tion, asking permission to connect
the Washington School on Grand-
view Ave., with the sanitary sewer
in Grandview Ave., presented.
Councilman Brede moved that the
prayer of the petition be granted;
seconded by Councilman Gabriel;
carried by the following vote:

Petition of Geo. Huber asking per-
mission to lower the curb in front
of his place of business at 1654 Cen-

Petition of the Strandberg Bros.
Co., asking for the use of 14th
street from Central Avenue to the al-
leyfirst east of Central Avenue,
while constructing the new Union
Trust and Savings Bank, presented.

seconded by Councilman Schrempf;
carried by the following vote:

Petition of Mary D. Schilling, ask-
ing for relief to the extent of one -
half of the assessment levied against
her property, lot 9 of Quigley's Out -
lot 709, stating that her reasons for
this are that the line from the man-
hole to the house is practically on
the level and any overflow is bound
to back up and injure her property,
and she thinks she is entitled to
some relief.
Councilman Schrempf moved that
the petition be received and filed;
seconded by Councilman Brede;
carried by the following vote:

Petition of Wm. Connolly and Ju-
lia Mosher, asking for reduction in
assessment against their property
for the construction of a sanitary
sewer in Pierce street, stating that
the assessment is much to high in
comparison to the value of the prop-
erty. Councilman Brede moved that
the petition be referred to the City
Manager to investigate; seconded.
by Councilman Gabriel; carried by
the following vote:

Petition of Theodore Buechele in
behalf of the people of the Commun- .
ity, asking that the City roll the
new Carter Road now under con-
struction, presented.

Communication of Myrtle A. West -
aby, presented.
City Council,
Dubuque, Iowa,
Gentlemen:
Inasmuch as the city desires to
purchase a strip twenty -two feet in
width off the west side of lot 2 of
Mineral Lot 179 and inasmuch as I
own this property, I am making you
a price for this strip of ground. need-
ed by the City in order to continue
Ayoca Street to Willow Street as a
42 foot street.
My price is $500.00 for this strip
of ground and I will hold it for the
City until next May, making out a
deed any time the city notifies that
they are ready to pay for the same.
This strip of ground is 149.82 ft.
in depth and 22 ft. in width and
leaves me only 32 feet of ground on
which to build, thereby reducing the
value of my lot more than the actu-
al value of the property would be in
case my lot was wider.
Please advise as to the accept-
ance of my proposition.

To the Honorable Mayor and Coun-
cil of the City of Dubuque:
Gentlemen:
In the year of 1891 an assessment
was levied by the City Council to
pay for the improvement of Grand-
view Avenue. In 1896 an action
brought by the property owners who
were assessed for the city improve-
ment to have the assessment set
aside and declared null and void.
The District Court sustained the po-
sition of the plaintiffs in that action
and enjoined the City from proceed-
ing with the collection of the tax.
There was an appeal to the Supreme
Court in this case and the decree
of the Lower Court was sustained.
Thereby the assessment was sup-
posed to have been cancelled against
the properties of the plaintiffs in
that action and the City enjoined
from proceeding further with the
collection of the tax. T. J. Donahue
was the owner of Lot One (1) of Min-
eral Lot Forty -Six (46), which lot
was assosed for the improvement
and he was one of the parties to
that action. It appears that the as-
sessment against his lot was never
cancelled and I am advised that the
present owner of the lot has been
notified to pay the assessment or the
property will be advertised for sale
at the coming tax sale. My purpose
in addressing this communication, to
the Council is to advise you of the
facts, so that you may order this
assessment cancelled at this time
before any expense is attached to it
by way of advertising, etc. These
are the facts in the case as I have
them from the records on file with
the clerk of the District Court and
my recommendation is that you or-
der the Treasurer to cancel the as-
sessment against this lot and indi-
cate upon his records that the same
was enjoined by the Court in 1896.

Report of the Sheriff of Dubuque
County.
To the Honorable Mayor and City
Council of the City of Dubuque:
Gentlemen:
Pursuant to your petition as sher-
iff of Dubuque County, Iowa, I caus-
ed to be summoned a commission or
jury consisting of six freeholders of
the City of Dubuque for the purpose
of viewing and assessing the dam-
ages to be sustained by the owners
of the property herein described on
account of the taking and appropriat-
ing of a right of way for street pur-
poses 100 feet in width over nd
across Lot Two (2) of the subdi-
vision of Lot Two (2) of the sub-
division of Lot (5) of the subdivision
of Mineral Lot (21) in the City of
Dubuque, the same to be a part of
the Cascade- Dubuque road sr e-lo-
cated. On the 27th day of October,
1922, said commission viewed the
premises and made its award of
damages. The award made by the
commission is as follows:
To Ross McMahon, John McMa-
hon, Geo. McMahon, Florence Ger-
trude Coleman, John Corcoran and
Owen McMahon, the sum of $600.00.
I am reporting this award to you
and await your further pleasure.

The following resolution was

Whereas, the commissioners ap-
pointed by the Sheriff to assess the
damages to the owners of the real
estate under the condemnation pro-
ceedings instituted by the City of
Dubuque, under which proceeding a
strip or belt of ground 100 feet wide
was taken and appropriated as a
right of way for street purposes
through the lands of the parties
herein named, said street to be an
extension of the Cascade- Dubuque
road as re- located, did on the 27th
day of October, 1922, examined said
premises and made an award of the
damages to the Sheriff of Dubuque
County, Iowa, and said Sheriff has
reported the same to the City Coun-
cil of Dubuque, Iowa; and
Whereas, in said award Ross McMa-
hon, John McMahon, Walter McMa-
hon, George McMahon, Florence
Gertrude Kollman, John Corcoran,
and Owen McMahon, owners of lot
two (2) of the subdivision of lot (2)
of the subdivision of lot five (5) of
the subdivision of Mineral lot twen-
ty -one (21 in the City of Dubuque,
Iowa, were awarded damages in the
sum of $600.00; now therefor
Be it resolved by the City Council
of the City of Dubuque, that said
award of the Sheriff's jury or com-
mission be and the same is hereby
accepted.
Be it further resolved that an
award in the sum of $600.00 be issu-
ed to Ross McMahon, John McMa-

In accordance with your instruc-
tions bids were received at two
o'clock p. m. Monday, November
6th, for the grading of that part of
KirkwoodStreet lying west of Alta
Vista Street. The following bids
were received:

per cu. yd.
J. F. Lee Paving Co.— earth, 38c
per cu. yad; loose rock, $1.75 per cu,
yd.; solid rock, $3.00 per cu. yd.
Thomas Welsh— earth, 36c per cu,
yd.
Felix Becker, earth, 36c per cu. yd.
The Engineer's estimate is that
practically 1500 cubic yards of
earth will be removed.
The bids as received from Felix
Becker and Thomas Welsh are both
low. I would recommend that a con-
tract be awrded to one or the other
of these men at once, in order that
the work may be finished before
freezing weather.

Gentlemen:—
In connection with the improve-
ment of Main Street, which was
made in 1893, two pieces of property
belonging to J. H. Shields were as-
sessed for the improvement of this
street. One piece of property, the
Und. 1 -2 of Lot 17, Block 1, was sold
to the city on Septmeber 2nd, 1921,
tax title sertificate being given to
the city for this property. The
amount of the delinquent tax was
$53.65 and $12.87 interest. The or-
iginal assessment for this improve-
ment was considerably more. Appar-
ently Mr. Shields paid what he felt
would have been due had one -quar-
ter of the intersection not been
charged to the corner lot.
At the same time an assessment
was levied against Mr. Shields for
the Und. 1 -2 of Lot 1, Block 10,
which was handled in the same
way, Mr. Shields paying a portion of
the assessment. The balance $165.44
was not paid, neither has the prop-
erty been up for sale on account of
taxes.
On account of the age of these as-
sessments and also on account of
the fact that a considerable part of
the assessment was paid twenty -four
years ago and also in view of the
fact that the assessments on a num-
ber of other pieces of property, as-
sessed at the same time for the same
improvement, were afterwards set-
tled for a very nominal amount, I
would recommend the cancellation
of the certificates which the city now
holds on the Und. 1 -2 of Lot 17 in
Block 1 and the cancellation of the
assessment now remaining unpaid
on the books against the Und 1 -2 of
Lot 1, Block 10.

of the City of Dubuque, that the rec-
ommendation of the Manager be ap-
proved and the Engineer be and he
is hereby instructed to prepare a
plat and schedule showing the lots
or parcels of real estate subject to
assessment for said improvement
and file the same in the office of the
City Clerk subject to public inspec-
tion, and the City Clerk shall, upon
receipt of such plat and schedule,
publish the notice of said assess-
ment as required by law.

the Assessor has promised to ha-

For the year 1918 the delinquent
list showed the following iiupaid
taxes in the City of Dubuque against
the following descriptions: Rail-
road Add. to Dubuque, Block. 16,
Lots 1 to 20, inclusive; Block 23,
Lots 1 to 9, inclusive. Same for
1917 and same for 1916. Block 26,

The last description appearing in
1918 delinquent list is shown as be-
ing Block 15. I believe this is an
error and should read Block 26.
The 1919, 1920 and 1921 tax rolls
should show the above descriptions
owned by this company as exempt,
for the reason that same is used for
railroad purposes.

A Resolution.
Whereas, the building situated on
the Southeast corner of Twenty -
Fourth and White Streets, in the
City of Dubuque, and owned by H.
Pfotzer, being further described as
part of Lot 20A, L. H. Langworthy's
Addition, has been investigated by
the Chief of the Fire Department,
and
Whereas, the Chief of the Fire De-
partment has found said building to
be in a dangerous and hazardous
condition and a menace to public
life and property, and
Whereas, the Chief of the Fire De-
partment has reported the condi-
tions as existing; now therefore
Be it resolved by the City Coun-
cil of the City of Dubuque, that H.
Pfotzr, owner of the building on part
of Lot 20A, L. H. Langworthy's Add.,
situated 011 the southeast corner of
Twenty- Fourth and White Streets,
be notified to remove the above de-
scribed building by the 4th day of
December, 1922, or to appear before
the City Council on the 4th day of
December, 1922, at 4:30 P. M., and
show reason, if ony there be, why
said building should not be removed.
Be it further resolved, that a writ-
ten notice of the passage of this
resolution, together with a copy of
the same, be served on H. Pfotzer
by the Chief of Police or a police
officer appointed by him.

Meeting called by order of Mayor
Alderson and Councilman Brede.
Council met at 4:30 p. m.
Mayor Alderson in the Chair.
Present, City Manager Carr, May-
or Alderson, Councilmen Brede, Ga-
briel, Melchior.
Absent, Councilman Schrempf.
Mayor Alderson read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of levying a
special assessment as is provided
by law to pay for the improvement
of Allison Place from Delhi Street
to College Street, West 5th Street
from Hill Street to Nevada Street,
and acting on any other business
that may come before the meeting.
Notice of publication, certified to
by the publisher, of the city coun-
cil's intention to levy a special as-
sessment as provided by law for
the improvement of Allison Place
from Delhi Street to College Street,
presented.
Councilman Brede moved that the
notice be received and filed; second-
ed by Councilman Melchior; carried
by the following vote:
Yeas -Mayor Alderson, Council-
men Brede, Gabriel, Melchior.

A remonstrance signed by the
Trustees of the Summit Congrega-
tional Church, Officers of Finley hos-
pital, G. A. Barnes, Adam Doerr et
al. protesting against the workman-
ship of the street, stating that it is
done in a poor manner.
Councilman Gabriel moved )that
the rules be suspended to allow any
one present to address the council;
seconded by Councilman Brede; car-
ried by the following vote:
Yeas -Mayor Alderson, Council-
men Brede, Gabriel, Melchior.
Nays -None.
Absent - Councilman Schrempf.
Attorney G. A. Barnes, repre-
senting the abutting property own-
ers, addressed the Council, stating
that the abutters were not com-
plaining about the cost of the street
but they want payment of the street
held up until it is put in condition
as called for in the specifications;
he claims there are cracks in the
gutters, and ruts in the street, and
that the work is not satisfactory to
the abutters.
Councilman Brede moved that ac-
tion on this street be deferred until
the next meeting of the Council,
pending investigation; seconded by
Councilman Gabriel; carried by the
following vote:
Yeas -Mayor Alderson, Council-
men Brede, Gabriel, Melchior.
Nays -None.
Absent - Councilman Schrempf.

The City of Dubuque in the State

Both principal and interest are pay-

State of Iowa. This bond is issued
by the City of Dubuque pursuant to
and by virtue of Chapter 8, Title V
of the Code of Iowa and amendments
thereto, and in accordance with a
resolution of the City Council of
said city, duly passed on the 10th
day of November A. D., 1922. This
bond is one of 'a series of 38 bonds,
37 for $300.00 each numbered 8002
to 8038 inclusive and one bond for
$225.84 numbered 8039, .dl of like
tenor and date, and issued for the
purpose of defraying the cost of the
improvement of West Fifth Street
from the north line of Hill Street to
the west line of Nevada Street, and

cost is assessable and levied along
said improvement, and is made by
law a lien on all abuting or adjacent
property, and payable in ten annual
installments, with interest on all
deferred payments at the rate of
five per cent per annum, and this
bond is payable only out of the mon-
ey derived from the collection of
said special tax, and said money can
be used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution;, and for the as-
sessments, collections and payment
here on of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably pledg-
ed.
In witness whereof the City of
Dubuque by its City Council, has
caused this bond to be signed by
its Mayor and countersigned by its

At a meeting of the City Council
on November 6th, 1922, a petition
signed by Wm. J. Connolly and Julia
Mosher, protesting against the as-
sessment against lots 4, 5, and 6
Connolly's Sub., which were assess-
ed for the sewer in Pierce street,
was referred to the City Manager
for investigation and report. I have
investigatied the matter and find as
follows:
Lots 4. 5 and 6 which were assess-
ed for the Pierce street sewer were
not previously assessed for any sew-
er. I also find that these lots are as-
sessed as follows on the City as-
sessor's books: Lot 4 is assessed
at $500.00; lot 5 at $400.00, and lot
6 at $400.00. The assessment for the
sewer against these lots is $82.34
for lots 4 and 5 and $60.94 for lot 6.
All of these assessments are way
under the one - quarter valuation of
the property as shown on the books
of the City Assessor. My recommend-
ation would ,therefore, be that the
petition be received and filed and
that Wm. J. Connolly be advised of
the disposition of the petition.

Gentlemen:
In 1919, a contract for a sewer in
Valeria Street was let to the Even -
Uhlrich- Staner Company. The as-
sessment on account of this sewer
was levied sometime during the year
1920. Among the assessments was
one of $432.82, levied against Lot 6,
Brewery Add., which is handled by
W. H. Mouser.
Under date of December 31st,
1920, I reported to the City Council
that this property was assessed for
$1,000, and recommended that the
assessment as levied be reduced to
$250.00 from $432.82. This recom-
mendation was accepted by the
Council.
On further investigation, I find
that Lot 6, Brewery Add., is a very
large lot, containing nearly one acre
of ground, and there is only a small
part of this lot which abutts Va-
leria Street. The value of that part
of the lot which could be served by
the sewer is probably not over
$325.00. I would therefore suggest a
further reduction of this assessment
from the amount as fixed by the
Council in December, 1920, to $81.25,
which is probably one - quarter of the
fair value of that part of this lot
which can be served by the Valeria
Street sewer.

cancelled.

the action and recommendation of
the City Solicitor be approved, and
the City Treasurer be authorized to
accept the $110.000 and cancel the
assessment now standing against
this property on the books. Sec-

stated that service thereof had been
duly made, and that this meeting is
called for the purpose of relevying
the assessment to pay for the im-
provement of Alta Vista street from
Julien Avenue to West 14th Street
and acting on any other business
that may come before the meeting.
Notice of publication certified to
by the publisher, of the City Coun-
cil's intention to relevy the assess-
ment provided by law, to pay for the
improvement of Alta Vista street
form the North property line of •
West 14th Street to the North prop-
erty line of Julien Avenue, present-
ed. There being no remonstrance,

A. Schilling addressed the Coun-
cil relative to a petition filed at a
previous meeting, relative to the
sewer in Angella Street. Petition
was received and field at that .meet-
ing. He stated that they could not
connect with the sewer owing to the
fact that the sewer is to near the
surface, and would freeze up in cold
weather. He further stated that he
. does not object to the sewer, that he
wanted it and would connect, but
owing to the reason stated he did
not think that the sewer can be used
as it is now.
Councilman Brede moved that the
matter be referred to the City Engi-
neer to investigate and report back
to the Council; seconded by Coun-
cil man Melchior; carried by the fol-
lowing vote:

Mr. Joe Heinen addressed the
Council relative to the assessment

ed that it be reduced. The attention
of the City Manager is to be called
to this matter to investigate immed-
iately upon his return form the City
Managers Convention at Kansas
City. No motion made.

Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That an ordinance es-
tablishing a grade on Audubon
Street, from West 14th Street to
Rosedale Avenue, be and the same is
hereby established and adopted as
shown by the profile of said street as
prepared by the City Engineer, the
same being profile No. 1072.

AN ORDINANCE REGULATING
TRANSIENT MERCHANTS, DE-
FINING WHO ARE TRANSIENT
MERCHANTS, PROVIDING FOR A
LICENSE TO TRANSACT BUSI-
NESS AS SUCH MERCHANTS
AND PRESCRIBING A PENALTY
FOR THE VIOLATION HEREOF.
Be it Ordained by the City Council
of the City of Dubuque:
Par. 873 — Transient merchant de-
fined. Section 1.
For the purpose of this Ordinance
a transient merchant shall be de-
fined to be any person or persons,
firm, association or corporation
whether residents of Dubuque or
not:
1st. Who shall either as owner,
agent, representative or employee,
temporarily place any goods, wares
or merchandise other than food
products, in any boat, railroad car,
automobile, building, house, tent or
in any other place whether covered
or in the open for the purpose of
sale thereof; or
2nd. Who shall bring any stock
of goods, wares or merchandise,
other than food products, into said
City for the purpose of offering the
same for sale without intending to
remain permanently therein as a
merchant; or
3rd. Who shall engage in the
sale of any stock of goods or mer-
chandise, other than food products,
which is not intended to be replen-
ished or kept up by the purchase of
new goods at its normal value; or
4th. Who shall engage in taking
orders for goods or merchandise on
his or its own account, the same to
be secured from a wholesale house
and shipped for delivery to the pur-
chasers, said person, or persons,
firm, association or corporation pay-
ing for the goods at wholesale and
collecting the retail price; or
5th. Who shall in any manner,
represent themselves to be perma-
nent residents for the sale of goods
or merchandise but who in truth or
in fact are only temporarily located
in said City.
Par. 874 — License. Section 2.
The license fee to be charged any
such person or persons, firm, asso-
ciation or corporation doing business
as transient merchants, as herein
defined, shall be $5.00 per day, $25.00
per week or $50.00 per month, which
fee shall be payable in advance, and
the license to be issued shall only
cover the period for which such fee
is paid.
Par. 875 — Refund. Section 3.
No refund shall be paid upon any
license where the time actually en-
gaged in business is less than the
period for the license which has
been issued or where the license has
been revoked before the period of
the license expires.
Par. • ,876 — Other arrangements.
Section 4.
Whenever a merchant claims to
be permanently located in said City
and the nature of his business is
such as to cause some doubt as to
the truth of such representation, the
City Council may instruct the City
Solicitor to enter into an arrange-
ment or agreement with such mer-
chant whereby the interests of the
City will be protected, which agree-
ment and arrangement shall be re-
ported to the Council for its ap-
proval.
Par. 877 — Penalty. Section 5.
Any person or persons, firm, asso-
ciation or corporation who, by the
terms of this ordinance, are required
to procure a license and the man-
ager or person in charge of such
business, but who fail to do so and
engage in business as transient mer-
chants, shall be subject to .a fine
of not less than $5.00 or more than
$100.00 per day for each day actual-
ly engaged in such business con-
trary to the provisions hereof, or be
imprisoned not to exceed thirty (30)
days in jail.
Publication clause. Section 6.
This Ordinance shall be in force
and effect ten days from and after
its final passage by the City Coun-
cil and publication as provided by
law.

tax list, I find an item stating that
the property described as follows:
W 1 -2 lot 139, East Dubuque Add., is
listed as delinquent for the years
1917, 1918 and 1919. This property
is owned by my husband, Henry
Grobstick. Being ignorant of the fact
that it was necessary to pay the
City taxes at the City Hall and sup-
posing that in paying the taxes on
abave property each year at the
Court House, all obligations had
been fulfilled, we were unaware of

the delinquency until reading an
account of the same in the paper.
The paying of the full amount at
this time would mean a consider-
able hardship, as my husband is an
invalid, and the only source of in-
come being that of one daughter
who is working for a small salary.
Being desirous to meet the obliga-

hereby ask your honorable body to
cancel the interest on the indebted-

Report of the delegates who at-
tended the Convention of City Man-
agers held at Kansas City, Mo.
They reported that they had a splen-
did meeting, and interchanged views
and ideas with other delegates in
atendance, that the meeting was
very beneficial to all, that the Du-
buque delegation was the largest in
attendance and they attended every
meeting; that our own Mr. Carr
ranks as one of the most competent
of City Managers, also that one of
the features of the meeting, which
was of special interest to every one
present, was the debate on Munici-
pal Ownership by Delos Wilcox of
ew York City on the affirmative and
Paul Haynes of Indianapolis, Ind.,
former chairman of the State Util-
ity Commission, on the Negative.

Council met at 4:30 p. m.

Mayor Alderson read the call and
stated that service thereof had peen
duly made and that this meeting is
called for the purpose of passing an
ordinance establishing the street
which is a continuance of and ex-
tension of the Dubuque- Cascade road
as relocated, and acting on any oth-
er natter that may come before the
meeting.
Petition for vacation of Alley, pre-
sented.
To the Honorable City Manager and
City Council of the City of Du-
buque.
Gentlemen:—
The undersigned, the Archdiocese
of the City of Dubuque and William
P. Slattery Estate, being owners of
all of the property adjoining the al-
ley between Alta Vista street and
Nevada street, and running In an
Easterly and Westerly direction
from Martha Ann street to Julien
Avenue, respectfully state: That the
alley, while it was originally laid
out and dedicated and platted as a
part of Levan's 'Add., to Dubuque, as
shown by the plat fecorded in Book
Q, pages 338 a,nd 339, has never
been used between Martha Ann
street and Julien Avenue, and is not
cpened up.
The plans have been prepared for
the erection of a new church and
school building upon that part of the
ground owned by the Archdiocese of
Dubuque, covering ground on both
sides of said alley, and that itis not
feasible or practical to build such a
church or school building without
the vacation of said alley, and the
placing the title thereto in the ad-
joining property owners.
That said alley has never been us-
ed, with the exception of a small
portion thereof, which was used by
the Wm. P. Slattery Estate, as an
entrance to the Slattery property.
That the same was elevated about
12 to 15 feet above the adjoining
streets, and the same was practic-
ally of no use to the City or to the
inhabitants thereof.
That the Slattery Estate is the
owner of lot one (1) of the Sub. of
Mineral lot (174) and of (2) of
Marsh's Dubuque, both of which
border on the said alley, and that
property, together with lots (1),
( ( (3), (4), ( (6), (7),
(8) and (15) in Levan's Addition of
Dubuque, is all the property border-
ing or abutting upon said alley.
That tho undersigned owners of
all the adjoining and abutting prop-
erty, therefore, respectfully request
that said alley be vacated, and the
title be placed in the property own-
ers abutiing said alley.

Council relative to the Transient
Merchant Ordinance, objecting to
Sections 4 and 5, Paragraph 873
thereof, stating that he was a resi-
dent of Dubuque, and always has
been, that his business is soliciting
orders for certain merchandise, that
he has done this for the past four
years, that he maintains an office,
and if the Ordinance is. put into ef-
fect as adopted it will put him and
others who are doing practically the
same as he is, only in other lines.

deferred, pending investigation.
Messrs. Kerper, Attorney O'Con-
nor and Cassatt addressed the Coun-
cil, relative to the stipulation and
agreement for the proposed rest
room and comfort station in the
Chamber of Commedce Building, ob-
jecting to certain parts of the docu-
ment as it is now written. The
matter was referred back to the
committee for further conference.

The following petition was pre-

Gentlemen: The Neighborhood
House, a charitable and benevolent
association of women to provide for
the care of children whose mothers
are required to go out to work, and
other like charities, is the owner of
the south half ( / of the north mid-
dle one -fifth (1 -5) and north one -half
( / of middle one -fifth (1 -5) of Lot
479, in the City of Dubuque. The
building on these premises is used
for the sole purpose of carrying on
its work. No, revenue is derived from
it for any other purpose. The proj-
erty has been assessed for taxation
fc.r the years 1921 and 1922. We are
advised that under the law it is ex-
empt from taxation.
Your honorable board cancelled
the taxes assessed against it for the
year 1920. We respectfully request
hat the taxes for the years 1921 and
1922 be cancelled and that an order
be made exempting the property
front taxation for City purposes so
long as it shall be used for its pres-
ent purposes.

The City Solicitor reported on the
delinquent assessments for side-
walks constructed in front of Lot 45,
Union Addition, in 1910, and owned
by M. and M. A. Kemler, total as-
sessment including interest and
costs $45.80, and for sidewalk in
front of City. S. 1/2 of Lot 3 -A, own-
ed by S. R. and J. Kemler, construct-
ed in 1912, total assessment includ-
ing interest and costs, $29.95; stat-
ing that he had made a settlement
with Miss Julia Kemler for the
above described delinquent assess-
ments for $25.00 and presented
check for same and recommended
that said sum be accepted as pay-
ment in full for said delinquent as-
sessments and the tax sale certifi-
cates be cancelled.

or be approved, the $25.00 be accept-
ed and the tax sale certificates be

that he may be able to effect a set-
tlement for the special assessment
against the Rose Walker estate for
the improvement of O'Hagan street,
and now in litigation. The matter
of settlement was left to the City
Solicitor. No motion necessary.
City Engineer Cullen reported that
the State Highway Commission here-
by asks the privilege to cut a block
of Vibrilithic pavong out of Jackson
street four inches square for testing
purposes. Permission granted pro-
viding the excavation made is put
back in as good condition as it was.

The Clerk was authorized to no-
tify Mr. Joe Heinen that his request
that the Council reduce the assess-
ment against his property for the
improvement of Hill Street was not
granted.
The City Engineer reported on
the petition of A. A. Schilling,
which was received and filed at a
previous meeting, in which Mr.
Schilling stated that he could not
connect with the sewer in Angella
Street, owing to the fact that the
sewer was o• near the surface and
City Engineer reported that although
the sewer was nearer to the surface
than most sewers are, owing to the

condition of the location of the
same, he did not think it would
freeze, owing to the fact that it was
running water in the sewer. No
further action taken.

A Resolution.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a sanitary
sewer in Stoltz Street, hereinafter
described has been completed and
the City Engineer has computed the
cost and expense of said improve-
ment amounts to $382.28.
Therefore, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of con-
structing a sanitary sewer in Stoltz
Street, from Lemon Street for a dis-
tance of about 375 feet, there be is-
sued Sewer Bonds to the amount of
$382.28. Said bonds shall be issued
under the provisions of Chapter 8,
Title V of the Code of Iowa and the
amendments thereto, shall, bear date
as of the 29th day of December, A.
D., 1922, shall be in the denomina-
tions of $100.00 each, except that
there shall be one bond to the
amount of $82.28; they shall be num-
bered from 8040 to 8043 inclusive,
and shall be divided into four
series of which the bond num-
bered 8,040 shall constitute the
'first series, and shall be payable on
the first day of April, A. D., 1923;
the bond numbered 8,041 shall con-
stitute the second series and shall be
payable on the first day of April, A.
D., 1925; the bond numbered 8,042
shall constitute the third series and
shall be payable on the first day of
April, A. D., 1929; the bond num-
bered 8,043 shall constitute the
fourth series and shall be payable
on the first day of April, A. D., 1932.
Said bonds shall bear interest at
the rate of five per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach-

SEWER BONDS
The City of Dubuque, in the
State of Iowa promises to pay as
hereinafter mentioned to the bearer
hereof, on the first day of April, A.
D., 19..., or at any time before that
date at the option of the City the
sum of One Hundred Dollars,
with interst thereon at the rate of
fiveper cent per annum, payable on
the prestntation and surrender of
the interest coupons hereto attached.
Both principal and interest are pay-
able at the office of the City Treas-
urer in the City of Dubuque in the
State of Iowa. This bond is issued
by the City of Dubuque pursuant to
and by virtue of Chapter 8, Title V
of the Code of Iowa and amend-
ments thereto and inaccordance with
a resolution of the City Council of
said city, duly passed on the 29th
day of November A. D. 1922. This
bond is one of a series of four
bonds, three for one hundred dollars
each numbered from 8040 to 8042 in-
clusive and one bond for eighty -two
and 28 -100 dollars, numbered 8043, all
of like tenor and date, and issued for
the purpose of defraying the cost of
constructing a sanitary sewer in
Stoltz Street from Lemon Street for
a distance of 375 feet and described
in said resolution; which cost is as-
sessable and levied along said im-
provement, and is made by law a
lien on all abutting or adjacent prop-
erty, and payable in ten annual in-
stallments, with interest on all de-
ferred payments at the rate of five
per cent per annum, and this bond
is payable only out of the money
derived from the collection of said
special tax, and said money can be
used for no other purpose.
And it is hereby certified and re-
cited that all the acts and conditions
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably pledg-
ed.
In witness whereof the City of Du-
buque by its City Council, has caus-
ed this bond to be signed by its
Mayor and countersigned by its
City Clerk, with the seal of said
City affixed this 29th day of Decem-

lots were formerly known as Mosh-
er's Subdivision and prior to that

Assessor Manneman showed that

ture, ceven and 40 -100 acres of waste
land, hillside, etc. Shows twenty ac-
res in the two lots, one cow, one
horse, fifty chickens, one wagon and

A Resolution.
Whereas, the contract heretofore
entered into by the•City of Dubuque
for the improvement of Allison
Place from Delhi Street to College
Street, hereinafter described, has
been completed and the City Engi-
neer has computed the cost and ex-
pense of said improvement amounts
to $3,876.88.
Therefore, be it resolved by the
City Council of Dubuque, that to
provide for the cost of the improve-
ment of Allison Place from the south
property line of Delhi Street to the
west property line of College Street
there be issued Improvement Bonds
to the amount of $3.876.88. Said
ponds shall be issued under the pro -
visions of Chapter 8, Title V, of the
Code of Iowa and the amendments
thereto, shall bear date as of the
29th day of December, A. D. 1922.
shall be in the denominations of
$300.00 each, except that there shall
be one bond to the amount of
8276.88: they shall be numbered
from 7989 to 8001 inclusive, and shall

Said bonds shall bear interest at
the rate of 5 per cent per annum,
which interest shall be payable semi-
annually. in accordance with the
terms of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment levied for said improve-
ment. Both principal and interest
shall he payable at the office of the
City Treasurer in the City of Du-
buoue. Said bonds shall be substan-
tially in the following form:

The City of Dubuque, in the State
of Iowa, ,promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 , or at any time before that date
at the option of the City the. sum of
Three Hundred Dollars, with interest
thereon at the rate of 5 per cent per
annum. payable on the presentation
and surrender of the interest cou-
pons hereto attached.. Both princi-
pal and interest are payable at the
office of the City Treasurer in the
City of Dubuque in the State of
Iowa. This bond is issued by the
City of Dubuque persuant to and by
virtue of Chapter 8, Title V, of the
Code of Iowa and amendments there-
to, and in accordance with a resolu-
tion of the City Council of said City,
duly passed on the 29th day of No-
vember, A. D. 1922. This bond is
one of a series of thirteen bonds,
twelve bonds for $300.00 each, num-
bered 7989 to 8000 inclusive, and one
for $276.88, numbered 8001, all of
like tenor and date, and issued for
the purpose of defraying the cost of
Allison Place from the south prop-
erty line of Delhi Street to the west
property line of College Street, and
described in said resolution; which
cost is assessable and levied along
said improvement, and is made by
law a lien on all abutting or adja-
cent property, and payable in ten
annual installments, with interest on
all deferred payments at hte rate of
five per cent per annum, and this
bond is payable only out of the
money derived from the collection of
said special tax, and said money can
be used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the
assessments, collections and pay-
ment hereon of said special tax, the
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.
In witness whereof the City of Du-
buque by its City Council, has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 29th day of December, A.
D. 1922.
