DATE: June 4, 2021 The December 16, 2019 Development Agreement by and among the City of Dubuque, Roshek Property, LLC, Cottingham & Butler, Inc. and Heartland Financial USA, Inc. requires the City to "complete and open for parking by December 31, 2023" a Parking Structure of no less than five hundred (500) parking spaces within a certain area of downtown in the City of Dubuque. The Development Agreement requires that the real estate for the site of the Parking Structure must be acquired by December 31, 2021. In addition, the 2019 Development Agreement by and among the City of Dubuque, lowa, Dupaco Voices, LLC, and Dupaco Community Credit Union requires City to initiate and, work with the parties to that Development Agreement and other stakeholders in the Historic Millwork District, revise and update the Historic Millwork District Master Plan to address transportation and parking needs and uses within the District. The revised Plan includes the following: City shall, on or before December 31, 2019, develop and maintain an off-street parking inventory and long-term parking master plan for the Historic Millwork District which shall include: (i) Each year on or before December 31, beginning in the year 2020, City shall provide a detailed block by block breakdown of the available off- street parking within 2,500 feet of the Voices Building and identify any parking shortfalls or surplus and provide a narrative of such breakdown to Employer. (ii) The annual parking inventory and master plan shall provide a strategy to accommodate the demand created by commercial and residential development that are under development within the Historic Millwork District. The plan shall provide the location of, or for the development of, additional parking to meet that demand. (iii) At such time as 85% of the existing off-street parking is leased/permitted City shall, within twenty-tour(24) months of the date of the annual review, develop additional off-street parking facilities within 2,500 feet to meet the projected demand. After an investigation by City staff of potential sites for the Parking Structure that meet the requirements of those Development Agreements, the Hendricks Feed & Seed Co., Inc. property at 880-890 Central Avenue was selected. While the city will be acquiring the entire site owned by Hendricks the city does not need the entire area where the historic structures are located on the west side of the site along Central Avenue and after the project the city would intend to sell those buildings. The city does need additional space and easements to build a more efficient parking ramp and will be in discussions with the two other property owners on this block. The City and Hendricks Feed & Seed Co., Inc. have negotiated the attached Offer to Buy Real Estate and Acceptance, subject to City Council approval. The Offer to Buy Real Estate and Acceptance includes the following terms: • $1,699,000 purchase price • Closing following environmental investigation satisfactory to the City • Hendricks Feed & Seed Co. A�er considering these aspects, city staff established 1,QOQ feet as a criterion for evaluating the area that will be served b}� the new parking r�r�rtip site_ �nce the t�eenchmarking criteria was established, it was used to ev3luate the l�est site� for a new parking rainp. Then a ranking matrix �+as created to determine which locations were the inost vial�le. The top four ranked locations in order were the following: 1. �th and �entral Avenue (Hendricks Feed} �. 7th and lowa�treet (��uth of DLE� building} �. 11th and �entral A�+enue {Pfiohl �urtace Lot) 4. �th and lowa�treet (�outh of NI��) After t�e top o locati�ns were identified !�y ciiy staff, Desman was asked to provide concept plans to evaluate how m�n}+ parking spaces per parking level could be acoominodated at each loc�ti�n. The next phase of site selection stud�+for the top locations then involved e+raluating historic preservation impacts, constructability of each parking structure, and cost of construction. Historic Preservation: Each of the top four parking structure loc�tions fall within a doa+mtown conservation district. The Planning �ervices Departi�nent evaluated how a new parking structure at each of the four locations ma�r potentially impact existing historic structures on the developmer�t site itself or arry adjacent hist�nc structures_ ��n�tructability: Locations ranked 1, �, and 3 listed alaove all have reasonable access regarding c�nstructal�ility and general site development. The concept fnr 4`" ranked locati�n would require partial demolition of the existing I�wa �tre�et Ramp. It would also require relocation of sever�l large Alliant Energy transfnnrMers�nd sen+ice feeds to adjacent buildings which w�auld add measurable cost t�the project_ Lastly there is an alle}+ that sen+ices deliveries to the back of buildings located on the east side �f h+lain �treet_ In orderto keep the alley in service, the intemal �+ehicle circulation �attem inside the new parking structure would be negatively impacted_ �onstruction �ost: An estimated construction cost for each of the top sites was deueloped in earl�r�0�0_ The c�st of the top four sites ranged from�16,70Q,Q00 to �19,8��,QOQ. The oast variability of a parking structure priirraril�r depends�n several key factors including site acquisition oosts, existin� building deconstruction costs, utility c�nnection and relocation costs, and deeorative building fa�ade features_ The oost of c�nstructing a standard parking floor ba}r unit is relativel�+ consistent beiween sites in the Dubuque d�rntown are�_ ��nsidenr�g all of the above �n estiinated cost of 5��,000 p�r parking space w+r�s utili�ed to develop the initial cost estimates. �#s a m�re detailed design is developed for a specific sit�, the cost per parking space oould end up costing between ��8,000 to�35,000 per space_ A final site selection evaluati�n criteria was the parking requirements detail�d in tw+rr� deuelopment agreements that the �ity executed with R�shek Property LL� (�ottingham 8� Bukler and Heartland Financial}and Dupaco�oices LL�. In Deeember�0�1� the �ity of Dubuque 8� F��shek Properhr LL� signed a development agreement which contained pro+risions that a new+r ramp be constructed within an area approxiinately no inore than 1,OQ0' from the Roshek Building_ A�econd Amendment to Development Agreement signed in December�Q�O �Iso contained sehedule pro�+ision�for the new parking structure pmject that included it be completed and opened !�y �eoember�1, 202�. In January 201�the �iiy�f Dubuque and Dup�c�1�oices LL� signed a dev�lopment agreement which oont�ined provisions that at such time when 85�'a of available o� street parking within �,500' of the�oices Buildir�g is utilized, the �ity shall within �4 inonths of the annual p�rkin� utiliz�tion rep�rt devel�p additional off street parking facilities with �,500' �f the ��ices Building to rrreet the demand. DI��I.IS�I�N Af[er several iterations of site review t3nd evaluatian, city staif have identified the block n�rth �f 8'h �treet between �entral Avenue and White �treet as the#1 r�nked location fnr a new parking structure. A new parking structure at this location would run n�rth to south across the eastem half of the block {see �tkachments�_ The structure as proposed would have a capaciiV for��1 vehicles on fi parking levels with a maximui�n roof height of 7�feet. The following is a list of reasons why city staff is recommending this loca.tion and p�rking structure configuration: • This site meets the stated goal of constructing at least 50Q new parking spaces for one of the lowest total project costs. • �ity staif predict some of the vacant buildings in the southem half of the Historic f��illwork District {Hh9D} are the most likel�+to !�e renovated over the next several �rears_ The 8k'' �treet and �entral Avenue site is �vell suited to serve future develapment in this area. • This locati�n serves 1� large buildingsldevelopment sites within a 1,Q0�' radius which is the most sites served b�+ any of the top four r�nked sites. • B�r building the new parking structure �n the eastem half af the l�lock the existing high quality, historic brick buildings along �entral A+renue currently owned by Hendricks Feed c�n remain in plaoe. Additionally the view of the Dubuque �ouni�r �ourthouse+�+�t7en appro�ching it fmm �entral Av�nue wauld not be obstructed. • A new parking structure at�`" and lo�+a �treets would require partial dem�lition of the existing lovda �treet Ramp, relocati�n r�f several lar�e Alliant Er�ergy transformers, �nd negatively impact intemal vehicle circulation p�ttern inside the new parking structure in order to maintain servic�s deliveries t�the buildings located on Main �treet as detailed in the �onstructability paragraph above. Forthese reasons further in�+estigation into the viabiliiy of this location was ended_ • The 1�th and �entral A+renue site was eliininated froin consider�tion because of it's close proximity to the existing 10th and �entral parking ramp along with it's extended distance from the southern portion of the H�1D. • The 7th � lowa �treet site is a viable location, but it's location immediately in front of the Dubuque �ounty �ourthouse and the need for a multi-le�+el parking structure neg3tiuely impacts the viewvsheds of the court house and is seen as detracting aspect of this site. Additionall�+ �th �treet is considered to be oonnector street bet�veen the HMD, the Dubuque �ounty �ourthouse, the Dubuque Law Enforcement �enter public entranee and the lovda �treet Parking Ramp entrar�ce. For these reasons this site is not reoammended. FOR THE CONSTRUCTION OF A DOWNTOWN PARKING STRUCTURE WHEREAS, on December 16, 2019 the City Council approved a Development Agreement by and among the City of Dubuque, Roshek Property, LLC, Cottingham & Butler, Inc. and Heartland Financial USA, Inc.; and WHEREAS, the Development Agreement requires the City to "complete and open for parking by December 31, 2023" a Parking Structure of no less than five hundred (500) parking spaces within a certain area of downtown City of Dubuque and that the real estate for the site of the Parking Structure must be acquired by December 31, 2021; and WHEREAS, the Development Agreement by and among the City of Dubuque, Iowa, Dupaco Voices, LLC and Dupaco Community Credit Union requires the City to initiate and, work with the parties to that Development Agreement and other stakeholders in the Historic Millwork District, revise and update the Historic Millwork District Master Plan to address transportation and parking needs and uses within the District, which revised Plan includes the requirement that at such time as 85% of the existing off-street parking in the District is leased/permitted, City shall develop additional off-street parking facilities within 2,500 feet to meet the projected demand; and WHEREAS, after an investigation by City staff of potential sites for the Parking Structure that met the requirements of those Development Agreements, City staff recommended selection of the Hendricks' Feed & Seed Co., Inc. property at 880-890 Central Avenue, Dubuque, Iowa and legally described as: City Lot 279, 280, 280A, 281, 282, 326, 327, 328 and the North 26.2 feet of City Lot 325, according to the United States Commissioners Map of the Town of Dubuque, Iowa ; and WHEREAS, the City and Hendricks Feed & Seed Co., Inc. have negotiated an Offer to Buy Real Estate and Acceptance a copy of which is attached hereto, subject to City Council approval; and WHEREAS, the City Council finds that it is in the best interest of the City of Dubuque to approve the Offer to Buy Real Estate and Acceptance. 05202021BAL NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA AS FOLLOWS: Section 1. With these and other recent demolitions downtown, it appears that the City of Dubuque only cares about historic preservation when it's convenient. This doesn't look like a well-thought-out plan. It's expensive,feels rushed, and threatens two attractive buildings on a street with very few of them. And seven existing ramps in a small downtown? Development agreements can be altered.
