With the adoption of the State legislation on texting and cell phone use, it is necessary
to repeal the City ordinance.
City Attorney Barry Lindahl recommends the City Council repeal Ordinance No. 11 -10,
which prohibits the use of an electronic communications device while operating a motor
vehicle.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

to repeal the City ordinance. The state legislation took effect July 1, 2010.
Attached is an ordinance repealing Ordinance No. 11 -10, which prohibits the use of an
