RESOLUTION NO. 1-95
RESOLUTION AUTHORIZING
SUBMISSION OF A REQUEST FOR
RELEASE OF FUNDS FOR CERTAIN
COMMUNITY DEVELOPMENT BLOCK
GRANT PROJECTS
Whereas, the City of Dubuque Community and
Economic Development Department has
completed an environmental assessment of the
following projects to be funded in the Community
Development Block Grant:
Hills and Dales Child
Development Center and
Dubuque Rescue Mission
Americans with Disabilities Act Improvement
Projects
Whereas, pursuant to Resolution No 383-94,
adopted December 19, 1994, public notice of a
"Finding of No Significant Effect on the
Environment" for the above projects was published
December 22, 1994, in the Dubuque Telegraph
Herald and provided for a public comment period
until 12:00 noon, Friday, January 6, 1995; and
Whereas, public notice of a "Finding of No
Significant Effect on the Environment" for the
projects was sent by regular mail to various
federal, state and local public agencies and to the
local news media, individuals and groups known
to be interested and believed to be appropriate to
receive such a public notice: and

Whereas, any and all objections, if any, to such
proposals have been duly considered, and
Whereas, it is the intent of the City Council to
authorize the submission of a request to the U S_
Department of Housing and Urban Development
for the release of funds to cavy out the above
identified projects
NOW, THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1 That the environmental review
record for each of the projects shall continue to
remain on file in the Office of the City Clerk where
said record may be examined and copied by any
interested party
Section 2 That the Mayor of the City of
Dubuque is hereby authorized and directed to
submit to the U S_ Department of Housing and
Urban Development seven (7) days after
publication of appropriate notice a Request for
Release of Funds to undertake the said projects
Section 3. That the Mayor of the City of
Dubuque is hereby authorized to consent to
assume the status of a responsible federal official
under the National Environmental Protection Act
insofar as the provisions of the said Act apply to
the U.S. Department of Housing and Urban
Development responsibilities for review, decision
making, and action assumed and carried out by the
City of Dubuque as to environmental issues_
Section 4 That the Mayor of the City of
Dubuque is hereby authorized to consent
personally, in his official capacity and on behalf of
the City of Dubuque, to accept the jurisdiction of
the federal courts if an action is brought to enforce
responsibilities in relation to environmental
review, decision making, and action
Section 5. That the Mayor of the City of
Dubuque be and he is hereby authorized and
directed to execute a certification pertaining to the
environmental review procedures
Section 6_ That the City Clerk be and she is
hereby authorized and directed to publish a public
notice for a Request for Release of Funds and
Certification attached hereto and made a part
hereof

RESOLUTION AUTHORIZING
COLLECTION OF DELINQUENT SEWER
ACCOUNTS IN ACCORDANCE WITH
SECTIONS 44-83 AND 44-86 OF THE CODE
OF ORDINANCES OF THE CITY OF
DUBUQUE, IOWA
Whereas, Section 44-83 of the Code of
Ordinances authorizes the City to levy and collect
just and equitable charges, rates or rentals upon all
lots, parcels or real estate and buildings that are
connected directly or indirectly with the sanitary
sewer system: and
Whereas, Section 44-86 of the Code of
Ordinances provides that the City shall have a lien
upon the real property served by the sanitary sewer
system for all delinquent rates and charges: and
Whereas, delinquent sewer charges shall be
certified as of December 3lst of each year by the
City Clerk to the Dubuque County Treasurer for
collection with, and in the same manner as, general
property taxes
NOW, THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1 That the persons hereinafter named,

people, groups, businesses, dwellings and other
buildings_ Business services shall include

election to which they apply, and removed

schedule of assessments and accompanying plat

Concrete Paving Project under contract with
Tschiggfrie Excavating of Dubuque, Iowa, which
final plat and schedule were filed in the office of
the City Clerk on the 28th day of December, 1994,
the said schedule of assessments be and the same is
hereby approved and adopted.
That there be, and is hereby assessed and levied
as a special tax against and upon each of the lots,
the respective sums indicated Provided, further,
that the amounts shown in said final schedule of
assessments as deficiencies are found to be proper
and levied conditionally against the respective
properties benefitted by the improvements as
shown in the schedule, subject to the provisions of
Section 384.63 of the Code of Iowa. Said
assessments against said lots are hereby declared to
be in proportion to the special benefits conferred
and not in excess of twenty-five percent of the
value of same

That the City Clerk be and is hereby directed to
certify said schedule to the County Treasurer of
Dubuque County, Iowa, and to publish notice of
said certification once each week for two
consecutive weeks in the manner provided in
Section 362 3, the first publication of which shall

filing of the final schedule On or before the date
of the second publication of the notice, the City
Clerk shall also mail a copy of said notice to
property owners whose property is subject to
assessment, as provided and directed in Section
384.60 of the Code of Iowa.
That assessments may be paid in full or in part
without interest at the office of the County
Treasurer, at any time within 30 days after the date
of the first publication of this notice of the filing of
the final schedule of assessments with the County
Treasurer After 30 days unpaid assessments of
$50.00 or more are payable in 10 annual
installments and will draw annual interest at 9
percent (commencing on the date of acceptance of
the work) computed to the December 1 next
following the due dates of the respective
installments as provided in Section 38465 of the
Code of Iowa Each installment will be delinquent
from October 1 following its due date on July 1 of
each year. Property owners may elect to pay any
annual installments semiannually in advance

ACCEPTING IMPROVEMENT
Whereas, pursuant to Resolution Nos_ 355-93
and 124-94 certain improvements including street
paving, storm sewers, sanitary sewers, watemain
and street lighting were installed by the developer
of Sunset Park Eighth Addition, and
Whereas, the improvements have been
completed and the City Manager has examined the
work and has filed a certificate stating that the
same has been completed in accordance with the
plans approved by the City Council and in
conformance with City specifications, and has
recommended that the improvements be accepted
by the City Council
NOW THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1 That the recommendation of the
City Manager be approved and that said

Whereas, the Iowa Department of Trans-
portation has acquired a parcel of property from
the Dubuque Community School District for the
purpose of re -aligning and reconnecting Lombard
Street into the new U 20 construction project,
and
Whereas, said property will become part of the
Lombard Street right-of-way.
Whereas, the Iowa Department of Trans-
portation acquired the property on behalf of, and in
the name of, the City of Dubuque; and

describing the proposed dedication of StarGte
Drive abutting Lots 4 and 5 of Hansel's Addition
in the City of Dubuque; and
Whereas, upon said acquisition plats appears
right-of-way for Starlite Drive which the owner by
said plat has dedicated to the public forever: and
Whereas, said plats conforms to the laws and

Whereas, the City of Dubuque has established
such a local childhood lead poisoning prevention
program; and
Whereas, the Iowa Department of Public
Health has offered to provide financial support for
a local childhood lead poisoning prevention
program in the City of Dubuque; and
Whereas, the City of Dubuque will provide
environmental and medical case management of
identified lead poisoned children in addition to
community outreach and education on the problem
of childhood lead poisoning
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1 That the City of Dubuque, Iowa
hereby approves the attached contract between the
Iowa Department of Public Health and the City of

testing for employees who have a commercial
drivers license; and
Whereas, the City of Dubuque has employees
who are covered by these regulations: and
Whereas, the Drug and Alcohol Testing
Alliance has established a consortium whose
membership consists of members of the Iowa
Association of Municipal Utilities, League of Iowa
Municipalities and Iowa State Association of
Counties; and
Whereas, the Drug and Alcohol Testing
Alliance, through the consortium, will provide
dig and alcohol testing services to the City of
Dubuque.
NOW, THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF

That the City Manager is authorized to enter
into an agreement with the Drug and Alcohol
