mayor or Alderson stated that this is
the
regular monthly meeting of the
Council for the transaction of such
business as may regularly come be-
fore the meeting.
A communication of the play-
ground committee, stating what has
been done by the committee during
the past year, a budget for the ex-
penses they expect to have during
the coming summer, giving an out-
line of the needs of the committee,
and the amount to be appropriated
by the Board of Education, and ask-
ing that the City increase their
appropriation; also recommending
that Mrs. H. B. Gratiot be appointed
on the Board.
Councilman Gabriel moved that
the rules be suspended to allow any-
one present to address the Council.
Seconded by Councilman Brede.
Carried by the following vote:

Messrs. Frank Baumgartner and
Kisel Karberg addressed the Coun-
cil relative to the petition, stating
that they would like to install a play-
ground at the Lincoln School and
also one at the Marshall School,
which will cost more money, and
the appropriation the same as last
year will not be sufficient. They al-
so stated that they might be able to
get about $2,250.00 from the Board
of Education.
Councilman Brede moved that the
Council appropriate any amount
that the Board of Education will ap-
propriate, not to exceed $2,250.00.
Seconded by Councilman Melchior.

A communication of the Dubuque
Electric Co., relative to the one -man
car system, presented, stating that
as evidenced by the operating re-
Ports of their street railway depart-
ment for some time past there is a
pressing need for financial relief of
some source. That in addition to
this they find themselves confronted
with an application from their street
car employees for an increase of

wages, that they do not believe it in
their power to increase revenue by
an increase in fares, and it is simply
a question of reducing operating ex-
penses to allow an increase in the
wage scale. They feel that a consid-
erable economy may be effected by
one -man car operation and at the
same time offer the public more
satisfactory service. They feel that
the Dodge- and - Linwood, and the Ea-
gle Point lines are well adapted for
one -man operation and desire per-
mission to give the matter a fair
trial on these lines. Mr. T. E. Par-
ker, general manager, addressed the
Council on the merits of the peti-
tion. Action on this matter was de-
ferred to the next meeting of the
Council.
Louis Kuehnle addressed the Coun-
cil and submitted plans and specific-
ations asking that the Council grant
the Leader Oil Co. the privilege to
erect a gasoline filling station near
19th street and Central avenue, the
same as the one erected by the com-
pany on the corner of 8th street and
Central avenue.
Council Brede moved that the
prayer of the petition be granted.
Seconded by Councilman Melchior.

Notice is hereby given that on
March 9th, 1923, at about 9:30
o'clock P. M., Rosa Trilk, while walk-
ing on the east side of Main street
at the nrotheast corner of 5th street,
fell on a defective sidewalk and
broke her right arm a few inches
above the wrist. She therefore claims
from the City of Dubuque the sum

Communication of the Dubuque
Chamber of Commerce recommend-
ing that a River and Harbor Com-
mission be appointed, stating that
the Chamber of Commerce feels that
the time is ripe to obtain a share of
the funds appropriated by the recent
River and Harbors bill of Congress
and that steps should be taken to
make sure that the money will be
set aside to improve the harbor and
river front at Dubuque. The officers
and directors of the Chamber are
convinced that Dubuque will only
get a share of this money by going
after it in a forceable manner and
believe that a River and Harbor
Commission should be appointed for
the purpose of outlining plans for
river and harbor development cover-
ing a number of years. The Council
took no action, deeming it advisable
to leave the matter entirely in the
bands of the Chamber of Commerce.

completed, all excepting some of the
backfilling and repairing of the
crossings at some of the intersecting
streets.

of the City of Dubuque that the
recommendation of the Manager be
approved and that the City Engineer
be and he is hereby instructed to
prepare a plat and schedule showing
the lots or parcels of real estate
subject to assessment for said im-
provement and file the same in the
office of the City Clerk subject to
public inspection, and the City Clerk
shall upon receipt of such plat and
schedule publish a notice of the as-
sessment as required by law.

Gentlemen: At the meeting of the
Council held on April 30th, a peti-
tion of property owners asking for
a number of things in connection
with Algona street, was referred to
the City Manager.
First, the request is made that Al-
gona street be extended north to
Rosedale avenue. I think this is
most desirable and should be effect-
ed as soon as possible.
Second, the request is made that
Algona street be paved from West
14th street to Rosedale avenue.
Sewer, water and gas are now in
Algona street as far as from West
14th street to Delaware street. The
stretch from Delaware to Rosedale is
not supplied with either sewer, wa-
ter or gas. The street certainly
should be paved as soon as the ex-
tension is made and utilities are
placed on the ground. Scarcely any
real benefits will accrue from paving
Algona street until the same can be
laid through to Rosedale avenue and
Rosedale avenue is also improved to
furnish improved streets clear to the
new high school.
Third, • the request is made that
the Council order the poles of the
Dubuque Electric Co. moved from
Algona street to the alley between
Algona and Auburn street. This last
request I do not feel is practical at
this time. I appreciate the fact that
th poles are more or less objection-
able, but the City must cause the
streets to be lighted and unless the
property owners wish to take care
of some other method of lighting the
street than from the arc lights which
are now supplied it would not be

practical to move the pole line off
the street.

Gentlemen: Some time ago a peti-
tion of property owners on Shiras
avenue, north of the entrance to
Eagle Point Park, was referred to
the City Manager for investigation
and report.
Since that time other property
owners have called on me to protest
against the improvement.
I have been out over the street and
feel that the improvement unques-
tionably should be made. In fact all
of the property owners want the
street improved, but do not feel like
paying for the cost of the same.
After going over the pros and cons
of the matter, I would make the fol-
lowing recommendation.
First, that the City grade the
street. Second, that they haul and
place as a Telford base for a bitum-
inous macadam pavement, the gutter
rock discarded by the contractor in
connection with other street improve-
ments this year. Third, that later
in the year, a contract be retained
for the laying of a 3 -inch bituminous
surface on the Telford base prev-
iously placed by the City.
The City has some obligation to
perform to make this street passa-
ble. The property owners are, some
of them, unable to pay for the cost
of the improvement. In handling it
this way the assessed cost will not
be over $1.00 per front foot abutting
on the street. I believe this will be
within the means of most of the
property owners and will come un-
der the 25 per cent of the actual
value of the property. I also know
that the people living beyond the
city limits are anxious enough to
have this improvement made to aid
some of the property owners who
themselves would have difficulty in
meeting an assessment of even $1.00
per front foot.
In the above recommendation it is
expected that an 18 -foot bituminous
macadam roadway will be construct-
ed about 4 feet from the west prop-
erty line of this 40 -foot street and
that the waterway will be crowded
ever to the east 14 feet of the street.
If this plan meets with the approval
of the Council. we will start work on
the grading within a few days.

large number of sewers petitioned
for in the past few months. Work
is proceeding satisfactorily on the
big proposition for supplying Bag
Point with sewerage facilities. There
remains the necessity of securing
right -of -way over a considerable pri-
vate property, which will be done as
rapidly as possible.
The Engineer, however, has pre-
pared plans covering the following
sewer extensions:
Julien avenue district which in-
cludes Julien avenue from Wood
street to Delhi street; Stewart street
from Julien avenue to Delhi street;
Atlantic street from Julien avenue
nearly to West 14th street; Auburn
street from Delhi street nearly to
West 14th street; Auburn street
from Delhi street nearly to West
14th street; Custer street from Al-
gona street to Atlantic street.
Stafford street from Merz street
to Ries street; Pleasant street from
Stafford street to Viola street; Hen-
nepin street from Windsor avenue
down to Brecht's Lane, and from
Brecht's lane to Stafford street.
Alley between Forest Lane and
West 5th street from Glen Oak
street to the end of the alley.
West 16th street from Cornell
street to Catherine street and in
Catherine street to West 17th street.
The above plans are completed. I
would therefore request authority to

Gentlemen: Considerable repairs
on our asphalt and bitulithic streets
should be eeded on Bluff Repairs street,
ularly Main
street, Fourth street, Locust street
and Rhomberg avenue. Probably be-
tween two and three thousand yards
of repairs are necessary.
I requested prices from the J. F.
L Paving Co. and also from J.
Rasmussen & Sons Co. for doing
this work. The bids were received
on Monday, May 7th.
J. F. Lee Paving Co., quote a price
of $13.50 per ton for this work with
the exception of small patches of
five yards or less in isolated places,
on which a price of $17.50 per ton is
quoted. The mix used is to be the
same as last year.

stated that service thereof had been

called for the purpose of consider-
ing for adoption a resolution to grant
the Dubuque Electric Co. the right
to operate one -man cars and acting
on any other business that may come
before the meeting.
Councilman Brede offered the fol-
lowing resolution and moved its
adoption:
Resolution.
Whereas the Dubuque Electric Co.
filed a request with the City Council
of the City of Dubuque to be grant-
ed permission to install one -man car
operation upon the Eagle Point and
the Dodge- and - Linwood lines and
Whereas, there is now in force and
effect in the City of Dubuque an or-
dinance requiring both a motorman
and conductor to operate all street
cars, said ordinance being Ordinance
No. 41 of the Revised Ordinances of
the City of Dubuque, 1919; and
Whereas, It is deemed advisable
by the City Council of said city, that
said Dubuque Electric Co. be afford-
ed an opportunity of establishing
the value and efficiency of one -man
car operation;
It is therefore resolved that said
Dubuque Electric Co. be and it is
bereby authorized to install and
operate one -man car operation on
the Eagle Point and the Dodge -and-
Linwood lines, with the express
understanding that this permission
or privilege shall be revoked by the
City Council whenever it is proved
to the satisfaction of the City Coun-
cil that such operation is not in the
interest of the safety of the people
of Dubuque, it being understood that
this privilege may be revoked with
in a year from the date hereof.
Be it further resolved that during
the time that the privilege herein
conferred is not revoked, the terms
and conditions of the ordinance
above referred to shall be suspend-
ed and the penalty not enforced.

by electricity will be more econom-
ical than by steam; and
Whereas, satisfactory arrange-
ments can be made with the Du-
buque Electric Co. to supply the City
of Dubuque with electrical energy to
operate its waterworks system; now
therefore
Be it resolved that a contract be
entered into by and between the City
of Dubuque and the Dubuque Elec-
tric Co. for the furnishing of elec-
tricaI energy to operate the water-
works system for a period of ten
years, said contract being hereto at-
tached and made a part hereof.
Be it further resolved that this
resolution and contract be placed on
file for one week with the City
Clerk for public inspection, after
which time this resolution shall be
considered for final action and
adoption.
Be it further resolved that after
this resolution is finally passed and
adopted, the Mayor shall and he is
hereby directed to execute said con-
tract on behalf of the City, which
contract shall be attested by the
City Clerk and sealed with the great
seal of the said City of Dubuque.

Petition of the Federal Building
Co., asking permission to construct
a sanitary sewer extending from the
property line of their property on
the southwest corner of Ninth and
Main streets and extending down
Ninth street connecting at a certain
manhole with a sewer in the alley
between Main and Iowa streets, and
requesting that action be taken on
this petition at the earliest possible
moment, as the work has been sus-
pended on account of a misunder-
standing in relation to using the ex-
isting sewerage system.
Having been advised by competent
engineers that a private sewer would
he the safest and most satisfactory,
because of the limitations of the
sewer as installed (which is but 8
inches in diameter), and desiring to
avoid any controversy of future com-
plications with the owners of the
existing sewer with which they were
directed to connect. Presented.
Councilman Brede moved that the
rules be suspended to allow any one
present to address the Council. Sec-
onded by Councilman Melchior. Car-

Gentlemen: On the 9th day of De-
cember, 1895, an assessment was le-
vied for the improvement of Locust
street. The north 35 feet of City
Lot 477, owned by J. H. Shields, was
assessed for $204.56.
On December 10th, 1898, $96.76 on
the principal and $17.46 on the in-
terest was paid. This was all that
Mr. Shields felt he should have paid
for the improvement as the City as-
sessed the entire cost of the inter-
section to the four adjacent lots,
which under his contention was not
in accordance to the benefits.
This property was advertised for
sale in December, 1920, and pur-
chased by the City at an adjourned
sale. Mr. Wm. Lawther, Jr., wishes
to clear any cloud on the title to
this property and for that reason
offers to pay the sum of $50.00 as
settlement in full for the sale. His
check is now in my hands made out
in favor of the City Treasurer, for
this purchase.

City of Dubuque and the assessment
to them of the sum of $1.00 per
front foot, that they waive all the
formalities required by law to be
done by the City of Dubuque pre-
liminary to the construction of said
improvement and the levying of an
assessment to pay therefor; and
agree to pay the assessment which
the City of Dubuque will levy upon
their property to pay the same on a
basis of $1.00 per front foot, and fur-
ther agree that they will make no
objecjion to the assessment and will

To the Honor Mayor and Coun-
cil of the City of Dubuque:
Gentlemen:
Agnes Field fell on an icy side-
walk caused by an overhanging
broken waterspout at the corner of
12th and Jackson streets on Janu-
ary 18, 1922, and as a result of such
fall sustained Injuries which pro-
duced a miscarriage. Suit was
brought against the City in the sum
of $15,000.00. The case was called
for trial at the present term of Court
and from all the facts and circum-
stances surrounding the nature of
the injury and the cause thereof it
was deemed advisable by me to af-
fect a settlement in the case. The
settement agreed upon is the pay-
ment to the plaintiff of the sum of
$1,500.00. The plantiff to pay the
costs of the suit.
In view of the circumstances sur-
rounding this action I believe that
this settlement is an advantageous
one to the City and should receive
the approval of the council. I there-
fore recommended that a warrant be

drawn in favor of Wells Rupert, at-
torney for plaintiff, in the sum of
$1,500.00 in full settlement of the in-
jury sustained by the plaintiff as
above stated.

SPECIAL ORDINANCE.
An Ordinance granting Federal
Building Company, its successors
and assigns, permission to con
struct, maintain a private sewer in
West Ninth street in the City of
Dubuque and regulating the use
thereof.
Be it ordained by the City Coun-
cil of the City of Dubuque:
Section 1. That permission be
and the same is hereby granted the
Federal Building Company, its suc-
cessors and assigns, a corporation
of Iowa and located at the southwest
corner of Main and West Ninth
streets, to maintain and construct a
private sanitary sewer in West
Ninth street extending from the
present location of the building at
the southwest corner of West Ninth
street to the manhole at the pres-
ent location in West Ninth street at
the alley between Main ard Iowa
etreets, said sewer to be construct -
ed of standard materials, but not
less than eight (8) inches in diam-
eter and constructed and maintain-
ed at the expense of the grantees,
its suc ^es; or, and assigns herein,
he permission hereby granted being
sanject to the conditions nerelu pr.
vided for.
Section 2. The City of Diib, •rut
does not assume any obligation; to
repair or naintain said ewer but
all expenses incident to such repair
or maintenance which said City
might be called upon to make shall
be charged to the grantee, its suc-
cessors or assigns, herein, and
should said City at any time find it
necessary or advisable to order or
construct a new sewer or a public
sewer on said West Ninth street,
permission to the laying of the pri-
vate sewer herein provided for shall
not be deemed to be a waiver on the
part of said City of the right to
make a legal assessment for said
new sewer upon the property of the
grantee, its successors or assigns,
herein.
Section 3. By accepting the terms
hereof said grantee; its successors
and assigns shall at all times hold
said City safe and harmless from
any damages, costs or expenses to
which the City may be put in any
manner for any reason by reason
of the construction, existance and
maintenance of the sewer herein au-
thorized. In order that said City
may be protected against loss or
damages during the construction of
said sewer and as a guarantee that
the pavement which it will be nec-
essary to disturb in order to con-
struct said sewer in the street, will
be replaced in a satisfactory man-
ner and will be maintained for a
year after the completion of said
sewer by the grantee, its successors
and assigns, hereunder said grantee,
its successors and assigns shall be
required to furnish said City with a
surety bond in the sum of $5,000.00,
said bond being conditional, first, to
save the City harmless from any
damages to personal property on ac-
count of the construction of said
sewer, and second, as a guarantee
that the grantee, its successors and
assigns will replace all pavement
removed in a proper manner and
leave the same in as good condition
as it was before disturbed, and
third, that any pavement removed
will be maintained for one (1) year,
the grantee, its successors and as-
signs being required to repair any
defects occurring in the street as a
result of said sewer being built in
the street for one (1) year subse-
quent to its completion.
Section 4. Whenever it may be
found necessary or advisable to
grant other persons the right to con-
nect with this sewer herein author-
ized the City Council may author-
ize such connections to be made,
but such permission shall not be
granted by the City Council except
upon and with the understanding
that such persons shall pay to the
grantee, its successors and assigns,
herein their proportionate share of
the original cost of constructing
said sewer and maintaining the
same, such charge to be determined
by the City Engineer. Extensions
to or connections with said private
sewer may also be ordered by the
City Council upon the same terms
and conditions as herein provided
for.
Section 5. Before the sewer is
constructed a plan or sketch there-
of shall be filed with the City Coun-
cil for its approval and said sewer
shall not be constructed in any
manner other than that authorized
by said Council.
In the construction of said sewer,
said grantee, its successors and as-
signs shall be charged with the re-
sponsibility of seeing that the work
is done in a workman -like manner
and in such a way as not to unnec-
essarily delay or obstruct traffic,
and it shall be completed as speed-
ily as possible. If at any time it
should appear that the work is be-
ing negligently done or is being un-
necessarily delayed, or traffic is be-
ing unnecessarily interfered with or
obstructed, the Council may at its
option recall the permission herein
granted and stop said work.

ized sworn statement of the actual
cost of the construction of said
sewer, which statement shall be
filed as soon after the work is com-

such statement shall be deemed to
constitute a waiver of said benefits,
and the City shall thereafter be au-
thorized to permit any person or
corporation to connect with said
sewer without cost.
Section 7. This ordinance being
deemed urgent and of immediate
necessity shall be in force and ef-
fect from and after its passage and
adoption by the City Council and its
publication in the official newspa-
pers of said City, and when written
acceptance by Federal Building
Company has been endorsed hereon.

levied upon adjoining lots and
tracks of railways on Iowa street,
between First and Third streets in
the City, for brick paving on Iowa
street.
The various amounts of assess-
ments were subsequently changed,
and as shown by the correspondence
the I. C. R. R . Company paid
$1,341.98 in payment of the assess-
ment for the improvement adjacent
to and between tracks. It appears
that a portion of this assessment
was not cancelled in the sum of
$322.27. The treasurer has made a
demand for the payment of this as-
sessment levied March 25th, 1910.

As your Health Officer, 1 desire
to call your attention to a condition
relative to the City Milk supply that
is of immediate importance.
All dairy herds supplying raw
milk at retail have, within the past
year and a half, been tuberculin
tested.
Some few dairy herd owners have
of their own accord, applied and re-
ceived a retest, free, from the Fed-
eral agents now operating in the
community.
The findings of tubercular react-
ing dairy cows in large number in
some of these herds supplying raw
milk indicates that the former test
was unreliable or some very infecti-
ous animals were added to the test-
ed herd after the test was made.
According to Section 12 of the
Milk Ordinance enacted late in the
year 1921 it lies within the Power of
the Board of Health to require that
this test be applied once each year
or oftener if they deem it necessary
for the protection of the Public
Health.

Honorable body give this matter

Wheras, the contract for the in.
stallation of sewer, water and gas
connections in Melrose Terrace from
the east line of Alpine Street to the
east line of Paulina street, has been
completed, and
Whereas, the City Manager has ex-
amined said work and recommended
its acceptance, now therefore
Be it resolved by the City Council
commendation of the City Manager
of the City of Dubuque that the re-
be approved and that the City Engi-
neer be and he is hereby instructed
to prepare a plat and schedule show-
ing the lots and parcels of real es-
tate subject to assessment for said
improvement and file the same in
the office of the City Clerk subject
to public inspection, and that the
City Clerk shall upon receipt of such
plat and schedule publish the notice
of said assessment as is required by
law.
