Present —City Manager Carr, May- or Alderson, Councilman Gabriel, Melchior, Schrempf. Absent — Councilman Brede. Mayor Alderson in the Chair. Mayor Alderson stated that this is the regular monthly meeting of the City Council for the dispatch of such business as may regularly come be- fore it. Notice of publication of resolution of necessity, certified to by the pub- lisher, that it be deemed necessary and advisable to construct a sani- tary sewer in Ashton street from Delaware street to a point one hun- dred feet south of Decorah street. There being no remonstrance, Coun- cilman Gabriel moved that the no- tice be received and filed. Seconded by Councilman Schrempf. Carried by the following vote: Yeas — Mayor Alderson, Council- men Gabriel, Melchior, Schrempf. Nays —None. Absent — Councilman Brede. Resolution of Necessity for Sewer. Be it resolved by the City Coun- cil of the City of Dubuque that it be deemed necessary and advisable to construct a six -inch tile sanitary sewer in Ashton street from Dela- ware street to a point 100 feet south of Decorah street. Said sewer to be provided with manholes and any other appurten- ances that may be necessary. Said sewer to be constructed in accordance with the plans and spec- ifications prepared by the City Engi- neer and now on file in the office of the City Clerk, having been duly ap- proved by the City Manager and submitted to the State Board of Health. That the cost and expense of mak- ing and constructing said sanitary sewer shall be assessed against the property abutting upon the same and. also against all adjacent prop- erty benefited thereby. Be it further resolved that the above and foregoing sanitary sewer is hereby proposed to be constructed as hereinbefore set forth, and that this proposed resolution, except this paragraph, be and the same is here- by set down for further and final hearing, consideration and determin- ation at a meeting of the City Council to be held November 5th, at 4:30 o'clock p. m., and that the City Clerk be and he is hereby in- structed to cause notice of the above resolution, and of the time and place when and where said proposed resolution will be considered for passage, and objections to the pas- sage, thereof and to the construc- tion of said sanitary sewer heard, to be given by publication in the official newspapers of the City of Dubuque in the manner and for the time provided by law. Be it resolved by the City Coun- cil of the City of Dubuque, that pursuant to a resolution of neces- sity, proposed at a meeting of this Council on the 16th day of October, 1923, and duly passed and approved on the 5th day of November, 1923, it is hereby ordered that the im- provements described in said resolu- tion of necessity providing for the construction of a sanitary sewer in Ashton street from Delaware street to a point 100 feet south of Decorah street, be and the same is hereby ordered constructed. Be it further resolved that the City Clerk be . and he is hereby in- structed to advertise for proposals for the construction of the improve- ment above described, the said im- provement to be constructed in strict accordance with the plans and spec- ifications thereof, prepared by the City Engineer and approved by the City Manager and the State Board 746 Regular Session, November "5th, 1923 of Health and now on file in the office of the City Clerk, the work to be completed on or before the 1st day of April, 1924. The cost and expense of said work as is by law assessable against the property abutting upon or adjacent to said improvement will •be assess- ed and payment will be made to the contractor to the amount of the as- sessment out of funds to be created by the sale of Sewer bonds, to be issued in anticipation of the collec- tion of said special assessment un- der the provisions of Chapter 8, Title V of the Code of Iowa, and amend- ments thereto; and any deficiency between the amount of the contract price and the amount of said bonds will be paid from the proceeds of a special tax to be levied under the provisions of Section 831 of the Code of Iowaa 01 anticipation of which bonds will be issued under the provisions of Section 912 of the Cocle of Iowa and Section 912A of the Code Supplement. A petition of property owners on Lois street asking that a grade be es- tablished on said street and the street be improved also that sewer, water, and gas mains be laid. Signed by Geo. O. Jansen, F. B. McCarten et al, presented. Councilman Gabriel moved that the petition be referred to the City Man- ager for investigation and report. Seconded by Councilman Schrempf. Petition of the Key City Paper Box Factory, stating that they are located at 517 Garfield avenue. That the property belongs to Theo. Schar le, that the property was recently condemned for not being in a sani- tary condition. That the proprietor instead of making the necessary con- nections with the Sanitary sewer and installing toilet facilities, ordered the tenants to move out. Gentlemen: At a meeting of the Council held on October 29th, a pet- ition of property owners along Lang - worthy street from Nevada to Col- lege streets asking for a reduction in the assessment as levied for the improvement of this street, was re- ferred to the City Manager. Originally I had suggested that in- stead of levying the cost of the hill- side brick paving, the property own- ers be asked to bear only what the cost would have boen had it been possible to use vibrolithic paving on this street. This recommendation was passed up due to the fact that the Council had no right to reduce an assessment unless the property itself is not worth the amount of the assessment as levied. I have endeavored to arrive at a fair value of the vacant property abutting this street. Lots occupied by buildings of course are worth four times the amount of the assessment without question. Also lots back from the street are unquestionably within the proper as- sessment. The vacant lots however, in this block lying between Nevada and Booth streets which face either on Nevada or Booth streets and hav- ing their long side abutting the im- provement are in excess of the 25 per cent value. I have prepared a little table on which the approximate value with improvement in is based upon a re- cent selling price cn a lot in this neighborhood plus the assessed cost of the improvement. I also indicate the present assess- ed values for taxation purposes which are not only rediculously small out are also entirely out of balance. This is cited to show again to the Council necessity of compiling a revaluation of residence property in Dubuque, for taxation purposes. The figures used in this table would indicate a proper reduction in the assessment against S. A.. Craw- ford of $175.93; Frank Hird, $164.33; H. C. Torbert, $239.42; and Philip Erschen, $171.01. These four prop- erty owners being the only ones af- fected by the 25 per cent proposition. The total reduction recommended amounts to $750.69. Gentlemen: Some months ago an agreement was entered into by which the City was to sell a cer- tain block in the ground filled in Rafferty's Slough to the Ott Rubber Co. This agreement was to be com- pleted after the City prepared and filed a proper plat by which this property could be described. I be- lieve that this plat will be ready for filing in a short time. The triangular tract of ground bounded by Fourth street extension, Sixth street and the railroad track is owned principally by The Adams Company. The Rhomberg estate owns two lots and the Burlington Ry. Co. owns six lots. Reasonable prices have been placed on the prop. erty owned by The Adams Company and the Rhomberg Estate. I would recommend the reinvest- ment of the money as far as neces- sary, secured from the sale of the tract of ground in Rafferty's Slough to the Ott Rubber Co. in this property. In my judgment this ground can be filled by the City of Dubuque in the course of two years by discon- tinuing the care of the dump at the foot of 13th street and the dump near the athletic field, and concen- trating the dumping, as far as pos- sible, in this vacant hole. City Council, Dubuque, Iowa. Gentlemen: Sometime ago the petition of Mr Hammond, regarding an assessment for improvement of Foye street was referred to the City Manager for investigation and report. I have delayed making a report inas- much as I felt that the correction of the error made in the assessment would make the whole thing satis- factory to Mr. Hammond. I find how- ever that that has not been the case. Sub. 1 of 1 of 1 of J. P Schroeder's Add. was assessed $543.52 for the improvement of Foye street and .$32.45 for the improvement of Lowell street. This is a large lot on which Mr. Hammond's house is situated. There is therefore no authority for any reduction in this assessment. There is a little lot about 25x40 feet which forms a corner of the yard and really forms a part of the prin- cipal lot. This is Sub. 2 of 108 Me- chanic's Add. This lot was assessed $80.15 for the improvement of Foye street and $13.78 for the improve- ment of Lowell street. The entire assessment levied against this lot amounts to $93.88 and the assessment levied against Mr. Hammond's prop- erty amounts to $679.85. There will probably be an assessment amount- ing to $600.00 next year for the im- provement of Seminary street. The small lot above referred to, 2 of 108 Mechanic's Add. is probably not worth over $100.00. I would sug- gest that the value of property be taken as $100.00, making the maxi- mum assessment to be levied against it $25.00 which would give a reduc- tion on the assessment as levied amounting to $55.15. My recommendation would be that the assessment be reduced accord- ingly and that a warrant be drawn from the general fund to the special improvement fund in order to make up this shortage in the levy. Whereas, the contract heretofore entered into by the City of Dubuque for the improvement of Douglas street hereinafter described has been completed and the City Engineer has computed the cost and expense of said improvement amounts to $4,- 333.12. Therefore, be it resolved by the City Council of the City of Dubuque that to provide for the cost of im- proving Douglas street from the west line of College street to the west line of Walsh street, there be issued Improvement Bonds to the amount of $4,333.12. Said bonds shall be issued under the provisions of Chapter 8, Title V of the Code of Iowa and the amendments thereto, shall bear date as of the 12th day of December A. D. 1923, shall be in the denominations of $200.00 each, except that there shall be one bond to the amount of $133.12; they shall be numbered from 9369 to 9390 inclusive, and shall be divided into ten series of which the bonds numbered 9369 to 9371 shall constitute the first series; and shall be payable on the first day of April A. D. 1924; the bonds numbered 9372 to 9373 shall constitute the second series and shall be payable on the first day of April A. D. 1925; the bonds numbered 9374 to 9375 shall constitute the third series and shall be payable on the first day of April A. And it is hereby certified and re- cited that all the acts and condition and .things required to be done pre- cedent to and in the issuing of this series of bonds, have been done, hap- pened and performed in regular and due form as required by said law and resolution; and for the assess- ments, collections and payment here- on of said special tax, the faith and diligence of said City of Dubuque are hereby irrevocably pledged. Gentlemen: I am submitting here- with a report made by the City Engineer regarding the assessment on Langworthy street from Nevada street to College street, based on the cost of paving this street with vibrolithic instead of Hillside brick, the cost of vibrolithic being taken the same as the cost was on Booth street. This new schedule of cost is worked out, from my understanding of the desire of the Council, which was to correct the assessment in connection with the improvement to what it would have been had it been possible to use vibrolithic on this street instead of Hillside brick. The total reduction to $4,068.91 with an additional reduction as al- lowed by the Council at the meeting held on November 5th, in connec- tion with the A. L. Rhomberg peti- tion, of $130.84. If the Council wish to have the assessment as levied corrected in accordance with this new schedule, authority should be given to the Auditor to draw a warrant from the general funds in favor of , the spe- cial improvement funds in the sum of $4,199.75. Gentlemen: Some months ago we were appointed as members of a committee to prepare a Building Code for the City of Dubuque. We were also aware of the fact that the reduced insurance rates were depen- dent upon the passage and adoption of a building code by the City of Dubuque at an early date. Copies of the building code of Davenport and Waterloo were se- cured. We have followed along the lines of these two codes, following more closely the Davenport code than the Waterloo code. We are submitting herewith a copy of the building code which we would recommend for adoption by the City of Dubuque. The indepen- dent preparation of a building code is a matter which would require a year or two of time and a consider- able expense. We have therefore tried to adapt those codes that we have followed to meet the conditions in Dubuque. We have also tried to hear in mind the need for more homes in Dubuque and have tried to avoid any requirements which would ^^ease unnecessarily the cost of building. Where the requirements have been made, we believe that the additional safety and prevention of fire which these requirements in- sure. more than counterbalance any additional expense occasioned by the requirement. We trust that the code as sub- mitted for adoption by the City Council will be adopted without many changes. To take up the sub- jects covered, one at a time and to give them full discussion will take a considerable time and after being thoroughly discussed, the probabil- ity is that public opinion will be divided about equally. Our sugges- tion would be that the code be adopted practically as submitted, leaving changes to be worked out in the course of time and after a full 768 Special Session, November 12th, 1923 Special Session, November 12th, 1923 769 opportunity has been afforded to see just what the requirements are and the effect of these requirements on building operation. The above suggestion does not apply with the same force to certain portions of the gide. For instance, the first chapter covering the organ- ization of the department and the fees charged as well as the next to the last part which deals with the fire limits can be amended in any way that the Council feels desirable without effecting the code. The fees charged in this code are practically the same as those charged in Davenport and Waterloo. From corresponding with these two cities we find that the fees in Da- venport and Waterloo are practically enough to take care of the expense of the inspection. Whether or not the fees will be adequate will de- pend very largely on the amount of building done. The code as submitted is to be effective January 1st, 1924. It is the thought of your com- mittee that Dubuque should have had a building code years ago and that the adoption of a building code should not be very much delayed. Respectfully submitted, W. D. Dr. Steelsmith advises that the Visiting Nurses Association has co- operated to the fullest extent with his department and are taking care of quarantine and isolation of com- municable diseases together with their other work. This being the case, I would rec- ommend that a further appropria- tion of $100.00 a month, or $600.00 for the rest of the year, be made as remuneration for the public health work being done by the Visiting Nurses. Be it resolved by the City Council of the City of Dubuque that, upon petition of the property owners and recommendation of the City Man- ager, it be deemed necessary and advisable to improve Holly street from the North line of Rush street to the South line of Cleveland ave- nue, by constructing new concrete curb and gutter where required, re- setting the old curb where desir- able, by installing sewer, water and gas connections to every lot, in case a lot has more than 50 feet front- age, additional connections to be in- stalled to furnish one connection for every 50 feet, paving said portion of street with sheet asphalt, warrenite bitulithic or asphaltic concrete, all on the present foundation. Said work to be done in accord- ance with the plans and specifica- tions to be prepared by the City Engineer. The cost and expense of said im- provement will be assessed against all of the property subject to assess- ment for the improvement as is provided by law. Be it resolved by the City Council of the City of Dubuque that, upon petition of the property owners and recommendation of the City Man- ager, it be deemed necessary and advisable to improve Rush street from the East line of Bryant street to the East line of Holly street, by constructing new concrete curb and gutter where required, resetting the old curb where desirable, by install- ing sewer, water and gas connections for every lot, in case the lot has more than a 50 foot frontage, addi- tional connections to be installed to furnish one connection for every 50 feet, paving said portion of street with sheet asphalt, Warrenite bits - lithic, or asphaltic concrete, all on the present foundation. Said work to be done in accord- ance with the plans and specifica- tions to be prepared by the City Engineer. The cost and expense of said im- provement will be assessed against all of the property subject to assess- ment for the ;improvement as is provided by law. Whereas, the contract heretofore entered into by the City of Dubuque for the construction of a sanitary sewer hereinafter described has been completed and the City Engineer has computed the cost and expense of said improvement amounts to $2,- 476.25. Whereas, the contract heretofore entered into by the City of Dubuque for the improvement of High Bluff street hereinafter described has been completed and the City Engineer has computed the cost and expense of said improvement amounts to 52,- 145.74. Therefore, be it resolved by the City Council of the City of Dubuque that to provide for the cost of im- provement of High Bluff street from the south line of Fengler street to the south line of Farley street, there be issued Improvement Bonds to the amount of 52.145.74. To the Honorable Mayor and City Council of the City of Dubuque, Iowa: Gentlemen: On October 28th, 1921. the City Council levied a special as -, sessment against lot 2 of Yates and Pickett's Subdivision, City of Du- buque to pay for the construction of a sanitary sewer in Pickett street from Cornell street westerly. The _ amount of the assessment was $186.92. Lot 2 has a frontage on Pickett street of 50 feet and under the law an assessment for sewer cannot exceed $3.00 for a linear foot. D. J. Lenehatl the owner of said lot, remonstrated against said assess- ment and took an appeal to the Dis- trict Court, and this appeal was tri..d before said court at the present term. The Court after hearing the evidence which was submitted and the law in the case, entered a de- cree in favor of the City in the sum of $150.00 with interest thereon at the rate of 5 per cent from the date of levy. The assessment which was levied by the Council was found to be ex- cessive to the extent of $36.92 and the amount was cancelled by the Court. Judgement was also rendered against the appellant for the cost of the proceedings. Attached hereto you will find a copy of the decree which was entered by the Court in the case and I would recommend that the Treasurer be in- structed to correct the assessment according to this decree. In view of the fact that the as- sessment was reduced to the extent of $36.92 I would further recommend that a warrant be drawn upon the General Fund in favor of the Special Assessment Fund for the sum of $36.92. To the Honorable Mayor and City Council of the City of Dubuque: Gentlemen: On the 20th day of July, 1922, the City Council levied a special assessment against City lot 589 in the sum of $96.11 to, pay for the construction of a sanitary sewer in the alley between Locust and Bluff streets, beginning at a point 75 feet south of Jones street, and Mary A. Halpin the owner of said lot ap- pealed from said assessment to the District Court of Dubuque County, Iowa. I beg to advise that at the present term of Court I secured the consent of the .executor of the es- tate of said Nary A. Halpin, de- ceased, to pav the assessment in full together with interest thereon from the date of levy. This has been done and the Treasurer now has the check for the full amount. T find however that this lot was sold at tax sale to the City of Du- buque last year and the City now holds the tax certificate for the same. This should not have been done be• cause the property could not be ad- vertised for sale while the appeal is pending. This fact however was not known to the Treasurer and since the property was not listed in the name of Mrs. Halpin it slipped through and the City became the pur- chaser of the tax certificate. I would recommend that the Treasurer be instructed to cancel the tax certifi- cate, execute a receipt in full for the Special assessment which has been paid. Respectfully submitted, M. H. To the Honorable Mayor and Council of the City of Dubuque: Gentlemen: On January 24th, 1922 the City of Dubuque levied a special assessment against the Klauer Mfg. Co., to pay for the improvement of Washington street from the north property line of 8th street to the south property line of llth street. This Company protested against the .assessment and subsequently ap- pealed to the District Court of Du- buque County, Iowa. This appeal has been pending ever since that time. Some time ago I had a conference with Mr. Wm. Klau- er and with his attorney and with the City Engineer and at that time it was understood that the assess- ment would be paid. However the case has been pend- ing in the District Court, and at this term I made an effort to have the same disposed of. yesterday Mr. Klauer was in to see me and • advised me that his company would pay their assessment in full togeth- er with the interest charged upon the same. • He made this request, Special Session, November 22nd, 1923 however, that said Company be per- mitted to pay its assessment on the installment basis and agreed that if this is done the Company would pay all of the assessment with in- terest which are due at this time, and would pay the subsequent as- sessments when they became due according to the installment plan. Council it should instruct the City Treasurer to accept from the Klauer Mfg. Co. that portion of the assessment with interest which is due at this time and distribute the balance upon the books in the County Treasurer's office under the remaining installment period. Be it resolved by the City Coun- cil of the City of Dubuque that, up- on petition of property owners and recommendation of the City Man- ager, it be deemed necessary and advisable to improve Rush street from the east line of Bryant street to the east line of Holly street, by constructing new concrete curb and gutter where required, resetting the old curb where desirable, by instal- ling sewer, water and gas connec- tions to every lot, in case lot has more than a 50 -foot frontage, addi- tional connections to be installed to furnish one connection for every 50 feet; paving said portion of street with sheet asphalt, Warrenite bitu- lithic or asphaltic concrete, all on the present foundation. Said work to be done in accord- ance with the plans and speciflca- tions to be prepared by the City Engineer. The cost and expense of said im- provement will be assessed against all of the property subject to as- sessment for the improvement as is provided by law. Be it further resolved that the above and foregoing improvement is hereby proposed to be made and constructed as hereinbefore set forth and that this proposed resolu- tion (except this paragraph) be and the same is hereby set down for further and final hearing, consider- ation and determination at a meet- ing of the City Council to be held the 3rd day of December, 1923, at 4:30 p. m., in the Council Chamber and that the City Clerk be and he is hereby instructed to cause notice of the pendency of the above reso- lution and the time and place, when and where said resolution will be considered for passage and objec- tions heard, to be given by publica- tion in the official newspapers of the city, in manner and for the time provided by law.
