Dr. D. D. Burrell representing the
Dubuque Ministerial Association, ad-
dressed the Council, and asked that
measures be enacted by the Council
to reform the style of music and
the varieties of dancing now found
in the public dance halls of the City.
He 'remarked on the origin of Jazz,
and stated that that type of dancing
was degenerating the characters of
the young people that attended these
public dances.
He also asked that steps be tali-
en to eliminate the front window
curtains of pool halls and soft drink
parlors, stating that if the business
is being conducted in a legal man-
ner, there is no reason to hide it
from public view. He also informed
that both of these matters were
now pending and that action on
them would be taken in the near
future.
'A communication from Peter H.
McCarthy to the City Council, pre-
sented. Calling the attention of the
Council to the fact that he would
sell to the City the desirable loca-
tion for factory sites, the property
immediately west of the Allison -
Henderson Park on the 7th street
extension. This property is described
as Lots 20 to 38 'inclusive in Block

ed there, and in falling sustained
severe breaks and fractures of the
bones of the left leg, between the
ankle and knee. That as a direct
result therefrom, the said Eva Goe-
belt has suffered severe pain of body
and anguish of mind, and will be
partially permanently disabled, and
claimant has also incurred great ex-
pense for hospital, nurse and med-
ical services, all to her damage in
the sum of $7,500.00, no part of

that the system of assessing a uni-
form tax on every operator of a soda
fountain in the City, no matter how
great or small the amount of bus-
iness he does, - be placed by a sys-

Gentlemen: On February 24, 1922,
your Monorable Body referred to tie
the petition of Catherine Rea, ask-
ing for a reduction in her special
assessment for the construction of
a sanitary sewer in West Seven-
teenth street, which assessment was
levied against Lot 1 of Quigley's Sub-
division, Outlot No. 712 and is in the
suit of one hundred twenty -eight
($128.00) dollars. Mrs. Rea offers to
pay fifty per cent (50 %) on said as-
sessment and asks a remission of the
balance upon the ground that she is
old and has limited means and is
therefor unable to pay the entire as-
sessment.
I beg to advise you that this as-
sessment is not excessive, based up-
on benefits of her lot, and is within
the legal limitation. The actual
value of this lot, as shown upon the
tax books, is one thousand ($1,000.00)
dollars.
There is no provision in the law
authorizing the Council to remit any
part of a special assessment for the
reasons urged in the petition. There-
fore, for the reasons stated above,
I am constrained to advise you that
this petition should be received and
filed.

ervisors and by them referred to the

of the La Crosse Dredging Company,

agree to start this work as soon as
the Mississippi River opens for the
movement of their equipment. They
also agree to complete the work dur-
ing the coming season.
The representative of the North-
ern Dredging Company, of Minneap-
olis, was also in the City, but had
no equipment available for this work
before next October and for that
reason refrained from giving us a
bid.

of March 6th, relative to the right
and power of the city, as a muni-
cipal corporation, to enter into a
contract for the filling of property
owned by the City and commonly
known as Rafferty's Slough. Pre-

To the Honorable Mayor and Coun-
cil of the City of Dubuque.
Gentlemen: My opinion has been
requested relative to the right and
power of the City, as a municipal
corporation, to enter into a contract
for the filling of property owned
by the City and commonly known
as "Rafferty's Slough." Incident to
the power to enter into such a con-
tract and related thereto is the
method of financing the work con -
templated by the contract. In this
project is also contained the ques-
tion of the City's right to acquire
by purchase or gift other property
adjacent to the property owned by
the City and to which private .par-
ties have title, and fill the same to
the grade of the street. In treating
this question in this opinion, I am
always mindful of the reason for fill-
ing such lands, because the entire
scheme must be kept in sight in or-
der to apply the legal tests.
The questions in their simplest
forms, are these:
(1) —Can the City expend funds
upon the improvement of publicly
owned property with the intention
Of making such property useful for
private enterprise?
(2) —Can the City acquire by pur-
chase or gift real estate and expend
public funds for its improvement
with the intention of making such
property useful for private enter-
prise?

In answering these questions the
fundamental principle of municipal
law. must be recognized and that
principle provides that municipal
corporations have and can exercise,
such powers only as are expressly
granted by their charters or legis-
lative acts, or are necessarily im-
plied therefrom or are necessarily
incidental thereto. Under the laws
of this State, Cities have the power
to own and hold real estate. They
also have the power to acquire real
estate by gift or purchase. But in
each instance there is a limitation
upon these powers, which limitation
substantially provides that these
powers must be exercised in the in-
terest of the public. It is true, also,
where Cities have acquired real es-
tate for public purposes and the
same is no longer useful or necess-
ary for the purposes for which it
was originally acquired for, such
real estate may be disposed of. It
must also be admitted that the City
may hold and own property which
might not be necessarily devoted to
public purposes, but this right to
hold and own such property cannot
be extended to the right to acquire
such property by the expenditure of
public funds.
The right to improve property
owned by the City is incidental to
the right to have and to hold but
the right to improve means the ex-
penditure of public money, and this
right can only be exercised when
the improvement is a public improve-
ment.
There isn't any question about
the City's right to expend money
upon property owned by it in order
to abate or remove a nuisance or
in the exercise of its police powers,
that is, to preserve the public
health, morale, comfort and conven-
ience. But again, a limitation must
be recognized here and that is, that
only so much money can be expen-
ed as will remove or abate the
nuisance or accomplish the end in-
tended.
With these prine'ples in mind we
come now to the main question. (1)
Can the City expend public funds
upon the improvement of publicly
owned property . with the intention
of making such property useful for
private enterprise?
My answer to this question, nec-
essarily, is in the negative. Nowhere
in the law is such power given. In
fact it is most emphatically denied.
The Courts all over this Country
deny such right and for very good
reasons. The primary purpose in
improving this property would be
to convert useless property into use-
ried by the following vote:

ful property. Ordinarily that would
be considered a laudable purpose. It
would mean that property which to-
day is of no value may, by the ex-
penditure of money, be made valu-
able and become a profitable invest-
ment. But a City cannot do the
things that a private person can. A
City has no right to go into the
real estate business nor has it a
right to develop property for a spec-
ulation. Councils are merely trustees
for the entire community and that
trust is sacred and surrounded by
legal limitations. Funds cannot be
expended except where and when
authorized.
If it were the intention of the
Council to reclaim this property and
expend money in doing so in order
to erect a necessary public building,
or for some other purely purpose,
there wouldn't be any question about
the power provided, of course, that
the legal proceedure were followed.
But here is a case where the purpose
of the expenditures of public funds
is to create lands for sale or as an
investment with the hope of profit,
or, in other words, as a speculation
proposition. This power, as I have
said, does not exist. The mere fact
that should the property be sold at
a profit and the City Treasury would
be enriched doesn't change or effect
the rule. Now does it matter that
the community, as a whole, is hene-
fited by great manufacturing estab-
lishments which are made possible
by providing sites for their locations.
Where the ultimate purpose is pri-
vate instead of public the expendi-
ture of public funds is denied.
If we conceded that the power to
improve this property were given
under the law, we would still be
confronted with the question of how
to finance the improvement. In the
first place bonds could not be is-
sued. In order to issue bonds there
must be expressed specific authority
from the legislature. No such
authority is provided for to meet
cases of this character. If this ex-
penditure could be made, it would
have to come from the general funds
of the City and from no other source.
Bonds executed without authority
are void. I refer to this question
merely in order to show your Hon-
orable Body that in attempting to
finance a contract of this character
by the issuance of bonds would be
absolutely illegal and void.
The second question "Can the
City acquire, by purchase or gift,
real estate and expend public funds
for its improvement with the in-
tention of making such property use-

ful for private enterprise ?" is an-
swered by the foregoing conclu-
sions. That right does not exist.
If the City could not expend public
.funds in the development of its own
property for private purpose, with
greater force it could not do so with
property acquired by it.
Before rendering this opinion, I
have made an exhaustive study of
the entire question, and my con-
clusions are based upon the laws
of this State and other States where
the questions have been raised. I
have also tried to find 'a way where-
by the improvement might be made
but must ,confess my failure to do
so. While you have been inspired
by the most laudable motives and
what, in your judgment, was for the
best interests of the community, the
law does not authorize you to pro-
ceed.

Gentlemen: The City Council is
to be congratulated on the very low
bids received for the paving work,
which bids were opened on Monday,
1\'Iarch 13th.
The loiv price on Sheet Asphalt
was $1.35 per square yard compared
with $2.65 last year, a reduction of
49 %. The low price on Bithulithic
paving was $1. 43 per square yard,
compared with $2.40 last year, a re-
duction of over 40 %. .The low price
for brick paving on a concrete base
was $3.05 as compared with $3.74
last year, a reduction of about 18 %.
The reduction in the cost of brick
paving is probably justified by a re-
duction in costs. The reduction in
Sheet paving costs is, in my judg-
ment not justified by the reduction
in paving costs particularly when it
is understood that our specifications
for Sheet pavement are more rigid
than last year. The total reduction
in cost of the 80,000 square yards
where Sheet or brick pavement was
bid this year as compared with the
price in 1921 amounts to$
This should be good news to the
property owners who in the end will
be called on to pay for the work.
These low prices were brought
about tthrough real competition be-
tween the bidders. There was an
active bidder here from another
state. Then too, our specifications
were opened up to permit the lay-
ing of a concrete pavement with a
granite wearing surface, which gave
competition in a line not controlled
by the state paving contractors or-
ganization, which organization di-
vides the sheet paving work among
their own members. All competi-
tive bidding between state contract-
ors matting in the sheet pavement
is more apparent than real. I am
not saying that the state organiza-
tion pronioting vibrolitic pavement
is operating any differently, but still
there is competition between the two
organizations and between the mem-
bers of the two organizations which
are picked by the organization to
handle the various jobs coming up.
In making my recommendations
regarding the kind of pavement to
be laid, I have had in the
importance of retaining for the peo-
ple of Dubuque this continued com-
petition. I have also bourne in mind
the cost, and the desirability of the
different types of pavement to meet
the traffic on the different streets.
I am also forced to consider the fact
that 82,000 square yards of paving
are included in these proposals and
while one contractor should be able
to lay this work in one season with-
out difficulty, yet from past perform-
ances here it would seen wise not
to expect too much of one contract-
or. I, also, in fairness to all types
of paving wish to state that the total
comparative costs are probably
somewhat high for bithulithic, as
there is a cost for binder included
in the estimate which we are assur-
ed will not be required or necessary.
Omitting the binder cost the differ-
ence in cost between sheet asphalt
and bithulithic will range between
eight cents per square yard and six-
teen cents per square yard, the sheet
asphalt being the cheaper in every
case.

for brick amounts to $15,23'9.64. The
J. F. Lee Paving Co., is low on all
three of these types of pavement.
Even - Uhlrich - Staner Co., is low on
vibrolithic, their bid amounting to
$15,684.78.
I would recommend that this
street be improved by paving with
sheet asphalt (Mexican .Brand, in
accordance with proposal,) Dubuque
has a great deal of asphaltic con-
crete paving and a considerable bitu-
lithic paving, but to date, there has
been no sheet asphalt laid in the
city. Other cities are using sheet
asphalt considerably for the paving
of streets on which a considerable
amount of traffic falls. They are
using this type of pavement in com-
petition with brick and bithulithic.
I feel that this type of pavement is
suited to meet the requirements of
West Fifth street and as the price
is materially. less than bitulithic, I
would recommend that the contract
for the improvement of West Fifth
street be awarded to the J. F. Lee
Paving Co., who are the low bidders
on this type of pavement.

Jackson Street is bound to become
the street on which most of the
heavy traffic to the north part of the
city will follow. After preliminary
investigation,' I was satisfied with
vibrolithic for a street of this char-
acter and included vibrolithic in our
specifications. Within the past few
weeks I have had reports from a
number of cities where vibrolithic
pavement has been used for a num-
ber of years, and, based upon these
reports togetaher with a personal
investigation of some three miles of
vibrolithic paving outside the city of
Chicago, I would recommend vibro-
lithic pavement for this street and
would therefore recommend that the
contract be awarded to the Even -
Uhlrich- Staner Co., as their bid is
the lowest one reecived for this type
of pavement.

The revenues and expenditures of the City Waterworks, the Athletic
Field and the Municipal Bathing Beach are not included in the above
statement.
The balance in the County Road Fund on April 1st, 1922, as well as
the moneys accruing to this Fund during the year is shown as being a
Miscellaneous Revenue. This money will be entirely expended during this
year in connection with the new grading work on Rockdale Road.
The total moneys anticipated to accrue to the General Funds both
from taxation and from Miscellaneous Revenues as shown on a previous
page amount to $356,871.89. The total proposed to spend from the General
Funds in accordance with the above statement amounts to $324,556.13,
which leaves an unappropriated balance in the General Funds of $32,315.76.
To this can be added the General Fund balance as of April 1st, 1922, which
should amount to approximately $30,000.00 which will leave the sum of
approximately $62,315.76 to be used during the year for any proper muni-
cipal purpose. In this statement the Tax Title certificates amounting to
about $107,000.00 are considered as cash.
In connection with Protection of Life and Property $26,859.00 is on
account of the Electrical Department. Of this amount $21,454.20 is on
account of permanent improvements in connection with the new Fire
Alarm Building and could be financed by bond issue if it was necessary
to do so.
In connection with the expenditures for the past year, there are certain
points to which particular attention is called:

Payment to Mrs. Spahn for Lease of Garfield Ave. Bldg
Municipal Indebtedness in excess of 1921 appropriation 50,170.00

$204,993.67
Of the above expenditures which were not anticipated in the last year's
budget, the item of Tax Sale Certificates is carried as a live asset. The
balance of the above expenditures have been cared for from the municipal
revenue. Also, if the tax sale certificates should be redeemed by April 1st,
this city would be absolutely without current deficit, and this is true, with
out touching the taxes in hand for the next fiscal year.

Mayor Alderson read the call and
stated that service therefore had
been duly made and that this meet-
ing is called for the purpose of can-
vassing the petitions of the various
candidates for the offices of Council-
men to be elected March 27th, 1922,
and acting on any other business
that may come before the meeting.
A RESOLUTION.
The City Council of the City of
Dubuque, having canvassed the pet-
itions of various candidates for the
offices of Councilmen, to be elected
March 27th, 1922, find that the pet-
itions of the following candidates
contain the required number of sig-
natures, and said candidates are
hereby declared nominated for the
various terms:

contract for filling that part of Raf-
ferty's Slough West of Salina, street
and North of Railroad avenue, be
awarded to the La Crosse Dredging
Company and the City Solicitor be
authorized to prepare contract, and
be it further more resolved by the
City Council of Dubuque that a part
of this property is to be used for
park playground purposes and the
the balance is to be disposed of for
manufacturing purposes at a price
not less than the present value of
the ground plus the expense Of Seconded by Councilman Mel -

streets and personally feel that all

removed. If the Council concur in
this belief I shall be glad to have
instructions to have these old posts
removed on Central avenue, Iowa
street, Main street and Eighth street.
It is a very good time now to do it,

have these posts removed.

An ordinance amending an ordin-
ance entitled "An ordinance regulat-
ing the sale and distribution of milk,
cream and ice cream within the City
of Dubuque, prescribing sanitary
,condition for dairies and milk, cream
and ice cream depots and other
places where these products are
sold, received and delivered from;
requiring licenses for the sale of
milk, cream and ice cream and de-
fining the procedure to procure the
same; providing for the appointment
and Dairy Inspector and defining his
duties; and fixing a penalty for the
violation hereof," the same being
ordinance number 112 and having
been adopted December 20th, 1921.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. —That an ordinance en-
titled, "An ordinance regulating the
sale and distribution of milk, cream
and ice cream within the City of
Dubuque, prescribing sanitary con-
ditions for dairies and milk, cream
and ice cream depots and other
places where these products are sold,
cream and ice cream and defining
the procedure to procure the same;
providing for the appointment of
Dairy Inspector and defining his dut-
ies; and fixing a penalty for the vi-
olation hereof," the same being or-
dinance number 112 and having been
adopted by the Council December
20th, 1921, be and the same is here-
by amended by adding thereto the
following paragraph. Paragraph 57 %.
Nothing contained in this ordinance
shall be construed as repealing or
relieving the persons who are re-
quired to secure a license, covering
the matters herein provided for, un-
der ordinance of the City of Du-
buque, the language of this ordin-
ance to the contrary notwithstand-
ing, so that wherever licenses are
required under tho ordinance of the
City of Dubuque, such license must
be procured by the persons provided
for in said ordinance.
This ordinance shall be in force
and effect ten days after its final
passage by the City Council and pub-
lication as is required by law.

of Dubuque from all claims for dam-
ages which she may have as a re-
sult of such injuries, her intention
being to settle her entire claim, in -_
cluding loss of services, doctor bills,
and hospital bills as well as pain and
suffering and permanent disability

A communication of the Retail
Druggists Association relative to the
licensing of soda fountains, present-
ed, claiming that soda business as a
side line is not profitable, that the
majority of fountains are operating
in the smaller outlying stores, that
there are few Cities in which is a
soda fountain license at all, that the
soda fountain license flat rate of
$10.00 is excessive in most cases.
They Suggest that the present li-
cense be abolished and if it is nec-
essary to have a license of this kind,
the rate should be not more than
$5.50 per table, to seat four persons,
or some other plan in .order that the
license may be graduated. No action
taken.
Councilman Brede moved that E.
E. Frith be allowed for collecting
garbage, $18.00 for each working day
in addition to his contract, from
April 1st, 1922, to December 1st,
1922, and the City Solicitor be auth-
orized to draw up a system similar
to the one adopted by the Council

The following budget of expenditures for the fiscal year 1922, on the
basis of the expenses for the several departments of the City, has been
submitted by the City Manager to the City Council, and such budget has
been adopted by the City Council as its budget for the fiscal year 1922.
This budget will be considered for final adoption by the City Council at
a special session to be held in the Council chamber of the City Hall on
the 31st day of March, 1922. Any taxpayer objecting or protesting to the
same or to any item thereof, or to any omission therefrom, shall present

Council met at 4:30 p. in.

Mayor Alderson in chair.
Mayor Alderson read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of adopting
the budget for 1922 and acting on
any other business that may come
before the meeting.
Supplemental Agreement.
Articles of agreement are hereby
entered into by and between the City
of Dubuque, a Municipal Corporation
of Iowa, and E. E. Frith, of the City
of Dubuque, with and under the fol-
lowing terms, conditions and limit-
ations, to wit: —
Whereas, said E. E. Frith has a
contract with the City of Dubuque
for the collection of garbage, waste
matter and dead animals bearing
date of October 2, 1916, and by the
terms of which he is to be paid the
stipulated compensation of forty dol-
lars ($40.00) per day; and
Whereas, it has been established
to the satisfaction of the City Coun-
cil of the City of Dubuque that said
E. E. Frith is unable, under prevail-
ing economic conditions to carry on
said contract for the compensation
agreed to in the original contract
and to attempt to do so would re-
sult in loss to the contractor and
ultimate discontinuation of the col-
lection of garbage:
Now. therefore, it is mutually
agreed between the parties hereto
that beginning with April 1, 1922
and ending with November 30, 1922,
the compensation to be paid said
contractor shall be increased from
forty dollars ($40.00)) per day to
fifty eight dollars ($58.00) per day
for each working day, with the fol-
lowing conditions and limitations at-
tached, to wit: —
Said contractor shall immediately
and during the period above stated
put into service, use and maintain
not less than (6) vehicles daily for
March 31, 1922
the collection of garbage, waste mat-
. ter and dead animals. Provided,
however, that if motor trucks are
used instead of horse drawn vehicles,
one such truck shall be equivalent
to two horse drawn vehicles. It is
specifically stipulated and agreed, al-
so, between the parties hereto, that
for each day that said contractor
uses and employs a lesser number
of vehicles for the collection of gar-
bage, waste matter and dead animals
than six (6), or the equivalent there-
of in motor trucks, there shall be
deducted by the City of Dubuque the
suin of nine dollars, sixteen and two -
thirds cents ($9.16 -2/3) per day for
each vehicle not used in such ser-
vice, and such deduction shall be-
made during the period of this agree-
ment.
It is further stipulated and agreed
that this supplemental agreement
shall expire by limitation-on the 30th
day of November, 1922, and from
and after that period tae compensa-
tion provided for in the original con-
tract shad be paid.
It is further stipulated and agreed
that during the period of this agree-
ment none of the terms and condi-
tions of the original contract, ex-
cept as the same apply to compen-
sation and number of venicles, shall
be affected and all of said contract
shall continue in force and effect.
Dated at Dubuque, this 31st day
of March, 1922, and signed by the
Mayor on behalf of said City of Du-
buque under direction of the City
Council, as one party, and by the
contractor as the other party.

The revenues and expenditures of the City Waterworks, the Athletic
Field and the Municipal Bathing Beach are not included in the above
statement.
The balance in the County Road Fund on April 1st, 1922, as, well as
the moneys accruing to this Fund during the year is shown as being a
Miscellaneous Revenue. This money will be entirely expended during this
year in connection with the new grading work on Rockdale Road.
The total moneys anticipated to accrue to the General Funds both
from taxation and from Miscellaneous Revenues as shown on a previous
page amount to $356,871.89. The total proposed to spend from the General
Funds in accordance with the above statement amounts to $324,556.13,
which leaves an unappropriated balance in the General Funds of $32,315.76.
To this can be added the General Fund balance as of April 1st, 1922, which
should amount to approximately $30,000.00 which will leave the sum of
approximately $62,315.76 to be used during the year for any proper muni-
cipal purpose. In this statement the Tax Title certificates amounting to
about $107,000.00 are considered as cash.
In connection with Protection of Life and Property $26,859.00 is on
account of the Electrical Department. Of this amount $21,454.20 is on
account of permanent improvements in connection with the new Fire
Alarm Building and could be financed by bond issue if it was necessary
to do so.
In connection with the expenditures for the past year, there are certain
- points to which particular attention is called:

Mortgage for Allison & Henderson Memorial Park 4,000.00
Payment to Mrs. Spahn for Lease of Garfield Ave. Bldg
Municipal Indebtedness in excess of 1921 appropriation 50,170.00

Of the above expenditures which were not anticipated in the last year's
budget, the item of Tax Sale Certificates is carried as a live asset. The
balance of the above expenditures have been cared for froth the municipal
revenue. Also, if the tax sale certificates should be redeemed by April 1st,
this city would be absolutely without current deficit, and this is true, with
out touching the taxes in hand for the next fiscal year.

by the city to meet emergency pur-
poses or deficits in the various de-
partments of the city or which may
arise from unforseen conditions.
Section Two. That the distribu-

cordance with the budget of expendi-
tures adopted by the City Council on
March 31, 1922, which budget is here-
by made a part of this ordinance by
reference thereto, and shall be taken
as the basis for and considered in
connection with the expenditures of

be available when properly trans-

Gentlemen: In connection with
the Appropriation Ordinance passed
at the last meeting in March, 1921,
for the ensuing fiscal year there are
remaining balances in .a number of
items and in other items the funds
are somewhat overdrawn. In order
to start the next year with a clean
account, I would recommend the fol-
lowing further appropriations, the
same to be made from the unap-
propriated balance and the contin-
gent fund, as provided in the last
Appropriation Ordinance.

that all the above deficits or short-
ages be taken care -of by ordering
transfers from the unexpended bal-
ance ?n the consolidated funds.

The deficit -on account of City
buildings was caused by expendi-
tures in connection with redecorat-
ing which were not contemplated.
The deficit on account of inspection,
is due very largely to the fact that
the superintendent of the fire alarm
station has been paid out of this
fund for the last -few months. The
deficit on account of the fire depart-
ment is due to the fact that the
new pumper was paid for out of
the funds appropriated for the pur-
chase of minor equipment. The defi-
cit in the health department is due
largely to the fact that an extra
nurse was employed for which there
was no regular apropriation. The
deficit on account of garbage collec-
tion is due to the increase com-
pensation which was granted to the
garbage collector. The big short-
age in municipal indebtedness is due
to the fact that the excess loan '
warrants beyond the amount for
which bonds were issued, were tak-
en care of.
There are also balances in a num-
ber of the appropriations notably in
the highways, amounting to $4,500
and in the street cleaning amount-
ing to something over $6,000 and
smaller amounts in .other depart-
ments. At the end of the fiscal
year, these balances are automatic-
ally ,cancelled and the unexpended
balance is transferred to the general
fund.

Mr. Rooney was elected to the
two year term, from 1920 to 1922,
and during his term in office he
proved that he was worthy of the
trust imposed in him; all of his ef-
forts were directed toward the pro-
motion of the best interests of the
city; he performed his duties with-
out fear or favor, at all times recog-
nizing the equality of rights of all
of the citizens in the community;
he is honored and respected by all
city employes and held in the high-
est regard by his fellow councilmen.
After two years of unselfish ser-
vice he refused to accept re -elec-
tion; his personal affairs are such
that they require his whole atten-
tion and it was impossible for him
to serve longer; the greatest com-
pliment that can be paid him is the
fact that citizens representing every
walk of life, exerted every effort to
cause him to accept re- election, and
this gives evidence of the respect
and confidence which the whole
community has in him.
His fellow members in the council
and Mr. Carr, desii e to take this oc-
casion to extend to Magnus Rooney
this expression of their respect for
him and pledge themselves united to
him in a bond of never- ending
friendship.
Be it therefore, resolved that, in
order that these sentiments may be
preserved to posterity, this resolu-
tion be spread upon the official rec-
ords of the City Council and the
same be published in the official
newspapers of the city.

Attorney W. W. Paisley addressed
the Council relative to special as-
sessment against the property of T.

pine street be improved as recom-
mended by the City Manager, bitul-
ithic pavement in center of street
and 7 foot hillside brick gutters,
from the South property line of Sol-
on street to the North property
line of Dodge street, and the con-
