City Engineer Gus Psihoyos recommends City Council acceptance of a dedication of
sanitary easement from Jesse E. Kemp and Jessica P. Kemp for an E1 sewer pump
station across property at 3400 Nightengale Lane.
The City of Dubuque will own and maintain the pump station and appurtenances per a
sewer service agreement with the Kemps. The agreement requires that owners dedicate
a new utility easement over the pump station area, which they have done by a recorded
Plat of Survey.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to seek acceptance of a dedication of sanitary
easement from Jesse E. Kemp and Jessica P. Kemp for an E1 sewer pump station
across Part of Lot 1 of Julian's Hill, in the City of Dubuque, lowa.
DISCUSSION
Recently the Kemps requested public sanitary sewer service for a new home they are
constructing on the property at 3400 Nightengale Lane. In December of last year, the
City extended a sanitary sewer force main from Cedar Cross Road along Nightengale
lane to serve properties in this area. The City has installed an E1 pump station with
appurtenances on the property to serve the new home. The City of Dubuque will own
and maintain the pump station and appurtenances per a sewer service agreement with
the Kemps. The agreement requires that owner dedicates a new utility easement over
the pumps station area.
The attached recorded Plat of Survey shows the new sanitary easement across Part of
Lot 1 of Julian's Hill, in the City of Dubuque, lowa. By said plat the owners have
dedicated the sanitary easement to the City of Dubuque.
RECOMMENDATION
I recommend accepting the dedication of Sanitary Easement through, under and across
Part of Lot 1 of Julian's Hill, in the City of Dubuque, lowa, as shown on page 1 of the
attached Plat of Survey.
ACTION TO BE TAKEN
I respectfully request acceptance of the dedication of Sanitary Easement from Jesse E.
Kemp and Jessica P. Kemp through the adoption of the enclosed resolution.

ACCEPTING THE DEDICATION OF SANITARY EASEMENT THROUGH,
UNDER AND ACROSS PART OF LOT 1 OF JULIAN'S HILL, IN THE CITY OF
DUIBUQUE, IOWA
Whereas, Jesse E. Kemp and Jessica P. Kemp have dedicated to the City of
Dubuque, by the Plat of Survey of Julian's Hill recorded as Instrument Number 2021-
00001758 in the Dubuque County Recorder's office, a Sanitary Easement through, over
and across Part of Lot 1 of Julian's Hill, in the City of Dubuque, Iowa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the dedication of Sanitary Easement for sanitary sewer utilities
through, over and across Part of Lot 1 of Julian's Hill, in the City of Dubuque, Iowa from
Jesse E. Kemp and Jessica P. Kemp, a copy of which is attached hereto.
Section 2. The Mayor is hereby authorized and directed to execute and
acknowledge on behalf of the City of Dubuque any instruments in connection herewith.
