shall proceed to have the work done
and the cost and expense thereof
shall be assessed against said lot

thereon a prosvided in case of spe-
cial assessments, which lein shall be
enforced in the same manner and
with the same penalty as in the case
provided for special assessments.
Be it further resolved that a copy
of this resolution together with the
notice herein provided for shall be
personally served upon resident own-

the notice shall be published in the
official newspapers of the City once
a week for three weeks, and said
notice shall contain a copy of this

A Resolution.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a sanitary
sewer in West 14th street, herein-
after described, has been completed
and the City Engineer has computed
the cost and expense of said im-
provement amounts to $289.28;
Therefore, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of the
construction of a sanitary sewer in
West 14th street, from Booth street
to the alley first east of Booth street,
there be issued Sewer Bonds to the
amount of $289.28. Said bonds shall

be issued under the provisions of
Chapter 8, Title V, of the Code of
Iowa and the amendments thereto,
shall bear date as of the 4th day of
January, A. D. 1923, and shall be in
the denominations of $100.00 each,
except that there shall be one bond
to the amount of $89.28; they shall
be numbered from 8044 to 8046 in-
clusive, and shall be divided into
three series of which the bonds num-
bered 8044 shall constitute the first
series and shall be payable on the
first day of April, A. D. 1924; the
bond numbered 8045 shall constitute
the second series and shall be pay-
able on the first day of April, A. D.
1927; the bond numbered 8046 shall
constitute the third series and shall
be payable on the first day of April,
A. D. 1923.
Said bonds shall bear interest at
the rate of 5 per cent per annum,
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment for said improvement.
Both principal and interest shall be
payable at the office of the City
Treasurer in the City of Dubuque.
Said bonds shall be substantially in

Sewer Bond.
The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 , or at any time before that
date at the option of the City, the
sum of One Hundred Dollars with
interest thereon at the rate of 5 per
cent per annum, payable on the pre{
sentation and surrender of the in-
terest coupons hereto attached. Both
principal and interest are payable at
the office of the City Treasurer in
the City of Dubuque in the State of
Iowa. This bond is issued by the
City of Dubuque persuant to and by
virtue of Chapter 8, Title V, of the
Code of Iowa and amendments there-
to, and in accordance with a resolu-
tion of the City Council of said City,
duly passed on the 4th day of De-
cember, A. D. 1922. This bond is
one of a series of three bonds, two
for one hundred dollars each, num-
bered from 8044 to 8045, inclusive,
and one bond for $89.28, numbered
8046, all of like tenor and date, and
issued for the purpose of defraying
the cost of construction of a sanitary
sewer in West 14th street from
Booth street to the alley first east
of Booth street, and described in
said resolution; which cost is assess-
able and levied along said improve-
ment, and is made by law a lien on
all abutting or adjacent property,
and payable in ten annual install-
ments, with interest on all deferred
payments at the rate of five per
cent per annum, and this bond is
payable only out of the money de-
rived from the collection of said
special tax, and said money can be
used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done hau-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment here-
on of said special tax, the faith and
diligence of said City of Dubuque
are hereby irrevocably pledged.
In witness whereof the City of
Dubuque, by its City Council, has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 4th day of January, A. D.

An Ordinance establishing a street,
the same being an extension and
continuation of the Dubuque- Cascade
road, as relocated.
Whereas, the City Council of the
City of Dubuque has, by proper re-
solution, declared for the necessity,
advisability and public convenience
of establishing a public street over
and across Mineral Lot No. 4, Min-
eral Lot No. 5, Mineral Lot No. 10,
Mineral Lot No. 12, Lot No. 2 of the
subdivision of Lot No. 2 of the sub-
division of Lot No. 5 of the subdivi-
sion of Mineral Lot No. 21, and Min-
eral Lot No. 35, said street to be
100 feet in width and commence
where said Dubuque - Cascade road
enters the southwesterly limits of
said city, the general direction of
said street being more particularly
described herein; and whereas the
right -of -way over said lots has been
acquired by said City by purchase

Gentlemen: In connection with the
assessment against the abutting
property owner for the improvement
of Shiras avenue, I beg to advise
that there was an error made in the
levy against Grace Papin owner of
lot 199 Julien Addition. She agreed
to pay $50.00 toward the cost of the
improvement instead of 50c per front
foot. The amount of the levy is
$55.41 and should therefore be re-
duced. A reduction of $5.41 on this
assessment against Grace Papin
should be mado.

Gentlemen: In connection with
the acquiring of property necessary
for the Rockdale Road as relocated,
between Rowan Street and Locust
Street, I beg to advise as follows:
The city will need a part of Lots 1
and 2 and Lots 16, 19, 20, 21 and 22
in Randall's Sub. for this street.
These lots are assessed for $50.00
for No. 1 and 2 and $40.00 each for
the others. They contain somewhere
near 5,000 sq. ft. each. J. J. Nagle
the owner, offers to sell the entire
lots to the city for $100.00 each.
J. J. Nagle also owns Lot 1 of
Sub. of 1 of M Lot 37. The pro-
posed street passes through about
the middle of this lot. The lot con-
tains about one and one -third acres.
J. J. Nagle offers to sell this lot
to the city for the sum of $300.00.
I would recommend the purchase
of these eight lots at the prices as
named.

Gentlemen: I beg to advise that
I have secured propositions from A.
A. Cooper, the owner of Lot 1 of
Min. Lot 364 and Lot 2 of Min. Lot
36A for the sale of such property
as will be required for the Rockdale
Road as relocated. Mr. Cooper agrees
to sell this property to the city for
the sum of $200.00.
I have also secured a proposition
from Mrs. Elizabeth Duggan, the
Duggan, the owner of the east 40
ft. of Lot 1 and the west 10 ft. of
Lot 2 and the east one -half of Lot
3 in Newman's Sub., to sell to the
city such portions of these three
lots as is needed for the right of way
on the Rockdale Road as relocated,
for the sum of $75.00.
I think both of these prices are
reasonable and I would recommend
the acceptance of these propositions
by the city.

Gentlemen: In the delinquent tax-
es as advertised on December 4th,
1922, appears the property bought on
June 20th, 1921 by the City of Du-
buque for the building of the fire
alarm station. This property is as-
sessed to Ida Dement and was adver-
tised for sale on December 4th.
As I recall it, attention of the
assessor was called to the fact that
the city had purchased this ground
at the time the purchase was made
and that the property should be ex-
empt from taxes. I then suggested
that the city clerk be directed to
advise the county auditor and county
treasurer that this was city property,
having been purchased in June 1921.
Therefore the 1921 taxes should be
cancelled.

Gentlemen: Sometime ago the
matter of a petition for permission
to erect a garage on the end of Al-
mon Street as presented by Mr.
Hoeksma was referred to the City
Manager for investigation and re-
port.
I have investigated this matter and
personally see nothing objectionable
in the placing of additional garages
at the end of this street.
Mr. James Lee, who lives on Al-
mond Street, and who already has
two garages at the end of this street,
same being erected by him without
permission from the city, does ob-
ject to any additional garages be
erected and states that rather than
see any more garages erected here,
he will move his garages off the
street.
I would recommend that the Coun-
cil direct Mr. Lee to remove his two
garages from the end • of Almond '
Street, same to be done within thirty
days. If he should fail to remove
his garages within that time then
permission should be given to Mr.
Hoeksma to erect a garage on this
street and to pay a small fee for the
privilege, the same fee to be charged
to Mr. Lee providing he permits his
garages to remain in the same loca-
tion.

Mayor Alderson read the call and
stated that service thereof had been
duly made, and that this meeting
is called for the purpose of consid-
ering an Ordinance, providing for
the issuance of $100,000.00 Sewer
Bonds of the City of Dubuque, Iowa,
and acting on any other business
that may come before the meeting.
The following Ordinance was then
introduced and read:
ORDINANCE No. 132.
AN ORDINANCE PROVIDING FOR
THE ISSUANCE OF $100,000
SEWER BONDS OF THE CITY
OF DUBUQUE, IOWA.
Whereas, the City of Dubuque, in
the County of Dubuque, State of
Iowa, is a municipal corporation,
duly organized and existing under
the laws of the State of Iowa, and
is governed by Chapter 14 -d of the
Supplemental Suplement to the
Code of Iowa, 1915, as amended;
and
Whereas, this council deems it
necessary that there be built and
constructed additional swer improve-
ments in said City, the cost thereof
to the amount of $100,000 to be .de-
frayed by the issuance of bonds.
Now Therefore: Be it ordained
by the city council of the City of
Dubuque, Iowa. Section 1. That
there be and there is hereby auth-
orized to be issued the negotiable
coupon bonds of said City in the ag-
gregate amount of One Hundred
Thousand Dollars ($100,000) that
said bonds be designated Sewer
Bonds, be one hundred in number,
dated January 1, 1923, bear interest
at the rate of four and one half per
cent (4 %) per annum, from the
date of said bonds until payment
thereof, payable July 1, 1923, and
semi - annually thereafter on the first
days of January and July in each
year; that said bonds be signed by
the Mayor and attested by the City
Clerk and the seal of said City at-
tached, and be registered by the City
Treasurer, and a certificate of such
registration endorsed on the back
of each bond; that interest on said
bonds be evidenced by coupons
thereto attached and maturing on
the several days when such interest
matures; that said interest coupons
be executed with the facsimile sig-
nature of said Mayor and City
Clerk which officials, by the execu-
tion of said bonds, shall adopt as
and for their own respective signa-
ture, their facsimile signatures as
appearing on said coupons; and that
such principal and interest be pay-
able at the office of the City Treas-
urer in the City of Dubuque, State
of Iowa; that said bonds be of the
denomination of $1,000 each, be
numbered consecutively from one to
one hundred, both numbers included,
become due and payable in their
numerical order as follows: $25,000
on January 1 of each of the years
1939 to 1942 inclusive.
Section 2. The bonds hereby au-
thorized shall be in form substan-

This bond is one of a series of
bonds of like date and denomination

dred (100) both numbers inclusive,
aggregating One Hundred Thous-
and Dollars ($100,000) issued by the
City of Dubuque pursuant to and
in strict compliance with the pro-
visions of Chapter 243, Acts of the
Thirty- eighth General Assembly of
Iowa, and Chapter 179, Acts of the
Thirty -ninth General Assembly of
Iowa, and in conformity with an or-
dinance of the Council of said City,
duly passed, approved and published,
for the purpose of providing funds
for building and constructing sewers
in said City.
And it is hereby certified and re-

cited that all acts, conditions and
things required by the laws and con-
stitution of the State of Iowa to
exist, to be had to be done, or to be
performed precedent to and in the
issue of this bond, were and have
been properly existent, had, done
and performed in regular and due
form and time and that the total in-
debtedness of said City, including
this bond, does not exceed the con-
stitutional or statutory limitations
of indebtedness or taxation.
This bond shall pass by delivery
unless it has been registered in the
name of the owner on the books of
the City Treasurer in the City of Du-
buque, Iowa, and such registration
endorsed on the bond. Thereafter
no transfer of this bond shall be
valid unless made on said books and
similarly noted on the bond, unless
the last registration shall have been
t obearer, in which case transfer -
abiity by delivery shall be restored.
The registration of this bond shall
not affect the transferability of the
coupons by delivery; provided that
if, upon the registration of the bond,
all unmatured coupons hereto at-
tached shall be surrendered and
cancelled, thereafter both principal
and interest of this bond shall be
payable to the registered owner of
this bond.

meet the interest on the bonds here-
by authorized as the same accured
and also to create and maintain a
sinking fund which shall be suffici-
net to discharge the principal of said
scribed property, upon receipts of
`bonds at maturity.
Section 6. That this ordinance
shall be irrepealable until all afore-
said bonds, both principal and inter-
est are fuly paid and discharged.
Section 7. That all ordinances and
resolutions or parts of ordinances
and resolutions in conflict herewith
be and the same are hereby re-
pealed.
Section 8. That it hereby found
that an emergency exists and for the
immediate preservation of the pub-
lic peace, health and safety, this or-
dinance from and after its final pas-
sage, approval and publication as
by Statute provided.

Gentlemei.: Mr. and Mrs. Charles
Boyer are the owners of Lots 1, 2,
3, and 4 in O'Connor's Sub. These
lots give about 210 feet along the
center line of Rockdale Road as re-
located. Mr. and Mrs. Boyer agree
to sell the amount of these lots
which is required for the street as
well as the parts of these lots south
of the road as now located, for the
sum of $400.00. This property has
a depth south of the road, varying
from 185 to 145 feet and I believe
from the elevation shown on our
plans, will be fairly satisfactory for
building lots after the road is con-
structed.
I would therefore recommend the

acceptance of their proposition.

Gentlemen: The Rockdale Road
as re- located will cross Lot No. 2
of Sub. of Mineral Lot No. 37. This
is the lot where the old brick house
is on the hillside. It belongs to
Frank Bakey. Mr. Bakey prefers to
sell the entire lot rather than just
the right of way and offers to sell
the entire for the sum of $300.00.
This lot contains about 2 -3 of an
area of Lot No. 1 which we pur-
chased from Mr. Nagle for $300.00,
but contains the foundation of the
old brick building which Mr. Bakey
holds to be of some value to him.
I think this is a fair price and I
would recommend the purchase from
Mr. Bakey at the price as above
mentioned.

Gentlemen: I have secured tent-
atively from the owners of property
along the Rockdale Road as relocat-
ed, prices for the amount required
for street purposes.
Thomas J. Mulgrew agrees to sell
the ground necessary for the road
as relocated, coming from Lot 1 of
1 of Min. Lot 50A and Lot 2 of 1 of
Min. lot 50A approximately one
acre, at the rate of $600.00 per acre.
Mr. Mulgrew paid $500.00 per acre
for this ground a couple of years
ago.
Mrs. Mary Crowley, the owner of
the West i/ of Lot 4, Lot 5 and Lot
6 in Newman's Sub., agrees to sell
the ground necessary for the oRck-
dale Road as relocated, for the sum
of $100.00.
M. B. Sheehan, the owner of Lot
6 in O'Connor's Sub., agrees to give
the city, such part of this lot as is
required for the Rockdale Road as
relocated, approximately 7,200 sq. ft.
for the sum of $75.00, provided oth-
er property owners whose property
is similarily located in this subdivis-
ion, settle on a similar basis.
I believe all of these offers to be
fair and recommend their acceptance
by the city.

Gentlemen: The laws of the State
of Iowa, fix definitely the amount
of pension to be paid to members
of the fire department on retirement
or the dependent members of their
families in case of their death.
The state also directs that a tax
levy not to exceed one mill on the
taxable property in the city, may be
levied to take care of this pension.
I beg to advise that in both 1921
and in 1922 the city of Dubuque lev-
ied the entire amount authorized by
statute for this purpose. We found
on the first of December only a very
small balance with which to meet
the November fire pension payroll.
There will be between now and April
1st, a deficit of approximately $4,400
in the fire pension fund. The laws
will not permit this fund to be over-
drawn, neither with the law permit
an increased tax levy for this pur-
pose.
In my judgement there are two
possible solutions to this matter,
both of which are objectionable. First
—the city may defer payment on
these pension payrolls until such a
time as there are moneys in the fire
pension fund. Second —in case there
was an unappropriated balance in
the Miscellaneous Revenues an
amount sufficient to take care of this
probable deficit, such amount could
be appropriated from the Miscellan-
eous Revenues, or in line with this
second suggestion, the Council could
appropriate the money from Miscel-
laneous Revenues, provided that
there was money available from this
source, month by month to meet the
fire pension payrolls.
I a mcalling this to your atten-
tion in order that you may determine
the proper proceedure as we are un-
able to pay further fire pensions un-
til the additional money from some
source is placed in this fund.

A communication fro the League
of Iowa Municipalities, presented.
Marshalltown, Iowa, Dec. 1st, 1922.
To the Honorable May and City
Council:
The coming session of the Legis-
lature is of the greatest importance
to cities and towns of Iowa. The
.control of public utilities, changes
in the tax laws and many other ques-
tions of vital interest to every mun-
icipality will come up for action. It
will be our fault if bad laws are
passed on account of our neglect in
this important matter.
The utilities and every other spec-
ial interest will have representatives
in Des Moines to look after their
welfare and if we do not do like-
wise we will certainly be the losers.
We owe it to our people to look
after their affairs.
The officers of the League and Leg-
islative Committee arranged with
Hon. W. A. Hunt, City Solicitor of
Ottaumwa and Chairman of the Leg-
islative Committee to take chage of
the legislative work, and we are sure
that he will do it in a most efficient
manner. There is no question but
what you can legally employ Mr.
Hunt to do this work for you.
If every city of town, whether a
member of the League or not, will
do its share, the payment of each
will be small. We estimate that if
every municip1Jity will pay for this
work, one -half ti F annual dues in the
league, that it will create a fund, suf-
ficient for the purpose.
We have asked Secretary Pierce
to act as Treasurer of this special
fund and the warrant or draft should
be sent to him.
We are confident of your co -oper-
ation and therefore enclose you a
resolution that we aSk you to pass
at your first meeting. Fill in the
amount according to your population,
pass the resolution and send in the
amount at once in order that we may
know what we can depend on.

Gentlemen: At the Council meet-
ing held on the 29th of November
a petition signed by Geo. Korman,
asking for a reduction of the assess-

ment as levied against lots 13 and
14 Voelker's Add., for the improve-
ment of Rosalin Street was referred
to the City Manager for investiga-
tion and report. I have investigated
the matter and find as follows:
A petition was presented to the
City Council on March 20th, 1919,
signed by Geo. L. Korman and others,
asking for the improvement of this
street. In accordance with the no-
tice of the petition, the Council pro-
ceeded with the improvement of the
street. The assessment was levied
on December 4th, 1919. Lot 13 was
assessed for $174.69 and Lot 14 was
assessed $171.43. Two payments
were made by MrM .Korman on these
assessments. The last payment w'Ls
made on November 1st, 1920.
These two lots are carried on the
assessor's books under one valua-
tion, which is $1,800. There is a
house on lot 13 and on lot 14 there is
a garage. Each of these lots have
a fifty foot frontage on Rosalin
Street and a depth of approximately
one hundred twenty feet.
From the records, it appears that
the Mr. Korman was the main insti-
gator of the improvement. It also
appears that the assessment as lev-
ied is within 25 % of the value of
either of these lots. This assessment
was permitted to become delinquent
and the property was advertised for
sale and was bought by the City of
Dubuque on Monday, December 4th.
I would suggest that the petition be
received and filed.

Be it resolved by the City Council
of the City of Dubuque: that the
tentative plans submitted by D. W.
Mead of Madison, Wisconsin, for the
rebuilding and rehabilitating of the
Dubuque City Water Works Pump-
ing Station, be approved with slight
modifications. The above plans in-
clude two compressors with pumping
devices for artesian wells, two boil-
ers with automatic stokers, one ad-
ditional pump together with the in-
stallation of venturia meters and pip-

Road as relocated and acting on any

A petition signed by the Fairfield
Gospel Team, S. B. Lattner and Fred
A. Hoerner Building Committe, pre-
sented. For permission to erect a
Tabernacle for the purpose of con -
ducting religious services, said Tab-
ernacle to be 65 feet by 120 feet and
to be erected on the corner of
Eighth and Bluff streets. The build-
ing to be erected on or about Dec.
26th, material to be a frame struc-
ture with rubberoid roofing, to be
heated with stoves, and tha same be
permitted to remain about 90 days.

Gentlemen: Rockdale Road as re-
located passes over Lot 2 of 4 of
the Sub. of Min. Lot 37. This lot
is owned by Micheal Kelly and is
one hundred feet in width to the
back property line. Mr. Kelly offers
to sell to the city such a part of this
lot as is needed for the Rockdale
Road together with that part of the
lot lying south of the Rockdale Road
as relocated, for the sum of $150.00.
I consider this to be a very fair
offer and would recommend its ac-
ceptance by the city.

East 1 /2 of Lot 4 in Newman's Sub.
This property is assessed to Roy
Houpes and is held by real estate
contract by Geo. D. Cable.. Cable
offers to sell such portions of these
two lots as the city will need for
street purposes for the' sum of $75.00.
Geo. D. Cable also owns lot 5 of
Rowan's Addition. Rockdale Road
crosses this lot taking nearly one -
half of the lot. Cable offers to dis-
pose of a part of this lot necessary
for street purposes for the sum of
$75.00.
I would recommend the acceptance
of both of these propositions.

Gentlemen: Sometime ago the
special assessment for the improve-
ment of Shiras Street was levied.
Mr. C. Braun was assessed $247.50.
This was arrived at on the basis of
fifty cents per foot, which Mr. Braun
agreed to pay. This was taken from
the recorded plat. By actual meas-
urement we find the plat to be one
hundred thirty -nine feet in error. For
that reason the special assessment
against Mr. Braun should be reduced
by the amount of $69.50. I would
recommend that Mr. Braun's assess-
ment be reduced $69.50 and that the
City Auditor be authorized to trans-
fer to the special assessment fund
$69.50 from the general fund to make
up for this reduction.

ter of Lot 4 of O'Connor's Sub. This
property belongs to Charles Dillon.
Mr. and Mrs. Dillon agree to let
the city have the part of their lot
the sump of $75.00.
Mr. Isaac Wyburn is the owner of
Lot 47 of the Sub. of Min. Lot 39.
The Rockdale Road as relocated
passes through this lot and uses
considerably over one -half of the
area of the lot, the center of the road
passing about ten feet from Mr. Wy-
burn's house. Mr. Wyburn has his
house, some out buildings, a well as
well as a garden on this lot.
Mr. Wyburn is glad to co- operate
with the city in the location of this
road and will permit the moving of
his house to some other location.
Tentatively, he has agreed to take
lots 7 and 8 and 17 and a part of
lot 16 not used by the city, in ex-
change for the part of lot 47 which
the city needs for this road. In ad-
1 dition, the city is to allow him the

expense of moving his house from its
present location to either lot 7 or
8, to connect with the water main
on Southern avenue and extend such
connection to his house and also pay
the cost of placing foundation walls
under the house, sufficient to permit
of a basement.
M. J. J Nagle is the owner of
Lot 7 and 8 and 17 in Randall's Sub.
He offers to sell these three lots to
the city for the sum of $300.00. I
have not yet ascertained the cost
of moving Mr. Wyburn's house but
would recommend the acceptance of
his proposition as well as tbe prop-
osition of Charles Dillon, by the city.

and he has been at the office once
I have received no proposition

Be it resolved by the City Council
of the City of Dubuque that the City
Engineer be and he is hereby in-
structed to make a plat and survey
of such proposed improvement show-
ing the land that it is necessary to
secure and file such plat in his of-
fice subject to public inspection.
That after such plat is prepared
and filed said City Engineer shall
give the owners of property a notice
as is prescribed for in Section 2 of
Chapter 31 of the Ordinance of the

Barker. asking for refund of penalty
amounting to $79.00 attached to the

against City Lot 113, presented,
stating that this property is located
at the southwest corner of Third and
Locust streets, that the assessments
for the improvements of these two
streets came within two years of
each other, that Mr. Powers is 81

years old and unable to work, and
Mrs. Barker is a widow, their only
source of income is the rent derived
from this property, that after paying
for insurance, repairs, improvements,
taxes and then these street assess-
ments they have hardly enough to
live, and that two years ago the
proprty was sold for noh- payment of
this street. On December 8th, 1922,
they placed a mortgage on this prop-
erty to redeem it from the tax list.
In view of these facts they ask that
the Council refund the penalty.

allow them to conduct a dance on
December 25th, on January 1st, 1923,
and one dance a week thereafter.

the manner of installation, and im-
posing a penalty for the violation
thereof," the same being Ordinance
No. 116 of the Ordinances of the
City of Dubuque and adopted Jan-
uary 24th, 1922, by omitting the re-
quirements of paragraph 820 with
reference to repairs: by adding cer-
tain requirements in installation to
paragraph 821, and by making spe-
cific provisions for industrial plants.

been completed and the City Engi-
neer has computed the cost and ex-
pense of said improvement amounts
to $503.20.
Therefore, be it resolved by the
City Council of the City of Dubuque,
that to provide for the cost and con-
struction of a sanitary sewer in Ran-
dall Place from Grandview avenue to
Bradley street, and in Bradley street
as far as can be of service, there be
issued Sewer Bonds to the amount
of $503.20. Said bonds shall be is-
sued under the provisions of Chapter
8, Title V of the Code of Iowa and
the amendments thereto, shall bear
date as of the 26th day of January,

ations of $100.00 each, except that
there shall be one bond to the

tion asking that the City vacate 12th
Street from Central Avenue to White
Street, presened, stating that they
owned all the property abutting on
both sides of the street, that the
school buildings are on the north
side of the street and the play
grounds are on the south side, and
that it is dangerous for the school
children to cross the street, and that
the danger can be eliminated by va-
cating the said street. Action deferr-
ed, petition referred to the City So-

Petition of Edmund A. Linehan,
contractor, presented, asking that
the time for the completion of the
sewer in Air Hill street be extended
to next spring, stating that on ac-
count of being unable to get enough
laborers on the Park Hill sewer, he
was delayed and therefore could not
start the Air Hill sewer until now,
and on account of weather condi-
tions it will be impossible to start
the work until next spring.

Gentlemen:
At the last meeting of the City
Council, I recommended the pur-
chase of such a part of Lot No. 4 of
O'Connor's Sub. owned by Chas.
Dillon, necessary for street purpos-
es, for the sum of $75.00.
Mrs. Dillon has changed her mind
about her desire to retain the por-
tion of this lot lying south of the
road. This runs back for about 150
feet from th eroad. She offers to sell
this to the city at the same price as
was authorized for the right of way.
The city owns the lots on the east
but does not own the lot on the west
of the Dillon property. I think prob-
ably it might be desirable to acquire
this property at the price named. I
do not wish however, to make any
definite recommendation on this
proposition.

At the last meeting of the Council
I reported that we were unable to
come to an agreement with Mr. W.
W. Bandy as to a fair value for the
portion of his property which is need-
ed for the Rockdale Road as re-
located. The road takes approximate-
ly fifty feet off his lots. The proper-
ty consists of the West 10 feet of
Lot No. 1 and the East 40 feet of
Lot No. 2 in Newman's Sub. I beg
to advise that Mr. Bandy has offer-
ed to let the city have this property
for the sum of $100.00. This is a lit-
tle higher than we have paid for oth-
er property, Mr. Bandy claims some
damage to his house on account of
the road crossing his lot. In view
of that fact, I believe it would prob-
ably be the best policy to purchase
the property at the price named than
to go to the expense of condemna-
tion. I therefore recommend that
the City Auditor be directed to draw
up a warrant in favor of Mr. Bandy
in the sum of $100.00 after proper
deed and abstract has been approved
by the City Solicitor.
This completes all the property to
be acquired for the Right of Way
for the Rockdale Road as relocated.
The distance is slightly over a mile.
The road is to be one hundred feet
wide. The city has in many cases se-
cured property on either side of the
road as well as the portion neces-
sary for the road itself. The entire
expense when passed upon, the pay-
ment of warrants to the jury and the
agreements in other cases, will
amount to approximately $10,000.00.

An Ordinance amending an Ordin-
ance entitled "An Ordinance pro-
viding for the appointment of an
Electrical Inspector, defining his
powers and duties, prescribing rules
and regulations for the installation
of electric light and power, wiring,
electric fixtures and applances and
electrical work and the manner of
installation and imposing a penalty
for the violation thereof, "the same
being Ordinance number one hun-
dred sixteen (116) of the Ordinances
of the City of • Dubuque and adopted
on January 24, 1922, by omitting the
requirement of paragraph 820 with
reference to repairs; by adding cer-
tain requirements in installation to
paragraph 821; and by making spe-
cific provisions for industrial plants.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That an Ordinance en-
titled "An Ordinance providing for
the appointment of an electrical in-
spector, defining his powers and du-
ties, prescribing rules and regula-
tions for the installation of electric
light and power, wiring, electric fix-
tures and appliances and electrical
work and the manner of installation
and imposing a penalty for the viola-
tion thereof," the same being Ordin-
ance number one hundred sixteen
(116) of the Ordinances of the City
of Dubuque and adopted on January
24, 1922, be amended by striking out
of paragraph 820 the words `nor re-
pair of" in the fourth line thereof,
so that said paragraph thus amend-
ed will read as follows:
"Par. 820. PERMIT FOR ELEC-
TRICAL WORK. Before commenc-
ing or proceeding with the installa-
tion, alterations in any wiring sys-
tem through or by which is convey-
ed or intended to be conveyed,' elec-
trical, current for power, heating or
illuminating purposes including de-
vices used for the generation, trans-
mission, conduction, absorption,
transformation, reduction or con-
sumption of electric current in any
building or structure, a permit
therefore shall first be obtained by
the contractor or person in charge of
such work from the electrical inspec-
tor or other official authorized, to
issue such permits, and it shall be

unlawful to commence or proceed
with such work unless such permit
shall have first been obtained. The
electrical inspector may in his dis-
cretion require that plans and spe-
cifications of the proposed installa-
tion and materials be submitted to
him for his examination and ap-
proval."
Section 2. That said Ordinance
be further amended by adding after
period in Section 2 of Par. 820 the
following:
"No permit shall be required for
making repairs or maintainence re-
placements to any wiring system."
Section 3. That said Ordinance be
further amended by inserting be-
tween the words, "including" and
"switch," in the sixth line of Sec-
tion 5 of Par. 821 the words "ex-
ternally operated," and that said sec-
tion of said paragraph be further
amended by adding thereto follow-
ing the period at the end thereof,
the following provision:
"Circuit or branch fuses must be
installed for all circuits in such a
manner as to be easily accessible to
the consumer or owner of the
premises."
Said section, as hereby amended,
will hereafter read as follows:
"Section 5. ENTRANCE CABI-
NETS. All meter installations here-
after named shall be equipped with
a standard approved blocked steel
service cabinet inclosing all service
connection parts, including external-
ly operated switch, fuses and meter
connections. This standard service
outfit shall be used for entrance as
well as customer's meter connections
and shall be arranged so as to be
sealed by the company supplying the
electricity or its authroized repre-
sentatives. Circuit or branch fuses
must be installed for all circuits in
such a manner as to be externally
accessible to the consumer or "own-
er of the premises."
Section 4. That said Ordinance
be further amended by adding to the
end of paragraph 822, and as a part
of said paragraph the following:
"INDUSTRIAL PLANTS EX-
CEPTED. In industrial plants
where expert electricians are regu-
larly employed and who have charge
of the electrical work in such plants,
the general provisions of this Ordi-
nance shall not apply except as fol-
lows: A monthly inspection shall be
made by the electrical inspector of
the installation or electric wiring,
fixtures, appliances, work and ma-
terials used and done in connection
with the operation of electric work
in said plant. A record shall be kept
at such plants by the person in
charge of such work of all installa-
tion of electric wiring, fixtures, ap-
pliances, work done and materials
used in such plants covering the pre-
ceding month. This record shall be
filed with the electrical inspector
each month prior to the time he
makes his regular inspection. All
wiring, fixtures, appliances, work
done and materials used in connec-
tion with electrical installations in
such plants shall conform to the pro-
visions of this Ordinance and the
electrical inspector shall be in pow-
er to enforce such provisions, ex-
cept as the same are hereby limited
or exempted. Any falsity contained
in the reports required to be filed
with the electrical inspector shall
subject the person, firm or corpora-
tion responsible therefore to the pen-
alties provided for in paragraph 824
hereof.
"Any industrial plant to whom the
provision hereof applies shall pay to
the City of Dubuque inspection fees
of $5.00 per month, which fee shall
cover the service to be performed

man Schrempf. Carried by the fol-

The ordinance was then read.

this be the second reading of the
