Planning Services Manager Wally Wernimont recommends City Council approval of a
100% voluntary annexation request filed by the City of Dubuque for approximately 51.56
acres of property. The annexation territory is comprised of the western on and off
ramps of the intersection of the Southwest Arterial and US Hwy 151/61 and the
intersection of Tamarack Drive and the Southwest Arterial. The 51.56-acre annexation
territory provides connection to the City of Dubuque corporate limits for a 156.25-acre
property owned by River City Development Group LLC. River City Development Group
LLC has filed a 100% voluntary annexation with the City Council.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This memorandum transmits a 100% voluntary annexation request for City Council
approval after a public hearing. The request is being filed by the City of Dubuque for
approximately 51.56 acres of property. The resolution, maps, and other supporting
documentation are enclosed.
DISCUSSION
The City received a written application from City of Dubuque for voluntary annexation of
approximately 51.56 acres of property. The annexation territory is comprised of the
western on and off ramps of the intersection of the Southwest Arterial and US Hwy
151/61 and the intersection of Tamarack Drive and the Southwest Arterial.
The 51.56-acre annexation territory provides connection to the City of Dubuque
corporate limits for a 156.25-acre property owned by River City Development Group
LLC. River City Development Group LLC has filed a 100% voluntary annexation with
the City Council.
This annexation is:
1) Consistent with the City's Comprehensive Plan; and
2) the future growth and development of the City of Dubuque, Iowa makes it
desirable that the annexation territory be made part of the City of Dubuque,
Iowa; and
3) the City of Dubuque has the capacity to provide substantial municipal
services to the annexation territory; and
4) the annexation is in the public interest.
By Iowa Code, the annexation will be approved upon acknowledgement by the
Secretary of State that the legal description, map and resolution have been received.
RECOMMENDATION
Staff recommends the City Council approval of the voluntary annexation request for
51.56 acres filed by the City of Dubuque.

Whereas, the City Council of Dubuque has received a written application from the
City of Dubuque for the voluntary annexation of 51.56 acres of property. The property is

City of Dubuque hereby be extended to include the 51.56 acres of property as shown on
Exhibit A.
Section 3. That the City Council does hereby certify that the City of Dubuque
has complied with the notice and hearing requirements of the Iowa Code pertaining to
100% voluntary annexation of territory not in urbanized area of another city.
Section 4. That the territory hereby annexed shall become a part of Ward One
of the City of Dubuque.
Section 5. That the City Clerk shall file this resolution, all exhibits and the
applications for voluntary annexation with the Secretary of State in accordance with the
provisions of Chapter 368 of the Iowa Code.

received and filed by this office as required by Iowa Code section § 368.7. You may consider the annexation

In accordance with § 368.1(15) and § 368.7A the territory extends to the center line of all secondary roads
adjacent to the above described properties.
Iowa Code 312.3(4) requires the mayor and city council to certify the population of any annexed territory, as
determined by the last certified federal census, to the treasurer of state in order for apportionment of street
construction funds to be adjusted.
Please review your city's precinct ordinance (if any) and confer with your county auditor to ensure this territory

Physical Characteristics: The subject property is comprised of Southwest Arterial/US
151/61 and Tamarack right-of-way totaling approximately 51.56-acres. The annexation
territory is the western on and off ramps of the intersection of the Southwest Arterial
and US 151/61 and the intersection of Tamarack Drive and the Southwest Arterial.

Utilities: Presently, city water is available in Tamarack Business Park. The water
main is adequate and can be extended to serve future development of the subject
property. City sanitary sewer service is stubbed across US HWY 151 /61 to
Tamarack Business Park and can be extended to provide service. The sewer main
is adequate to serve a proposed development. There is a high-pressure gas main
that extends through a portion of the property
Traffic Patterns/Counts: Because the area is newly developed, there are no traffic
counts available for the Southwest Arterial and Tamarack Drive. Tamarack Drive,
a 24-foot-wide paved street, provides access to Tamarack Business Park. The
Southwest Arterial is a priority one (controlled access) freeway.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided that any future development of the property is in compliance with
established City standards for storm water management and erosion control.
Adjacent Properties: Staff does not anticipate any impacts to adjacent property as
the proposed annexation territory comprises of existing Southwest/US 151/61 and
Tamarack Drive public rights -of -way.
CIP Investments: Future extension of city water, sanitary sewer, and storm sewer.
Imagine Dubuque Comprehensive Plan Recommendations:
The annexation is to facilitate a 156.25-acre property owned by River City Development
Group LLC. River City Development Group LLC has filed a 100% voluntary annexation
with the City Council. This area will provide land for future industrial development.
Industrial
Attract large employment centers with access to infrastructure facilities. Ensure that
such development does not disproportionately impact residential areas.
Allow for appropriate expansion of existing industrial parks as identified on the
Future Land Use Map.
Explore additional industrial development opportunities near the Dubuque
Regional Airport, particularly in the U.S. Highway 61 corridor.
The comprehensive plan notes that expansion within and adjacent to existing industrial
development is anticipated, along with potential selected new industrial locations within
major roadway corridors like U.S. Highway 20, U.S. Highway 151, or the Southwest
Arterial.

Create a vibrant environment where residents can live, work, and play within walking
and biking distance of their home and opportunity sites throughout the community.

Staff Analysis and Recommendation: The City received a written application for a
100% voluntary annexation of approximately 51.56 acres that comprises the western on
and off ramps of the intersection of the Southwest Arterial and US 151/61 and the
intersection of Tamarack Drive and the Southwest Arterial.
The 51.56-acre annexation territory provides connection to the City of Dubuque
corporate limits for a 156.25-acre property owned by River City Development Group
LLC. River City Development Group LLC has filed a 100% voluntary annexation with
the City Council.
The construction of the Southwest Arterial and its interchange with U.S. Highway 15/61
has been anticipated for several years. Planning staff anticipates that the area around
the interchange will generate additional annexation & zoning requests and development
in the coming years.
The future development of the site requires subdivision and site plan reviews. These
reviews will be conducted by city departments (Fire, Water, Engineering, Planning and
Construction & Inspection Division) to ensure compliance with the Unified Development
Code, Building and Fire Codes and SUDAS (Statewide Urban Design and
Specifications).
If the annexation is approved, the property will be brought into the city with an AG
Agricultural zoning classification.
The City of Dubuque has the capacity to provide substantial municipal services to the
annexation territory. By Iowa Code, the annexation will be approved upon
acknowledgement by the Secretary of State that the legal description, map and
resolution have been received.
Planning staff recommends City Council approval of the voluntary annexation request.
