Petition of James F. Lee Paving
Co., asking the City Council to allow
an extension of time for completion
of the contract on Grandview ave-
nue on account of the condition of
the soil until July 1st, 1920, present-
ed and read. On motion of Ald. Frith
prayer of the petition was granted.
Waiver and agreement signed by
the Jas. F. Lee Paving Co., and Lon-
don & Lancashier Indemnity Com-
pany of America, relative to exten-
sion of time on the completion of
the improvement of Grandview ave-
nue until July lst, 1920, presented
and read. On motion of Ald. Hird
the waiver and agreement was made
a matter of record.
Petition of John H. Deitrich and
Frank Beutin asking the City Coun-
cil to have the City Engineer give
the grade line on Emsey Lane as the
people on the west side of Emsey
Lane from Fengler avenue to Ann
avenue Extension are filling up prop-
erty and causing the water to drain
onto their property, resulting in a
great deal of damage to same. Pre-
sented and read. On motion of Ald.
Frith the petition was referred to the
City Engineer to report to the Com-

Petition of the Blue Bird Laundry
asking the City Council to allow
them to cover and enclose an out-
side stairway on the south side of
building at 1036 Clay street. Pre-
sented and read. Ald. Leist moved
to suspend the rules for the purpose
of allowing anyone present to ad-
dress the Council.
Carried by the following vote:

Mr. R. D. Hughes, proprietor of the
Blue Bird Laundry, addressed the
Council relative to his petition.
On motion of Ald. Leist the prayer
of the petition of the Blue Bird
Laundry was granted.
Ald. Burch moved that the rules
be suspended for the purpose of al-
lowing any present to address the
Council.

Mr. F. O. Jacobson addressed the
Council relative to establishing a bus
line in the city, stating that if the
City Council were in a position to
grant a charter at a later date, he
would petition for the same.
Petition of Mrs. Mary A. Trenk
asking the City Council to allow her
to construct an apron to allow an
auto to enter her property at 580 Hill
street. Presented and read. On mo-
tion of Ald. Frith the petition was
referred back to Mrs. Trenk as the
city ordinances prohibit the laying
of aprons in the gutters, but she be
allowed to lay down the curbing un-
der the supervision of the City Engi-
neer.
Petition of I. M. L. Cutler asking
the City Council to inspect the con-
dition of Dell street. Presented and
read. On motion of Ald. Hird the
petition was referred to the Commit-
tee of the Whole to view the
grounds.
Petition of G. W. Fern asking the
City Council to refund some of the
license fee on the Riverview Roller
Rink building, as the building has
been sold and he is unable to get
another location. Presented and read.
On motion of Ald. Strobel the peti-
tion was referred to the Committee
of the Whole.
Petition of Mrs. Alf. Cartigny ask-
ing the City Council to remedy the
cause that results in the water over-
flowing the ditch that carries the
water from Park hill and floods her
property. Presented and read. On
motion of Ald. Frith the Sewer In-
spector was instructed to clean sew-
er that causes the water to flow in
the ditch carrying water from Park
hill near 30th street and Couler ave-
nue, adjoining property of Mrs. Alf.
Cartingy.
Petition of citizens and taxpayers
asking the City Council to order a
light installed at the intersection of
Queen and Clinton streets. Present-
ed and read. On motion of Ald.
Frith the prayer of the petition was
granted.
Petition of A. M. Pond asking the
City Council to allow him a soldier's
exemption of taxes on his residence.
Presented and read. On motion of
Ald. Frith the prayer of the petition
was granted.
Petition of Josephine Vogt asking
the City Council to allow her a re-
duction in taxes. Presented and
read. On motion of Ald. Frith the
petition was referred to the Commit-
tee of the Whole.
Petition of Thos. Lynch asking the
City Council for permission to lay
down the curbing at 12 Finley,
Waples and Burton's Addition. Pre-
sented and read. On motion of Ald.
Hird the prayer of the petition was
granted, the work to be done under
the supervision of the City Engineer.
Petition of Irvin Wm. Dettman
asking the City Council to allow
him a Soldier's exemption on Lot 1
of 70 Additional Stafford's Add.; Lot
2 of 2 of 62 Stafford's Sub. Pre-
sented and read. On motion of Ald.
Frith the petition was referred to
the City Attorney.
To the Honorable Mayor and City
Council.
Gentlemen: Lot 2 in Voelker's
Add assessed in the name of Alberta
Connolly for the year 1918 and the
taxes on the same were paid on
March 6th, 1920 as per receipt No.
6299, the amount with penalty being
$26.35. This assessment was entire-
ly an error as the same property has
been assessed to the Voelker Realty
Co. and the taxes thereon were paid
on May May 24th, 1919, as per receipt
No. 5380. We therefore ask you to
kindly draw a warrant refunding the
amount of $26.35 erroneously paid by
reason of this double assessment,
payable to the Voelker Realty Co.
Trusting that you will grant this
promptly was also request can-
cellation of 1919 assessment also
made doubly omit the Connelly as-
sessment.

bers of the City Council.
Gentlemen:
Your City Assessor to whom was
referred the petition of Rosa Keck,
relative to an erroneous assessment
on Lot 2 of Sub. 1 of 1 of 7 of Min-
eral Lot 159, for the years 1914,
1915, 1916, 1917, 1918, would respect-
fully report that I find that a valua-
tion of $550.00 was placed on the
above mentioned Lot in 1914, when
a revaluation of all City Property
was made, and find that the above
mentioned $550.00 valuation has been
carried for the above mentioned
years since 1914. I also find that
the above mentioned lot was reduced
from $550.00 to $50.00 by the Board
of Equalization for the 1919 Tax.
The Board went out and viewed the
grounds last fall on this Lot, and
found that the above mentioned
piece of ground is a small strip of
ground in the rear of Lot 2 of Sub.
26 O'Niell's Sub., which has a build-
ing on, and which house and lot is
carried for a valuation of $1,150.00,
so the $550.00 valuation placed on
the above mentioned Lot 2 Sub. 1 of
1 of 7 of Min. Lot 159, by the Somers
System in 1914, I would say that the
above mentioned Mrs. Rosa Keck,
was over assessed on the above men-
tioned Lot 2 of Sub. 1 of 1 of 7 of
Min. Lot 159, for the above men-
tioned years.

son, relative to an error on the val-
uation of Lot 315 Woodlawn Park
Add., for the 1914 Tax, find that the
above mentioned Lot 315 and Lot
Regular Session, April 1, 1920

308 Woodlawn Park Add., a valuation
of $2,550.00 was carried for the 1914
Tax, against the above mentioned
Lots, also find that someone, the As-
sessor or the Treasurer, placed
separate values on these Lots after
the books were turned over to the
Treasurer, placing a valuation on
Lot 308 at $200.00, and a valuation
on Lot 315 at $2,350.00 for the 1914
Tax, in 1915 the valuations on the
above mentioned Lots were carried
separately on the Tax Books, Lot
308 valuation $1,210.00, Lot 315 val-
uation $1,300.00, so the facts as
stated in his petition are true and
correct, pertaining to the 1914
Taxes, on the above mentioned
Lots.

Neenan, relative to a soldier's ex
emption, while he was in service of
the U. S. Army, on his property
known as Lot 8 Grandview Add., on
the 1919 Tax, and find that the facts
as stated in his petition are true and
correct, therefore if the Law so
states that a Soldier is entitled to
an exemption while in service of the
U. S. Army, his petition should be
granted.

Gentlemen:
Plumbers Excavation Bonds of
Richard Burke, Nesler and Buechel
and Mullen Brothers, have been re-
ferred to me fon examination and
report. I beg to advise you that
the bond of Richard Burks is pro-
perly executed in form and can be
placed on file.
The bonds of Mullen Brothers and
Nesier & Buechel have not been
properly executed because the firm
naive in each case has been signed
and no person is named who affixes
his signature on behalf of the firm.
This should be done by having some
member of the firm sign the firm's
name by some one authorized to
sign and obligate the firm. These
bonds should be returned to those
parties for proper execution.

Be it Resolved by the City Council
of the City of Dubuque, That it is
deemed necessary and advisable to
improve Louisa Street from the
north curb line of Delhi Street to
the south curb line of West Four-
teenth Street and it is hereby pro-
posed to grade, curb and gutter with
combination cement curb and gut-
ters and to pave said portions of
said street with tar - macadam, and
to assess the cost of said grading,
curb and guttering and paving
against the property, legally sub-
ject to assessment.
Ald. Hird moved the adoption of
the resolution. Carried by the fol-

Be it resolved by the City Council
of the City of Dubuque, that the city
engineer be and he is hereby direct-
ed to prepare a plat showing gener-
ally the location, nature and extent
to the proposed improvement of
Louisa Street from the north curb
line of Delhi Street to the south
curb line of West Fourteenth Street.
And the kind or kinds of materials
to be used, and an estimate of the
entire cost thereof, and the amount
and cost of such improvement, and
the amount assessable upon any
railway or street railway company,
the amount and cost thereof to be
paid by the city, if any, and the cost
thereby, and to file such plat and
each lot or parcel of land adjacent
to such improvement as contemplat-
ed by Chapter 76 of the Laws of
the Thirty -fifth General Assembly of
the State of Iowa and acts amended
thereby, and to file such plot and
estimate in the office of the city re-
corded; that the filing of said plat
and estimated in his office, the city
record shall publish in three conse-
cutive issues of a newspaper publish-
ed in this city, a notice stating that
such plat and estimates are on file,
the location and nature of the im-
provement, kind or kinds of ma-
terial or materials to be used, and
an estimate of its cost, and the time
before which objections thereto can
be filed, and the time fixed for hear-
ing, which time shall not be less
than five days after the last publi-
cation of such notice, and after such
publication shall have been made,
the city recorder shall, at the next
regular session of the City Council,
notify the Council thereof in writing,
with a printed copy of such notice
accompanying the same.

On motion of Alderman Leist, par-
ties receiving the largest number of
votes be declared elected, and the
Recorder be instructed to publish
same in the papers. Carried.
On motion of Ald. Frith the City
Recorder was instructed to issue
warrants in the sum of $10.00 each
for all judges and clerks that served
at the city election of April 5th, 1920,
and $1.00 extra be allowed the judge
of each precinct that returned the
poll books to the city recorder. Also
registration clerks be allowed the
sum of $32.50 each for their ser-
vices, also all bills incurred for the
rent of buildings used for polling
places and registration of electors,
also for stoves and wood for heating
said buildings.
On motion of Ald. Strobel the
Council proceedings for the month
of January, 1920, were approved as
printed.

"Gentlemen: The undersigned
committee has investigated the ac-
counts of the Key City Gas company
for the purpose of determining the
financial result of its operations for
the eighteen months period ending
December 31, 1919, and finds that the
books, records and accounts of said
company show for said period net
earnings of $26,354,94, as per the at-
tached statement.
"The net earnings permitted said
company for said period of time un-
der the agreement between the city
council and the Key City Gas com-
pany are $63,945.00; that is, 6 per
cent per annum for eighteen months
on $710,500.00
"The company's accounts repre-
senting interest on bonded debt, ex-
tensions and improvements have
not been charged as items of ex-
pense.

the Chicago, Milwaukee and St. Paul
Railroad Company's main tracks ex-
cept where the railroad tracks run
through said alley, such use to be
enjoyed by said Pier Bros. as long
as they continue to operate their
business at said location, and such
shall be exclusive to said company.
Section 2. If the Said company
their successors and assigns should
at any time discontinue the opera-
tion of their business at its present
location, they shall remove any
building or structure which has been
built upon the alley above mention-
ed within a reasonable time after
such discontinuance, and after be-
ing ordered to do so by the City
Council of said City of Dubuque, and
said alley shall then be open for
public travel thereon, and no rights
other than those herein above men-
tioned are intended to be given to
said Pier Bros.
Section 3. This ordinance shall
after its passage by the City Council
ejn force and take effect from and

east and to assess the cost of said
sewer against the abutting property.

provement, the extent thereof, the
size and kind of material to be used,
and to prepare an estimate of the
able upon each lot or parcel of land
cost thereof and the amount assess -

That after such plat is so filed,

is on file, and generally the nature
of the sewer, its location, size and
kinds of material to be used, and
the estimte of its cost, and fixing
the time before which objections can
be filed, which time shall not be
less than five days after the last
publication of said notice, and after
the completion of the publication of
such notice, he shall at its next ses-
sion, notify the Council thereof in
writing with a printed copy of such
notice accompanying the same.

ernment of the city of Dubuque
under chapter 14 D —Title V. of the
acts of the 36th. General assembly.
Whereas, at a special election
held in the city of Dubuque on Jan-
uary 26, 1920, there was submitted
to the voters of said City the ques-
tion:
"Shall the City of Dubuque organ-
ize under Chapter 14 D —Title V of
the acts of the 36th, General As-
sembly of the State of Iowa ?" and.
Whereas, at said election a ma-
jority vote was cast in favor of said
proposition thus submitted; and
Whereas, within the proper legal
period a number of persons filed
their nomination papers as candi-
dates for . the office of councilmen
for the two and three year terms,
respectively, and, thereupon their
names were placed upon the ballots
to be voted upon at the regular
biennial election held on April 5,
1920; and
Whereas, at said election the fol-
lowing candidates received the larg-
est number of votes cast for the
office of Councilmen; For the two
year terms: Harlan Melchior and
Magnus B. Rooney. For the three
year terms; Dr. James Alderson

Louis Brede and Theorore Gabriel,
and were by the City Council, de-
clared to be elected to the office of
Councilmen for the terms to which
they had been elected; and,
Whereas, it is provided by law,
that on the first Monday following
their election, said council thus
elected shall organize the govern-
ment of the City adopting the plan
contemplated by the Act of the
General Assembly above named said
form of government being commonly
known as "The Manager Plan."
Now, Therefore.
Be it resolved by the City Council
of the City of Dubuque:
That, in conformity with the laws
of the State of Iowa and especially
Chapter 14 D —Title V, of the 36th
General Assembly, on this 12th, day
of April A. D. 1920, the same being
the first Monday following the date
of election we, the undersigned as
the duly elected Councilmen for the
City of Dubuque, do hereby declare
and proclaim that from and after
this date and until changed as pro-
vided by law, the municipal affairs
of the City of Dubuque shall be
managed, governed and conducted
in accordance with the provisions of
Chapter 14 D —Title V. of the Acts
of the 36th, General Assembly, and
the same to be known and recogniz-
ed as "The Manager Plan of Muni-
cipal Government."

Whereas, The contract heretofore

for the construction of a sanitary
sewer in Henion Street hereinafter
described has been completed, and
the City Engineer has computed
that the cost and expense of said
improvement amount to $718.12.
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of con-
structing a sanitary sewer in Hen-
ion Street from the manhole in
West Fourteenth Street to the pre-
sent manhole in Henion Street,
north of Pickett Street the Mayor
be and he is hereby required to ex-
ecute and deliver to the City Re-
corder, to be by him registered and
countersigned, two bonds for Two
Hundred and Fifty Dollars each and
one for Two Hundred Eighteen and
12 -100 Dollars numbered 6146 to
6148 inclusive, dater May 15th, 1920

now operating under the Manager
Plan of Government, and
Whereas the statute provides that
all departments of the City shall
continue to exist as departments of
the City until abolished.
Now therefore be it resolved by
the City Council of the City of Du-
buque that the Board of Water
Works Trustees is hereby abolished.

session of the City Council of the
city of Dubuque, Iowa, to be held
Thursday, April 15th, 1920, to pay
for constructing an eight -inch tile
pipe sanitary sewer in Henion
street from the manhole in West
Fourteenth street to the present
manhole in Henion street north . t

In pursuance to the Laws of Iowa
and the Ordinances of this city, I
James, Saul, mayor of the City of
Dubuque, State of Iowa, do hereby
proclaim that an election will be
held April 5th, 1920, in said city on
purpose of eltcting five (5) Council-
men and Park Commissioners.
On said date the polls will be

4:30 p. m. Friday, April 30, 1920, for
hauling patients to the Detention
Hospital. Bidders must furnish con-
veyances and transportations, includ-
ing the furnishing of proper vehicles
as required by health regulations.

for hauling patient or patients from
their home to said Detention Hos-
pital.
The Board of Health reserves the
right to reject any and all bids.

AN ORDINANCE granting to Pier
Bros. the use of the Alley in
Block 15, Dubuque Harbor Im-
provement Co.'s Addition, from the
West property line of Pine street
to the Chicago, Milwaukee & St.
Paul Railroad Co.'s main tracks.
Except where railroad tracks run
through said alley, during the time
that said Pier Bros. maintain and
operate their business at its pres-
ent location.
Whereas, Pier Bros. are the own-
ers of the property in Block 15, Du-
buque Harbor Improvement Co.'s Ad-
dition, abutting the alley in said
block; and,
Whereas, said company are en-
gaged in the coal and wood business
in the City of Dubuque; and,
Whereas, said Pier Bros. desire
the use of that part of said alley not
occupied by railroad tracks; and,
Whereas, the use of said part of
said alley is necessary for the suc-
cessful operation of their business;
and,
Whereas, said alley has never been
opened up and is of no practical use
to any othr firm or corporation and
does not interfere with the rights of
any other person; and,
Whereas, the City Council feels
that the use of said part of said al-
ley is necessary for said Pier Bros.
for the successful promotion of their
business;
Now, therefore, Be It Ordained by
the City Council of the City of Du-
buque:
Section 1. That Pier Bros., their
successors and assigns, be and they
are hereby granted the exclusive use
of that part of the alley in Block 15,
Dubuque Harbor Improvement Com-
pany's Addition, from the west prop-
erty line of Pine street to the Chi-
cago, Milwaukee & St. Paul Rail-
road Company's main tracks, except
where the railroad tracks run
through said alley, such use to be
enjoyed by said Pier Bros. as long
as they continue to operate their

business at said location, and such
shall be exclusive to said company.
Sec. 2. If the said company, their
successors and assigns should at any
time discontinue the operation of
their business at its present loca-
tion, they shall remove any building
or structure which has been built
upon the alley above mentioned
within a reasonable time after such
discontinuance, and after being or-
dered to do so by the City Council
of said City of Dubuque, and said
alley shall then be open for public
x thereon, and no rights other
than those herein above mentioned
are intended to be given to said Pier
Bros.
Sec. 3. This ordinance shall be in
force and take effect from and after
its passage by the City Council and
its publication as provided by law,
and when the same has been duly
accepted by said Pier Bros., which
acceptance shall be made within ten
days after said ordinance is duly
passed, and shall be endorsed upon
said ordinance and become a part
thereof.

thereto of the Revised Ordinances of
1901 of the City of Dubuque, Iowa,

Bidders must state price per lineal
foot of completed sewer, also price
per manhole complete.
Each bid must be accompanied by
a certified check of $150.00 on some
Dubuque bank as a guarantee that
a contract will be entered into if
awarded . Checks and bid in separ-

The City Council reserves the

On Saturday, May 1st, 1920, at
10:00 o'clock a. m. sharp, the Mar-
ket Master will rent for cash the
market stands about the City Hall,
to the highest bidder for the ensuing
year. The parties having possession
of the various stands at present will
be permitted to retain the same for
the same as paid last year, provided,
however, that the rent be paid be-
fore May 1st, 1920, No renter will
be permitted to loan the use of same
to some other party under penalty
of having the rental of same an-
nulled. The City reserves the right
to reject any and all bids. Per or-

grade on Seventh Street Extension
from the West property line of
Pine Street to a point opposite
the West lot line of Lot 12, Block
13, Dubuque Harbor Improvement
Co.'s Addition.
Be It Ordained by the City- Council
of the City of Dubuque: •
Section 1. That an ordinance es-
tablishing a grade on Seventh street
from the West property line of Pine
street to the West lot line of Lot
12, Block 13, Dubuque Harbor Im-
provement Co.'s Addition, be and the
same is hereby established and ad-
opted as shown on the profile of said
street and grade, prepared by the
City Engineer, being profile No. 1004
B. M, Door sill on the corner of
Seventh street and Jackson street,
elevation 20.50. Said grade begins
at the west property line of Pine
street, which is station 0 -65, north
curb elevation, 20.50, south curb ele-
vation 20.50; thence to station 0,
l east property line of Pine street,
north curb elevation 20.50, south
curb elevation 20.50; thence to sta-
tion 7 -88, north curb elevation 19.50,
south curb elevation 19,50.
Sec. 2, The ordinance shall be in
force and effect from and after its
passage by the City Council and its
publication in the official newspapers
of the City as provided by law.
