BACKGROUND In 2016 the City of Dubuque undertook its Broadband Acceleration Initiative. The Initiative focuses on public/private collaborations and includes a comprehensive strategy to reduce the cost and time required for broadband expansions in Dubuque. One effort within that strategy is the use of "Master Agreements", where an overall legal, structural and financial relationship is established between the City and broadband providers and approved by City Council. Project Statements carried out pursuant to that Master Agreement can then be quickly considered and approved. In 2017 the City of Dubuque and ImOn entered into a Master Co -location and Shared Services Agreement to accelerate the deployment of new broadband capacity in Dubuque. Since then, the City and ImOn have entered into numerous amendments and project statements that have gone well and all anticipated value to the City has been received. DISCUSSION This amendment involves the licensing of conduit for ImOn to provide fiber service to Chaplain Schmitt Island. ImOn will also install several conduit extensions for the City at the same time to improve connectivity and services to McAleece Park Recreation Complex, the Ice Arena and a Water and Resource Recovery Center lift station. The market value for the collaboration to ImOn is $25,550. The market value for the collaboration to the City is $25,550. BUDGETIMPACT There is no negative budgetary impact to the approval of this amendment. This proposal generates revenue to the City and reduces its costs for providing fiber optic connectivity to several city -sites on Schmitt Island. ACTION STEP This amendment supports Dubuque's Broadband Acceleration Initiative and reduces the cost to City of providing a state-of-the-art fiber optic infrastructure. Crenna Brumwell, City Attorney Barry Lindahl, Senior Counsel Steve Brown, Project Engineer Amendment to Master Co -location and Shared Services Agreement between ImOn Communications and the City of Dubuque Pursuant to the Master Co -location and Shared Services Agreement between City of Dubuque (CITY) and ImOn Communications (IMON), dated February 21, 2022 and attached hereto, the Parties hereby agree to the following PROJECT STATEMENT: Narrative description of co -location and service sharing: CITY will provide IMON access to 2650 feet of existing city duct (16/12mm) from the NW corner of the intersection of Kerper Avenue and 16th Street to the vault located at the SE corner of the Ice Arena, and as further described in Exhibit A. - IMON will provide City with the following: ➢ Installation of 400 feet of two-inch duct from the vault located at 16th Street and Admiral Sheehy Drive to the south side of SCADA site to the SW. ➢ Installation of 275 feet of two-inch duct to the Ice Arena from the existing vault located between McAleece Field and the Ice Arena. ➢ Installation of 520 feet of two-inch duct to McAleece Park Recreation Complex from the existing vault located between McAleece Field and the Ice Arena. Charges and Payment Terms: - As estimated, the total cost of City for fulfilling its services under this Project Statement is $25,550.00 calculated as follows: ➢ $18,550 duct license (2650 linear feet x $7 per linear foot) ➢ $7,000 one-time license payment for access to high -cost infrastructure (16th Street River and Levee Crossing) - Upon completion of the three installations above, IMON shall provide City with complete cost detail for such work and, once approved in writing by the City, may deduct such costs from the license payment. - The remaining amount shall be paid by IMON or applied to the accrued construction and services account with the City. - The term of this license is twenty (20) years beginning December 1, 2021 and running through November 30, 2041. IMON or CITY may request up to two five-year extensions of the agreement at the same annual cost, and such extension shall not be unreasonably denied.
