It being the first meeting of the
fiscal year of 1923 it was necessary
to administer the oath of office to
James Alderson, Louis H. Brede,
and Theodore P. Gabriel, whose
terms of office expired and who were
reelected to succeed themselves.

Petition of Mrs. Louise Frieder -
ich, stating that in 1911 they ac-
quired title to lot 11 in Quigley's
sub. of outlot 709 through a mort-
gage which owner failed to meet.
Recently when paying taxes they
were informed' that the same was
sold Dec., 1922 for the improvement
of Angella Street in 1902. Four in-
stallments were paid by the prev-
ious owner which left $81.33' plus
April 2nd, 1923
interest delinquent, owing to the
fact that they did not know of this
delinquent assessment, it was .not
paid. They now offer to settle this
for $15.00 to clear title.

Gentlemen: I hereby petition for
a permit to install a free air ser-
vice .station on the curb in front of
my place of business at 1170 Iowa
Street. This station will not inter-
fere with traffic outside of parking
at the curb for a few minutes. This
station will consist of a steel box
set flush in the curb, below sketch
will give some idea of how it will

account of a clerical error in setting
forth unit price. Said error clearly
reveals itself in. the extension show-
ing total. Also by comparison with
all our bids, and especially the bid on
upper Washington Street where in
the true unit price is set forth.

Gentlemen: I beg to advise that
the J. F. Lee Company has completed
the laying of sewer and water con-
nections in each of the following
Streets and that the Key City Gas
Co, has as connect connections on contract for
each of
laying gas
following Street
Booth from Streets: Dodge Street to
Julien Avenue.
Asbury Street from Delhi to St.
Ambrose Street.
Seminary Street from St. Ambrose
Street to May Place.
The actual work of making the
connections was completed some
time ago. There' is still some un-
certainty about the trenches being
properly back filled. This, however,
can now be taken care of definitely
before the assessment is actually
levied if the work is accepted at this
time. I would therefore recommend
the acceptance of the above improve-
ments.

Gentlemen: In accordance with
your instructions bids were received
at ten a. m. Saturday, March 31st,
for the improvement of one alley and
various streets, this work covering
slightly over one hundred thousand
yards of paving.
There were but five bidders. How-
ever, the prices bid are very low
indeed for improvement work, there
being real competition in both the
hard top and the soft top pavements.
I am submitting herewith a report
covering each of the streets on which
bids were received. This report
shows the unit price for the paving
material as bid and also the total
cost as figured in accordance with
the instruction) to bidder, nan$ely
the unit prices are multiplied by the
engineer's estimated quantities and
the sum of their products being tak-
en as the total cost.

My judgement is that the total
estimated cost in all cases will be
slightly in excess of the actual cost
of the performance of the work. Par-
ticularly is this true in sheet asphalt,
as the amount of binder figured, in
my judgement, is in excess of the
actual amount of binder used. Like-
wise, in all probability, the amount
of crushed rock figured is slightly in
excess of the actual amount of crush-
ed rock to be used on the work.
The city is to be congratulated on
the very favorable prices received
for both hard and soft top pave-
ments.
I would recommend that the con-
tracts for all these improvements be
awarded without further delay in or-
der that the work can be completed
in the early end of the season.

blocks. The poster boards would be
so situated as to in nowise obstruct
traffic, or view, and we sincerely be-
lieve it would not call forth criti-

materials and performing the work
as provided for in the places and

tract for the improvement of the

tieth Streets be awarded Uhlrich -
Paley Co. for vibrolithic pavement
and the Manager be and he is hereby
directed to execute a contract on be-

Whereas, in the construction of
the sanitary and storm sewers which
are being built in White Street and
which are to empty into the Mississ-
ippi River, it is necessary to cross
under the railroad tracks of the Illi-
nois Central Railroad Company;
and
Whereas, such construction re-
quires a measure of protection to
the Illinois Central Railroad Com
pany in the operation of its trains
over the tracks at the place where
said sewer crosses under such tracks
in order that the use of such tracks
may not be interfered with:
Be it therefore resolved by the
City Council of the City of Dubuque
that the agreement which is hereto
attached and made a part hereof be
entered into and executed by the
City of Dubuque and the Illinois
Central Railroad Company, and in
order to carry out the provisions of
said agreement, the Mayor is here-
by authorized to execute said agree-
ment on behalf of said City of Du-
buque.

On January 9. 1923, between the
hours of 9:30 and 10:00 p. m. Frank
Fosselman fell at the southwest cor-
ner of White and 24th Street and
sustained a fracture of the left leg
at the ankle. The exact place where
the accident occurred is located up-
on the apron which runs from the
curb to the street. From my investi-
gation of this accident I find that the
apron was covered with snow and ice
for some time prior to the accident
and was in a more or less danger-
ous condition. Mr. Fosselman was in

An Ordinance requiring the secur-
ing of building permits, prohibit-
ing certain obstructions and pre-
scribing a penalty for violation of
the terms hereof.
Be it ordained by the City Council
of the City of Dubuque.
Par. 873. Sec. 1. Before any
building or addition to a building is
made, constructed, or erected with-
in the limits of the city of Dubuque,
the owner thereof or his authorized
architect or contractor, shall file
with the City Engineer plans and
specifications showing the proposed
improvement, which plans and speci-
fications shall be examined by said
Engineer for the purpose of determ-
ining the location of the proposed
improvement, the type of improve-
went proposed to be made, and the
dimension of such improvement.
Par. 874. Sec. 2. After sucn
plans and specifications have been
submitted to the City Engineer he
shall, within three (3) days there-
after determine whether or not a
permit shall be granted for such pro-
nosed building or improvement and
in such determination be governed
by the existing Ordinances of the
City of Dubuque.
Par. 875. Sec. 3. If such build-

o'clock p. m. Tuesday, April 10th, for
the Two Hundred Thousand Dollars
of 41 per cent Waterworks bonds,
maturities as follows: $20,000.00
April 1, 1937, and $30,000.00 each
year from 1938 to 1943 inclusive. The
following sealed bids were received:
Lamport, Barker & Jennings, New
York, $2,820.00 premium.
Graham, Schulte & Hilman, Water-
loo, $1,234.00 premium.
L. H. Allen & J. B. Walker, New
York, $560.00 premium.
Weil, Roth & Irving, Cincinnati,
$40.00 premium.
After the receipt of sealed bids only
Ames Emerich Co., of Chicago and
the Guaranty Company of New York
continued bidding. Ames Emerich
Company bid $3,125.00 premium and
the Guaranty Company of New York
bid $3,115.00 premium.
Some seven other firms were rep-
resented at 3 bidding but the seal-
ed bid submitted by Lamport, Bark-
er & Jennings was higher than their
authorized bid.
I would therefore recommend the
sale of the issue of bonds to the
Ames Emerich Company of Chicago
Illinois, at their bid of par and ac-
crued interest plus a premium of
$3,125.00.

A Resolution Authorizing the Exe-

Emerich Company of Chicago, III.
Whereas, appropriate proceedings
were instituted by the City Council
of Dubuque, Iowa, for the issue and
sale of four and one -half percent
Waterworks bonds to the amount of
$200,000, and the notice of the time
when bids would be received for the
sale of such bonds as duly publish-
ed in the Telegraph - Herald, one of
the official county newspapers of
the City of Dubuque, Dubuque Coun-
ty, Iowa, and also in the Des Moines
Register- Leader, a newspaper of gen-
eral circulation throughout the State
of Iowa, for two consecutive weeks,
all as is provided by law, and
Whereas, pursuant to such notice,
bids were received by the City Man-
ager of said City on April 10th, 1923,
at his office in the City Hall, at
which time the same were opened,
compared and examined, and
Whereas, such bids were submit-
ted to the City Council of the City
of Dubuque, at a meeting called for
that purpose on April 10, 1923, and
said City Council finds that the
Ames, Emerich Company of Chicago,
Illinois, submitted the highest bid
for said bonds, said bid being par
plus accrued interest together with
a premium of $3,125.00 and it is
deemed advisable that a contract be
awarded to said company for said
bonds; now therefore
Be it resolved by the City Council
of the City of Dubuque, in legal ses-
sion assembled, that a contract for
the sale of $200.000 of four and one-
half per cent Waterworks Bonds of
the City of Dubuque, be awarded to
said Ames, Emerich Company of Chi-
cago, Illinois, and that said contract
be executed by the Mayor in behalf
of the City of Dubuque upon final
passage of this resolution, and ap-
proval of the contract, a copy of
which is hereto attached and made
a part hereof.
This resolution being deemed ur-
gent and for the preservation of the
health, comfort and convenience of
the citizens of Dubuque shall be in
force and effect from and after its
final passage and adoption by the
City Council of the City of Du-
buque.

A Resolution.
Whereas the Commissioners ap-
pointed by the Sheriff of Dubuque
County, Iowa, to assess the damages
to the owners of the real estate un-
der condemnation proceedings insti-
tuted by the City Council of said City
of Dubuque, under which proceedings
a part of lot No. 47 in Finley's Ad-
dition to the City of Dubuque, Ther-
esa Rose Tamlin owner, was taken
in order to widen Seminary Street,
said strip being described as follows:
Beginning at a point 13 feet north
of the southeast corner of lot No.
47 in Finley's Addition to the City
of Dubuque, thence running south
13 feet to the southeast corner of
said lot, thence westerly 50 feet
along Seminary Street, thence north-
easterly to the point of beginning.
Said jury did on the 12th day of
April, 1923, examine said premises
and make an award of the damages
to be allowed the owner of said prem-
ises and said sheriff has reported
the same to the City Council of the
City of Dubuque, Iowa; and
Whereas, in said award Theresa
Rose Tamlin the owner, of Said prop-
erty was awarded damages in the
sum of $300.00; now therefore
Be it resolved by the City Council
of the City of Dubuque, that said
award of the sheriff's jury and com-
mission be and the same is hereby
accepted.
Be it further resolved that a war-
rant in the sum of $300.00 be issued
in favor of Theresa Rose Tamlin, in
payment of the damages assessed by
said jury, and that the same be
placed in the hand of the sheriff
of Dubuque County, Iowa, to be by

for investigation and report.
I beg to advise that I have investi-
gated this location and see nothing
objectionable in the installation of
an air post at this location. 1 would
therefore recommend that permission
be granted to Thomas H. Mahara to
install air posts as per his request.

Gentlemen: The petition of the
Voelker Realty Company, dated Feb-
ruary 16th, 1923, was referred to the
City Manager about six weeks ago.
I beg to advise that in company
with Mr. Louis Kolfenbach, I went
out on the street Saturday last and
would recommend that Lots 95, 96 and
100 in Woodlawn Park Addition be
given no reduction. Also that Lots
47 and 48 in Tschrigi and Schwind's
Addition be given no reduction in
assessment. Lots 35, 36, 37 and 38
in Rosedale Addition, I would recom-
mend that the assessment be re-
ducted 50 per cent. Also that the as-
sessment on the two lots, 39 in Rose-
dale Addition and 75 in Woodlawn
Park Addition be reduced to $42.48.
Also that the assessment on lots 56
and 57 Woodlawn Park Addition be
reduced from $98.10 to $68.10. Also
that the assessment on lot 27 in
Tschirgi and Schwind's Sub - division
be reduced from $106.99 to $35.00.

Gentlemen: The request of the
Dubuque Bill Posting Co., per Louis
Murphy for permission to erect signs
in the alley lying east of Rhomberg
Avenue and north of Hamilton Street,
was referred to the City Manager
at the last meeting of the Council.
I would recommend that permis-
sion be granted to the Dubuque Bill
Posting Co., to erect bills along Gar-
field Avenue, between Whittier
Street (formerly Third Avenue) and
Emerson Street (formerly Fourth
Avenue) and also that permission be
granted to erect signs in the alley
between Rhomberg Avenue and Gar-
field Avenue, between Emerson
Street (Fourth Avenue) and Roose-
velt Street.
I do not believe the erection of
signs in this street and this alley
will be objectionable to anyone in
the neighborhood. I do feel that in
view of the fact that this location •
is sought by the company that an
annual rental should be charged in
case permission is granted.

buildings in the City just as bad,
but that Mr. Nagle owner of the
buildings will remove the buildings

street under the contract let to J.
• Rasmussen and Sons on bids receiv-
ed February 8th, 1923 and protest -
4.76 leg against the levying of any special
assessment against their property on
account of said improvement for the
following reasons:
Stating that the said contract is
illegal in that Rasmussen and Sons
disqualified themselves in bidding by
attaching a condition to their pro-
posal that they be awarded not less
than 60,000 yards, when condition-
al bidding was not called for in the
notice. That Rasmussen and Sons
was not low on 60,000 yards, their
bid being $9,593.47 while that of the
Des Moines Asphalt Co. was $8,-
958.69 or $634.73 less. If the City
Council intended to consider condi-
tional bids, the public notice to con-
tractors should have been so an-
nounced. They further petition the
Council to cancel the Rasmussen &
Sons contract, (there being no lia-
bility on the part of the City) and
proceed to readvertise for bids and
give the property owners the bene-
fit of what may reasonably be ex-
pected, a reduction of not less than
10 per cent in the contract price.
They feel that they are within their
rights in making this request, that
they have tried to approach the sub-
ject from a business point of view,
and ask the Council as their rep-
resentatives to do likewise, to the
end that their interest may be pro-
tected.

And whereas, Ott Rubber Co., a
corporation of Iowa with its princi-
pal place of business at Dubuque,
Iowa has offered to purchase said
real estate and agreed to pay there-
fore in cash the sum of $10,500.00,
said real estate to be used for the
erection of a manufacturing indus-
try thereon; and

by said Ott Rubber Co., for said land,
is a fair and reasonable one; now

Be it resolved by the City Council
of the City of Dubuque that the real
estate hereinbefore described be sold
to said Ott Rubber Company, for the

Clerk are hereby authorized and di-
rected to execute a warranty deed

chaser, said deed to be delivered to
said purchaser upon the payment by

709, was referred to the City Man-
ager.
I have investigated and find that
Ibis assessment was levied on Aug-
ust 2nd, 1902, the property then be-
longing to Carrie M. Waller. Two
payments were made on this assess-
ment, leaving a balance of $31.33 un-
paid.
This property was purchased by
the City of Dubuque on account of
said delinquent special assessment.
The charges now amount to about
$44.00.
I would respectfully recommend
that Mrs. Louise Frederick be ad-
vised that the tax title will be sur-
rendered to her on the payment of
the balance of $31.33 without inter-
est.
Her criticism as made was that
her attention was not called to the
fact that there was a delinquent spec-
ial assessment against this property,
when she acquired it. Of course had
she had an abstract made covering
this property her attention would
have been called to the fact that
there was at that time a delinquent

year, the city purchased a twenty -
two foot strip from the west end of
a lot belonging to Mrs. Westaby, for
the purpose of widening Avoca
Street. It is necessary to cut this
down perhaps ten feet. It would
seem to me that it might be a very
good time now to have this work
done. This filling can be used to
bring that part of Avoca Street along
the High School property, up to
grade.
I would respectfully . recommend

Manager to receive bids for this

Mr .Brown owns lot 185 in Wood -
lawn Park Add. He was assessed
for a sewer in Auburn Street last
year. The lateral, as is stated by
Mr. Brown in his letter, was to high
for him to use. He therefore had to
put in a second lateral in order to
take care of the drainage from his
house.
He asks for a remission in the
assessment for the lateral, the as-
sessment for the lateral amounted
to $6.50.
I would recommend that a check
be drawn from the general funds of
the City of Dubuque for the amount
in favor of Crawford T. Brown.

Mr. Louis Motulsky addressed the
Council stating that owing to the fact
that the building on the corner of
Sixth and Main Streets formerly oc-
cupied by him as a Clothing Store,
was declared unsafe by the Council,
he was forced out of business, that
the building still stands and is now
occupied by others, and that he did
not see that the building was over-
hauled, only by being painted, and
wanted to know if the building is
any safer now than it was when he
occupied it. The Clerk was author-
ized to notify the Chief of the Fire
Department, to inspect the building,
and report to the Council.

Council relative to the one man car
system, stating that one man cars
are now being operated in a great
many cities, and that the system is
giving good satisfaction, no action
taken, Council to look into the mat-
ter.
To the Honorable Mayor and Coun-
cil of the City of Dubuque, Iowa.
Gentlemen: On October 3, 1921,
the City of Dubuque entered into
an agreement with Charles Pfotzer
and J. H. Rhomberg relative to the
adjustment of taxes, special and reg-
ular, which were due and delinquent
upon property jointly owned by them.
The basis for the settlement was
that said Charles Pfotzer and J. H.
Rhomberg pay to the City of Du-
buque the sum of $949.95. The
amount that they actually owed at
that time was $1,136.96, but in view
of the fact that some of these taxes
been delinquent' for many years
it was deemed advisable to affect a
compromise. In my judgment the
compromise was an advantageous
one.
The amount due upon this con-
tract was to be paid on or before
December 15, 1921. On or about that
date Mr. Pfotzer and Mr. Rhomberg
paid each the sum of $100.00 and
no amount was paid since that time.
Recently I talked the matter over
with these gentlemen and suggested
that the amount which was still due
should be paid. The contract pro -
vided for interest at the rate of 6
per rent upon all unpaid balances
after December 15, 1921. On April
23rd I had a . conference with Mr.
Pfotzer and Mr. Rhomberg and they
paid to me for the City the sum of
$749.95 plus the accured interest of •
(66.99, making a total of $816.94.
This amount was in full of their
contract and I executed to them re-
ceipts for these payments. I beg
therefore that the resolution which
is hereto attached be passed and
adopted by you that in order that
the record may be completed with
reference to this transaction. At-
tached hereto you will find check
covering the amount stated.

ing certain offenses as misdemean-
ors and providing for the punish-
ment of violations thereof" the same

vised Ordinances of the City of Du-
buque, 1919, by adding thereto an
additional provision defining a dia-
orderly house and providing for a
punishment for the keepers thereof.
Be it ordained by the City Coun-
cil of the City of Dubuque.
Paragraph 558 -A. Disorderly
houses. Keeping.
Section 1. If any person, or per-
sons, firm or corporation maintains,
operates or controls, or is in charge
of any house, building or place
where intoxicating liquor is illegally
kept, sold or given away, or any
person who on behalf of some other
person, or persons, firm or corpora-
tion, illegally keeps, sells or gives
away any intoxicating liquor, in any
house, building or place, such per-
son or persons, firm or corporation
shall be guilty of a misdemeanor
and be punished by a fine of not to
exceed $100.00, or imprisoned not to
exceed thirty (30) days in jail.
Section 2. This Ordinance, being
deemed urgent and for the preserva-
tion of the public peace, health and
safety, shall be in force and effect
from and after its final passage and
adoption by the City Council and
publication as provided by law.
