INTRODUCTION
The enclosed resolutions authorize the public bidding procedure for the 2021 John F.
Kennedy Road Sidewalk Installation Project between Asbury Road and the NW Arterial.
BACKGROUND
Since 1999 there have been discussions in the community concerning sidewalks along
John F. Kennedy Road between Asbury Road and the NW Arterial. Numerous petitions
were received both for and against the installation of sidewalks. At the July 2, 2018, City
Council meeting, the city council voted 5-2 to proceed with the installation of sidewalks with
City staff directed to proceed with the development of a sidewalk installation project and
use special assessments to fund the project. In October 2018, the project failed to get the
required unanimous support from the City Council, failing on a 5-2 vote.
At their May 17, 2021, meeting the City Council unanimously agreed City staff provide the
council with an updated John F. Kennedy Road sidewalk project. This is the fourth time
the John F. Kennedy sidewalk installation issue has been presented to the City Council for
consideration. The other times that the City Council considered JFK sidewalks was July of
1999, December of 2007, and October of 2018.
DISCUSSION
The John F. Kennedy Road Sidewalk Installation Project would provide installation of 4-
foot-wide sidewalks along John F. Kennedy Road on both sides of the street from Asbury
Road to the NW Arterial adjacent to abutting properties that do not currently have sidewalks
and would include the following elements:
— Excavation to allow for the installation of the sidewalk
— Installation of base stone for the sidewalk
— Installation of 4" thick public sidewalk in most areas
— Installation of 6" thick sidewalk at driveway crossings
— Installation of private retaining walls where needed due to topography to
accommodate the sidewalk.
— Restoration of disturbed area with topsoil and seed.
This project will have special assessments and the project construction documents will
follow the Statewide Urban Design and Specifications (SUDAS).
The estimate for the assessments includes the sidewalk costs, engineering costs,
contingency, mobilization, and traffic control. These costs are estimated as follows:

Additionally, the City will have estimated cost of $54,611.00 for the ADA ramps and City
owned sections of sidewalk in various locations in the corridor. Those costs are shown in
the table above.
The sidewalk ordinance has been revised over the years and requires that sidewalks be
installed when development of a subdivision or as part of a site plan. The new policy states
assessments over$500, may be paid in fifteen (15)annual installments. Sidewalks are also
required when the footprint of a building or dwelling has changed when curb and gutter are
present. The City manager has the right to waive this requirement on a case-by-case basis.

RETAINING WALLS
The project will require the installation of short retaining walls at seven (7) locations on the
project. The construction cost for the retaining walls is estimated to be $69,840.00 for 1164
square feet of wall including construction, engineering, and contingency.
In 1973, there was a City-wide specific sidewalk program much like this one being
proposed. It required sidewalks and many retaining walls where no sidewalks existed. The
property owners were assessed for the sidewalks and the walls in front of their property.
Related to this John F. Kennedy location, in 2018, City staff recommended that all the
property owner's share in 100% of the cost of the retaining walls necessary for the project.
The City Attorney office recently determined there are two ways to look at the benefits of
the retaining wall installation. One, the sidewalk installation project, including retaining
walls, benefits the entire assessment area and the costs of the retaining walls should be
shared by all in the assessment area. Two, the retaining walls confer a special benefit only

to the abutting property owners and they are specifically assessed for the retaining wall
construction.
There have been exceptions for the installation of retaining walls where the City paid for a
portion of the retaining wall cost as part of an overall street reconstruction project. These
were not stand-alone sidewalk projects but were part of a total street reconstruction project.
Some areas that come to mind are Kelley Lane, JFK Road between Pennsylvania and
Asbury, Clarke Drive, Rosedale, North Grandview, Bonson Road, and Fremont Avenue. In
these cases, all property owners shared for a small portion of the overall wall costs as part
of their street assessment.
SCHEDULE
In 2005 the City administered an assessment sidewalk project on Asbury Road between
JFK Road and the NW Arterial. In this instance the property owners got together and
installed over 90% of the sidewalks before the City's contractor had an opportunity to install
their sidewalks. By installing the sidewalks on their own, the property owners saved all the
assessment costs of a City let project including the cost of engineering, similar to the
previous example provided. By installing the sidewalks with their own private contractor,
we are estimating a property owner could save at least 25% on the cost of their sidewalk
installation over a City assessment project.
After the 2018 John F. Kennedy Road project was not passed by the City council, nine (9)
property owners decided to install their sidewalk by a private contractor. Additionally, the
City installed a section of sidewalk near the NW Arterial. Since 2019, 10 out of the 48
property owners or 21% have already installed sidewalks on their own.
Therefore, we are recommending that the John F. Kennedy Road project be bid in July and
awarded in August, so the contractor could still start or complete the installation of the
sidewalks this construction season. The property owners would have until September 17,
2021, to construct their sidewalks on their own, if the property owner does not do the
installation themselves, the City contractor could begin the sidewalk work September 18,
2021.
MAINTENANCE OF SIDEWALKS
In 2018, the motion included, that the property owners on Gordon Drive that have a
sidewalk on John F. Kennedy Road would not have to maintain their sidewalks for snow
and ice removal. City staff does not recommend this since no other private sidewalks are
maintained by the City. Many private sidewalks abut more than one street, and the City
does not maintain those sidewalks. Some areas, much like Gordon Drive that illustrate this
are Glenwood Court, Cora Drive, Amy Court, Kimberly Drive, Council Hill Drive, Arrowhead
Lane, LaVista Court, Wartburg Place, Pego Court, Autumn Ridge, Aspen Drive, Aspen
Court and Clarke Drive.

RECOMMENDATION
I recommend that the City Council give preliminary approval to the construction plans and
specifications and approve the Resolution of Necessity, approve the Preliminary Schedule
of Assessments, establish June 21, 2021, as the date of the public hearing, and hereby
authorize the City Clerk to advertise for bid proposals for the John F. Kennedy Road
Sidewalk Installation Project. The property owners would have until September 17, 2021,
to have their sidewalks installed by their own private contractor.

PROPERTY ASSESSMENTS
The estimated assessment, including contingency and engineering for a 100-foot lot would
be $4,700 or $47 per lineal foot.

If property owners elect to install sidewalks prior to the assessment project, property owners
would not incur costs for any of the mobilization, traffic control, engineering and inspection
costs the assessment project would incur. If the property owner elected to do the sidewalk
installation on their own for a 100-foot lot would be $3,600 or $36 per lineal foot. This could
result in a savings of approximately $1,100 or $11 per lineal foot.
If the property owners choose to have the City install their sidewalk for them with this
assessment project, they would have 15 years to pay for the improvement at 3% interest
on their property tax bill. For every $1,000 of assessment the property owner could expect
to pay approximately $83.77 a year or $7/month for principal and interest cost for their
sidewalk.
According to State Code Section 384.62, the assessment shall not exceed twenty-five
percent of the value of the lot as shown by the plat and schedule approved by the council.
There is no assessment for this project that meets these criteria.
Low- to moderate-income property owners subject to street assessment will be eligible for
financial assistance of the street assessment for the owner-occupied resident property
depending on family size and income level. This financial assistance program is made
available through the Community Development Block Grant Funds. City staff will review
and process financial assistance applications for owner occupied properties once final
costs are developed for the project. See attachment B.
OPPOSITION TO ASSESSMENTS
Based on lowa Code 384.51, if there is opposition to special assessments on the project,
approval of the resolution of necessity will require the city council vote be super majority or
unanimous based on the percentage of opposition. The City council vote is required to be
75% in favor of the resolution of necessity if the opposition to the project is less than 75%
of the proposed assessment. If more than 75% of the proposed assessment is opposed to
the project, the council vote must be unanimous to approve the resolution of necessity.
In 2018, over 90% were opposed to the project assessment. The City Council will be
required to approve the resolution of necessity on a 7-0 vote to proceed with levying the
special assessments.
REQUESTED ACTION
The City Council is requested to give preliminary approval to the Resolution of Necessity,
approve the Preliminary Schedule of Assessments, establish the date of the public hearing,
and authorize the City Engineer to advertise for bid proposals through the adoption of the
enclosed resolutions for the John F. Kennedy Road Sidewalk Installation Project.

SIDEWALK REQUIREMENTS
Title 16 Unified Development Code, Chapter 11, Section 16: Sidewalks
A. Sidewalks shall be required on all public street frontages and constructed of
concrete or permeable pavement in accordance with the city and ADA standards.
B. Sidewalks shall be placed five feet (5') behind the curb parallel to the street,
unless an exception has been permitted by the city engineer to preserve
topographical or natural features or to provide visual interest, or unless the
subdivider shows that an alternative pedestrian system provides safe and
convenient circulation.
C. In planned developments, sidewalks may be located away from the road system
to link dwelling units with other dwelling units, the street and on site activity
centers such as parking areas and recreational areas. They may also be required
parallel to the street for safety and other reasons.
D. Sidewalk installation shall be the responsibility of the owner of property abutting
the public right-of-way. This responsibility shall extend to all successors, heirs
and assignees. Sidewalk installation shall be required when the development of a
lot has been completed. All vacant lots shall have sidewalks installed upon
development of eighty percent (80%) of the lots shown on the approved final plat.

Title 10 Public Ways and Property, Chapter 1, Section 2: Sidewalk Installation and
Repair
A. Installation:
1. The owner of any lot or parcel in the city, that abuts upon any improved public
street that has concrete or stone curb shall, at the owner's cost, install to standard
city specifications a sidewalk along the full length of the portion of the lot or parcel
abutting the public street when said lot or parcel is developed or redeveloped or at
the direction of city council. For purposes of this subsection, "development or
redevelopment" means any improvement that creates a new parking lot, new
principal structure, garage, carport, covered deck, or covered patio on the lot or
parcel or changes the footprint of the parking lot, principal structure, garage,
carport, covered deck, or covered patio on the lot or parcel.
2. Upon application and for good cause shown, the city manager may grant a full or
partial exception to the above requirement. (Ord. 44-09, 9-8-2009)
B. Duty Of Abutting Property Owner To Maintain: The abutting property owner must
maintain the area from the back of the curb to the right of way line and must keep such
area in a safe condition free from defects, debris, nuisances, obstructions or any other
hazard. The abutting property owner is liable for damages caused by failure to maintain
such area. The abutting property owner must maintain such area in a safe condition, in a
state of good repair, and free from defects. The abutting property owner is liable for
damages caused by failure to maintain such area. Notwithstanding the obligations
imposed hereunder, the property owner may not remove diseased trees or dead wood or
plant, trim, remove or treat any tree or plant material on public right of way without first
obtaining a permit from the city forester. (Ord. 57-14, 9-2-2014)
C. Notice To Replace, Repair Or Reconstruct:
1. Whenever the city manager shall determine that the conditions of any sidewalk as
described in subsection B of this section exist, the city manager shall serve notice
by certified mail on the abutting property owner, as shown by the records of the
county auditor, requiring the abutting property owner to replace, repair or
reconstruct the sidewalk.
2. If the city manager determines that the replacement, repair or reconstruction of the
sidewalk is not practicable because of circumstances beyond the control of the
abutting property owner, the city manager may allow or require a temporary repair
of the sidewalk until such circumstances no longer exist. (2007 Code § 41-102)
D. Collection Of Costs Of Replacement, Reconstruction Or Temporary Repair By City:
If the abutting property owner who has been notified pursuant to subsection C of this
section to repair, replace, reconstruct, or temporarily repair the sidewalk shall fail to repair,
replace, reconstruct, or temporarily repair such sidewalk within thirty (30) days after the
mailing of such notice, the city manager may cause the required action to be perFormed
and assess the costs against the abutting property for collection in the same manner as
a property tax. (2007 Code § 41-103)
E. Installments: If any amount assessed against property under subsection D of this
section exceeds one hundred dollars ($100.00), the assessment may be paid in ten (10)
annual installments, in the same manner and with the same interest rates as provided for
assessments against benefited property under the code of lowa. (2007 Code § 41-104)
F. Procedures For Levy: The procedures for making and levying a special assessment
pursuant to subsection D of this section and for an appeal of the assessment are the
same procedures as provided under the code of lowa. (2007 Code § 41-105)
G. Sidewalk Inspection Policy: The city manager shall develop, with the approval of
the city council, a written sidewalk inspection policy which shall govern the repair,
replacement, reconstruction or temporary repair of sidewalks.

CONTRACT, AND ESTIMATED COST; SETTING DATE OF PUBLIC HEARING

COST; AND ORDERING THE ADVERTISEMENT FOR BIDS
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE

The proposed plans, specifications, form of contract and estimated cost
for the John F. Kennedy Road Sidewalk Installation Project 2021 in the estimated
amount $266,198.00, are hereby preliminarily approved and ordered filed in the
office of the City Clerk for public inspection.
A public hearing will be held on the 6th day of July, 2021, at 6:30 p.m. in the
Historic Federal Building Council Chambers (and/or by virtual means) 350 W. 6tn
Street, Dubuque, Iowa, at which time interested persons may appear and be heard
for or against the proposed plans and specifications, form of contract and
estimated cost of said Project, and the City Clerk be and is hereby directed to
cause the attached notice of the time and place of such hearing to be published in
a newspaper having general circulation in the City of Dubuque, Iowa, which notice

date of such hearing. At the hearing, any interested person may appear and file

There is on file in the office of the City Clerk an estimated total cost of the work,
and a preliminary plat and schedule showing the amount proposed to be assessed to
each lot for the improvement.
The date, time, and place the council will hear property owners subject to the
assessment and interested parties for or against the improvement, its cost, the
assessment, or the boundaries of the district:
That the City Council deems it advisable and necessary for the public welfare to
make the herein mentioned improvements.
Unless a property owner files objections with the City Clerk at the time of hearing
on the resolution of necessity, the property owner is deemed to have waived all objections
pertaining to the regularity of the proceeding and the legality of using the special
assessment procedure.
Said improvements shall be constructed in accordance with the plans and
specifications which have been approved by the City Council and are now on file in the
Office of the City Clerk. The cost of making such improvement will be assessed against
property lying with the assessment limits.

Whereas, the City Council of the City of Dubuque, Iowa, has given its preliminary
approval to the plat, preliminary schedule of assessments, and estimated total cost for
the John F. Kennedy Road Sidewalk Installation Project 2021 and ordered the plat,
schedule of assessments, and estimate of total cost placed on file in the Office of the City
Clerk; and
Whereas, the proposed Resolution of Necessity for Project has been introduced
and is now on file in the Office of the City Clerk.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
The City Council will meet on the 6th day of July 2021, at 6:30 p.m. in the Historic
Federal Building Council Chambers (second floor), 350 West 6th Street, Dubuque, Iowa.
At which time the owners of property subject to assessment for the proposed
improvement or any other person having an interest in the matter may appear and be
heard for or against the making of the improvement, the boundaries of the district, the
cost, the assessment against any lot, or the final adoption of a resolution of necessity.
A property owner will be deemed to have waived all objections unless at the time

Dear Honorable Mayor Roy Buol and Dubuque City Council Members:
On behalf on my husband and I, Michael and Jolene Rettenberger of 2291 Gordon Drive,
Dubuque, lowa, WE BOTH STRONGLY OPPOSE THE ISSUE OF INSTALLING
SIDEWALKS ALONG JOHN F. KENNEDY ROAD FROM ASBURY ROAD TO THE
NORTHWEST ARTERIAL (HWY 32).
As soon as I saw the article entitled, "Dubuque City Council to once again consider JFK sidewalk
projecY'on THonline on Monday, May 24th, 2021, communication began with all property owners
from Asbury Road to the Northwest Arterial, per emails, in-person conversations, typed notes
distributed, telephone calls and/or text messaging.
Needless to say, both Mike and I were shocked by this since all property owners were informed that
before the City of Dubuque unfairly targets property owners again, whose property abuts John F.
Kennedy Road, a City-wide Sidewalk Mandate Policy, as well as notifying property owners ahead
of time would be done due to cost / time involved with having the Engineering Department begin the
work with assessments and pedestrian / traffic studies.
On Monday May 24th, 2021, I called and left a voice mail message for our Council Member Laura
Roussell regarding this matter. We invited her to come and visit our neighborhood, to view the
property along our backyards and guardrail area. Member Roussell returned my call (at 6:22 pm —
left voice mail message). I called her back and she is coming to our Gordon Drive neighborhood on
Friday, May 28th at 6:30 pm.
On Friday, May 28th, 2021 at 6:30 pm, Council Member Laura Roussell stopped by our home
address at 2291 Gordon Drive. Upon the arrival of Member Roussell, I gave her copies of photos
from the backyards of Gordon Drive residents, guardrail pictures, and a 66-page typed document of
City Council Agenda and Minute notes that I have kept and saved in a storage container, as well as
comments/quotes taken from Telegraph Herald newspaper articles that I had cut out of the
newspapers since June 2nd, 1999 to the present. During this time, we introduced ourselves and
shared our concerns and issues with Member Roussell. Items addressed were:
• Who is the person / group behind this? (Back on July 5th, 2018, we heard that it was from
a local political party — Dubuque Democratic Socialist.)

• Why are we doing this again?
• How many more times will this be brought up to the City Council? This has been on-
going since 1999.
• There is NO foot traffic along the backsides of property along Gordon Drive, as well as
very few pedestrians along John F. Kennedy Road up from Kaufmann Avenue to the
Northwest Arterial — there are NO worn-out paths.
• How can sidewalks be placed behind the homes on Gordon Drive with the guardrail that
is in place and steepness along our properties? It would involve a lot of extensive work to
put sidewalks and retaining walls in this area — there's utility poles and underground utilities
that would need to be moved and re-installed. As you know, John F. Kennedy Road has been
expanded a few times and a guardrail was put in place due to the steepness in our backyard
properties. At 2291 Gordon Drive, we have a 30-degree pitch. The ends of the guardrail
cannot be safely opened up due to the "spearing" effect that a vehicle would sustain if it were
to hit the guardrail. Opening up that guardrail would only be an "accident waiting to happen"
for any vehicle to go through. As you look at the guardrail, look closely and see how many
times it's been hit— lots of dents in it. That guardrail, most of the time, has saved many
vehicles from coming over the steep embankment, BUT NOT ALWAYS. Check with the
property owners at 2291 Gordon Drive and 2343 Gordon Drive, they'll tell you what property
damage has happened over the years. The end of the guardrail closer to Kaufmann Avenue
had to be replaced due to a truck hitting it, over-turning and taking out the neighbor's backyard
fencing. This is certainly not a safe area to have a sidewalk for anyone to be on. (NOTE: If
you straighten the guardrail opening, it would be 12' 6"; it is currently at 8'.)
• There needs to be a more accurate study not only on a traffic count, but a pedestrian
count. Note that the parking lot at the corner of Gordon Drive and Kaufmann Avenue
was installed for usage of Honkamp Krueger employees to park there and safely walk
across the intersection of John F. Kennedy Road and Kaufmann Avenue to get to their
offices. Where is their crosswalk at? We now have a "flashing red' Stop sign located at
this intersection due to the amount of traffic accidents in this area.
• What is the status of the City-wide Sidewalk Mandate? This was talked about at the City
Council meeting.
• We shared with Member Roussell that eight (8) properties at the other end of John F.
Kennedy Road (near the Northwest Arterial) have installed sidewalks. Those addresses
are: 3058, 3078, 3150, 3139, 2955, 2975, 3087 and 3169. (A KCRG-TV 9 news report

• There are many, many streets in the City of Dubuque that don't have sidewalks. Some
of those sidewalks lead to the Dubuque Golf and Country Club (fireworks display), the
Bunker Hill Golf Course, the front lawn area outside the Nicholas J. Sutton Pool, the
access area to get to the bike path/walking trail along the Mississippi River off of Kerper
Boulevard (from Garfield Avenue), sidewalk along 16t" Street from Sycamore Street to
the gas stations (as well as the grassy area that leads you to the Mystique Community
Ice Center and the McAleece Recreation Complex past the bridge on the one side), the
Shiras Extension that takes you to A.Y. McDonald Park and along the Mississippi River
frontage road where many people walk, jog, push their baby strollers and ride bicycles
back/forth to the Lock and Dam area, the area outside the Dubuque Soccer Complex
along John F. Kennedy Road, West 32"d Street, Peru Road, Roosevelt Street (hit and
miss sidewalks), to name just a few. In an hour's time you could find a listing of 92
streets in Goog/e that have no sidewalks...
• We talked about Ordinance 10-1-2: SIDEWALK INSTALLATION AND REPAIR. In that
article, it is noted under#2: Upon application and for good cause shown, the city
manager may grant a full or partial exception to the above requirement. (listed in #1 of
Ordinance 10-1-2)

• Can exemptions be made? Have exemptions been given?
• Petitions that have been submitted for both OPPOSING and IN FAVOR OF sidewalks
along John F. Kennedy Road have been filed in the past and we are certain, will be filed
priorto the upcoming City Council meeting. Concerns have been voiced about the
petitions that are IN FAVOR OF, as those petitions may not be 100% accurate with
property owners' signatures and people living outside the targeted area (whether they
live in another section of Dubuque, resident in Illinois or resident in Wisconsin).
• In talking with Member Roussell, she shared with us that there are seven (7) similar
streets with high traffic volume like John F. Kennedy Road, but JFK doesn't have
walkways on both sides.
• In talking with Member Roussell, she shared with us that there are ten (10) places with
front and back walkways in Dubuque.
• What about the crosswalks at the intersection of John F. Kennedy Road and the
Northwest Arterial where you can only cross safely on two (2) sides? (The other 2 sides
you can't cross because No Walk button to push.)
• Do we know what time frame we are following as to when this will appear on the City
Council Agenda?
• Do we know when our Public Hearing will be scheduled for property owners to address
the City Council in-person?
• When will property owners receive the updated assessments showing the high costs for
sidewalks, as well as the installation of retaining walls along John F. Kennedy Road?
• It is our understanding (from correspondence received in an email thread dated July
5th, 2018, beginning with Amy Gilligan at the Telegraph Herald) that a resolution of
necessity to assess the properties for sidewalk installation requires a 6 — 1
supermajority vote. If a written protest is filed by property owners amounting to 75% of
the project value, a unanimous vote is required for a resolution of necessity to pass.
Correct?
I also want to share with all of you that back on Thursday, April 22nd, 2021 at 9:45 am, I witnessed
noise and people up on our hillside behind 2291 Gordon Drive, so I went up and spoke with two (2)
City of Dubuque workers. (Normally 1 am not at home during the workday as my City of Dubuque
office is located at the Park and Recreation office at Bunker Hill, but due to the Covid-19 pandemic, 1
have been working remotely from my home since March of 2020.) I thanked both men for cutting and
weed trimming along the public-right-of way behind all of our properties along Gordon Drive. I have
never seen them up on the hill, so I asked them both a few questions. One worker stated that this
public right-of-way is a "low priority to do". The other worker said they try to do it once a month. I
sent an email to Public Works to share with them that they were very polite and courteous and
"thanked" them for mowing / trimming. I also shared with them that we try to pick-up garbage that is
thrown unto our properties, but it's a never-ending battle. (Not only is litter a never-ending battle
along John F. Kennedy Road, but we also had a fire on the backside of our property on April 1 st,
2019, in which the City of Dubuque Fire Department was called to the scene to extinguish. The
firefighters had a hard time battling the fire on the hillside due to the steepness of the property that
abuts to John F. Kennedy Road near the Asbury Road intersection.)
In closing, both Mike and Jolene Rettenberger, as well as our neighbors, invite
you to come and visit us along Gordon Drive. You are most welcome to come

and walk along the backside of our properties to see for yourself the difficult
task it would be to maintain a sidewalk in our backyards along Gordon Drive,
especially in the winter months of snow removal, in which the City of Dubuque
does a wonderful job.
How would we ever be able to maintain the clearing of snowy and icy walkways
along the John F. Kennedy Road corridor in the winter months after snowplows
go up /down John F. Kennedy Road numerous times? It would be
impossible...and another huge liability to property owners.
