Assistant City Engineer Robert Schiesl recommends City Council approval and
authorization for the Mayor to execute an Amendment to the Cooperative Funding
Agreement with the Iowa Department of Transportation (Iowa DOT) for the development
and implementation of an Intelligent Transportation System (ITS) along the U.S. 52 /
Southwest Arterial Corridor.
The City, Iowa DOT staff, and HDR Engineering, Inc. have been developing and
finalizing plans for an ITS network consisting of fiber optic communication, cameras,
sensors, dynamic message boards, and other related technology along the Southwest
Arterial Corridor from U.S. 20 to U.S. 61/151.
Now that the system design and implementation plans are nearing completion, the
developed project cost estimate has increased due to the anticipated increase in costs
for fiber optic cable and ITS related equipment. Due to the anticipated higher project
cost, an Amendment to the original Cooperative Funding Agreement is necessary to
increase the reimbursement amount by an additional $400,000.
In return for the City designing, constructing, operating, and maintaining the fiber optic
communications and ITS system, including the 24 strands of fiber optic cable reserved /
used by the Iowa DOT, the State of Iowa shall reimburse the City for an amount not to
exceed $1,900,000.

The purpose of this memorandum is to request City Council approval and authorization
for the Mayor to execute an Amendment to the Cooperative Funding Agreement
(Agreement No. 2020-16-033A) with the Iowa Department of Transportation (Iowa DOT)
for the development and implementation of an Intelligent Transportation System (ITS)
along the U.S. 52 / Southwest Arterial Corridor.
BACKGROUND
In April 2020, the Mayor and City Council approved and executed a Cooperative
Funding Agreement (Resolution 102-20) between Iowa DOT and the City for the
development and implementation of an Intelligent Transportation System (ITS) along
the U.S. 52 / Southwest Arterial Corridor.
DISCUSSION
The City, Iowa DOT staff, and HDR Engineering, Inc. have been developing and

The City has budgeted $50,000 in both FY2022 and FY2023 to cover staff payroll
expenses to administer the design and construction of the fiber optic communications
and ITS system.
RECOMMENDATION
I recommend that the City Council adopt the enclosed resolution and authorize the
Mayor to sign the Amendment to the Cooperative Funding Agreement (Agreement No.
2020-16-033A) with the Iowa DOT.
ACTION TO BE TAKEN
I request that the City Council approve the attached resolution authorizing the Mayor to
execute an Amendment to the Cooperative Funding Agreement (Agreement No. 2020-
16-033A) with the Iowa DOT for the development and implementation of an Intelligent
Transportation System (ITS) along the U.S. 52 / Southwest Arterial Corridor.

RESOLUTION APPROVING AN AMENDMENT TO THE COOPERATIVE FUNDING
AGREEMENT (AGREEMENT NO. 2020-16-033A) WITH THE IOWA DOT FOR THE
DEVELOPMENT AND IMPLEMENTATION OF AN INTELLIGENT TRANSPORTATION
SYSTEM ALONG THE U.S. 52 / SOUTHWEST ARTERIAL CORRIDOR
WHEREAS, on April 6, 2020, the Mayor and City Council approved and executed
a Cooperative Funding Agreement (Resolution 102-20) between Iowa Department of
transportation (Iowa DOT) and the City of Dubuque for the development and
implementation of an Intelligent Transportation System (ITS) along the U.S. 52 /
Southwest Arterial Corridor: and
WHEREAS, due to the anticipated higher project cost, an Amendment to the
original Cooperative Funding Agreement is necessary to increase the reimbursement
amount by an additional $400,000; and
WHEREAS, Iowa DOT and the City wish to Amend said Agreement to revise and
increase the reimbursement amount from $1,500,000 to $1,900,000; and
WHEREAS, all other terms and conditions of the Cooperative Funding Agreement
remain unchanged.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA, THAT:
SECTION 1. That the Amendment to the Cooperative Funding Agreement is
hereby approved.
SECTION 2. That the Mayor be authorized and directed to execute said
Amendment to the Cooperative Funding Agreement.

Staff Action No.
This Addendum, is entered into by and between the Iowa Department of Transportation, hereinafter
designated the "DOT", and the city of Dubuque, Iowa, a Local Public Agency, hereafter designated the
"CITY" in accordance with Iowa Code Chapters 28E, 306, 306A and 313.4 and 761 Iowa Administrative
Code Chapter 150 as applicable;
The DOT and the CITY previously entered into the following agreement(s) for the above referenced project:
Agreement No. 2020-16-033 for the installation of an Intelligent Transportation System (ITS) was executed
by the DOT and the CITY on April 16, 2020, and April 6, 2020, respectively; and
Subsequent to execution of the above referenced Agreement it was determined that funding needed to be
increased for five additional camera site locations for a total of nine camera site locations. See Exhibit A
for locations.
This Addendum reflects the current concept of this project which is subject to modification by mutual
agreement between the CITY and the DOT; and
Now, therefore, it is agreed as follows:
1. The following changes are hereby added:
A. The CITY shall end all of the DOT assigned fibers from each of the above paths (total of 24 strands
– 12 strands from each direction), in the City-owned communications hut located adjacent to the
existing water tower near the intersection of West 3rd Street/College Street. The CITY shall
terminate all DOT assigned fibers into a new fiber distribution panel using SC connectors at no cost
or obligation to the DOT. The CITY shall also allocate space in the communications hut for future
Iowa DOT network equipment and provide adequate electrical service for future equipment at no
cost or obligation to the DOT.
B. Additional funding was received for the project and shall hereby be included as follows:
i. An increase in funding of $400,000 for an additional five camera sites. The total
reimbursement amount shall not exceed $1,900,000. See Exhibit B for costs.
C. The CITY shall make the minimum 4 strands of the redundant fiber loop available to the DOT within
two years of this Addendum.
General Provisions
2. If the CITY has completed a Flood Insurance Study (FIS) for an area which is affected by the proposed
Primary Highway project and the FIS is modified, amended or revised in an area affected by the project
after the date of this Agreement, the CITY shall promptly provide notice of the modification, amendment
or revision to the DOT. If the CITY does not have a detailed Flood Insurance Study (FIS) for an area
which is affected by the proposed Primary Highway project and the CITY does adopt an FIS in an area

affected by the project after the date of this Agreement, the CITY shall promptly provide notice of the
FIS to the DOT.
3. The CITY will comply with all provisions of the equal employment opportunity requirements prohibiting
discrimination and requiring affirmative action to assure equal employment opportunity as required by
Iowa Code Chapter 216. No person will, on the grounds of age, race, creed, color, sex, sexual
orientation, gender identity, national origin, religion, pregnancy, or disability, be excluded from
participation in, be denied the benefits of, or be otherwise subjected to discrimination under any
program or activity for which State funds are used.
4. It is the intent of both (all) parties that no third party beneficiaries be created by this Addendum.
5. If any section, provision, or part of this Addendum shall be found to be invalid or unconstitutional, such
finding shall not affect the validity of the Addendum as a whole or any section, provision, or part thereof
not found to be invalid or unconstitutional, except to the extent that the original intent of the Addendum
cannot be fulfilled.
6. All previously executed agreement(s) and or addendum(s) will remain in effect except as amended
herein.
7. This Addendum may be executed in (two) counterparts, each of which so executed will be deemed to
be an original.
8. This Addendum, as well as the unaffected provisions of any previous agreement(s), addendum(s),
and/or amendment(s); represents the entire Agreement between the CITY and DOT regarding this
project. All previously executed agreements will remain in effect except as amended herein. Any
subsequent change or modification to the terms of this Agreement will be in the form of a duly executed
amendment to this document.
