The application, staff report and related materials are attached for your review. Discussion The applicant, Kevin Oberbroeckling, spoke in favor of the request. He stated that he is working to accommodate the changing needs of his tenants, one of whom is seeking a single chair for a hair salon. He said that he felt this change will complement the area, and that he will keep the facility well-maintained. Bill Smith, 5604 Saratoga Road, spoke on behalf of his wife, who he said owns Happy Hair Studio. He noted that as the current CS designation allows for pet grooming, the C- 3 district's allowance of human grooming should be reasonable. He described challenges due to the pandemic leading his wife to leave a larger salon. Staff reviewed the staff report noting that neighbors within 200' of the subject property were notified and that two letters of support were received. Staff reviewed the zoning and development history of the area along with current land uses and activities. Staff explained the parking requirements for a barber/beauty salon. Staff noted that, if rezoned to C-3 General Commercial, none of the existing uses on the property would become non-conforming. The Zoning Advisory Commission discussed the request finding it appropriate. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. Property History: The subject property was previously used for agricultural purposes prior to its platting and grading for a commercial subdivision in 2002. The property has more recently been used as a contactor shop, home furnishing sales and mini warehousing. A portion of the surrounding property was rezoned from CS to R-4 Multiple-Family Residential circa 2009. Physical Characteristics: The property is an approximately 1-acre interior lot located one parcel from the intersection of Commerce Park and Seippel Road. The subject property is served by Commerce Park, a public street that runs east to west and ends in a cul-de-sac. Commerce Park provides access to contractor shops/yards, residential apartments and East Central Intergovernmental Association Office Building and Regional Transit Authority Bus Storage Facility. The subject site itself is nearly fully developed and accommodates three large structures. The building and building additions on the lot consume about 14,000 square feet of area or approximately 32% of the property. The balance of the lot is landscaped, or paved area used mostly for parking. Concurrence with Comprehensive Plan: The City's 2030 Future Land Use Map shows the property as commercial. The Comprehensive Plan goals encourage mixed- use commercial and residential development. The goals also recommend buffering non-compatible uses from each other. It is also noted that the `commercial use' category is defined as supporting a variety of businesses that provide residents with desired goods and services while creating jobs and a stronger tax base. Impact of Request on: Utilities: The property is nearly fully developed, and the rezoning will have little impact on existing utilities or service. Traffic Patterns/Counts: The proposed rezoning should have little impact on the overall traffic patterns or traffic counts on Seippel Road or Commerce Park. Public Services: Existing public services are adequate to serve the site. As with most commercial properties, trash disposal may require the services of a private hauler. Environment: Staff does not anticipate any adverse impact to the environment given that the site is nearly fully developed. Adjacent Properties: The subject property is nearly fully developed and is currently zoned as Commercial Service and Wholesale. Rezoning of the subject parcel should have little impact on the surrounding properties. Additionally, the list of uses in the C-3 district includes some that are not likely at this location due to lot size limitations and the cost to redevelop an already fully-developed property. There appears to be adequate on-site parking for the current proposed uses. In the event that additional or different uses are proposed, on-site parking would have to meet standards existing at that time. CIP Investments: None proposed. Staff Analysis: The applicants propose to rezone an approximately 1-acre parcel at 7869 Commerce Park from CS Commercial Service and Wholesale to C-3 General Commercial zoning district to facilitate a 1-chair barber/beauty salon. The surrounding neighborhood is mixed-use with commercial, office, light industrial and single and multi- family uses. The C-3 district permits a mix of 52 uses (attached). Residential use is permitted above the first floor only. C-3 uses have the potential for an increase of noise, activity, and hours of operation compared to the listed CS uses. However, a number of those listed uses are not likely be located at this property due to lot size limitations and the cost to redevelop an already fully-developed property. Rezoning of the subject parcel should have little impact on the surrounding properties. The property is nearly fully developed, and the rezoning should have little impact on existing utilities or service and should have little impact on the overall traffic patterns or traffic counts on Seippel Road or Commerce Park. Factors such as the specific mix of uses and the hours of operation can affect the demand on parking. As within any commercial development, those patrons looking for parking will generally utilize the closest and most convenient spaces whether on- or off-street.
