Regular Session, March 3rd, 1924.
Council met at 4:30 P. M.
Present — City Manager Carr
Mayor Alderson, Councilmen Brede,
Gabriel, Melchior, Schrempf.
Mayor Alderson in the Chair.
Mayor Alderson stated that this is
the regular monthly meeting of the
City Council for the purpose of act-
ing on such business as may regu-
larly come before it.
Petition of Margaret Masterson,
stating that she is the owner of Lot
28, Levin's Add., that she lives in
Chicago, that when the assessment
was levied for the improvement of
Alta Vista street she received the
notice too late to take advantage of
the installment plan, and hereby peti-
tions the Council to be permitted to
do so.
Councilman Brede moved that the
prayer of the petition be granted
providing she pays two installments
this month. Seconded by Council-
man Schrempf. Carried by the fol-
lowing vote:

Nays —None.
Notice of claim against the City
for $7,500.00 for personal injuries re-
ceived by Hugh Kearney (sometimes
spelled Carney), filed by Lyon &
Willinging, his attorneys. Claimant
states that he fell January 5th, 1924,
on the south side of Rush street at
a point about the west line of Union
street on a cinder walk covered with
ice and snow and that he fractured
the femur of the right leg above the
knee.
Councilman Schrempf moved that
the petition be referred to the City
Solicitor. Seconded by Councilman
Brede. Carried by the following
vote:

Schrempf.
Nays —None.
Petition of C. E. Kampman stat-
ing that he is the owner of Lot 99,
Woodlawn Park Add., that the total
valuation of this lot is $340.00, that
the levy for the street assessment
amounts to $366.50 and the assess-
ment for sewerage amounts to
$106.00, and that this is far in ex-
cess of a 25 per cent valuation of
this lot. He further states that he
is anxious to pay the assessment and
therefore wants it adjusted and re-
duced to the proper amount.
Councilman Brede moved that the
petition be referred to the City Man-
ager and Engineer for investigation.

Petition of Julia McGrath Norton
and John McGrath remonstrating
against the assessment as levied
against Lots 1 and 2 in McGrath's
Sub., for the making of sewer and
water connections on the improve-
ment of West Locust street, stating
that the lots are assessed as fol-
lows: Lot 1 for $136.00 and Lai 2
for $133.00, which is wholly out of
proportion to the valuation of these
lots, and asks that this be inves-
tigated and made right. They also
state that they had a plumber en-
gaged to do this work but somehow
he did not being work at once owing
to other work that he bad to finish,
and before they knew it the City had
the work done.
Councilman Brede moved that the
petition be referred to the City Soli-
citor and City Engineer for investi-
gation. Seconded by Councilman
Gabriel. Carried by the following
vote:

Petition of T. A. Polsean asking
permission to install a gasoline pump
and underground storage tank in
front of his place of business, 705
Seminary street, presented. Council-
man Gabriel moved that the prayer
of the petition be granted; proper
stipulations to be signed. Seconded
by Councilman Brede. Carried by
the following vote:

Petition of G. R. Booth asking per-
mission to install a gasoline pump
and underground storage tank in

the prayer of the petition be grant-
ed; proper stipulations to be signed.

the construction of the Eagle Point
sanitary sewer .>ystem. Uhlrich Paley
Co., contractor, has been completed
and is now being tested out by the
sewer inspector.
Daily there are requests from peo-
ple along this sewer to be permitted
to connect their homes with the sew-
er. I would therefore recommend
the acceptance of this work at this
time, in order that it may be used.

A Resolution.
Whereas, the contract for the con-
struction of a sanitary sewer to
serve the Eagle Point District, has
been completed, and
Whereas, the City Manager has ex-
amined the work and recommend its
acceptance, now therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque that the
recommendation of the Manager be
approved and the City Engineer be
and he is hereby instructed to pre-
pare a plat and schedule showing
the lots or parcels of real estate sub-
ject to assessment for said improve-
n; en!, and file the same in the office
of the City Clerk subject to public
inspection and the City Clerk shall
upon receipt of such plat and sched-
rle publish the notice of said assess-
ment as required by law.

completed and tested by the sewer

Councilman Schrempf moved the

The City Manager reported that
the Woolworth Company asked per-
mission to shut off the side walk on
Main street between Seventh and
Eighth streets abutting the old build-
ing which they are about to tear
down. The Council agreed that they
be allowed to shut off a space ex-
tending to 6 feet from the building
line. No vote taken. The Manager
also reported that he had a letter
from Mr. Crowley of the Davenport
Construction Co., asking for .a re -em-
bursement for the cost of hauling
sewer pipe during the construction
of a storm sewer constructed by his
Company. No action taken.
There being no further business,

tracts or parcels of ground which are
subject to be furnished with sewer
connections or drained by such
sewer system, such property to be
considered as adjacent property.

Gentlemen: Your Committee on
Building Code held a further meet-
ing on Wednesday last, with those
interested, and as a result of that
meeting we have the following addi-
tional changes to recommend to the
Council in connection witht he Build-
ing Code:
In Definition 20, Section 6, after
"for which plans have been filed"
add "or permits issued ".
. Section 23. Strike out the last
three lines beginning with "mater-
ials" and substitute the following:
"and a permit is not required for
ordinary repairs as covered by Defi-
nition 47A."
Section 137. Add the following
sentence at the end of the section:
"This section not to apply to resi-
dences not exceeding two stories in
height."
Sections 283 and 283A. Omit en-
tire of both sections, which deal with
roof covering.
Section 335. Omit the word
"range" in second line.
Section 411. Add: "if of concrete
basement walls shall not be less than
ten inches thick."
Section 631. Omit the words
"dressing rooms" in second line.
Section 633. Strike out the last
clause beginning with the word
"same" in third line from the last.
Section 776. The date of taking
effect of this ordinance should be
moved ahead to April 1st instead of
March 15th.
Section 326. Omit the sentence
beginning with. "All hot air registers
when placed "; also omit the sentence
beginning with "No wooden lathing
shall be placed in front of or over
any hot air pipe."
Section 326A. In third line from
last change the ".36 lbs." to ".26
lbs."
Section 770. In regard to fire lim-
its, the Council should decide as to
whether they wish to include all the
territory within the fire limits as in-
cludd in •Section 770.

cil of the City of Dubuque:
Section 1. That the Carr, Ryder &
Adams Company, a corporation or-

ganized under the laws of the State
of Iowa, with its principal place of
business in Dubuque, Iowa, its suc-
cessors and assigns, be and it is
hereby authorized to build and per-
petually maintain an arch or cover-
ing over the alley between Jackson
and Washington streets and 10th and
11th streets, in the City of Dubuque,
Iowa.
Sec. 2. Soid Company is further
authorized to excavate under the al-
ley at said point and construct an
underground tunnel or subway con-
necting the two sections of the base-
ments of the buildings located
thereat.
Sec. 3. It is further authorized
and permitted to construct a two -
story bridge of steel construction
across 10th street, and a one -story
bridge of steel construction across
Washington street, thereby connect-
ing the buildings owned, operated
and controlled by said Company with
such structures.
Sec. 4. That said arches or cov-
erings shall not be less than 16 feet
in height from legal grade of said
alley to the underside of the crown
of said arch or covering.
Sec. 5. In the construction of the
underground tunnel this permission
is expressly made subject to the
rights of the City to at all and any
times lay, maintain, construct, in-
spect water mains, sewer mains, gas
mains and electric conduits, and to
so regulate the placing of said mains
and conduits at all times so that they
will not interfere with or be dis-
turbed by reason of the existance of
said tunnel; the understanding be-
ing that this ordinance shall in no
manner limit or restrict the rights
and powers of the City of Dubuque
to control and regulate the use of
this alley whereon the bridge and
tunnel is being constructed.
Sec. 6. That the said Company,
its heirs, successors and assigns, by
the acceptance of the privilege grant-
ed hereunder, hereby perpetually ob-
ligates itself and themselves, to be-
come responsible to any individual,
persons or corporation sustaining
any injury or damage by reason of
the construction and maintenance of
said arches or coverings, or said
tunnel, and hereby agree to hold the
City of Dubuque harmless and free
from all or any such loss, damage
or litigation as may result from the
construction of the matters and
things herein authorized. It being
understood that this section shall in-
clude the time that said structures
are being built as well as all the
time thereafter.
Sec. 7. This Ordinance shall be
in force arid effect 10 days from and
after its final passage and adoption
by the City Council and publication

Petition of Mrs. Irene Spiegel -
halter asking for exemption of taxes

petition be referred to the City Soli-
citor for investigation and report.

Petition of the T. J. Mulgrew Co.,
together with a letter received by
said company from the Chief of the
Fire Department, which suggested
that facilities be provided for bring-
ing fire trucks closer to their build-
ings in case of fire, stating that they
agree with the suggestion made by
the Chief and hereby invite the Coun-
cil to visit the site and investigate.
Councilman Melchior moved that
the communication be approved and
the Council investigate. Seconded
by Councilman Gabriel. Carried by

Councilman Melchior moved that
the bond, being duly executed, he
received and filed. Seconded by
Councilman Gabriel. Carried by the
following vote:
Special Session, March 10th, 1924
Dubuque for the collection of gar-
b and dead animals within the
City of Dubuque, which contract
bears date of October 2, 1916, and
expires on May 1, 1928, by the terms
of which contract a stipulated price
of $40.00 per day is provided for as
compensation for the collection of
such garbage and dead animals, and
Whereas, it is deemed necessary
and advisable by the City Council of
the City of fDubuque, that in order
to insure more satisfactory results
in the collection of garbage, the con-
tract heretofore existing be cancelled
and a new contract entered into in
its stead; and
Whereas, the parties to said con-
tract and the only ones interested
therein have mutually agreed to sur-
render the same on the 30th day of
April, 1924; now therefore,
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That the contract here-
tofore existing between E. E. Frith
and the City of Dubuque providing
for the collection of garbage and
dead animals be and the same is
hereby cancelled and rescinded, such
cancellation to become effective on
April 30, 1924, and from and after
said date said E. E. Frith, his suc-
cessors, and representatives shall be
released from any further obligation
thereunder.
Sec. 2. That the mayor be and he
is hereby authoried and instructed
to enter into and execute on behalf
of the City of Dubuque the written
contract hereto attached providing
for the collection of garbage and
dead animals within said City, said

shall become effective as of May 1,
7924, and continue in operation until

tract, the price for the collection of
said garbage and dead animals shall
be fixed in the contract referred to,
namely, said contractors shall be
paid the sum of $55.00 for each
working day from May 1st until No-
vember 1st, and the sum of $50.00
for each working day from Novem-
ber 1st to May 1st, and the City
Clerk is hereby instructed to attest
the signature and cause the great
seal of the City of Dubuque to be
affixed thereto.
Sec. 3. That this ordinance and
the contract herewith submitted
shall remain on file in the office of
the City Clerk for public inspection
for at least one (1) week before the
same shall be taken up for final
passage, adoption and approval, and
if t the end of that time no objec-

Be it ordained by the City Council
of the City of Dubuque:
Par. 880, Sec. 1. Garbage defined
The term "garbage" as used herein
shall mean any and all refuse from
food incidental to preparation or use
for human consumption.
Par. 881, Sec. 2. Duties of house-
holder. The occupant of every build-
ing, premises, apartment or place
where garbage does or may exist,
shall provide himself with a garbage
can made of substantial galvanized
iron or other non - rusting metal in
which he shall deposit all garbage
existing at the place occupied by
him. Such can shall be water tight.
They shall be of a size that can be
conveniently handled by the garbage
collector, not smaller than will con-
tain one week's garbage for the re-
spective family, not to exceed in
holding capacity more than 15 gal-
lons, and shall be kept where they
can be conveniently reached by him
Where alleys are accessible,such can
shall be placed close to same, and
where alleys cannot be so used such
can shall be placed as close to the
street as may be for the convenience
of the collector. No garbage can
shall be placed, kept or left on any
street, alley or public way for any
purpose whatsoever. In buildings or
apartments of more than one story
in height, all garbage cans shall be
placed at the street level for collec-
tion. All garbage cans shall be kept
reasonably clean.
Par. 882. Sec. 3. Things excluded
from garbage receptacles. It shall
be unlawful for any person to place
in said above mentioned vessels or
cans any ashes, tin, glass refuse,
waste, or any other material what-
soever, except garbage as defined in
this ordinance.
Par. 883, Sec. 4. Garbage prohib-
ited upon streets and other places.
No person shall throw, bury, burn or
leave in or upon any street, court,
lane, alley, public square, public en-
closure, vacant lot or any pond,
stream, or body of water or branch
thereof within the limits of the City
of Dubuque, any garbage or dead
animals or waste, fish or fowls or
any portion thereof except under per-
mission granted by the Health
Department.
Par. 884, Sec. 5. Miscellaneous
collections prohibited. No person or
persons, except the garbage con-
tractor, shall collect, handle, haul, or
transport on any of the streets, al-
leys, public ways or places of the
City any garbage without first hav-
ing procured a permit therefor from
the Health Officer. The holder of
such permit shall handle, haul or
transport garbage only in water-
tight covered vehicles, so that there
will be no spilling, dripping or drain-
ing of liquid matter from the gar-
bage from such vehicles during tran-
sit. Such vehicles shall at all times
be subject to the inspection and ap-
proval of the Health Officer as to
condition and cleanliness. All per-
sons securing such permits shall file
with the Health Department a list of
names and addresses of all occu-
pants of property from which he de-
sires to collect garbage, and it shall
be the duty of such collector to no-
tify the Health Officer ten (14) days
prior to the discontinuance of such
collections of his intention to so dis-
continue further collections.
Par. 885, Sec. 6. All ordinances
or parts of ordinances which are in
consistent with the terms hereof are
hereby repealed.
Par. 886, Sec. 7. Any person who
shall violate any of the provisions
of this Ordinance shall be punished
by a fine of not more than $100.00
or he imprisoned not more than
thirty (30) days in jail for each of-
fense or by both such fine and im-
prisonment upon subsequent con-
victions.

Be it ordained by the City Council
of the City of Dubuque, Iowa, as
follows:
Section 1. There are hereby or-
dered issued the negotiable coupon
bonds of the City of Dubuque 'Coun-
ty'of Dubuque, and State of Iowa, in
the aggregate amount of $125,000.00
for the purpose of improving and
extending the municipal water works
system of
Sec. 2. That said said City. bonds be de-
nominated "Water Works Bonds,"
numbered from 201 to 325, both num-
bers included, of the denomination
of $1,000.00 each, be dated April 1,
1924; become due and payable in
numerical order, $20,000.00 on April
1 of the year 1937, and $10,000.00 on
April 1 of each of the years 1938
to 1943, inclusive, and $45,000.00 on
April 1; 1944; that such 'bonds bear
interest at the rate of 4 per cent
per annum, payable October 1, 1924,
and semi=annually thereafter on the
first day of 'April' and October of
each year. That interest on said
bends 'be evidenced by proper cou-
pons attached to 'each of said bonds,

Sec. 3. That upon presentation at
the office of the City Treasurer of

Sec. 2. That there has been con-
structed within said district a main
sewer consisting of a main sewer
and tributary and lateral sewers,
which sewers comprise the system
of sewers within said district.
Sec. 3. That, for the purpose of
paying the cost of the construction
of said main sewer system and, in
order to equitably and proportionate-
ly distribute the same upon the lots,
tracts or parcels of ground benefited
by said sewer system, all property
which is subject to be furnished'with
connection to said sewer system or
which may be drained and served
thereby, shall be subject to assess-
ment therefor and shall be consid-
ered as adjacent property; provided,
however, that' all property lying
within the limits of the defined dis-
trict which had been previously as-
sessed for a sewer system 'before the
creation of said district shall be
expressly 'exempted from the pay-
ment of any part of the sewers con-
structed within said' district, estab-
lished hereby.
Sec. 4. That the basis for assess-
ing the cost of such sewer system
'shall be ' determined by the City
Council in advance of the levying of
the assessments and shall be fixed
in an amount up to 66 percent of
the total cost of said system.
Sec. 5. That the remaining 33
per cent of' the total cost of said
system shall be assumed by the City
of Dubuque 'and shall be paid for out

partly from each of such funds.

City, it is necessary to enter into a
new contract with said Company;

Whereas arrangements have been
made with said Company for the
lighting of streets, which arrange-
ments embody terms satisfactory to
the City Council, be it therefore
Resolved, that a contract be en-
tered into by and between the City
of Dubuque and said Dubuque Elec-
tric Company providing for the fur-
nishing of electrical energy for street
illumination, and the contract here-
to attached be executed on behalf of
the City by the Mayor thereof, and
that this Resolution and Contract be
placed on file with the City Clerk
for at least one week before final
passage and adoption and approval
of the contract, and if no objections
are filed thereto at that time, that
this Resolution be adopted and the
contract approved.

Contract.
This Agreement, made and enter-
ed into this 10th day of March, 1924,
by and between the Dubuque Electric
Company, hereinafter called the Com-
pany, and the City of Dubuque, here-
inafter called the City, witnesseth:
That, whereas, the Company is en-
gaged in the manufacture, distribu-
tion, and sale of electric current
within the City of Dubuque, Iowa,
and the City desires to operate cer-
tain lamps necessary for the illum-
ination of its streets, alleys, and pub-
lic places,
Therefore, it is mutually agreed
and contracted, that such lamps as
are deemed necessary by the City
shall be installed, maintained, and
operated by the Company upon an
all- night, every -night schedule of ap-
proximately four thousand (4000)
hours per year, to be lighted fifteen
minutes after sunset and extin-
guished thirty (30) minutes before
sunrise of each calendar day.
For the installation, operation, and
maintenance of said lamps, the City
shall pay to the Company, on or be-
fore the tenth (10th) day of each
month, one - twelfth (1 -12) of the to-
tal annual bill based upon the fol-
lowing schedule of rates:
For each Type C gas filled Mazda
lamp of 600 candlepower rating, over-
head construction, the sum of $65.00
per year.
For each Type C gas filled Mazda
lamp of 400 candlepower rating, over-
head construction, the sum of $57.00
per year.
For each Type C gas filled Mazda
lamp of 250 candlepower rating, over-
head construction, the sum of $45.00
per year.
For each Type C gas filled Mazda
lamp of 100 candlepower rating, over-
head construction, the sum of $27.50
per year.
It is understood and agreed, by and
between the parties hereto, that the
Company will install and equip at its
own expense any additional lamps of
overhead construction, within a dis-
tance of one average city clock from
any existing street lamp, upon the
written order of the City Council,
it being understood, however, that
in the event this contract is not re-
newed at its expiration, the City shall
pay to the Company upon the expira-
tion of the contract seventy -five (75)
percent of the cost of installing any
additional streets lamps which may
have been ordered by the City Coun-
cil during the last two years of the
life of this contract.
For the various types of lighting
units now being supplied with under-
ground service, and which were not
installed at the expense of the Com-
pany, the following rates, covering
maintenance and electric service
shall apply:
For each 250 candlepower Type C
gas filled Mazda boulevard type unit
on Grandview avenue, burning" all
night, the sum of $42.50 per year.
For each 250 candlepower Type C
gas filled Mazda boulevard type unit
on Grandview avenue, burning until
midnight, the sum of $35.00 per year.
For each 50 watt traffic light, the
sum of $24.00 per year.
For each railroad crossing signal,
similar to those now installed on
Rhomberg avenue, the sum 'of $35.00
per year.
For each 5 -light post as now in-
stalled in Washington, Jackson, and
Phoenix parks, each post containing
1 -100 watt and 4 -50 watt lamps, the
sum of $57.91 per year.
For each 4 post lights now in-
stalled in Caledonia park of 100 watts
each, the sum of $3.00 per post per
month.
The Company agrees to hold the
City harmless from all damages
which may occur by reason of the
construction, maintenance, or oper-
ation of its poles, wires, or electrical
appliances in connection with such
street lights.
At the expiration of this contract,
the Company, if so ordered • by the
City Council, shall remove all poles
and wires employed in furnishing the
above lights, excepting such poles
and wires as may be necessary for
providing electric current for com-
mercial and domestic purposes, and
shall repair all streets, alleys, and
sidewalks damages by the removal
of such poles and appliances.
It is understood and agreed, by
the parties' hereto that this contract
may be subject to review at the re-
quest of either party, at the end of
the first five (5) years, both as to
rates for the various size units and
as to type of illuminant, provided
changes and conditions come about
during such five year period which
materially affect the cost of furnisn-
ing the service herein provided for,
or should there be perfected during
such period a more efficient type of
street - lighting apparatus, the econo-

RESOLUTION.
A Resolution declaring vacated, an-
nulled and forfeited certain rights
heretofore granted to the Chicago
Burlington and Northern Railroad
Company, its successors and assigns.
Whereas, on February 10, 1886, an
Ordinance was adopted by the City
Council of the City of Dubuque en-
titled "An Ordinance, granting to the
Chicago Burlington and Northern
Railroad Company, its successors and
assigns, the right of way across and
along certain streets and alleys, and
to the use and occupy for Railroad
purposes certain public grounds in
the City of Dubuque "; and
Whereas, on October 6, 1890 an
Ordinance was adopted by the City
Council of the City of Dubuque en-
titled "An Ordinance granting to the
Chicago Burlington and Northern
Railroad Company, its successors and
assigns, the right to use and occupy
certain streets and public grounds
in the City of Dubuque, and to amend
Chapter 84 of the Revised Ordinances
of the City of Dubuque, granting
said Railroad Company certain rights
and privileges "; and
Whereas, by virtue of said Ordin-
ances rights were granted to said
Railroad Company to use and oc-
cupy certain streets and public
grounds within the City of Dubuque
for the laying of track thereon, such
rights, however, being conditioned up-
on the performance of certain duties,
obligations and things upon the part
of said Railroad Company and re-
serving to the City of Dubuque the
right and privilege to declare a for-
feiture of rights granted upon the
failure to comply with such duties,
obligations and things; and
Whereas, by virtue of subdivision
A of Section I of the first of the
aforesaid Ordinances, said Railroad
Company was given a right of way
over a strip of ground twenty -eight
feet wide commencing at a point at
the alley next South of 6th Street
Extention adjoining and immediate-
ly East of the rights of way granted
to the Dubuque and North Western
Railroad Company, on the 8th day
of June, 1885, and extending thence
Southerly adjoining and parallel with
the right of way of said Dubuque and
North Western Railroad Company to
and across Third Street; and
Whereas, by virtue of Section I of
the second of the aforesaid Ordin-
ances said Railroad Company was
given a right of way over a strip of
land fourteen (14) feet in width ad-
jacent to, and on the Easterly side
of the right of way granted to the
Chicago Burlington and Northern
Railroad Company by the original Or-
dinance aforesaid, and extending
North Westerly to the center of the
alley between Fifth and Sixth
Streets; and
Whereas, said rights of way con-
veyed by said Ordinances were grant-
ed in order to afford said Railroad
Company the opportunity to con-
struct, operate and maintain Rail-
road Tracks thereon for the running
of locomotives, cars and trains for
the use and purposes of said Rail-
road; and
Whereas, such rights and privileg-
es were subject, however, to the
express provision that said Railroad
was required to construct and lay
its tracks upon the streets and public
grounds upon which rights of way
were thus granted within three (3)
years after the completion and open-
ing for business of the line of Rail-
road in the City of Dubuque, and
there was expressly reserved to the
City of Dubuque the right and op-
tion to declare a forfeiture of all
rights thus granted in case said Rail-
road Company failed to lay its tracks
within said time; and
Whereas, said Railroad Company
has never used, taken possession of,
occupied or laid its tracks upon, over
or across that portion of the rights
of way granted to it by the afore-
said Ordinances lying North of 4th
- Street and between Fourth Street
Northerly to the alley located be-
tween 5th and 6th Streets:
Be it therefor, resolved by the
City Council of the City of Dubuque
that because said Railroad Company
has failed to lay its tracks upon, or
to use or occupy that portion of the
rights of way above described lying
between 5th and 6th streets, the op-
tion reserved to the City Council
of the City of Dubuque, to declare
all rights to the use and occupancy
of said rights of way forfeited be
and the same is hereby exercised,
and from and after the date of the
adoption of this Resolution all rights
to the use for railroad purposes by
said Railroad Company of so much
of said rights of way which have
not heretofore been used by said
Railroad Company for railroad pur-
poses and upon which tracks have
not been laid and lying between
Fourth Street Northerly to the alley
between Fifth and Sixth Streets be
and the same are hereby vacated,
forfeited and annulled and lost to
said Railroad Company for Railroad
purposes.
Be it further resolved that from
and after the date of the adoption
of this Resolution said lands shall
be repossessed by the City of Du-
buque, free from any rights upon
the part of said Railroad Company
Special Session,
to occupy or use the same for Rail-
road purposes.
Be it further resolved that the
City Clerk be and he is hereby in-
structed to serve a copy of this Res-
olution upon the local representative
of said Railroad Company and report
the fact of such service to the City
Council at its next meeting.

Our report up to the first of March shows that we have spent so far this
year on municipal improvements, the sum of $277,922.89. About $96,000 of this
was supplied from bond issues made this year and the money from bond issues
carried forward from last year. The appropriation in our budget last year for
municipal improvements was $35,350. Deducting this amount and the amount
of the bond issues we have expenditures in excess of our receipts of $146,042.92.
The Auditor also reports an overdraft of $86,246.38. This overdraft is occasioned,
as you will note, on account of the carrying of some improvements from the
sale certificates and subsequent taxes. These tax sale certificates (hould be
largely realized during the next twelve months.

City Council,
Dubuque, Iowa.
Gentlemen: In accordance with
your instructions bids were received
on Tuesday, March 18th, at 2:00 P.
M., for the $125,000 4r/ Water
Works Bonds, maturing as follows:
$20,000 April 1st, 1937, $10,000 April
1st, each year from 1938 to 1943 and
$45,000 April 1st, 1944. The follow-
ing sealed bid was received:
Old Colony Trust Co., Boston,
Mass., $98.81.
The White - Phillips Co., Bechtel &
Co., and Ringheim, Wheelock & Co.
were prepared to submit oral bids.
They all stated that they were un-
able to pay par and accrued interest
for immediate delivery.
Bechtel & Co. of Davenport, Iowa.
made the following proposition. They
would take up bonds at par on the
following basis. The entire amount
would be on interest until May 15th,
when $25,000 would be paid, $20,000
to be paid on the 15th day of each
month to and including October 15th,
when the whole $125,000 would be
paid; 2% to be paid on all deferred
payments and in addition they would
pay a premium of $395.00 for the
bonds.
I would recommend that this pro-
position be accepted and the bonds
sold to Bechtel & Co., as I believe
this is the best proposal that can be
secured at the present time in con-
nection with the disposal of these
bonds.

A Resolution.
A Resolution Authorizing the Exec-
ution of a Contract for the Sale of
$125,000.00 of four and one -half per-
cent Waterworks Bonds of the City
of Dubuque to Bechtel & Co., of
Davenport, Iowa.
Whereas, appropriate proceedings
were instituted by the City Council
of Dubuque, Iowa, for the issue and
sale of four and one -half percent
Water Works Bonds to the amount
of $125;000.00 and the notice of the
time when bids would be received for
the sale of such bonds as duly pub-
lished in the Telegraph - Herald, one
of the official county newspapers of
the City of Dubuque, Dubuque Coun-
ty, Iowa, and also in the Des Moines
Register- Leader, a newspaper of gen-
eral circulation throughout the State
of Iowa, for two consecutive weeks,
all as is provided by law, and
Whereas, pursuant to such notice.
bids were received by the City Man-
ager of said City on March 18th,
1924, at his office in the City Hall,
at which time the same were opened,
compared and examined, and
Whereas, such bids were submitted
to the City Council of the City of
Dubuque, at a meeting called for that
purpose on March 18th, 1924, and
said City Council finds that Bechtel
& Co. of Davenport, Iowa, submitted
the highest bid for said bonds, said
bid being par and accrued interest
together with a premium of $395.00,
and it is deemed advisable that a
`contract be awarded to said company
for said bonds; now therefore
Be it resolved by the City Council
of the City of Dubuque, in legal ses-
sion assembled, that a contract for
the sale of $125,000.00 of four and
one -half per cent Water Works
Bonds of the City of Dubuque be
awarded to said Bechtel & Co. of
Davenport, Iowa, and that said con-
tract be executed by the Mayor in
behalf of the City of Dubuque upon
final passage of this resolution, and
approval of the contract, a copy of
which is hereto attached and made a
part hereof.
This resolution being deemed urg-
ent and for the preservation of the
health, comfort and convenience of
the citizens of Dubuque shall be in
force and effect from and after its
final passage and adoption by the
City Council of the City of Dubuque.

Whereas, the City Council of the
City of Dubuque has, pursuant to
call, met in special session on this
22nd day of Match, 1924, for the pur-

number of qualified electors neces-
sary in order to qualify as candidates

Gentlemen: At a meeting of the
Council held on March 10th, the pet-
ition of Elizabeth Pier remonstrat-
ing against the assessment for sewer,
water and gas connctions as levied
against her property at the corner
of Cleveland avenue and Union
street, was referred to the City Man-
ager for investigation and report.
This property has a frontage of
116.1 feet on Cleveland avenue and
is 160 feet deep on Union street. The
assessment as levied for sewer and
water was $83.73. Miss Pier states
that there should have been no con-
nection made to this lot as they could
have been made at any time from
Union street. This is probably true
so far as the gas and water connec-
tions are concerned but there is no
sewer in Union street. The assess -
as levied is well within the one- quart-
er of the value of the property. I
would therefore recommend that the
petition be received and filed.

Co. who are about to erect a gasoline
station at the southeast corner of
Central avenue and 21st street. Ask-

struct outside or canopy post at edge
of lot line, which will necessitate
over - hanging of eaves on canopy roof
for a distance of two feet, this will
be 12 feet above the sidewalk level,
agreeing to prevent any possible dif-
ficulty through the overflow of wat-
er from this roof to the edge of the
sidewalk below through suitable gut-
tering and draining.

City Manager Carr reported that
he had appointed R. G. Humphrey
of Davenport as local Building In-
spector.
The original budget draft appro-
priated 2,750 as salary for the build -
building inspector. The salary of this
official was increased to $3,600 in the
budget adopted. The total appropri-
ation for this office, however, re-
mains at the same figure, namely,
$5,350. The Council eliminated the
appropriation for an automobile for
the inspector so as to meet the sal-
ary increase an dkeep the office ap-
-.propriation at the same figure.
Under the agreement with R. G.
Humphrew, Davenport man named
to this post, he will use his own
automobile in his work. The in-
spector will be paid mileage.
A Resolution.
A resolution authorizing the exe-
cution of a contract for the sale of
$125,000.00 of four and one -half per
cent Water Works Bonds of the City
of Dubuque to the Bechtel & Co,
of Davenport, Iowa.
Whereas appropriate proceedings
were instituted by the City Council
of Dubuque, Iowa, for the sale of
four and one -half per cent Water
Works Bonds to the amount of $125, -
l00.00 and the notice of the time
when bids would be received for
the sale of such bonds as duly pub-
lished in the Telegraph - Herald one
of the official County Newspapers
of the Cit yof Dubuque, Dubuque
County, Iowa, and also in the Des
Moines Register Leader a newspaper
of general circulation throughout the
State of Iowa, for two consecutive
weeks, all as is provided by law, and
Whereas, pursuant to such notice,
bids were received by the City Man-
ager of said City on March 18th,
1924, at his office in the City Hall,
at which time the same were opened,
compared and examined, and
Whereas such bids were submitted
to the City Council of the City of
Dubuque, at a meeting called for
that purpose on March 18th, 1924,
and said City Council finds that
Bechtel and Company of Davenport,
Iowa, submitted the highest hid for
said bonds, said bid being par and
accrued interest together with a pre-
mium of $395.00 and it is deemed
advisable that a contract be award-
ed to said Company for said bonds;
now therefore
Be it resolved by the City Coun-
cil of the City of Dubuque, in legal
session assembled, that a contract
for the sale of $125,000 of four and
one -half percent Water Bonds of the
City of Dubuque be awarded to said
Bechtel and Company, Davenport,
Iowa, and that said contract be exe-
cuted by the Mayor in behalf of the
City of Dubuque upon final passage
of this resolution, and approval of
the contract a copy of which is here-
to attached and made a part hereof.
This resolution, being deemed ur-
gent and for the preservation of the
health, comfort and convenience of
the citizens of Dubuque shall be in
force and effect from and after its
final passage and adoption by the
City Council of the City of Dubuque.
