The Dubuque City Council met in special session at 5:00 p.m. on May 3, 2021.
Due to the COVID-19 pandemic and mandates for social distancing, this meeting was con-

Mayor Buol read the call and stated this is a special session of the City Council called for the
purpose of conducting work sessions to receive updates on cyber security and the COVID-19
pandemic.

City staff and network partners provided updates on the internal and community -facing re-
sponses to the COVID-19 pandemic.

Update on vaccine distribution, call center and outreach to marginalized communities: Rick
Steines, Fire Chief; Cori Burbach, Assistant City Manager; and Kelly Larson, Human

Community Partner Presentations: Jenna Manders, Director of Strategic Relations at the
Community Foundation of Greater Dubuque
The presenters responded to questions from the City Council following their presentations.
City Council expressed interest in coordinating with the Dubuque County Board of Supervisors
on the sunset date of the Face Covering Ordinance. Mayor Buol requested the next City Council
meeting contain an agenda item or work session related to the Face Covering Ordinance.
There being no further business, Mayor Buol declared the meeting adjourned at 6:20 p.m.

4. Approval of City Expenditures: City Manager recommended City Council approval for pay-
ment of City expenditures. Upon motion the documents were received and filed and Resolution
No. 133-21 Authorizing the Director of Finance and Budget/City Treasurer to make certain pay-
ments of bills that must be paid and approved for payment in accordance with City procedures
was adopted.

AUTHORIZING THE DIRECTOR OF FINANCE AND BUDGET / CITY TREASURER TO MAKE
CERTAIN PAYMENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR PAYMENT
IN ACCORDANCE WITH CITY PROCEDURES
Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that the
Finance Director -City Treasurer shall keep an accurate account of all disbursements, money, or
property, specifying date, to whom, and from what fund paid; and
Whereas, the invoices, presented by those firms and persons providing such goods and ser-
vices have been pre -audited by Finance Department personnel in accordance with generally
accepted internal control procedures and have been determined to have been requisitioned for
a lawful municipal purpose; and
Whereas, the Finance Director -City Treasurer has provided a list of Expenditures attached
hereto, and by this reference made a part hereof, to be drawn to pay for goods and services
provided for City purposes; and
Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142-18
adopted May 7, 2018, authorized the Finance Director -City Treasurer to issue checks in pay-
ment of certain expenditures known as Exception Expenditures prior to City Council approval
and such list is attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA THAT:
Section 1. The Finance Director -City Treasurer is hereby authorized to issue payment for
goods and services provided for City purposes in response to the purchase orders and contracts
issued in compliance with state and municipal code requirements as requested by designated
requisitioning authorities in accordance with approved budget appropriations.
Section 2. In accordance with Iowa Code Section 372.13(6), the City Clerk and Finance Di-
rector are hereby authorized and directed to provide the statement of receipts and disburse-
ments to the City Council, and to publish a summary thereof.

5. Resolution Approving the Consent to Assignment and Assumption in the Matter of the
Development Agreement by and among the City of Dubuque, Giese Properties, L.L.C., and
Giese Manufacturing Company, Inc.: City Manager recommended approval of the consent to
the assignment by the Developer, Giese Properties, L.L.C., of its rights and obligations in the
Development Agreement dated April 19, 2021, by and among the City of Dubuque, Giese Prop-
erties, L.L.C., and Giese Manufacturing Company, Inc., to MBMSD, LLC. Upon motion the doc-
uments were received and filed and Resolution No. 134-21 Approving the assignment of the
Development Agreement by and among the City of Dubuque, Giese Properties, L.L.C. and

APPROVING THE ASSIGNMENT OF THE DEVELOPMENT AGREEMENT BY AND AMONG
THE CITY OF DUBUQUE, GIESE PROPERTIES, L.L.C. AND GIESE MANUFACTURING
COMPANY, INC BY GIESE PROPERTIES, L.L.C. TO MBMSD, LLC
Whereas, the City Council of the City of Dubuque, Iowa on April 19, 2021, approved a Devel-
opment Agreement by and among the City of Dubuque, Giese Properties, L.L.C. and Giese
Manufacturing Company, Inc. as Developer; and
Whereas, pursuant to the terms of the Development Agreement, City will convey to Developer
and Developer is required to provide certain improvements to real estate legally described as:
Lot 1 of Dubuque Industrial Center North First Addition, in the City of Dubuque, Iowa; and
Whereas, Giese Properties, L.L.C. as Developer desires to assign all of its rights and obliga-
tions under the Development Agreement to MBMSD, LLC and MBMSD, LLC desires to accept
such rights and obligation on the terms and conditions set forth in the Assignment of Develop-
ment Agreement attached hereto; and
Whereas, the Development Agreement requires the consent of City to an assignment; and
Whereas, the City Council finds that consent to the Assignment of Development Agreement
is in the best interest of the City of Dubuque.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. The Assignment of Development Agreement is hereby approved.
Section 2. The Mayor is hereby authorized and directed to execute the Assignment of Devel-
opment Agreement on behalf of the City of Dubuque.
Section 3. The City Clerk is authorized and directed to record this resolution and the Assign-
ment of Development Agreement with the Dubuque County Recorder.

6. First Amendment to Grant Agreement between the City of Dubuque and Friends of Para-
dise Church to Redevelop Property at 2501 Jackson Street: City Manager recommended City
Council approval of a First Amendment to Grant Agreement between the City of Dubuque and
Friends of Paradise Church for rehabilitation of 2501 Jackson Street. Upon motion the docu-
ments were received and filed and Resolution No. 135-21 Approving the First Amendment to
Grant Agreement between the City of Dubuque, Iowa and Friends of Paradise Church was
adopted.

Whereas, the City of Dubuque (City) and Friends of Paradise Church (Grant Recipient) pre-
viously entered into a Grant Agreement dated May 4, 2020 for the redevelopment of 2501 Jack-
son Street in the City of Dubuque, Iowa (the Project); and
Whereas, City and Grant Recipient desire to amend the Grant Agreement as set forth in the
attached First Amendment to Grant Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. That the First Amendment to Grant Agreement between the City of Dubuque, Iowa
and Friends of Paradise Church, a copy of which is attached hereto, is hereby approved.
Section 2. That the Mayor is hereby authorized and directed to execute the First Amendment
to Grant Agreement on behalf of the City of Dubuque and the City Clerk is authorized and di-
rected to attest to his signature.
Section 3. That the City Manager is authorized to take such actions as are necessary to
comply with the terms of the First Amendment to Grant Agreement as herein approved.

7. University of Iowa Data Transfer and Use Agreement: City Manager recommended ap-
proval for the Bee Branch and Healthy Homes Program to enter into a Data Transfer and Use
Agreement with the University of Iowa. Upon motion the documents were received and filed,
and Resolution No. 136-21 Approving a Data Transfer and Use Agreement with the University
of Iowa for the National Disaster Resiliency Grant Review requested by the US Department of
Housing and Urban Development was adopted.

APPROVING A DATA TRANSFER AND USE AGREEMENT WITH THE UNIVERSITY OF
IOWA FOR THE NATIONAL DISASTER RESILIENCY GRANT REVIEW REQUESTED BY
THE US DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
Whereas, the City of Dubuque was award National Disaster Resiliency Competition grant
funds to improve the flood resiliency of homes and persons residing in them; and
Whereas, the U.S. Department of Housing and Urban Development (HUD) commissioned a
grant opportunity to study the effectiveness of National Disaster Resiliency Grantees ability to
meet outcomes stated; and
Whereas, the University of Iowa was awarded the grant opportunity by HUD and requires the
use of the City's Bee Branch Healthy Homes data to meet HUDs stated goals of the grant.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA, AS FOLLOWS:
Section 1. The City Council approves the Data Transfer and Use Agreement with the Univer-
sity of Iowa.
Section 2. The City Council authorizes the City Manager or the City Manager's designee to
manage the agreement and act in accordance with the terms of the agreement.

8. FY2022 Planning Services Department - Increased Fees (4%): City Manager recom-
mended approval of a 4% increase for Fiscal Year 2022 Planning Services Department fees.

RESCINDING RESOLUTION NO.46-18, ESTABLISHING A SCHEDULE OF DEVELOPMENT
SERVICES FEES, AND ADOPTING IN LIEU THEREOF A NEW SCHEDULE OF DEVELOP-
MENT SERVICES FEES AS PROVIDED IN TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE
Whereas, the City Council of the city of Dubuque, Iowa establishes by resolution certain fees
for development services pursuant to the Unified Development Code, pursuant to the attached
schedule of Development Services Fees for the Planning Services Department.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. Resolution No. 46-18 and its Schedule of Fees is hereby rescinded effective July
1, 2021.

9. Recommendation in Response to City of Sageville Annexation Proposal: City Manager
transmitted information about the City of Sageville annexation history and recommends that the
City Council direct the City Manager to forward this information onto the City Development Re-
view Board. It is further recommended, regarding the most recent annexation request from the
Sageville City Clerk/Treasurer, that the City of Dubuque take a neutral position (neither for nor
against) the proposed annexation. Upon motion the documents were received, filed and ap-
proved.
10. Thank You Letter to Greater Dubuque Development Corporation (GDDC) from the Dubu-
que County Public Health Incident Management Team (IMT): Correspondence from the Dubu-
que County Public Health Incident Management Team (IMT) acknowledging Greater Dubuque
Development Corporation (GDDC) and its partners in assisting the IMT with vaccination of es-
sential workers in the community. Upon motion the documents were received and filed.
11. Improvement Contracts / Performance, Payment and Maintenance Bonds: 2021 Asphalt
Overlay Ramp Project Two; 2021 Asphalt Overlay Ramp Project Three; Eagle Point Park Bridge
Pavilion Roof Replacement Project. Upon motion the documents were received, filed and ap-
proved.
12. Signed Contract(s): Vendor Service Agreement with Graymont Western Lime for Eagle
Point Water Plant High Calcium Quicklime. Upon motion the documents were received and filed.
13. DuRide Financial Support Related to Free Rides to COVID-19 Vaccine Clinics: City Man-
ager recommended a one-time payment to DuRide for $5,000, recognizing them for the free
rides they have been providing all Dubuque area residents to COVID-19 vaccine clinics. Upon
motion the documents were received, filed, and approved.
14. Acceptance of the City Hall Sidewalk Heating Boilers and Sensor System: City Manager
recommended acceptance of the construction contract for the City Hall Sidewalk Heating Boilers
and Sensor System, as completed by Portzen Construction, in the final contract amount of
$77,106. Upon motion the documents were received and filed and Resolution No. 138-21 Ac-
cepting the City Hall Sidewalk Heating Boilers and Sensor System and authorizing the payment
to the contractor was adopted.

Whereas, the public improvement contract for the City Hall Sidewalk Heating Boilers and

Sensor System, (the Project) has been completed by the Contractor, Portzen Construction, Inc.
(Contractor), the City Engineer has examined the work and recommends that the Project be
accepted; and
Whereas, the final contract amount for the Project is $77,106.00; and
Whereas, the Contractor has previously been paid $69,395.40, leaving a balance of
$7,710.60; and
Whereas, the City Council finds that the recommendation of the City Engineer should be
accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is hereby
accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the balance of the
retainage of $7,710.60 as provided in Iowa Code chapter 573, and to pay such retainage in
accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.

15. Dubuque Smart Traffic Routing with Efficient & Effective Traffic System (STREETS) Pro-
ject Vendor Selection: City Manager recommended approval of the selection of PARSONS as
the consultant to provide services to design and implement the Smart Traffic Routing with Effi-

Whereas, Bishop's Block Limited Partnership, an Iowa limited partnership (Bishop's Block),
is the owner of the property at 90 Main Street, Dubuque, Iowa, legally described as follows:
Lots 1 and 2 of the West 1/2 of Block 1 of Dubuque Harbor Co's Addition, in the City of
Dubuque, Iowa, according to the recorded plat thereof, and Lot 531 and the North'/2 of Lot
532 in the City of Dubuque, Iowa, according to the United States Commissioner's Map of
the Town of Dubuque, Iowa (the Property); and
Whereas, the City of Dubuque (City) entered into an Amended and Restated Loan Agreement
(the Loan Agreement) dated March 5, 1999, as amended, with Bishop's Block; and

Whereas, pursuant to the Loan Agreement, City loaned to Bishop's Block $350,000 secured
by a Promissory Note and Mortgage on the Property dated March 5, 1999 filed May 7, 1999,
Instrument Number 7663-99, Records of the Dubuque County, Iowa Recorder; and
Whereas, the Note and Mortgage remain unsatisfied; and
Whereas, Bishop's Block has entered into a Real Estate Sales Agreement to sell the Property
to Affordable Housing Network, Inc. (AHNI); and
Whereas, the Loan Agreement requires City to consent to the sale of the Property; and
Whereas, City and AHNI have tentatively entered into a Development Agreement with City
for to the Property, a copy of which is attached hereto; and
Whereas, pursuant to the Development Agreement City agrees to consent to the sale of the
Property, terminate the Loan Agreement, cancel the Note and release the Mortgage, subject to
the terms and conditions set forth in the Development Agreement; and
Whereas, approving the Development Agreement releasing the Mortgage requires a public
hearing; and
Whereas, the City Council finds that it is in the best interests of the City of Dubuque to ap-
prove the Development Agreement including the release of the Mortgage.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. The City Council of City intends to dispose of City's interest in the foregoing -de-
scribed real property pursuant to the proposed Development Agreement including the release
of the Mortgage.
Section 2. The City Clerk is hereby authorized and directed to cause this Resolution and a
Notice to be published as prescribed by Iowa Code § 364.7 of a public hearing on City's intent

2. Sale of City -Owned Property at 1659 Iowa Street: Proof of publication on notice of public
hearing to consider City Council approval of the disposition of City -owned real property located
at 1659 Iowa Street to GT Investments for $100, and City Manager recommended approval.
Motion by Cavanagh to receive and file the documents and adopt Resolution No. 142-21 Dis-
posing of City interest in real estate located at 1659 Iowa Street, in the City of Dubuque, Iowa.
Seconded by Roussell. Tim Johnstad, 1255 Southern Ave., questioned the low price of the
property sale and requested the City Council reject this proposal and issue a new RFP. Housing
and Community Development Director Alexis Steger stated that this property must be rehabili-
tated quickly due to the roof collapsing. City Manager Van Milligen stated that the City often
acquires properties that are not in a good state, frequently leading to demolishing the properties
or paying property owners to acquire them. City Attorney Brumwell provided an overview of the
petition process. City Council expressed concern over acquiring properties with significant dis-
repair and referenced City Council's recent discussions on historic properties. Motion carried 7-
0.

5. Proposed Change to Building Code Amendments Modifying Window Sill Height Require-
ments for Existing Properties: City Manager recommended City Council approval of an amended
ordinance to adopt changes to the International Property Maintenance Code and the Interna-
tional Existing Building Code. Motion by Jones to receive and file the documents and that the
requirement that a proposed ordinance be considered and voted on for passage at two Council
meetings prior to the meeting at which it is to be passed be suspended. Seconded by Cavanagh.
City Council expressed support of the amendments as a solution to necessary changes that
considers the City's diverse housing inventory. Motion carried 7-0.
Motion by Jones for final consideration and passage of Ordinance No. 17-21 Amending City
of Dubuque Code of Ordinances Title 14 Building and Development, Chapter 1 Building Codes,
Article J Property Maintenance Code, Section 14-1J- 2 International Property Maintenance
Code Amendments; and Ordinance No. 18-21 Amending City of Dubuque Code of Ordinances

AMENDING CITY OF DUBUQUE CODE OF ORDINANCES TITLE 14 BUILDING AND DE-

CODE, SECTION 14-1J-2 INTERNATIONAL PROPERTY MAINTENANCE CODE AMEND-
MENTS
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. Section 14-1J-2 of the City of Dubuque Code of Ordinances is amended to read
as follows:
14-1J-2: INTERNATIONAL PROPERTY MAINTENANCE CODE AMENDMENTS:
The following additions, deletions, modifications, or amendments of the International Property
Maintenance Code, 2018 edition, adopted in section 14-1J-1 of this article to read as follows:

Section 702.4. Emergency escape openings. Amended to read:
702.4. Emergency escape openings. Required emergency escape and rescue openings
shall be operational from the inside of the room without the use of keys, tools, or special
knowledge. Bars, grilles, grates or similar devices shall be permitted to be placed over emer-
gency escape and rescue openings provided that the minimum net clear openable area is
met and such devices shall be releasable or removable from the inside without the use of a
key, tool, special knowledge, or force greater than that which is required for normal operation
of the escape and rescue opening.
Where required, existing emergency escape and rescue openings shall have a minimum
net clear opening of 4.0 square feet. The minimum net clear opening height dimension shall
not be less than 24 inches. The minimum net clear opening width shall not be less than 20
inches. The net clear opening dimensions shall be the result of normal operation of the open-
ing.
Exception: Window replacements permitted between April 11, 2016 and the effective date
of this ordinance that serve as the required emergency escape and rescue opening will be
allowed to remain as long as they meet the following requirements:
a. Window was permitted as required by the City of Dubuque.
b. Window was approved as code compliant as documented by the City of Dubuque.
When windows are provided as the emergency escape and rescue opening they shall
have a finished sill height not more than 48 inches above the floor. An existing finished sill
height may exceed 48 inches (1219 mm) above the floor if the following conditions are met:
a. A platform capable of supporting a live load of 300 pounds shall be permanently
affixed at the interior of the structure. This platform shall be no lower than 20 inches (508
mm) above the floor and no higher than 36 inches (914 mm) above the floor. The distance
from the platform to the finished sill height shall not exceed 36 inches (914 mm). The
platform shall extend outward from the wall a minimum of 24 inches (610 mm) and shall
be at least as wide as the clear openable width of the window, or another approved
method/platform.
b. The emergency escape or rescue window shall comply with International Residential
Code Section R310.2.
c. The building is equipped with smoke alarms installed in accordance with International
Residential Code Section R314.
Section 2. This ordinance shall take effect upon publication.

6. Greater Dubuque Development Corporation - Board of Directors Membership: Corre-
spondence from the Greater Dubuque Development Corporation requesting confirmation of City
of Dubuque representation on its Board of Directors for terms starting July 1, 2021 through June
30, 2022. Motion by Roussell to receive and file the information and refer to City Council. Se-
conded by Farber. Council Members Roussell and Resnick both confirmed their interested in
continuing to serve on the Board of Directors. Council Member Jones suggested Council Mem-
ber Roussell amend the motion to re -appoint the members currently serving on the Board of
Directors. Council Member Roussell amended the motion for Mr. Resnick and herself to con-
tinue serving in their roles on the Board of Directors. Seconded by Farber. Motion carried 7-0.
7. City Council Salary Compensation Review Process Initiation: City Clerk submitted

information for initiating the process of reviewing City Council salary compensation beginning
January 1, 2022. Motion by Cavanagh to receive and file the information and refer to the City
Council. Seconded by Sprank. City Council discussed the history, previous recommendations,
and significance of the City Council Compensation Task Force. Mayor Buol requested each City
Council Member provide the name and contact information of their selected representative to
the City Clerk by May 17. Point of Order by Cavanagh that his original motion was to receive
and file the information and refer to City Council. Council Member Cavanagh requested clarifi-
cation from Mayor Buol if he should amend his motion to reference the process. After receiving
confirmation from the Mayor, Council Member Cavanagh amended his motion to receive and
file the information and initiate the City Council Compensation discussion using the previous
process for determining Compensation. Seconded by Sprank. Motion carried 7-0.
8. City Council Hybrid Meetings in Council Chambers: City Clerk transmitted information for
initiating the discussion of City Council returning to Council Chambers for City Council meetings
in a hybrid meeting format. Motion by Cavanagh to receive and file the information and refer to
the City Council. Seconded by Farber. City Clerk Breitfelder responded to questions from the
City council regarding the process for selecting City Council voting order and security in Council
Chambers. Council Members expressed support of the hybrid meeting proposal. Mayor Buol
requested additional information, including a potential date for implementing this option, at the
next City Council Meeting. Motion carried 7-0.
COUNCIL MEMBER REPORTS
Council Member Sprank reported on the Farmer's Market occurring this past Saturday and
the Labor Harvest's Annual Food Giveaway occurring this Saturday. Council Member Cavanagh
reported on his recent attendance at the Iowa League of Cities Executive Board Meeting and
the discussion centering around the challenges and responses to COVID-19.
CLOSED SESSION
Motion by Jones to convene in closed session at 8.35 p.m. to discuss pending litigation and
purchase or sale of real estate — Chapter 21.5(1)(c),(j) Code of Iowa. Seconded by Resnick.
Mayor Buol stated for the record that the attorneys who will consult with City Council on the
issues to be discussed in the closed session are City Attorney Crenna Brumwell and Attorney
Les Reddick. Motion carried 7-0.
Upon motion, the City Council reconvened in open session at 9.37 p.m. stating that staff had
been given proper direction.
There being no further business, Mayor Buol declared the meeting adjourned at 9:38 p.m.
