Rejection of Bids
DATE: February 1, 2022
City Engineer Gus Psihoyos is recommending rejection of the bid proposals received
through the adoption of the enclosed resolution for the Bee Branch Creek Trail Project —
Phase 1 Project.
The submitted bids substantially exceeded the budget for the project and the project will
be redesigned and brough back at a later date.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Rejection of Bids
INTRODUCTION
The enclosed resolution authorizes the rejection of the competitive bid proposals
received for the Bee Branch Creek Trail Project — Phase 1 Project due to
reconsideration of the alignment of the trail.
BACKGROUND
This project was originally bid to include an alignment around the Alliant Solar Field site
located at 12t" street. Engineering solicited bids through the Iowa DOT for the project on
January 19, 2022.
A grant application was approved by the Iowa DOT on May 19, 2020, in the amount of
$410,000.
DISCUSSION
During the development of the original bid documents, Engineering staff developed in-
house concepts where the trail would cut across a portion of the site that contains the
Alliant Solar Field located at the end of 12t" Street. The property owner of this parcel did
not want the trail to cut across the site in an easement. Their concern was the trail
would impact future development opportunity for the parcel.
During the design process, the alignment was shifted off the property to accommodate
the property owner request and keep the trail on City owned land. Unfortunately, this
revised alignment required significant retaining wall work and protective railing to
accommodate the new trail alignment.
When bids were received through the Iowa DOT, it was very evident construction costs
would exceed current available funding if the project proceeded.

The primary difference between the two estimates above is the addition of the required
retaining wall and safety railing.

Competitive sealed bids were received by the Iowa DOT on the Bee Branch Creek Trail
Project — Phase 1 Project on January 19, 2022. The low bidder was 1.9% over the
Engineer's Revised Estimate.
RECOMMENDATION
I recommend that the City Council reject all bids received for the Bee Branch Creek
Trail Project — Phase 1 Project to reconsider other alignment alternatives to minimize
costs. Engineering staff will revise the scope of this project to better match the available
funding and bring this back to the City Council at a later date.
ACTION TO BE TAKEN
I recommend that the City Council reject the bid proposals received through the
adoption of the enclosed resolution for the Bee Branch Creek Trail Project — Phase 1
Project.

RESOLUTION NO. 44-22
REJECTING COMPETITIVE BID PROPOSALS RECEIVED FOR THE BEE BRANCH
CREEK TRAIL PROJECT — PHASE 1 PROJECT
Whereas, competitive sealed bid proposals were submitted for the Bee Branch
Creek Trail Project — Phase 1 Project (the Project) pursuant to the Iowa DOT'S bidding
process; and
Whereas, the competitive sealed bid proposals were opened and read on the 19th
day of January, 2022; and
Whereas, the City Council has deemed it advisable to reject all competitive sealed
bid proposals for the Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The competitive sealed bid proposals for the Bee Branch Creek Trail
Project — Phase 1 Project are hereby rejected.
Section 2. The City Clerk is authorized and instructed to return the bid deposits
to unsuccessful bidders for the Bee Branch Creek Trail Project — Phase 1 Project.
Passed, approved and adopted this 7th day of February 2022.
