Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer DATE: February 21, 2022 RE: Stumps / Sidewalks Project Three INTRODUCTION Dubuque AII•Ameriea M 1 I I I 2007-2012.2013 2017*2019 The purpose of this memorandum is to provide the City Council with information related to the public hearing for the Stumps / Sidewalk Project Three. BACKGROUND Iowa Code and Dubuque's City ordinance states that the abutting property owner is responsible for all maintenance in the area between the property line and the back of curb. City policy is property owners are required to replace sidewalks that are defective no matter what has caused the defect. When the City is notified of a sidewalk defect a notice is sent to the abutting property owner. The property owner is provided a time frame to correct the defect(s). If a property owner fails to correct a defect the City intervenes, corrects the defect, and assesses the property owner for the project. There is an exception regarding sidewalks disturbed by street trees a second time. If the sidewalk has been replaced by the abutting property owner once due to a tree heaving or affecting the sidewalk, the City warrants any future sidewalk replacement caused by the tree. Upon a repeat instance, the City repairs the sidewalk. A change in policy adopted May 17, 2021, allows for Engineering Department to have a combined stump/sidewalk replacement project with the City paying for the sidewalk repairs instead of the abutting property owner the first time and all subsequent times it may occur. In 2021 the City was able to contract out and removed 204 diseased or dead ash tree stumps and replaced necessary defective sidewalk and curb. DISCUSSION The Stumps / Sidewalk Project Three will provide for the removal of 101 tree stumps and replacement of abutting sidewalks and curb in defective locations. Stumps sizes range from 12 to 90 inches in diameter. The sidewalk replacement behind the trees is approximately 40 to 100 square feet depending on the location. BUDGETIMPACT The preliminary estimate of probable costs for the Stumps / Sidewalk Project Three is as follows: Description Cost Estimate Construction $ 159,732.40 Contingency 15,973.24 Engineering Design and Administration 17,570.56 Total Construction Cost Estimate $ 193,276.20 The funding summary is as follows: CIP Fund Description Fund Amount 1022830 Tree Removal & Replacement $ 100,255.76 3002849 Pavement Rehab Concrete Streets $ 93,020.44 Total Project Funding $ 193,276.20 The Pavement Rehab Concrete Streets CIP is recommended for funding the sidewalk and curb and gutter portion of the project. The remainder of the Pavement Rehab Concrete Streets CIP will be used on N. Grandview Ave. between Loras Blvd. and Rosedale Ave. to address defective pavement. ACTION TO BE TAKEN The City Council is requested to approve the plans, specifications, form of contract and estimated cost for the Stumps / Sidewalk Project Three through the adoption of the attached resolution.
