Oliver Kringle presented. Council-
man Brede moved that the bid be re-
turned to the bidder unopened, and
the Clerk be instructed to readver-
tise for bids. Seconded by Council-
man, Gabriel. Carried by the follow-
ing vote.

To the Honorable Mayor and Coun-
cil of the City of Dubuque:
Gentlemen:
Hereto attached you will find a
copy of the decree entered in the
District Court in and for the United
States, Northern District, Eastern
Division in the case of City of Du-
buque vs. Dubuque Electric Com-
pany, relative to the enforcement of
the provisions of the franchise or-
dinance relating to service, and in
vrhich action the city sought to en-
force specific performance of the
franchise as to service by a man-
datory injunction. You will also
find the stipulation agreed to by the
defendant company that it will, dur-
ing the life of the franchise keep
the city informed as to receipts and
expenditures in that which has been
properly signed by the defendant
company through its proper officers.
Both of these instruments should
be made on record and preserved
as permanent records in this case.
You will also find hereto attached
the bond of Glenn Brown as Park
Commissioner. I have examined this
bond and find the same properly ex-
ecuted in form and the same may
be filed with the clerk.

In the District Court of the United
States, in and for the Northern
District of Iowa, Eastern Division.
City of Dubuque, a Municipal Cor-
poration, Plaintiff, ,
vs.
Dubuque Electric Company, a
Corporation, Defendant.
This cause carne on to be heard
at this term, and was by agreement
submitted for final hearing upon
the pleadings, awl being argued by
Council and considered by the Court,
it is upon consideration thereof,
ordered, adjudged and decreed by
council and considered by the court,
as follows:
1. That the provisions as to rates
of fares contained in the defendants
franchise ordinances, set forth in
the pleadings herein, do not con-
stitute a contract between the plain-
tiff and defendant that the said pro-
visions were and are beyond the
power of the plaintiff to enact, and
are void, and the plaintiff is hereby
permanently enjoined from enforc-
ing such provisions against the de-
fendant.
2. That the defendant is entitled
to reasonable and just rates fo:
street car service furnished by it,
and that the plaintiff is empowered
from time to time to fix reasonable
and just rates for such service, sub-
ject to the right of the defendant;
to have the reasonableness and
justice of such rates determined by
a court of competent jurisdiction in
a proceeding for that purpose.
3. That the defendant is by the
terms of its franchise bound, and is
hereby ordered unless prevented by
cause beyond its reasonable control,
to furnish continuous street car ser-
vice to the City of Dubuque and its
inhabitants during the remaining
period of its franchises, in accord-
ance with all the terms thereof, ex-
cept said provision as to rates of
fare.
4. That for the time being, the
defendant shall not charge to exceed
the following rates of fare with
transfer privileges, namely: (a) eight
(8c) cents for a single fare; (b)
seven (7) tickets for fifty (50c)
cents; (c) children under twelve
years of age, single fare four (4c)
cents or seven (7) tickets for twenty -
five (25c) cents. Defendant claims
at this time, in open court, that the
said rates are not reasonable or just,
and the court does not determine
that question, nor does the defendant
waive any of its rights in that re-
spect. In case defendant shall at
any time desire a change in said
sates, it shall first apply to the pro-
per rate -fixing body, if there be such,
for a change in such rates, and de-
fendant shall not increase such rates
until it has been authorized to do so
May 3rd, 1920
by either such rate -fixing body or
has been granted relief against such
rates by some court of competent
jurisdiction, by temporary or per-
manent injunction, or otherwise.
5. That the counterclaim of the
defendant as to the alleged invalid-
ity of the ordinance of the plaintiff,
prohibiting the operation of so- called
"one -man" cars is hereby dismissed
without prejudice.
6. That each party shall pay its
own costs in this proceeding. To all
of which neither party excepts.

ceedings for a revision of rates,

Board of Education were approved
as follows: That in cases of Dip -
theria do not admit to school until
quarantine to be lifted upon securing
two negative cultures taken on suc-
cessive days. Cultures to be taken
not sooner than five days after all
membranes and inflammation have
disappeared from nose and throat.

The superintendent reported the
purchase of one car of cast iron
water pipe from J. B. Clow Com-

Street Reservoir was thoroughly
cleaned April 17th, 1920; the steam
engine on the .Buffalo pump at the
Eagle Point pumping station was;
thoroughly overhauled.
The samples of water from West
3rd Reservoir, Level Station, Eagle
Point station and 9th street hydrant
at post office; sent to the State
Chemist where reported as satis-
factory
The Superintendent also reported
that all valves throughout the City
are being inspected and a card index
made for the sane.
The State Auditor's report for
audit of books from Feb. 1st, 1918
to April 1st, 1920 of the City Water
Works, was received and a copy
ordered filed with the City Clerk.

NOTICE TO CONTRACTORS.
Bids will be received at the City
Clerk's office, City Hall, up to 4:30
p. m. Monday, May 10, 1920, for
the erection of Street Signs in the
City of Dubuque, Iowa, in accord-
ance with the plans and specifica-
tions prepared by the City Engi-
neer and now on file in the office
of the City Clerk.
The work to be paid for when
completed and accepted by the City
Council of the City of Dubuque,
Iowa.
Bidders must state price per sign
erected and also price per post
erected separate.
Each bid must be accompanied by
a certified check of $25.00 on some
Dubuque Bank as a guarantee that
a contract will be entered into with-
in the time specified in specifica-
tions if awarded. Check and bid in
separate envelopes.
The City Council reserves the
right to reject any and all bids.

NOTICE TO SEWER CONTRAC-
TORS.
Sealed proposals will be received
at the City Clerk's office, City Hall,
by the City Clerk until 4:30 p. m.
Monday, June 7, 1920, to be acted
on by the City Council on said date
for the construction of an eight -inch
tile pipe sanitary sewer in Seventh
street from the end of the present
sewer in said street to a point oppo-
site the west line in Lot 12, in
Block 13, Dubuque Harbor Improve-
ment Co's Addition, in accordance
with the plans and specifications
prepared by the City Engineer and
now on file in the office of the City
Clerk.
It is estimated by the City Engi-
neer that said improvement will re-
quire:
780 lineal feet of eight -inch tile
pipe.
4 manholes.
The work to be paid for when
said work is completed and as pre-
scribed by Chapter XXXIV and
amendments thereto of the Revised
Ordinances of 1901 of the City of
Dubuque, Iowa, work to he complet-
ed on or before the 1st day of July,
1920.
Bidders must state price per lin-

price per manhole complete.

Notice of Special Assessment.
Notice is hereby given to all con-
cerned that a special assessment as
provided by law will be levied at a
session of the City Council of Du-
buque, Iowa, to be held Tuesday,
June 1st, 1920, at 4:30 p. m., to pay
for constructing an eight -inch tile
pipe sanitary sewer in Seminary
Street from Harold Street to Wood-
worth Street, and in Seminary Street
from the westerly line of lot 2 of 2
of Mineral Lot 193, to Woodworth
Street and in Woodworth Street
from Seminary Street to Leibnitz
Street and in Leibnitz Street from
Woodworth Street to Hempstead
Street, and in Hempstead Street
from Leibnitz Street to Kaufmann
Avenue. James Street, contractor.
Amount of Special Assessment,
$8237.46, same to be assessed against
the property legally subject to as-
sessment upon and along said
streets.
And that there is a plat and sched-
ule on file in the office of the City
Recorder of said City of Dubuque,
showing the streets in which said
sewer was constructed and the sep-
arate lots and parcels of ground or
specified portions thereof subject to
rssessment for such improvement,
the name of the owner thereof as
far as practicable and the amount to

be assessed against each lot or par-
cel of ground, which plat and sched-
ule are subject to public inspection.
And that any and all persons ob-
jecting to said special assessment
or to said plat must file his or their
objections in writing with the City
Recorder of said City of Dubuque on
or before said session of the City
Council to be held Tuesday, June
1st, 1920, at 4:30 P. M. or to appear
at said session of the Council to
show cause, if any you have, why
said assessment should not be levied.

parcel of ground, which plat and
