dation of the City Manager it be
deemed necessary and advisable to
improve each of the following
streets, presented:
South Locust Street from the
North property line of Grandview
Avenue to the South property line
of Cannon street, by grading, instal-
lation of concrete curb and gutter
and by paving with either bitumin-
ous macadam or vibrolithic paving.
Apple Street from the 'South prop-
erty line of Cleveland Avenue to the
North property Inc of Oak Street,
by grading,' installation of concrete
curb and gutter and by paving with
either bituminous macadam or vibro-
lithic paving.
Algona Street from the North
property line of Delhi Street to the
South property line of West Four-
teenth Street by grading, installa-
tion of concrete curb and gutter
and by paving with either bitumin-
ous macadam, or vibrolithic paving;
also by the installation of sewer,
water and gas connections wherever
found necessary.
Edward Street from the West
property line of Windsor Avenue to
the East property line of Queen
Street by grading, installation of
concrete curb and gutter and by

Alley between Rhomberg Avenue
and Garfield Avenue from the West
property line of Farley street to the
East property line of Fengler Street
by grading and by paving with eith-
er bituminous macadam or vibro-
lithio paving.
Councilman Brede moved that the
notices be received and filed. Sec-
onded by Councilman Gabriel. Car-
ried by the following vote:

A remonstrance against the im-
provement of South Locust street,
signed by John Brady, Everett
Brown, O. H. Simonds et al, asking
that the improvement be not made
at this time, but that the same shall
be held in abeyance until such time
as the interested parties again ask
action on part of the Council; stat-
ing that South Locust street from
Southern Avenue is approximately
3,100 feet long and is in no way a
traveled thoroughfare, and therefore
to improve only 277 feet on the
south end of this street would in
no way serve the general public;
were the general public to be bene-
fitted by this improvement no pro-
test would be filed. Certain of the
petitioners hereto are not subject to
assessment for this contemplated
improvement, but participate in this
remonstrance as evidence that the
improvement is unnecessary at this
time from the viewpoint of the
neighborhood.
Councilman Schrempf entered and
took his seat at 4:35 p. m.
Miss Mae Peabody and Mrs.
Blount addressed the Council rela-
tive to said improvement, stating
that they wanted the improvement
made, that it is very necessary that
the work should be done. that the
street is at times in very bad condi-
tion. Mr. O. L. Simonds, one of
the signers of the remonstrance, ad-
dressed the Council, stating that
Miss Peabody and Mrs. Blount would
surely be benefitted by the improve-
ment, but personally thinks that the
driveway was in a very fair condi-
tion and that work of improving this
part of the street should be deferred
until the City saw fit to improve the
whole street. Councilman Brede
moved that action on this matter be
deferred until the next meeting of
the City Council. Seconded by Coun-
cilman Gabriel. Carried by the
following vote:

men Brede, Gabriel, Melchior,
Schrempf.
Nays —None.
A remonstrance against the im-
provement of Annie Street. signed
by Mrs. Mary Dolan, Mrs. Ella O.
Marhan, Phil. Lavery et al. pre-
sented, stating that the road is in
fair condition and that all it needed
was a little repairing. and asked
that the Council give the street a
thorough inspection before improv-
ing it. Mr. Roddy, a resident on said
street. addressed the Council in fa-
vor of having the street improved,

The Clerk was authorized to again
notify the County Treasurer to ac-
cept from Josephine Wasser City
taxes in the same sum as she paid
last year on City N. 1 /2 of N. W. 1-5
of Lot 482.
The bond of Herbert Adams, Park
Commissioner, presented. It being
properly executed, Councilman Ga-
briel moved that it be received and
filed. Seconded by Councilman
Brede. Carried by the following
vote:

Bond of the Dubuque Auto -Tire
and Accessories Co. for the operation

Be it resolved by the City Council
of the City of Dubuque that, upon
recommendation of the City Man-
ager, it be deemed necessary and
advisable to improve Apple Street
from the South property line of
Cleveland Street to the North pro-
perty line of Oak Street, by grading,
curbing and guttering with combin-
ation cement curb and gutters, and
by paving said portion of said street
with either bituminous macadam or
vibrolithic paving.
Said work to be done in accord-
ance with the plans and specifica-
tions to be prepared by the City
Engineer.
The cost and expense of said im-
provement will be assessed against
all of the property subject to assess-
ment for the improvement as is
provided by law.
Be it further resolved that the
above and foregoing improvement
is hereby proposed to be made and
constructed as hereinbefore set forth
and that this proposed resolution
(except this paragraph) be and the
same is hereby set down for further
and final hearing, consideration and
determination at a meeting of the
City Council to be held the 1st day
of May, 1922, at 4:30 p. in., in the
Council Chamber, and that the City
Clerk be and he is hereby instruct-
ed to cause notice of the pendency
of the above resolution and the time
and place, when and where said
resolution will be considered for pas-
sage and objections heard, to be
given by publication in the official

pending investigation. Seconded by

ifications prepared by the City Engi-
neer and now on file in the office of
the City Clerk, having been duly ap-
proved by the City Manoger and sub-
mitted to the State Board of
Health for approval.
That the cost and expense of mak-
ing and constructing said sanitary
sewer shall be assessed against the
property abutting upon the same
and also against all adjacent prop-
erty benefitted thereby.

Gas Co. accepting the Special Ordin-
ance and the terns of the Special
Ordinance, as follows:
At a meeting of the Board of Di-
rectors of the Key City Gas Com-
pany, duly called and held at the
Company's • office, Dubuque, Iowa,
April 25, A. D. 1922, the said Board
of Directors duly adopted the follow-
ing Resolution of Acceptance:
The Key City Gas Company here-
by accepts the special ordinance and
the terns of the special ordinance,
entitled:
purpose of widening Grandview Ave-
nue east of Southern Avenue. There
was, however, but one isolated strip
of ground acquired at that time for
that purpose and without the carry-
ing out of the propositon for the
widening of the street this piece of
ground is useless to the City. I find
that the popular idea was that this
was to be used for park purposes
and is known as Hickey's Park, hav-
ing been purchased from a Mr.
Hickey for the sum of $240.00. It
liar been, however, left without any
attention and is by itself, in my
judgment, without value for park
purposes.
The ground back of this strip is
owned by Miss Margaret Maher. I
have taken up with Miss Maher the
matter of the purchase of this strip
of ground. She desires to purchase
it and Will pay the City the amount
which the City paid to Mr. Hickey
in 1914, on the basis of $50.00 down
and the balance $10.00 per month
without interest.
I would respectfully recommend
that this property be sold to Miss
Margaret Maher and that the City
Solicitor prepare the necessary sti-
pulation and agreement to safeguard
Miss Maher in connection with her
property.

of twenty -five years and regulating
the same; repealing all existing
franchise ordinances heretofore

a vote of the legal voters of said

Rafferty's Slough. So far I have
completed negotiations for all but
three pieces. Negotiations are pend-
ing on these three pieces.
I would recommend the purchase
by the City of the following prop-
erty.
Lot 1, Coates Add.; Block 12, Du-
buque Harbor Company Add.; Block
21, Dubuque Harbor Company Add.;
owned by the Shield's Estate and
handled by Wm. Lawther, Jr., at
the price of $2,280.
The -undivided % interest of
Blocks 22 and 23 Dubuque Harbor
Company Add., owned by James
Burch, at the price of $800.
The undivided 1 72 interest of
Blocks 22 and 23, Dubuque Harbor
Compony Add., owned by Scott's
Estate, at the price of $800.

Gentlemen: On January 16, 1922,
Miss Margaret Galvin fell and broke
both bones in her right ankle on a
sidewalk located in front of Number
135 South Locust street. The ac-
cident occurred about seven (7)
c'clock • in the morning while Miss
Galvin was on her way to work. The
place where she fell was dangerous
by reason of the fact that there is
a depre-sion in the walk of about
six to eight inches and this condi-
tion has existed for a long time. In
fact there is no improved sidewalk
at this point. There is a space pos-
sibly eight feet wide which is dirt
and stone and entirely unimproved
and Miss Galvin in stepping from a
cement sidewalk was required to
walk over this place to get to the

next sidewalk. In doing so she slip-
ped and fell in this depressed spot
which at that time was covered with
ice. I have consulted with all of
the persons who know something
about the condition that morning
and they all say that there was a
good deal of ice there where she
fell. I pointed out the place to Mr.
Carr some time ago after the acci-
dent occurred.
Miss Galvin is confined to her
home at this time and has incurred
a good deal of expense by way of
doctor bill and loss of time. She is
willing to accept a settlement in
the sum of Three Hundred ($300.00)
Dollars which I consider fair and
reasonable under the circumstances
in the case. It is possible that her
injury is permanent and I believe
that it were better to settle with
her now than to permit the case to
go to suit. The city would have no
defense in the action. For that
reason I am suggesting a settlement
with her in the sum of Three Hun-
dred ($300.00) Dollars.
This condition will continue to be
dangerous until the same is improved
and I would suggest that the proper-
ty owner be required to construct
a sidewalk at this point and thereby
avoid any further occasion. for in-
juries.

Resolution of Necessity for Sewer
Be it resolved by the City Council
of the City of Dubuque, that it be
deemed necessary and advisable to
construct a Sanitary Sewer in Rush
Street and Holly Street, as follows,
to -wit:
A six -inch sanitary sewer in Rush
Street from the sewer in Bryant
Street to Holly Street and in Holly
Street from Rush Street to a point
about 200 feet north, said sewers to
be constructed with laterals to lot
line where necessary -
Said sewer to be provided with
man -holes and any other appurten-
ances that may be necessary.
Said sewers to be constructed in
accordance with the plans and spec-
ifications prepared by the City Engi-
neer and now on file in the office of
the City Clerk, having been duly ap-
proved by the City aMnager and
submitted to the State Board of
Health for its approval.
That the cost and expense of
making and constructing said sani-
tary sewer shall be assessed against
the property abutting upon the same
and also against all adjacent prop-
erty benefited thereby.
Be it further resolved that the
above and foregoing improvement is
hereby proposed to be made and
constructed as hereinbefore set forth
and that this Iroposed resolution
(except this paragraph), be and the
same is hereby set down for further
and final hearing, consideration and
determination at a meeting of the
City Council to be held the 23d day
of May, 1922, at 4:30 p. m. in the
Council Chamber, and that the City
Clerk be and he is hereby instructed
to cause notice of the pendency of
the above resolution and the time
and place, 'when and where said
resolution will be considered for pas-
sage and objections heard, to, be giv-
en by publication in the official

SPECIFICATIONS FOR SIDEWALK
CONSTRUCTION.
Opproved By Dubuque City Councli
May 1, 1922.
All permanent sidewalks hereafter
built in the City of Dubuque are to
be constructed in accordance with
these specifications, whether the
City of Dubuque lets the contract or
whether the work is done by prop-
erty owners themselves.
Location —All sidewalks shall be
placed one (1) foot off of the street
margin or property line, except as
follows:
When the sidewalk extends to the
curb it shall also extend back to the
property line; when a heavy cut or
fill is encountered the Engineer may
so locate the walk as to best serve
the public; when the sidewalk space
is not over 6 feet in width, the walk
shall be placed on property line.
In no case shall a walk be laid
less than five (5) feet in width ex-
, cept with special permission from
the City Council.
Kind of Walk —Only concrete
walks laid in accordance with these
specifications shall be built hereaf-
ter, in the City of Dubuque.
Foundation —All excavation or fill-
ing necessary to bring the base to
proper sub- grade must be done by
the contractor. The sub -grade shall
be ten (10) inches below the finished
grade of the walk except as herein
noted. Upon the sub -grade there
shall be placed a layer of cinders six
(6) inches in thickness after being
thoroughly tamped. In case the
sidewalk is being laid in a soil of
sand or gravel the cinder base can
be dispensed with. When cinders are
not used the ground must be cleaned
of any vegetable matter and thor-
oughly tamped before the concrete
is placed.
Cement —The cement shall meet
the requirements of the current
standard specifications for Portland
cement of the American Society for
Testing Materials.
Sand —The sand used in the con -
truction of sidewalks shall be clean
and graded from fine to coarse, the
coarse particles predominating. The
fine aggregate, when dry, shall pass
a screen having four (4) meshes to
the inch; not more than twenty -five
(25) per cent shall pass a sieve hav-
ing fifty (50) meshes to the inch;
and not more than five (5) per cent
shall pass a sieve having one hun-
dred (100) meshes to the linear
inch. Sand shall contain no injuri-
ous vegetable or other organic mat-
ter nor more than five (5) per cent
by volume of clay or loam.
Stone or Gravel— Coarse aggre-
gate shall consist of clean durable
crushed rock, or river gravel. The
size of coarse aggregate shall range
front one (1) inch down to not more
than (5) per cent passing a screen
having four (4) meshes per linear
inch.
Forms —All forms used shall be
free from warp and strong enough
to keep their shape. They shall be
well secured in place and held to
established grades and lines and
their upper edges shall conform to
the established grade of the walk.
All wood forms shall be thoroughly
cleaned and wetted and all metal
forms must be oiled or coated with
soft soap before being used.
Construction.
Size of Slabs —The length slabs or
independently divided blocks shall
be in no case more than one and one
half (1 tunes the width of the
walk.
Thickness of Walk —The total
thickness of the finished walk shall
be in no less than four (4) inches;
m the business section this thick-
ness could be increased to six inches.
Joints —A joint filler made of a
suitable elastic waterproof com-
pound shall be provided at least
once every fifty (50) feet in the

length of the walk and along the
property line produced at every
street. Sidewalks in business dis-
tricts shall be separated from abut-
ting buildings by a one -hal ( inch
joint. The joint filler shall be one -
half ( inch in width and shall
extend the entire width and thick-
ness of the walk. Suitable joint fill-
er strips can be secured either at
the City Hall or from local dealers.
Mixing of Base — When crushed
rock is•used for concrete the pro-
portions shall be one part cement,
three parts sand and five parts
stone. When river gravel is used
the mixture shall be one part cement
to five parts gravel. All concrete
shall be mixed by machine, except
special permission may be given by
the City Engineer to mix by hand to
meet unusual conditions. A batch -
mixer of any approved type may be
used. The materials shall be mixed
wet enough tb produce a concrete
that will flush readily when slightly
tamped but which can be handled
without causing a separation of the
coarse aggregate from the mortar.
The concrete base shall in no case
be less than three (3) inches in
thickness. Whenever the walk meets
the curb a space of one (1) inch
shall be left between the walk and
the curb which space shalll ate, be
filled with sand.
Wearing Surface — Upon the con-
crete base shall be placed a wearing
surface of not less than one (1)
inch in thickness composed of one
(1) part cement and two (2) parts
sand well mixed together of the con-
sistency of mortar. This wearing
surface shall be placed on the base
before the same has set in order to
secure a homogenious mass.
Finishing —After the wearing sur-
face is brought to the established
grade by means of a strike board it
shall be worked with a wood float
n a manner that will thoroughly
compact it and provide a surface
free from depressions or irregular-
ities of any kind. When required
the surface shall be steel trowled
but not excessively worked. In no
case shall dry cement be sprinkled
on the surface to take up moisture
or hasten hardening. When 'division
plates are not used the slab .work-
ings shall be placed in the wearing
surface directly over the joints in
the base, finished with a tool which
will completely ' separate the wear-
ing course of adjacent slabs.
Cleaning Up —After the contractor
has completed his work he shall
clear away all obstructions, dirt,
sand or gravel or any other material
which may be left over on the work..

removed within two days after com-
pletion of the work the City may
clear same away and charge the

the City will charge the same to the
contractor which bill must be paid

rial shall be stored by contractor in
such a way as to leave an open

Claims — Before the City makes

he shall give satisfactory evidence
to the City that all claims for labor
and material used in connection with
the contract have been settled in
full.
Permits — No permit shall be Is-
sued by the Engineer for a perman-
ent walk unless plan for the same
shall first be submitted to him and
approved by him. All new walks
must be constructed to conform as
nearly as possible to contiguous
walks.
Maintenance —The contractor shall
guarantee and maintain the sidewalk
built under these specifications in
good condition for one year after the
work is completed and accepted.

Dubuque— License.
Whereas, there is no storm water
sewer in the northerly end of Mount
Pleasant avenue where said avenue
terminates at the property on which
the home maintained by Mount
Pleasant Home is situated, and the
only outlet for storm water in the
locality is into the sanitary sewer,
and
Whereas, the City of Dubuque de-
sires to place, without expense to
said Mount Pleasant Home, a storm
water sewer from the northerly end
of Mount Pleasant avenue across the
property platted as Lot one (1) of
Gray's sub - division number one (1)
which lot is also described - as lot 1
of 3 of Mount Pleasant, a part of
Dubuque and which property is own-
ed by Mount Pleasant Home and
constitutes a part of the grounds ad-
joining and used for its said Home,
said storm water sewer to eventually
connect with the storm water sewer
to be placed in Wood street, and
Whereas, said - storm water sewer
is needed to take care of the storm
water gathering at and around the
notherly end of said Mount Pleas-
ant avenue,
Nov therefore, know all men by
these presents: That the undersign-
ed Mount Pleasant Home, a corpor-
ation not for pecuniary profit, organ-
ized under the laws of the State of
Iowa with its principal place of bus-
iness at Dubuque, Iowa, in consider-
ation of the premises as above stated
and of one dollar in hand paid by the
City of Dubuque, the receipt of which
is hereby acknowledges does hereby
grant to said City of Dubuque a
• license to place and maintain during
the northerly side of lot one (1) of
Gray's subdivision number one (1)
otherwise described as lot 1 of 3 of
Mount Pleasant, a part of Dubuque,
from Mount Pleasant avenue to the
alley at the westerly end of said
lot, said storm water sewer to be
placed at sufficient depth so that
when completed it will not interfere
with the cultivation and use of the
surface of the ground, to be not to
exceed 15 inches in diameter and to
be placed and installed without any
cost or expense to this grantor.
This license is to continue with-
out right of revocation for the term
of seven years, from March 1, 1922,
and thereafter until it shall be re-
voked by this grantor or its succes-
sors or assigns, this grantor reserv-
ing the right to revoke said license
at any time after the expiration of
said seven years in case this grantor,
its successors or assigns should de-
sire to carry on any building opera-
tions on said grounds that would be
interfered with by said storm water
sewer. Such revocation may be by
a notice to the said city and in case
of such revocation the city will
promptly remove said storm water
sewer from said premises.
In testimony whereof the said
Mount Pleasant Home which has no
corporate seal has caused this in-
strument to be executed by its duly
authorized officers this 27th day of
April, 1922.

Whereas, under proceedings insti-
tuted by the City Council of the City
of Dubuque to condemn certain real
estate for the purpose of widening
Alta Vista street, said real estate
belonging to Edward Muntz and be-
ing described as a strip of land off
of Lot forty -six (46) in Oxford
Hiights Addition to the City of Du-
buque, a jury was appointed and its
award adopted by the City Council,
and an appeal has been taken from
said award to the District Court of
Dubuque County, Iowa, by the said
owner of said land; and
Whereas, it appears that said con-
demnation proceedings were irregu-
lar and no jurisdiction to condemn
said land attached thereto or was
acquired by the City Council of the
City of Dubuque: Now, therefore,
Be it resolved by the City Council
of the City of Dubuque, that all con -
demnation proceedings heretofore
taken by the City upon the matters
hereinbefore stated be, and the same
are hereby rescinded, and the award
of the jury set aside, and the war-
rant drawn in favor of Edward
Muntz cancelled.
This resolution being deemed ur-

Julien Avenue, and for that purpose

strip of land off of Lot Forty -six (46)
in Oxford Heights Addition to the
City of Dubuque, Edward Muntz,
owner; and
Whereas, said City of Dubuque
and the owner of said land are un-
able to agree upon the fair and rea-
sonable price of compensation to be
paid therefor; and
Whereas, in order to acquire said
land for the purposes named, it will
be necessary to condemn, by proper
proceedings, so much of said land
as is needed for the contemplated
improvement; now, therefor be it
Resolved by the City Council of
the City of Dubuque, that the City
Engineer be and he is hereby in-
structed to make a plat and survey
of the land necessary to be taken
for said improvement and, when the
same is made, to present the same
to the Sheriff of Dubuque County,
Iowa, for the information of the
Jury to be summoned by him, of the
property owner and of himself.
Be it further resolved that written
application be made to the Sheriff
of Dubuque County, Iowa, to appoint
six (6) free holders, all of whom to
be resident of the City of Dubuque,
Iowa, and not interested in the
same or a like action, to inspect
said premises and assess the dam-
ages which said owner will sustain
bythe taking of said real estate.

said free holders are appointed, a
ten (10) days' notice in writing be

An ordinance repealing Section
Thirteen, Pharagraph 485, of an or-
dinance entitled "An Ordinance re-
lating to public dances and the li-
censing and regulating of public
dance halls;' the same being Ordin-
ance Number Sixty -five of the Ite-
vfsed Ordinance of the 'City of Du-
inutile of 1919, and enacting a sub-
stitute in lieu thereof; also chang-
ing the words "Mayor or Chief df
Police" to "Manager" in Section
Four, paragraph 476 of said Ordin-
ance; also 'changing the word "May-
or" to "Manager" in Section Eleven,
Paragraph '483 of said
Be it ordained by the City 'Connell
of 'the City of Dubuque:
Section One. That section thir-
teen, paragraph 485 of an ordinance
entitled "An Ordinance relating to
public dances and -The licensing and
- regulating of public dance halls," 'be
and the same is 'hereby repealed,
said section reading as follows:
485. "Police Officer shall attend.
Section Thirteen. 'That no person,
club, society or corporation shall
give, conduct, or carry on a public
dance as defined in this ordinance
without having in attendance, con -
tinuously during such dance a mem-
ber of the Police Departmen 'who
shall see that the provisions of this
ordinance are strictly complied with.
The Chief of Police shall detail the
member of the Police Department
who shall attend each public dance
and•the person; club, society or corp-
oration giving, conducting or carry=
ing on such public dance shall pay
to the officer, for such attendance,
a sum equal to a day's wages of
such officer, determined by his sal-
ary per month.
Section Two. That, in lieu of said
section there shall be substituted
and enacted the following provision,
the same being made a part of said
ordinance and 'numbered so as to
take the place of said ordinance and
numbered so as to take the place of
the section herein repealed:
485. "Police Regulation, Section
Thirteen. That whenever a public
dance is being conducted in a public
dance hall, as herein defined, the
Chief of Police shall detail a special
or regular officer to be in attendance
at such dance, either 'continuously
or at periods during the dance. It
shall be the duty of such officer to
strictly enforce the provisions of
this ordinance and to prevent any
violation thereof, even to the extent
of closing the dance and recommed-
ing a revocation of the license for
violation 'of the provisions of the
ordinance. The perGnns
the dance -shall .pay the City, in ad-
vance, the sum of $5.00 for each
:night 'or day the dance is held, -and
such fee shall cover •the expense of
such police protection and regula-
tion. It shall 'be unlawful to •pay
to any police officer any money or
thing of value for such services,
and it shall be a breach of discipline
for any officer to accept any money
or thing of value from any person,
other than the City, for services or
for any purpose in - connection with
such public dance."
Section Three. That wherever the
words "Mayor or 'Chief of Police"
appear in Section Four, paragraph
476, there shall be substituted there-
-fore the word "Manager."
Section Four. 'That wherever the
word 'Mayor" appears in Section
Eleven, paragraph 483, there shall
be 'substituted therefore the word
"`Manager:"

complied with said notice and have
failed to tear down said building
within the time stated in said notice,

being formerly occupied by the
Southern Hohel, be and the same is
hereby declared to be ,a nuisance
and a constant .danger and menace

Be it further resolved that said
parties 'be notified, in writing, by the
Chief of 'Police of the action of the
City Council in declaring said build-

June, 1922, and if said parties fail
or refuse to comply with said notice,
then the Chief of Police shall notify

sessed against the property and col-
lected in the same manner as spe-
cial assessments.
