Water Department Manager Chris Lester is recommending acceptance of the public
improvement construction contract for the Orchard Drive, Cider Ridge and Jonathan
Lane Water Main Project 2021, as completed by Temperley Excavating, in the final
contract amount of $425,052.44, which is 1.7% less than the original bid amount.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to provide discussion and final project summary along
with the enclosed resolution for the acceptance and authorization for final payment of the
Orchard Drive, Cider Ridge and Jonathan Lane Water Main Replacement Project 2021.
BACKGROUND
Since 2004, the area in and around Orchard Drive, Cider Ridge and Jonathan Lane was
subject to thirteen (13) water main breaks across a 1,250 feet portion of water main, with
four (4) of those events occurring on March 1, 2021, which occurred following isolation of
the Roosevelt Street Water Tower during a planned outage. Not only are the residents
inconvenienced with unplanned water outages, but the water also comes to the surface
during the main breaks resulting in significant street damage.
The City's Public Works department has scheduled the area to be "milled -and -filled" and
have requested the water main work be conducted ahead of their paving program.
The water main in the Orchard Hills subdivision area was installed between 1962 and
1965 and is 6-inch ductile iron pipe with standard bury depths of around 5.5 feet.
DISCUSSION
The project was advertised, and sealed bids were received and publicly opened on August
9, 2021.Temperley Excavating of East Dubuque, Illinois submitted the apparent low bid in
the amount of $432,316.50.
Approximately 1,361 lineal feet of water main on Orchard Drive was replaced from the
intersection of Orchard Drive south toward the intersection of Jonathan Lane and Delicia
Drive. The project also included the replacement of approximately 1,430 feet of curb and
gutter and 657 feet of sidewalk, including the replacement ADA ramps.
The Public Works Department will be financially assisting with a portion of the hot mix
asphalt (HMA) pavement replacement costs and are scheduled to complete the final HMA
surface wearing course in the spring of 2022.

The lowest bid of $432,316.50 from Temperley Excavating includes ADA curb ramp
replacement and hot mix asphalt (HMA) pavement removal and replacement beyond the
original project scope, this additional work was requested by the Public Works Department
to reduce coordination conflicts and to ensure the project is completed prior to the asphalt
plant season closure. The additional line -item expense for the requested ADA and HMA
pavement totals $94,604.67 which will be paid for from the Public Works ADA and
Pavement CIPs.
The construction administration and construction engineering (inspection) were completed
by Origin Design of Dubuque, Iowa under a separate contract.
Funding for the project is from Unspent Bond Proceed funds and FY21 Water Main
Improvement CIP No. 7401405, see table below; plus, a portion of the Public Works ADA
and Pavement project funding sufficient to cover the additional HMA and curb ramp project
expenses. The authorized funding sources available to cover the projects costs at the time
of bidding are:

The final project construction costs are $425,052.44 which 1.7 % less than the original bid
amount. The contract adjustment is recorded via Change Order No. 1.

ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution to accept the improvements
and authorize the final payment for the Jonathan Lane, Cider Ridge, and Orchard Drive
Water Main Replacement Project 2021.

RESOLUTION NO. 7-22
ACCEPTING PUBLIC IMPROVEMENT CONTRACT FOR THE JONATHAN LANE,
CIDER RIDGE AND ORCHARD DRIVE WATER MAIN REPLACMENT PROJECT 2021
WHEREAS, the public improvement contract for the Jonathan Lane, Cider Ridge,
and Orchard Drive Water Main Replacement Project, (the Project) has been completed
by the Contractor, Temperley Excavating of East Dubuque, Illinois, (Contractor), the
Water Department Manager has examined the work and recommends that the Project be
accepted; and
WHEREAS, the final contract amount is $425,052.44 of which retainage in the
amount $21,252.62 shall be held for 30 days after acceptance and approval, and paid at
that time provided no claims from others are filed; and
WHEREAS, the City Council finds that the recommendation of the Water
Department Manager should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the Water Department Manager is
approved, and the Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the final payment $21,252.62 as provided in Iowa Code chapter 573.13.
