The Dubuque County Supervisors approved the cost share agreement on February 22, 2022. Dubuque County agrees to pay the city a lump sum of $76,100 for this asphalt project. Van Milligen, City Manager FROM: John Klostermann, Public Works Director JK SUBJECT: 2022 Asphalt Overlay Program — Dubuque County Agreement DATE: February 25, 2022 INTRODUCTION The purpose of this memorandum is to request that you endorse the attached agreement with Dubuque County. DISCUSSION The 2022 Public Works Department Asphalt Overlay program includes a section of Old Highway Road from Radford Road to Cousins Road and Cousins Road from Old Highway Road to the end. In these segments of roadway, both the City of Dubuque and Dubuque County have pavement maintenance responsibilities. Ajoint cost share agreement with Dubuque County was developed by Senior Council Barry Lindahl and was approved by the Dubuque County Board of Supervisors at its meeting on February 22, 2022. The cost share agreement is as follows; Dubuque agrees to provide for this project all labor, material, equipment, and traffic control necessary to place a less than 2-inch asphalt mat using Public Works department staff, on county owned sections of Old Highway Road and on County owned sections of Cousins Road. The sections on Old Highway Road are approximately 3,325' of the west bound lane, and 915 ft. of the east bound lane between Radford Road and Cousins Road. The sections on Cousins Road include approximately 120 ft. in the north bound and approximately 1,430 ft. in the south bound lane. Lane marking will be completed by a private contractor at a cost to the city as it currently is done. 2. County agrees to pay the City of Dubuque a lump sum of $76,100 for this project. The lump sum reimbursement from the County will cover the Public Works labor, equipment, and material cost for the County sections. A similar agreement was entered into with the City of Asbury for the Pennsylvania Avenue project last year. ACTION STEP Your endorsement of the attached agreement is requested. Z11 6 WHEREAS, Dubuque County and the City of Dubuque have scheduled a joint paving project on Old Highway Road and Cousins Road in Sections 31 & 32, Dubuque Township, T89N-R2E; and WHEREAS, the City of Dubuque proposes to provide all labor, equipment and material to mill and pave with a less than 2-inch finish mat for said project and Dubuque County agrees to reimburse the City of Dubuque for the county portion, 8,254 sq. yards of county pavement at an agreed price of $9.22 per sq. yard; and WHEREAS, it is necessary for Dubuque County and the City of Dubuque to enter into an agreement regarding said project. THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign the Asphalt Paving Agreement between Dubuque County and the City of Dubuque for the project on Old Highway Road and Cousins Road. City agrees to provide for this Project all labor, material, equipment, and traffic control necessary to place a less than 2-inch asphalt mat using City Public Works department staff, on County owned sections of Old Highway Road and on County owned sections of Cousins Road. The sections on Old Highway Road are approximately 3,325 ft. of the west bound lane, and 915 ft. of the east bound lane between Radford Road and Cousins Road. Nothing in this Agreement shall be construed to transfer any liability from one jurisdiction to the other, except as herein specified. 4. This Agreement shall take effect upon approval by both parties and shall terminate upon completion of this Project on or before June 30, 2022. 5. This Agreement may be terminated at any time prior to the start of the Project by either party upon thirty (30) days written notice delivered to the other party. 6. The County Engineer and the City Public Works Director shall administer this Agreement. In doing so, the County Engineer shall consult with the County Supervisors and the City Public Works Director shall consult with the City Manager on matters related to this Agreement. No real or personal property shall be acquired by either party under the provisions of this Agreement. 7. Dubuque shall defend, indemnify, and hold harmless the County, its officers, agents and employees, from any and all causes of action, suits at law or in equity, losses, damages, claims or demands, and from any and all liability and expense of whatsoever nature, arising out of or in connection with City's negligent performance of its duties related to said roadway pursuant to this Agreement.
