acceptance of the dedication of said lots for street Right of Way and public utility
purposes for the existing and proposed cul-de-sacs on Carmel Drive.

INTRODUCTION
This memo provides information regarding the platting and acceptance of additional
rights of way at the north and south ends of Carmel Drive.
BACKGROUND
Carmel Drive is a short stretch of public street at the southern end of South Grandview
Avenue that serves several private residences and the Mount Carmel (Sisters of Charity
of the Blessed Virgin Mary) campus.
The approved site plans for the second construction phase of the Mt. Carmel Bluffs
senior living facility include a new public cul-de-sac at the southern terminus of Carmel
Drive. These public improvements will be constructed by the owner and dedicated to
the City and include street pavement, drainage, lighting, and sidewalks. There is
currently no cul-de-sac at the south end of Carmel Drive and in the past public works
vehicles had been turning around on private property in the course of maintaining the
public street. As part of the new public improvements, the owners have agreed to
dedicate the land needed (in street right of way) to accommodate the proposed cul-de-
sac improvements.
Currently there is a small cul-de-sac at the north end of Carmel Drive. This was the
southerly terminus of South Grandview Avenue until the street was extended and
named Carmel Drive as part of the Carmel Heights Subdivision. The right of way for the
easterly side of the cul-de-sac was previously platted, but the westerly side has never
been formally platted and dedicated to the public. Because the owners were platting
right of way for the new cul-de-sac on the south end of Carmel Drive, they have decided
to clean this right of way issue up at the same time and dedicate the westerly side now.
DISCUSSION
The additional rights of way of Carmel Drive need to be platted. The platting of these
additional areas has been coordinated with the owners of the property and they have
signed and consented to the plats.
Origins Design has prepared the two acquisition plats to provide the right of way areas.
The areas being platted will be dedicated to the public for street and utility purposes.
The City will own and maintain the public improvements after they have been
constructed, inspected and dedicated.
RECOMMENDATION
I recommend that the City Council approve the Acquisition Plats of Lot 1A and 2A of
Carmel Heights No. 2, in the City of Dubuque, Iowa, which provide right of way for the
existing and proposed cul-de-sacs on Carmel Drive by the adoption of the attached
resolutions.
ACTION TO BE TAKEN
I respectfully request approval of the Acquisition Plats of Lot 1A and 2A of Carmel
Heights No. 2, in the City of Dubuque, Iowa, and acceptance of the dedication of said
lots for street Right of Way and public utility purposes, through the adoption of the
enclosed resolutions.

Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, an Acquisition Plat dated August 17, 2021 prepared by Origins
Design describing Lot 1A of Carmel Heights No. 2, in the City of Dubuque, Iowa;
and
Whereas, said plat conforms to the laws and statutes pertaining thereto;
and
Whereas, upon said plat appears Lot 1A, which BVM-PHS Senior Housing,
Inc., by said plat has dedicated to the public forever.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated August 17, 2021 prepared by Origins Design,
relative to the real estate hereinabove described be and the same is hereby
approved, and the Mayor and City Clerk be and they are hereby authorized and
directed to execute said plat and on behalf of the City of Dubuque, Iowa.
Section 2. That the dedication of Lot 1A of Carmel Heights No. 2, in the City
of Dubuque, for street Right of Way and public utility purposes, as it appears on
said Acquisition Plat, be and the same are hereby accepted.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated August 17, 2021 prepared by Origins Design,
relative to the real estate hereinabove described be and the same is hereby
approved, and the Mayor and City Clerk be and they are hereby authorized and
directed to execute said plat and on behalf of the City of Dubuque, Iowa.
Section 2. That the dedication of Lot 1 A of Carmel Heights No. 2, in the City
of Dubuque, for street Right of Way and public utility purposes, as it appears on
said Acquisition Plat, be and the same are hereby accepted.
Section 3. That the City Clerk be and is hereby authorized and directed to
file said plat and certified copy of this resolution in the office of the Recorder, in
and for Dubuque County, Iowa.
