Project Manager Steve Sampson Brown is recommending acceptance of the
construction contract for the Chaplain Schmitt Veterans Memorial Project, as completed
by Conlon Construction, in the final contract amount of $2,579,595.77. This is a 0.8%
increase over the original contract amount of $2,560,000.00 due to several factors
including the following: parking lot modifications, landscape & irrigation enhancements,
and architectural changes to the elevated boardwalk.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Chaplain Schmitt Veterans Memorial Project.
BACKGROUND
In November 2018 The Dubuque City Council approved the Chaplain Schmitt Island
Improvement Agreement between the City of Dubuque and the Dubuque Racing
Association, LTD (DRA) for the development of the Chaplain Schmitt Veteran's Memorial
Project. The Improvement Agreement required that all design, bids, change orders over
$5,000.00, and design changes must be approved by a majority of the Chaplain Schmitt
Project Advisory Committee.

On June 14, 2019 the Chaplain Schmitt Project Advisory Committee met and affirmed the
final project scope, budget, and to initiate bidding on the project.
The Chaplain Schmitt Veterans Memorial Project included several amenities to honor
Veterans, Chaplain Schmitt himself, and improved the overall experience and enhanced the
existing monuments. The improvements also included enhancing the Veterans Memorial
Plaza by improving the edge of the pond with seating, plaza expansion space for additional
memorials and Veterans' tributes, and clean-up of the pond edge to enhance viewsheds.
The Chaplain Schmitt Island Memorial itself was composed of a decorative swirling concrete

path that transforms into an elevated boardwalk that extends from the Veteran's Plaza over
the pond. Located at the end of the boardwalk is a circular landing that contains a sculpture
titled "Skyward". The sculpture is a 52' long stainless -steel sheet with vertical cut slits that is
24' high on one end and tapers down to 15' on the other end. The sheet was then loosely
rolled to a diameter of 11'. An opening allows pedestrians to enter the sculpture to where
they are able to read a poem that is etched onto the metal. The design also included
colorful nighttime lighting used in a subtle way to honor our Veterans and add prominence to
the memorial.
The Memorial Plaza is intended to facilitate formal and informal gatherings, ceremonies, and
contemplation. The Plaza as designed will become part of the overall public space system
on the island. Lastly, the Tri-State Vietnam Veteran's Memorial has been relocated from
Miller Riverview Park to the new Memorial Plaza.
DISCUSSION
The Chaplain Schmitt Veterans Memorial Project was completed by Conlon Construction, of
Dubuque, IA in the final contract amount of $2,579,595.77. This is a 0.8% increase over the
original contract amount of $2,560,000.00. The increase was due to several factors
including the following: parking lot modifications, landscape & irrigation enhancements, and
architectural changes to the elevated boardwalk. The project was formally dedicated and
opened to the public on May 30, 2021.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment of the
contract amount of $2,579,595.77 to Conlon Construction Company of Dubuque, IA for the
Chaplain Schmitt Veterans Memorial Project.

All of the $3,200,000 in project funding was provided by the Dubuque Racing

ACTION TO BE TAKEN

RESOLUTION NO. 300-21
ACCEPTING THE CHAPLAIN SCHMITT VETERANS MEMORIAL PROJECT, AND
AUTHORIZING THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the Chaplain Schmitt Veterans
Memorial Project (the Project) has been completed by the Contractor, Conlon
Construction, (Contractor), the City Engineer has examined the work and recommends
that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $2,579,595.77; and
WHEREAS, the Contractor has previously been paid $2,450,615.98, leaving a
balance of $128,979.79; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the
Project is hereby accepted.
Section 2. The Director of Finance & Budget is hereby directed to pay to the
Contractor the balance of the retainage of $128,979.79 as provided in Iowa Code chapter
573, and to pay such retainage in accordance with the provisions of Iowa Code chapter
573 or Iowa Code chapter 26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has inspected the Chaplain Schmitt Veterans Memorial Project has been performed
in compliance with the terms of the Public Improvement Contract, and that the total cost
of the completed work is $2,579,595.77.
