Petition of property owners and
residents in the vicinity of Althauser
and Stafford streets asking that a
street light be installed at said inter-
section was presented. Signed by

Petition of property owners on
Prescott street asking that the Coun-
cil view said street for the purpose
of installing a sanitary sewer, stat-
ing that the conditions are very un-
sanitary. Signed by Geo. Volrath,

Councilman Brede moved that the
petition be referred to the City En-
gineer to check the names on the
petition against the full number of
property owners on the street, and
report back to the Council. Second-

Petition of Ernest Berringer, stat-
ing that about five years ago he pur-
chased Lot 181, L. H. Langworthy's
Add., from J. H. Rhomberg; that he
paid taxes on this lot since that time
and had no knowledge that there
were any old assessments against
this property. This spring in paying
his taxes he was told that there was
a tax sale recorded against this prop-
erty. On investigation he found that
on August 6th, 1894, an assessment
was levied against this lot for the
improvement of White street, in the
amount of $66.66. No part of the
principal was paid and the property
was bought by the City at a tax sale
held April 180h, 1921. He hereby
offers to settle for this and asks the
City to accept one -half of the original
amount, being $33.33, and upon pay-
ment of which the same be cancelled

on the tax books and the tax sale
certificate be surrendered.
Councilman Brede moved that the
prayer of the petition be granted
and the Treasurer be instructed to
accept $33.33 in full for this assess-
ment, cancelthe same on the tax
books and surrender the tax sale
certificate upon receipt of same. Sec-
onded by Councilman Gabriel. Car-
ried by the following vote:

Petition of property owners on
Cardiff street, asking that said street
be improved, presented. Signed by
L. W. Greener, T. H. Callahan, Leo

Councilman Brede moved that the
petition be referred to the City Engi-
neer to check up and compare the
number of signers with the number
of taxpayers on the street and re-
port back to the Council. Seconded
by Councilman Gabriel. Carried by

Petition of Ed Muntz, stating that
some time ago he received notice of
assessment levied against Lot 19,
East Dubuque Add., in the sum of
$99.22 for the construction of a sani-
tary sewer in 19th street, also that
in 1920 he w.as ordered by the Coun-
cil to connect with a sewer; he con-
nected his property at a great ex-
pense with the sewer in the alley
between Washington and Elm streets
and objects to paying for the assess-
ment for that reason.
The City Manager reported that he
examined into this matter and does
not find any previous assessment for
sewer against this lot.
Councilman Melchior moved that
the petition be received and filed.
Seconded by Councilman Gabriel.

Petition of Ed. Mentz, stating that
on October 30th, 1923, the City as-
sessed Lots 18 and 19, Morgan's
Sub., for $197.52 for a sanitary sewer,
the lots are of little value, being
assessed for tax purposes at $50.00
each. He therefore asks that the
City Council reduce the assessment
to a 25% of the taxable valuation of
these lots.
Councilman Brede moved that the
petition be referred to the City Man-
ager for investigation and report.
Seconded by Councilman Melchior.

AN ORDINANCE AMENDING AN
ORDINANCE ENTITLED "AN OR-
DINANCE LICENSING AND REG-
ULATING PEDDLERS" THE
SAME BEING ORDINANCE NO.
62 OF THE REVISED ORDIN-
ANCES OF THE CITY OF DU-
BUQUE, 1919, BY INCREASING
THE LICENSE FEE REQUIRED
OF PEDDLERS OF FOOD COM-
MODITIES BY STRIKING OUT
THE WORD ICE CREAM IN PAR-
AGRAPH 465 THEREOF; AND BY
PRESCRIBING A LICENSE FEE
FOR VENDERS' OF ICE CREAM
UPON AND OVER THE PUBLIC
STREETS.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That an Ordinance en-
titled "An Ordinance licensing and
regulating peddlers ", the same being
Ordinance No. 62 of the Revised
Ordinances of the City of Dubuque,
1919, be and the same is hereby
amended by increasing the license
fee prescribed by Section 463 there-
of from $50.00 to $75.00 so that said
paragraph of said Ordinance shall
hereafter read as follows:
"Paragraph 463. Peddlers of food
commodities. Section 1. All persons
selling or offering for sale along the
public streets or other public places,
or from house to house, fruit, vege-
tables and farm products, including
poultry, eggs and butter, shall pay
an annual license fee of $75.00, pay-
able in advance, and such license fee
shall be charged against each vehicle
so used in side -line of occupation. If
paid . after October 1st and before
January 1st, the license shall be
535.00. Peddlers who desire a license
to sell merchandise as specified in
this section for a shorter period of
time, shall be required to pay a li-
cense of $2.00 per day. This section
does not apply to persons retailing
produced by them."
Section 2. That paragraph 465 of
said Ordinance, relating to the li-
cense required of street merchants,
be amended by striking out the
words, "ice cream" therefrom, so
that said paragraph will hereafter
:•^ad as follows:
"Paragraph 465, Street merchants,
Section 3. All persons who shall fol-
low the business of selling pop
corn, candies, confectioneries, nuts,
lunch, lemonade or drinks, newspa-
pers, magazines, or other publica-
tions, on the street or sidewalks,
whether in booths, tents temporary
buildings or from a push cart wag-
on or otherwise, shall pay a license
fee of $2.00 per day or $10.00 per
week, or $50.00 per year."
Section 3. That said Ordinance be
further amended by adding thereto
the following:
"Paragraph 465%. Vender of Ice
Cream . All persons who shall en-
gage in the business of vending ice
cream from vehicles upon public
streets or in public places, or from
booths, or other temporary structures
shall pay an annual license fee of
$75.00 per year for each vehicle or
booth thus used or if a license for
a shorter period is requested such
license may be granted by paying
the sume of $2. per 10.00
week therefor."

AN ORDINANCE REGULATING
THE SALE OF FOOD COMMODI-
TIES AND ICE CREAM FROM
VEHICLES, PROVIDING FOR IN-
SPECTION OF SAME, DEFINING
THE FOOD COMMODITIES
WHICH MAY BE SOLD AND
PRESCRIBING A PENALTY FOR
VIOLATING HEREOF.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That any person or
Persons engaged in the business of
selling food commodities and ice
cream from vehicles upon and
through the streets of the City of
Dubuque shall be subject to inspec-
tion by the food inspector of said
City, under the jurisdiction of the
Board of Health, and such shall re-
late to the quality of the commod-
ities sold, weights and measures,
and sanitation.
Section 2. That in the handling

and sale of food commodities and
ice cream from vehicles from the
streets, the commodities offered for
sale shall be in a solid and healthy
condition and free from contamina-
tion and the vehicles and containers
in which such commodities are
handled and from which same are
sold shall be protected against filth,
dust, flies and foreign substances
which would tend to contaminate
the articles sold, render the same
unfit for human consumption and un-
sanitary, and all articles sold or of-
ered for sale must be protected
against contamination as provided
for by the rules of the Department
of Agriculture of Iowa.
Section 3. That the only food
commodities which are permitted to
be sold upon the street of the City
of Dubuque from vehicles are fruit,
vegetables and farm products, poul-
try, eggs and wrapped butter, and
no other articles or groceries shall
be disposed of.
Section 4. That any person or
persons who refuses to permit the
food inspector or proper officer of
the Board of Health to make inspec-
tion, as herein provided for, or any
person or persons who are found
guilty of selling or offering for sale
food commodities or ice cream which
is unfit for human consumption or
in less quantities than prescribed by
the siAtutes of Iowa with reference
to weights and measures, or any per-
son or persons who are guilty of
selling, offering fo rsale food com-
modities or ice cream from vehicles
or containers which are filthy and
unsanitary, or any person or persons
who shall violate any of the provi-
sions of this Ordinance shall be
deemed guilty of a misdemeanor and
upon conviction shall be fined not
less than $10.00 nor more than
$100.00 and confined in jail until such
fine is paid, not exceeding however,
thirty (30) days.
Section 5. This Ordinance shall
be in force and effect ten (10) days
from and after its final passage and
adoption by the City Council and
publication as provided by law.

Petition of John Palen asking
that the Bell Telephone Company
be notified by the City Council to
remove the telephone pole in the
rear of his property, stating that he
intends to build a garage and the
pole is so located that he cannot
open the doors after it is construct-
ed.

ed and the Clerk notify the Tele-
phone Co. to move sal dpole. Sec-

Ed. Kuehnle of the Leader Oil Co.
addressed the Council relative to the
new filling station that his Company
is about to erect on Third street.
Stating that the Company intends
to build up to the curb, in line with
other buildings in this locality, but
the Building Inspector would not al-
low him to do it, and for that reas-
on he came before the Council now.
Councilman Brede moved that
Building Inspector Humphrey issue
a permit to the said Company, al-
lowing them to excavate to the curb
line, and the building when com-
pleted must be four feet from the
curb line. Seconded by Councilman
Gabriel. Carried by the following
vote:

Councilman Bre'le moved that a
resolution be drafted authorizing all
persons occupying City property to
pay a rental of 6 per cent of the ap-
praised value of the land occupied.

Mr. T. T. Parker of the Dubuque
Electric Co., addressed the Council
relative to the one man car opera-
tion, stating that they had operated
the one man cars for a year and
find it is very satisfactory, and he
hereby asks the Council to permit
the operation of the one man cars
on such lines and at such time as
the Company deems necessary, and
asks further that the Council repeal
the two man ordinance. The matter
to be taken under advisement, no
action taken at this time.

Gentlemen: At a meeting, of the
City Council, held April 14th, 1924,
the petition of C. E. Reynolds ask-
ing that the assessment be seduced
against lot 8 Lois Add. was referred
to the City Manager and the Mayor

We have investigated this lot and
would recommend that no reduction
be granted, at this time. This as-
sessment levied in October, 1922, and
there has been plenty of time prior
to April, 1924, in which to ask for
a reduction in this assessment. Fur-
thermore the assessment as levied
amounts to $222.87. It is the assess-
ment as levied which is limited to
25 per cent of the value and not
the interest accruing on account of
nonpayment.
It is our judgment that this lot
is worth four times the amount of
the assessment on account of the im-
provement of Alpine street.
For this reason and also on ac-
count of the fact that one and one-
half years have elapsed since the
levy was made, we would recom-
mend that the petition be received

Gentlemen: I beg to advise that
the sanitary sewer in Rush street
with laterals for a distance of ap-
proximately 210 feet west of Holly
street, Oliver Kringle, contractor,
has been completed.
I would recommend its acceptance
by the City. It has not been tested
by the Sewer Inspector, in as much
as there is no outlet at the present
time.

ing the lots or parcels of real es-
tate subject to assessment for said
improvement and file the same in
the office of the City Clerk subject
to public inspection and the City
Clerk shall upon receipt of such plat
and schedule publish the notice of
said assessment as required by law.

Chamber of Commerce, asking that
the City send one or more men to
the conference of the Mississippi
Valley Association to represent the

City Manager Carr reported that
he had received one bid for the
property at Booth and Dodge streets,
advertised for sale by the City. The
bid was for $1,800.00 offered by David
Howie, the bid was refused, being
to low for this property. No further
action taken at this time.

for $875.00 for right of way purpos-

Report of the City Solicitor.
To the Honorable Mayor and Council
of the City of Dubuque:
Gentlemen: On January 5, 1924,
E. Mendelson fell and broke his arm
on a sidewalk located at 1632 Main
street. The walk at this point was
in a bad condition because of the
presence of snow and ice and had
been in that condition for quite a
long time prior to the day of the
accident. I agreed with Mr. Mendel.
son at the time that the accident oc-
curred that the City would pay his
Doctor bill amounting to $16.50 and
hf has .accepted that proposition.

you order a warrant drawn in his
favor for $16.50.

Councilman Melchior moved that
the report of the City Solicitor be
approved and the Auditor be in-
structed to draw a warrant for $16.50

Petition of the Dubuque Moose
Lodge No. 355 asking permission to
hold a Spring Bazaar and show on
May 19th, 1924, and ensuing five
days, presented, attached to petition
were the names of 52 abutting prop-
erty owners asking that petition be
granted.

the rules be suspended for the pur-
pose of giving any one present an
opportunity to address the Council.

Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That an ordinance en-
titled "An Ordinance regulating cir-
cuses, menageries, carnivals and
shows and prescribing a penalty for
violation hereof," same being Ordi-
nance No. 124, passed on July 19th,
1922, be and the same is hereby
amended by adding to Par. 845, the
same being section 1 of said Ordi-

nance, the following provision, to
wit:
Provided, however, that should a
petition signed by 75% of the adja-
cent property owners be filed with
the City Council requesting permis-
sion for conducting a circus menag-
erie, carnival or show and should
the Council be satisfied that such
an entertainment be clean and in-
offensive as to health, comfort, con-
venience and morals, the Council
may grant permission for the hold
ing of such entertainment.
Provided, further, that where per-
mission is granted by the Council,
the person, company or corporation
holding such entertainment shall
procure a license from the Manager
and pay therefore the following fees:
For each circus or menagerie, $200
for the first day and $100 for each
succeeding day.
For each wild west show the sum
of $125 for the first day and $75.00
for each succeeding day.
For each dog and pony show the
Sum of $50.00 for the first day and
$25.00 for each succeeding day.
For each carnival company the
sum of $50.00 per day and $25.00
for each succeeding day.
It is further provided that the
Council may impose additional con-
ditions and restrictions as a condi-
tion to the issuing of the license as
it sees fit,
Section 2. This Ordinance being
deemed urgent, shall be in force and
effect from and after its final passage
and adoption by the City Council
and its publication as required by
law.

Petition of the August Pust Es-
tate, by Wm. A. Pust. Stating that
lot No. 528 Ham's Add. was assessed
$50.79 because of the construction
of a sewer in the neighborhood of
the property, claiming that the as-
sessment is excessive, owing to the
location of the lot, the back part
of the lot is a steep hillside, and
furthermore the owners of this lot
would have to meet the cost of dig-
ging and piping for about two blocks,
and the heirs hereby ask the Coun-
cil to investigate, and reduce the
assessment to a figure that would
be more equitably proportioned to
the benefits accruing to the property.

the petition be referred to the City
Engineer to investigate and report
back to the Council. Seconded by

Gentlemen: I own lots 2, of 43,
2 of 44, 2 of 45, 2 of 46, and I have
sold lot 2 of 45 for $250.00. There
is some assessment against it, and
I want to clear it up and all I ask
is the same treatment that the other
Rosedale property owners got. They
are short lots, the north lot is only
40 feet deep, and the depth increas-
es to the south.

payment of 60 per cent of the as-
sessment witth interest from Dec.
1920, the tax sale certificate be sur-
rendered. Seconded by Councilman

To the Honorable Mayor and Coun-
cilmen, City of Dubuque, Iowa:
Gentlemen: We note that a con-
tract has been awarded for the im-
provement of Jones 'street east of
Main street.
Our Company has a short spur of
track approximately eighty feet in
length extending east on Jones street
from Main, which track must be ele-
vated several inches to conform to
the new level of the street after
same is resurfaced.
In as much as this particular spur
of track is of practically no value
in the operation of our street car
system, we would much prefer to
remove the track entirely, replacing
the paving in as good condition as
at present, thus allowing th eentire
width of the street at this point to
be resurfaced under the same speci-
fications as those governing the por-
tion of the street exclusive of that
now occupied by our track.
We presume that since the con-
tract has already been awarded, it
will be necessary that our Company
assume the expense of resurfacing
a strip 8 feet in width after the
tracks have been removed and the
present paving eplaced, and this we
are willing to do.

A Resolution.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a sanitary
sewer in Alta place hereinafter de-
scribed has been completed and the
City Engineer has computed the cost
and expense of said improvement
amounts to $868.05.
Therefore, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of con-
structing a sanitary sewer in Alta
place from Delaware street to a
point 100 feet south of Fillmore
street there be issued Sewer Bonds
to the amount of $868.05. Said bonds
shall be issued under the provisions
of Chapter 6, Title V of the Code of
Iowa and the amendments thereto,
shall bear date of the 19th day of
June, A. D. 1924, shall be in the de-
nominations of $100.00 each, except
that there shall be one bond to the
amount of $68.05; they shall be num-
bered from 9764 to 9772 inclusive
and shall be divided into ten series
o f which the bond numbered 9764
shall constitute the first series, and
shall be payable on the 1st day of
April, A. D. 1925; the bond numbered
9765 shall constitute the second ser-
ies and shall be payable on the 1st
day of April, A. D. 1926; the bond
numbered 9766 shall constitute the
third series and shall be payable
the 1st day of April, A. D. 1927;
the bond numbered 9767 shall con-
stitute the fourth series and shall
be payable the 1st day of April,
1928; the bond numbered 9768 shall
constitute the fifth series and shall
be payable the 1st day of April,
1929; the bond numbered 9769 shall
constitute the sixth series and shall
be payable the 1st day of April,
1930; the bond numbered 9770 shall
constitute the seventh series and
shall be payable the 1st day of April,
1931; the bond numbered 9771 shall
constitute the eighth series and shall
be payable the 1st day of April,
1932; the bond numbered 9772 shall
be payable the 1st day of April,
1933; and shall constitute the ninth
series.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable semi-
annually, in accordance with the
t�rius of th, coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spec-
ial assessment levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City
of Dubuque. Said bonds shall be

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19_.-....; or at any time before that
date at the option of the City the
sum of One Hundred Dollars with
interest thereon at the rate of 5
Per cent per annum, payable on the
presentation and surrender of the in-
terest coupons hereto attached. Both
interest and principal are payable
at the office of the City Treasurer
in the City of Dubuque in the State
of Iowa. This bond is issued by the
City of Dubuque pursuant to and by
virtue of Chapter 8, Title V of the
Code of Iowa, and amendments
thereto, and in accordance with a
Special Session, May 19th, 1924 229
resolution of the City Council of
said city, duly passed on the 19th
day of May, 1924. This bond is one
of a series of nine bonds, eight for
One Hundred Dollars numbered from
9764 to 9771 inclusive an done for
Sixty -eight and 05 -100 Dollars num-
bered 9772; all of like tenor and
date, and issued for the purpose of
constructing a sanitary sewer in Al-
ta place from Delaware street to
a point 100 feet south of Fillmore
street, and described in said resolu-
tion; which cost is assessable and
levied along said improvement, and
is made by law a lien on all abutting
or adjacent property, and payable in
ten annual installment, with interest
on all deferred payments at the rate
of five per cent per annum, and this
bond is payable only out of the
money can be used for no other
purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment here-
on of said special tax, the faith and
diligence of said City of Dubuque are
hereby irrevocably pledged.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 19th day of June, A. D.
1924, and has authorized the useof
theirfac - simile signatures to the in-
terest coupons hereto attached.

of the Code of Iowa, the proceeds
of said sale to be kept in a special
fund to be known as Sewer Fund.
Be it further resolved that the in-
terest coupons attached to the bonds
be signed with the fac- simile sig-
nature of the Mayor and counter-
signed with the fac - simile signature
of the City Clerk.

Remonstrance of J. C. Buol, stat-
ing that his lot No. 9 Fairview Sub.
is assessed $281.78, and this seems
to him to be way out of proportion,
as compared to the assessment as
levied against the adjoining proper-
ty.

improvements as hereinafter de-

lowing street, to wit:
Stanton street from the west line
of Rhomberg avenue to the east line
of Lincoln avenue.
Said street improvement to con-
sist of grading, paving, and curb and
gutter, the curb and gutter to be con-
structed of concrete and the pave-
ment to be constructed of one or
more of the following materials and
methods, to wit: the 26 foot roadway
to be paved with bituminous macad-
am.
All of the work herein proposed
to be constructed shall be done in
accordance with the plans and speci-
fications to be prepared by the City
Engineer and approved by the City
Council and City Manager.
That the cost and expense of mak-
ing and constructing said improve-
ments shall be assessed upon and
against all privately owned property
whether abutting or not but lying
within the assessable distance pre-
scribed by law, according to the area

Be it resolved by the City Council
of the City of Dubuque, upon its own
motion, that pursuant to a resolution
of necessity proposed at a meeting
of the Council on the 25th day of
April, 1924, and duly passed and ad-
opted and approved on the 19th day
of May, 1924 it is hereby ordered
that the improvement described iu
said resolution of necessity provid-
ing for the improvement of Stanton
street from the west line of Rhom-
berg avenue to the line of Lin-
coln avenue by curbing with new
cement curb where required, or by
resetting old stone curb where re-
quired, and by making sewer, water
and gas connections to property not
already connected with the same, as
provided for in a resolution hereto-
fore adopted and approved, and by
Paving said street with bituminous
macadam and by constructing con-
crete gutter where provided for in
the type of pavement to be selected
as shown upon the plans and speci-

the City Engineer, which plans and
specifications have been approved
by the City Manager and are hereby
approved by the City Council, the
same being on file in the office of
the City Clerk for public inspection,
all of said work to be completed on
or before the 15th day of October,
1924.
The cost and expense of said work
will be paid by the levying of spec-
ial assessments against the privately
owned property abutting upon said
improvement and also against prop-
erty which does not abutt upon said
improvement but which lies within
the assessable distance as provided
by law, and payment to the contract-
or will be made out of funds realized
from the sale of Improvement Bonds
to be issued in anticipation of the
collections of said assessments un-
der the provisions of Chapter 8 Title
V of the Code of Iowa and amend-
ments thereto; and any deficiency
between the amount of the contract
price and the amount which can be
legally assessable against private
property will be paid either from the
proceeds of a special tax or to be
levied under the provisions of Sec-
tion 831 of the Code of Iowa, in an-
ticipation of which bonds will be is-
sued under the provisions of Sec-
tion 912 of the Code of Iowa and
912A of the Code supplement, or out
of the general fund.
This resolution being deemed ur-
gent and of immediate necessity,
shall be in force and effect after

petition of H. A. Coon of Manchest-
er, Ie., referred to him for informa-
tion. States that on February 16th,
1923, there was an assessment levied
against lots 71 and 72 Woodlawn
Park Add. for construction of Sani-
tary sewer in Audubon, Rosedale
and West 14th streets.
As said petitioner does not live in
the city he was unable to find for-
warding address and failed to notify
petitioner of the assessment. He
now wishes to pay this on the in-
stallment plan and is asking the
Council for permission to do so. In-

Resolution of Necessity for Sewer.
Be it resolved by the City Council
of the City of Dubuque on its own
motion that it be deemed necessary
and advisable to construct a six
inch salt glazed vitrified tile sanitary
sewer in Decatur street from Lin-
coln avenue to Prescott street and
in Prescott street from Hamilton
street to a point about 250 feet south
of Decatur street.
Said sewer to be provided with
manholes and any other appurten-
ances that may be necessary. Said
sewer to be constructed in accord-
ance with the plans and , specifica-
tions prepared by the City Engineer
and now on file in the office of the
City Clerk having been duly ap-
proved by the City Council, City
Manager and State Board of Health.
That the cost and expense of mak-
ing and constructing said sanitary
sewer shall be assessed against the
property abutting upon the same
and also against all adjacent prop-
erty benefited thereby.
Be it further resolved that the
above and foregoing sanitary sewer
is hereby proposed to be constructed
as hereinbefore set forth, and that
this proposed resolution except this
paragraph, be and the same is here-
by set down for further and final

An Ordinance prescribing the kind
and description of articles which
may be sold in the Central market,
as defined in Ordinance No 36 of
the Revised Ordinances of the City
of Dubuque, 1919.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That from and after
the final passage, adoption and ap-
',oval of this Ordinance the only
articles of food commodities which
may be sold upon the Central mar-
ket, including poultry, vegetables,
eggs, butter and fruits shall be sucn
. as are raised or produced by the
person or persons offering them for
sale and no other person or persons
rhall be permitted to occupy any
stand or place upon the streets or
sidewalks within the Central market,
as defined by Ordinance No. 36 of
the Revised Ordinances of the City
of Dubuque 1919, but nothing herein
shall be held to exclude the sale of
fresh fish upon said Iylarket.
Section 2. Any person or persons
violating this Ordinance shall be
Punished by a fine not to exceed
$100.00 or imprisonment not to ex-
ceed thirty (30) days, and each time

constitute a separate offense.
Section 3. This Ordinance shall
be in force and effect ten (10) days

PRESCRIBING THE CONDITIONS
UPON WHICH OWNERS OF
ABUTTING OR ADJACENT
PROPERTY MAY CONNECT
THEREWITH.
Be it ordained by the City Coun-
cil of the City of Dubuque:
Section 1. That permission be,
and the same is hereby granted to
Julia Froelich, the owner of part
of Lot 8 of the subdivision of part
of Mineral Lot 149,, and to her suc-
cessors and assigns, to construct a
six (6) inch sanitary sewer in York
Street from Dodge street southerly
for a distance of about 150 feet, said
sewer to be constructed at her ex-
pense and without any costs to the
City of Dubuque.
Section 2. That after said sewer
has been constructed any person
or persons desiring to connect there-
with shall re- imburse said Julia Froe-
lich for the actual cost of construct.
ing said sewer in proportion to the
number of feet of the lot to which
connection is to be made, and after
such payment has been made to her
such party or parties may have the
right to connect with said sewer
and use the same for suitable pi,
poses, all connections, however,
shall be subject to proper regulo -
tions of the City of Dubuque, its of-
ficers and departments.
Section 3. That after said sewer
has been constructed the grantee
shall file a report of the cost there
with the City Council, to be made a
matter of permanent record.
Section 4. That after said sewer
has been laid and completed, the
street in which the same has been
laid shall be replaced in as good
condition as it was before it was
torn up and the grantee herein, her
successors and assigns, shall be re-
sponsible for any and all damages
which may arise out of the con-
struction and maintenance of said
sewer.
Section 5. This ordinance shall
be in force and effect ten (10) days

tion by the City Council and publi-
cation by law:

A Resolution.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of 18th street
hereinafter described has been com-
pleted and the City Engineer has
computed the cost and expense of
said improvement amounts to
$12,523.71.
Therefore, be it resolved by the
city Council of the City of Dubuque
that to provide for the cost of im-
proving 18th street from the east
property line of Central avenue to
the C. 0. W. Ry. tracks, there be
issued improvement bonds to the
amount of $12,523.71. Said bonds
shall be issued under the provisions
of Chapter 6, Title V of the •Code
of Iowa and the amendments there-
of, shall bear date as of the 26th
day of June, A. D. 1924, shall be in
the denominations of $300.00 each,
except that there shall be one bond
to the amount of $223.71; they shall
be numbered from 9773 to 9814 in-
clusive, and shall be divided into
ten series of which the bonds num-
bered 9773 to 9777 shall constitute
the first series, and shall be pay-
able on the lst day of April, A. D.
1925; the bonds numbered 9778 to
9781 shall constitute the second ser-
ies and shall be payable on the lst
day of April, A. D. 1926; the bonds
numbered 9782 to 9785 shall consti-
tute the third series and shall be
payable the 1st day of April, 1927;
the bonds numbered from 9786 to
9789 shall constitute the fourth ser-
ies and shall be payable the 1st day
of April, 1928; the bonds numbered
from 9790 to 9793 shall constitute
the fifth series and shall be payable
the 1st day of April, 1929; the bonds
numbered •from 9794 to 9797 shall
constitute the sixth series and shall
be payable the 1st day of April, 1930;
the bonds numbered from 9798 to
9801 shall constitute the seventh ser-
ies and shall be payable the 1st
day of April, 1931; the bonds num-
bered from 9802 to 9805 shall con-
stitute the eighth series and shall
be payable the 1st day of April,
1932; the bonds numbered from 9806
to 9809 shall be payable the 1st
day of April, 1933, and shall consti-
tute the ninth series; the bonds
numbered from 9810 to 9814 shall
constitute the tenth series and shall
be payable the lst day of April, 1934.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spec-
ial assessment levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City
of Dubuque. Said bonds shall be sub-
stantially in the following form:

sum of Three Hundred Dollars with
interest thereon at the rate of 5 per
cent per annum, payable on the pre-
sentation and surrender of the in-
terest coupons hereto attached. Both
interest and principal are payable
at the office of the City Treasurer
in the City of Dubuque in the State
of Iowa. This bond is issued by the
City of Dubuque pursuant to and by
virtue of Chapter 8, Title V of the
Code of Iowa, and amendments there-
to, and in accordance with a resolu-
tion of the City Council of said city,
duly passed on the 26th day of May.
This bond is one of a series of 42
bonds, 41 for $300.00, numbered from
9773 to 9813 inclusive and one for
$223.71 numbered 9814, all of like
tenor and date, and issued for the
purpose of improving 18th street
from the east property line of Cen-
tral avenue to the C. G. W. Ry.
tracks, and described in said reso-
lution; which cost is assessable and
levied along said improvement, and
is made by law a lien on all abutting
or adjacent property, and payable in
ten annual installments, with inter-
est on all deferred payments at the
rate of five per cent per annum,
and this bond is payable only out of
the money and can be used for no
other purpose.
And it is hereby certified and recited
that all the acts and condition 'and
things required to be done precedent
to and in the issuing of this series
of bonds, have been done, happened
and performed in regular and due
form as required by said law and
resolution ;and for the assessments,
collections and payment hereon of
said special tax, the faith and dili-
gence of said City of Dubuque are
hereby irrevocably pledged.
In witness whereof the City of Du-
buque by its City Council, has caused
this bond to be signed by its Mayor
and countersigned by its City Clerk,
with the seal of said City affixed this
26th day of June, A. D. 1924, and
has authorized the use of their fac-
simile signatures to the interest
coupons hereto attached.

Petition of the Beatrice Creamery
Co. Stating that they had recently
installed on their building, corner of
7th and Iowa street, 5 electric lights
and reflectors, to illuminate a sign
which they had painted on the /lley
side of their building. That they
unintentionally violated one of the
rules of the Building Code, that they
extended the pipe supporting the
lights and reflectors 5 feet out from
the wall, that the Code restricts
these installations to 3 feet, and they
hereby petition the Council to allow
this installaion to remain and to
authorize the inspector to issue cer-
tificate covering same.
Councilman Brede moved that the
prayer of the petition be granted,
the proper permit to be taken out
by the Company. Seconded by Coun-
cilman Gabriel. Carried by the fol-
lowing vote:

Petition of Frank Beutin, stating
that when he erected his office on
the corner of Kniest street and Gar-
field avenue in 1915, he connected
with the Kniest street sewer inas-
much as the C. M. & St. P. R. R.
Co. would not permit him to con-
nect with their private sewer.
When he made this connection the
City Council would not permit him
to put his sewer connections through
the Sterna sewer, this made nee -

Dr. E. R. Young addressed the
Council in the interest of the Ku
Klux Klan. Stating that the Klan
had made arrangements with the
Rev. Frank P. George of Lancaster,
Ohio, representing the national or-
ganization of the Knights of the Ku
Klux Klan, to lecture in Dubuque
Tuesday evening, May 27th, 1924, and
asked that the Athletic Field be
made available as the place to hold
the meeting.
He stated that this was not to be
made a meeting of the Klan and that
the members of the Klan would not
appear in hoods and robes, that the
meeting was for the general public,
and open to anyone who wanted to
attend.
After considerable discussion and
debate, Councilman Melchior moved
that permission to use the Athletic
Park for this meeting be not granted.
The motion was lost by the following
vote:
Yeas — Councilman Melchior, and
Brede.
Nays —Mayor Alderson, Council-
men Gabriel and Schrempf.
Councilman Gabriel then moved
that permission to use the Athletic
Park for the above meeting be grant-
ed. Seconded by Councilman
Schrempf. Carried by the following
vote:

men Gabriel and Schrempf.
Nays— Councilmen Melchior and
Brede.
The Mayor then declared the vote
carried, and permission to use the
Park for the lecture, granted.
R. E. Haggerty addressed the
Council relative to an assessment
levied against his property lot No.
13 Newberry's Add., corner of West
5th street and Fenlon place for the
improvement of West 5th street.
Stating that the assessment is too
high in comparison to the lot value.
This matter was up before the Coun-
cil in August, 1923, and the Man-
ager reported on same in Sept., 1923.
Councilman Brede moved that the
matter be again referred to the City
Manager. Seconded by Councilman
Gabriel. Carried by the following
vote:

A communication from the Du-
buque Park Board, relative to the
rock sold to the Eagle Point Lime
Works, recommending that the plat
covering same be recorded. The fol-
lowing resolution presented and ad-
opted.
A Resolution.
Whereas the Park Board has ne-
gotiated for the sale of certain rock
from the grounds of the Eagle Point
Park to the Eagle Point Lime Works,
and
Whereas in order to have a defin-
ite understanding as to the limits
of the removal of rock, it is necess-
ary to have a plat recorded, prop-
erly describing the property from
which the rock can be removed.
Therefore be it resolved by the
City Council of the City of Dubuque,
Iowa, that the plat covering Min-
eral lot No. 305A, dated April lst,
1924, by the City Engineer, be ap•
proved and that the Mayor be auth-
orized to sign the same in behalf
of the City of Dubuque.

AN ORDINANCE AUTHORIZING
THE DUBUQUE ELECTRIC
COMPANY TO DISCONTINUE
THE SPUR TRACK EXTEND-
ING EAST ON JONES STREET
FROM MAIN STREET, A DIS-
TANCE OF APPROXIMATELY
EIGHTY (80) FEET, AND PRE-
SCRIBING THE CONDITIONS
THEREOF.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That the Dubuque
Electric Company, its successors
and assigns, are hereby authorized
to abandon the spur track extend-
ing easterly on Jones Street from
Main Street a distance of approxi-
mately eighty (80) feet and to
remove said track from said street.
Section 2. That as a condition
to the removal and abandonment
of said track said Company sha"11
be required to pay for the paving
to be laid within its right of
way previously occupied by said
track, the cost of which shall be
assessed to said Company in the
same manner as in case of private
ownership of real estate and such
right of way shall be paid at the
same time, in the same manner
and of the same materials as the
rest of he street.
Section 3. This ordinance shall
be in force and affect ten (10)
days from• and after its final pass-
age and adoption by the City
Council and publication as provid-
ed by law, and after said Company
through its proper officers, has

accepted the terms hereof by en-
dorsing its acceptance upon this
Ordinance, which acceptance shall
become a part hereof.

Petition of Jacob Ettenson, stating
that on July 3rd, 1923, there was
levied against his property lot 5
Home Add. ,an assessment for the
improvement of Mt. Pleasant street
amounting to $212.04. There was al-
so assessed against this property an
assessment for sewer and water con-
nections. This latter assessment he
paid, intending to pay the street as-
sessment later, being ignorant of the
fact that by not paying the first in-
stallment when due, the whole
amount becomes due. That when he
called at the Treasurer's office in-
tending to pay $112.04 with interest
due to date and offered to pay the
balance in full next year, the Treas-
urer informed him of the above facts.
And he hereby petitions the Council
to graft him permission to make the
payments as he intends to do.
