully submitted, O. E. CARR, City Manager. WALTER CULLEN, City Engineer. Councilman Brede moved that the recommendation of the City Man- ager and City Engineer Cullen be approved and carried out as recom- mended and the Auditor be instruct- ed to make the proper transfer from the General Fund to the Special Im- provement Fund. Seconded by Coun- cilman Gabriel. Carried by the fol- lowing vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior, Schrempf. Nays —None. February 12th, 1924. City Council, Dubuque, Iowa. Gentlemen: On January 8th, peti- tion of Oscar Hermann and C. B. Trewin, asking that the assessment as levied on January 2nd, 1921, on account of the guttering of Leibnitz street be compromised by the pay- ment of $50.00, was referred to the City Manager for investigation and report. This is a rather involved proposi- tion and a full report regarding it is rather difficult to make. I have seen the Lot 2 of 1 in Geo. D. Wood's Sub., and would state unquestionably that the assessment as levied was much more than one - quarter the va- lue of the property. Furthermore the purchaser, Mr. Hermann, was de- pending upon the clear abstract. The abstractor contends that the records in the Treasurer's office show this lot to be in the C. A. Voelker Sub. instead of the G. D. Wood's Sub., when the abstract was made. The records in the Treas- urer's office indicate erasures to have been made. There is a possibility that at this time the City might realize in full on the tax title certificate which was purchased by the City. On the oth- er hand, there is a question involved as to whether the City is not liable on account of the error in copying in the Treasurer's offic.e In view of the fact that this lot today is not worth more than two or three hun- dred dollars, and in view of the of- fer of $50.0Q for the tax title certif- icate, I believe that the best inter- ests of the City would be served by accepting this offer and surrender- ing the tax title certificate on the payment of $50.00. I am led to the above recommen- dation mainly on account of the evi- dent unfairness to the purchaser and also to the abstractor to demand settlement in full at this time when evidently the Treasurer's books were in error when the abstract was made. Resepcfully submitted, O. E. CARR, City Manager. Councilman Brede moved that the recommendation of the City Man- ager be approved and the Treasurer be authorized to accept from Oscar Herrmann the sum of $50.00 in full of above delinquent assessment, and surrender tax sale certificate upon receipt of same. Seconded by Coun- cilman Gabriel. Carried by the fol- lowing vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior, Schrempf. Nays —None. February 13th, 1924. City Council, Dubuque, Iowa. Gentlemen: In connection with the various paving jobs, it develops that there will be considerable rock excavation required to be made be- fore the pavement can be laid on West Locust street. I have advised the contractors by letter, written this day, that all rock excavation will be considered as an extra rather than to have it included in the price bid for paving as is provided in Section 52 of our specif- ications. My idea in this connection is that the cost will be less if bid for as rock than it will be if figured into the yardage cost of the pavement as laid. This charge for rock excava- tion outside the street car portion, will then have to be assumed by the City as a grading cost and will not be borne by the property owner. I 46 Special Session, February 13th, 1924 February 13th, 1924. City Council, Dubuque, .Iowa. Gentlemen: —At the meeting of the City Council held January 29th, peti- tions of A. L. Rhomberg and Adam Doerr remonstrating against the as- sessments as levied against their property of the seven lots to which connections were made has a front- age of property for making sewer and water connections on the improve- ment of West Locust street, were re- ferred to the City Manager and City Solicitor. Adam Doerr is the owner of eight lots. The City is stubbing out with sewer and water connections to serve five of these lotst, no assess- ment being levied. The other three lots are good lots and, while the assessment of $159.09, each may be slightly in excess of one - quarter of their value, yet the assessment as levied covers the assessment for both sewer and water connections. We would, therefore, recommend no reduction. A. L. R lomberg is the owner of eleven lots. Connections were laid to seven and omitted on four. One of 7 lots 125 feet, which is equivalent to two ordinary lots. Lots 24C, 25B and 26B, Wood's Add., lie just below where Rosedale avenue connects with West Locust street and are not of very much value. We would rec- ommend that the assessment for sewer and water connections to these lots be reduced to $50.00 each. Lots 28B, 29B, 3OB and 31B are more valuable lots. We would recom- mend that the assessment for sewer and water connections to these lots be reduced to $100.00 each. If this recommendation is ap- proved by the Council, the Auditor should be instructed to transfer the sum of $569.78 from the General Fund to the Special Improvement Fund to take care of the reduction herein recommended. • Respectfully submitted, O. E. CARR, City Manager. M. H. CZIZEK, City Solicitor. Councilman Gabriel moved that the recommendation of the City Manager and the City Solicitor be approved and carried out as recom- mended and the Auditor be instruct- ed to make the proper transfers. Seconded by Councilman Schrempf. Carried by the following vote: Yeas - -Mayor Alderson, Council- men Brede, Gabriel, Melchior, Schrempf. Nays —None. February 12th, 1924. City Council, Dubuque, Iowa. Gentlemen: At the meeting of December 29th, the petition of A. L. Rhomberg, protesting against the as- sessment as levied against Lots 139, 140 and 141, Julien's Addition, on account of the improvement of Shiras avenue, was referred to the undersigned for report. We beg to advise that Lot 141 was assessed $39.15 and Lots 140 and 139 were assessed $78.30 each. The im- provement of this street was done by the City on petition of all the other property owners excpt Mr. Rhomberg. The Ciey is therefore not able to collect the assessment from Mr. A. L. Rhomberg if he re- fuses to pay it. We, therefore, would recommend the acceptance of the proposition as made by Mr. A. L. Rhomberg in the petition above referred to, namely, that he pay $12.50 for Lot 141 and $25.00 each for the other two lots, and that the assessment be corres- pondingly reduced. Respectfully submitted, M. H. CZIZEK, City Solicitor. O. E: CARR, City Manager. Councilman Brede moved that the recommendation of the City Manager and City Solicitor be approved and carried out as recommended. Sec- onded by Councilman Gabriel. Car- ried by the following vote: Yeas —Mayor Aderslon, Council- men Brede, Gabriel, Melchior, Schrempf. Nays - -None. February 13th, 1924. City Council, Dubuque, Iowa. Gentlemen: At a meeting of the City Council held on December 27th, the petition of A. L. Rhomberg re- monstrating against the assessment levied against his property on Kirk- wood street for the making of sewer, water and gas connections, was re- ferred to the City Manager and City Engineer. The statement of Mr. Rhomberg that his request to the City Council was referred to the Manager and En- gineer, the connections be made only to every other lot, is true. Also, we had intended that fewer connections be made than were actually made, but partly through a misunderstanding the extra connections were made. February 16th, 1924. City Council, Dubuque, Iowa. Gentlemen: Nearly one year ago the Council directed me to secure property necessary to extend Algona Street through to Rosedale Avenue. I have been working along that line and am able to report some progress. In connection with the extension of Algona Street there are other things which strike me as being very important. The two subdivisions, Woodlawn Park and Mills West Du- buque, unfortunately do not match or fit in any way. Green Street in Mills West Dubuque Add., comes to a dead end when it strikes the Wood - lawn Park Add., and the streets in Woodlawn Park Add. come to an ab- rupt end whenever they came to Mills West Dubuque Add. It seems to me very desirable to extend Green Street through to Algona Street and extend Alta Vista Street through to Green Street in order to open up these dead ends as well as make the extension of Algona Street. The prices as set on the property necessary to make the extensions seem to be very unreasonable, when they were first asked. However I am able to report that Lot 27, Mills West Dub. Add., which is necessary for the extension of Alta Street to Green Street, can be secured for $140.00 and Lots 225, 226 and 269 in Woodlawn Park Add. which are necessary to be acquired in order to extend Green Street through to Algona Street, can be purchased for the sum of $450.00. Negotiations are progressing satis- factorily for the acquiring of Lots 19, 20 and 21 in Mills West Dubuque Add., which are necessary for the extension of Algona Street through to Rosedale Ave. I would ask for authority to pur- chase the above four lots at the prices named, which are practically 48 Special Session, February 13th, 1924 am advising you of this change for your information and approval. Respectfully submitted, O. E. CARR, City Manager. Councilman Brede moved that the action of the City Manager be ap- proved and made a matter of record. Seconded by Councilman Gabriel. Carried by the following vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior, Schrempf. Nays —None. To the Honorable Mayor and Coun- cil of the City of Dubuque, Gentlemen: At the present term of the District Court of Dubuque County, Iowa, a judgment was rend- ered against the City of Dubuque in the sum of $3,500.00 in the case of Mabelle McGlinchey vs. City of Du- buque, Law No. 21259. This action arose out of severe personal injuries which were sustained by the plaintiff on the 29th of January, 1923, at a point just opposite the southerly cor- ner of the building known as No. 359 Main Street a'nd occupied by one Max Berk. The suit was brought for $15,000.00 and the trial consumed the greatest part of seven (7) days. The condition which existed at the time of the accident and for several days prior thereto consisted of a ridge of ice about four (4' feet in width and from two to three inches in thick- ness extending completely across the sidewalk and was caused by a down spout from the building located at that point. I found it impossible to dispute the existence of the defect and my greatest effort was directed to keeping the amount of the dam- ages down as low as possible. The plaintiff was an actress and there was plenty of evidence introduced to the effect that she is incapacitated from continuing her profession and earning a good salary. Under all of the circumstances I feel satisfied with the verdict and for that reason I do not believe it wise to press the case further by way of a motion for a new trial or by appeal to the Supreme Court. I am certain that the City received a fair trial and the verdict would be sustained as reasonable and not excessive. For this reason I would recommend that the judgment be paid to Kintzinger and Stuart attor- neys for the plaintiff and have the same discharged. In addition to the judgment the City is required t opay the costs which amount to $105.50 and you will also have a warrant drawn in favor of M. J. Grace, Clerk of the District Court, for that amount. There was also tried at this term of Court the case of W. S. Gow vs. The City of Dubuque, Law No. 21468. the plaintiff claims to have sustained by a fall upon an icy sidewalk on January 4, 1923. The sidewalk is lo- cated at the North West Corner of Alta Vista Street and Harvard Street. Suit was brought for $2,500.00. In this case the jury rendered a verdict in favor of the City and the costs follow the verdict. The case of Peter Aird vs. the City of Dubuque was also started for trial, Law No. 21505. This case arose out of damages which it is claimed the plaintiff sustained when he drove his car into a ditch or across Grandview Avenue, where the same entersects with the Rockdale road as relocated in the night time. He claims to have sustained damages in the sum of $255.07. In this case S. J. Groves and Sons had the contract for this work and, as you recall, the Council or- dered a certain amount of money to be retained by the City out of any money belonging to said contractor to reimburse the City in the event a verdict was rendered against it in this action. I served a notice upon the S. J. Groves and Sons Company to defend the suit and this they did. After the jury had been secured to try the case the attorney represent- ing said contractor settled the case with the plaintiff and paid the costs and the case has been dismissed This case arose out of injuries which against the City. I also recommend that the Auditor be instructed to re- lease any money which he is now holding belonging to said contractor on account of the pendency of said action. There was also called and set for trial the following cases: Robert Sullivan vs. City of Du- buque, Law No. 21397 and Anna Koppes et al vs. City of Dubuque, Law No. 21204. In these cases I was ready to proceed with the trials of them when they were reached and had made all arrangments to do so, so far as witnesses were concerned but the attorneys representing the plaintiffs in these actions requested a continuance of the Court and this was granted and these cases have been postponed until the March term. Report of the City Solicitor. Respectively submitted, M. H. CZIZEK, City Solicitor. Councilman Melchior moved that the report of the City Solicitor on the several law cases be approved, and the recommendations therein made be carried out. Seconded by Cour cilman Brede, and carried by the fol- lowing vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior, and Schrempf. Nays —None. 50 Special Session, February 18th, 1924 one -half the first price asked. Fur- thermore, I believe that with the opening of these streets and the de- velopment of this section of the city, that the property not required for street purposes can be disposed of for the present purchase price. Respectively submitted O. E. CARR, City Manager. Councilman Brede moved that the request of the City Manager be granted and he be given authority to purchase the above described property for street purposes, as set forth. Seconded by Councilman Melchior. Carried by the following vote: Yeas —Mayor Alderson, Council- men Brede, Gabriel, Melchior, and Schrempf. Nays —None. February 16th, 1924. City Council, Dubuque, Iowa. Gentlemen: On August 6th, 1894, Lot 15 Nairn't Add., was assessed $12.41 on account of the improve- ment of Booth Street from Third Street to Dodge Street. This lot was again assessed last year for the improvement of Booth Street, slightly over $237.00. It still belongs to the Chas. Neuman Estate. Mrs. Neuman states that she under- stood from me that the old taxes would be cancelled in case they paid the present assessment in full. I think probably I made some such suggestion to her. The present as- sessment has been paid in full and I would therefore recommend that the tax certificate which the city holds on account of the 1894 taxes be cancelled at the Auditor's office. Respectfully submitted, O. E. CARR, City Manager. Councilman Brede moved that the recommendation of the City Manag- er be approved, and the Auditor be instructed to cancel the tax sale certificate held by the city for the 1894 taxes. I personally feel that a hard top paving would be more satisfactory in the long run - than a soft top. There is considerable difference in price between the low bid for vibro- lithic and the low bid for asphalti concrete. Asphaltic concrete will un- doubtedly give good service for some years. The proposition as to wheth- er the vibrolithic, costing nearly 45 per 'cent more than the asphalt concrete is more desirable is left to the Council. J. Rasmussen & Sons Co. are the low bidders on asphaltic concrete and the Uhlrich -Paley Company is low on vibrolithic. Respectfully submitted, O. E. CARR, City Manager. Resolution Awarding Contract. The following covers most of the unit prices as well as the esti- mated total cost of the work: James Saul, Dubuque —Brick at $4.43, $14,930.10; vibrolithic at $2.47, $8,844.06; reset curb, 40c. , J. F. Lee, Dubuque —Brick at $4.25, $14,249.50; reset curb, 35c. S. J. Groves, Minneapolis —Brick at $4.36, $14,503.28; vibrolithic at $2.54, $8,845.42; reset curb, 50c. Moore -Young Waterloo — Vibrol- ithic at $2.47, $9,283.56; reset curb. 50c. Uhlrich -Paley Co., Dubuque —Brick at $3.39, $11,614.74; vibrolithic at $2.23, $8,024.54; reset curb, 40c. Engineer's Estimate — Brick, $12,- 862.80; vibrolithic, $8,443.20. We took bids only on two types of paving. Uhlrich -Paley Co. is low on both vibrolithic and brick. My recommendation would be that they be awarded the contract for paving with brick at the price bid and that the City substitute Hillside brick for the ordinary paving brick on which bids were received, the City to as- asume the difference in cost. Respectfully submitted, 0. E. CARR, City Manager. Resolution Awarding Contract.
