Mayor Cavanagh read the call and stated this is a special session of th e City Council called
for the purpose of conducting a work session on workforce housing needs.
WORK SESSION
WORKFORCE HOUSING NEEDS – EARLY EFFORTS
Housing and Community Development Director Alexis Steger and Economic Development
Director Jill Connors provided introductory remarks. Dave Lyons, Sustainable Innovation Con-
sultant for Greater Dubuque Development Corporation, made a presentation on workfor ce hous-
ing needs. Mr. Lyons and Ms. Steger responded to questions from the City Council following
the presentation. Council Members discussed the importance of developing all areas of the
community, the challenges that the city faces in developing addition al housing options, and re-
quested data on how Airbnb rentals impact rental rates.
There being no further business, Mayor Cavanagh declared the meeting adjourned
at 6:25 p.m.

3. Disposition of Claims: City Attorney advising that the following claims have been referred

for vehicle damage. Upon motion the documents were received, filed, and concu rred.
4. Approval of City Expenditures: Upon motion the documents were received and filed, and
Resolution No. 81-22 Authorizing the Director of Finance and Budget/City Treasurer to make
certain payments of bills that must be paid and approved for payment in accordance with City
procedures was adopted.

AUTHORIZING THE DIRECTOR OF FINANCE AND BUDGET / CITY TREASURER TO MAKE
CERTAIN PAYMENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR P AYMENT
IN ACCORDANCE WITH CITY PROCEDURES
Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that the
Finance Director-City Treasurer shall keep an accurate account of all disbursements, money,
or property, specifying date, to whom, and from what fund paid; and
Whereas, the invoices, presented by those firms and persons providing such goods and ser-
vices have been pre-audited by Finance Department personnel in accordance with generally
accepted internal control procedures and have been determined to have been requisitioned for
a lawful municipal purpose; and
Whereas, the Finance Director-City Treasurer has provided a list of Expenditures attached
hereto, and by this reference made a part hereof, to be drawn to pay for goods and se rvices
provided for City purposes; and
Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142 -18
adopted May 7, 2018, authorized the Finance Director-City Treasurer to issue checks in pay-
ment of certain expenditures known as Exception Expenditures prior to City Council approval
and such list is attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA THAT:
Section 1. The Finance Director-City Treasurer is hereby authorized to issue payment for
goods and services provided for City purposes in response to the purchase orders and contracts
issued in compliance with state and municipal code requirements as requested by designated
requisitioning authorities in accordance with approved budget appropriations.
Section 2. In accordance with Iowa Code Section 372.13(6), the City Clerk and Finance Di-
rector are hereby authorized and directed to provide the statement of receipts and disburse-
ments to the City Council, and to publish a summary thereof.

5. Final Plat of Country View Estates Plat 2: Upon motion the documents were received and
filed, and Resolution No. 82-22 Approving the Final Plat of Survey of Country View Estates Plat
2, Dubuque County, Iowa was adopted.

APPROVING THE FINAL PLAT OF SURVEY OF: COUNTRY VIEW ESTATES PLAT 2,
DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Survey: Country View Estates
Plat 2, Dubuque County, Iowa that is within the City’s 2-mile extraterritorial jurisdiction; and
Whereas, said Final Plat provides for a 22 -foot pavement width, where 26-foot paving width
for a private street is required by Section 11-15 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code; and
Whereas, said Final Plat of Survey has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat of Survey has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-15 of Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is waived to allow two 22-foot-wide paved private streets.
Section 2. That the City Council hereby waives Sections 11-20 Water Supply, 11-21, Sanitary
Sewer, 11-23 Obligation to Install Improvements, and 11-24 Improvement Guarantees.
Section 3. That the Final Plat of Country View Estates Plat 2, Dubuque County, Iowa is hereby
approved, and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa upon said Final Plat, provided the owners of said property
herein named, execute their written acceptance hereto attached agreeing:
a) To construct private street improvements in accordance with improvement plans approved
by Dubuque County and certified upon completion by a professional engineer licensed by the
State of Iowa.
b) To maintain the private street improvements constructed as part of Country View Estates
until such time as a homeowners’ association is formed and is responsible for maintenance of
the same.
Section 4. That in the event that Ronald W. and Jessalynn J. Breiner fail to execute the ac-
ceptance within 180 days after the date of this Resolution, the provisions hereof shall be null
and void and the approval of the plat shall not be effective.

6. Request to Distribute RFP to hire Consultant for Parking Ramp Condition Assessment and
Maintenance Plan: Upon motion the documents were received, filed, and approved.
7. First Amendment to Grant Agreement Between the City of Dubuque and Real Property
Investments, LLC for the Rehabilitation of 1540 Central Avenue : Upon motion the documents
were received and filed, and Resolution No. 83 -22 Approving the First Amendment to Grant
Agreement between the City of Dubuque, Iowa and Real Property Investments, LLC was
adopted.

APPROVING THE FIRST AMENDMENT TO GRANT AGREEMENT BETWEEN THE CITY OF
DUBUQUE, IOWA AND REAL PROPERTY INVESTMENTS, LLC
Whereas, the City of Dubuque (City) and Real Property Investments, LLC (Grant Recipient)
entered into a Grant Agreement dated September 8, 2021 for the redevelopme nt of 1540 Central
Avenue in the City of Dubuque, Iowa (the Project); and
Whereas, City and Grant Recipient desire to amend the Grant Agreement as set forth in the
attached First Amendment to Grant Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. That the First Amendment to Grant Agreement between the City of Dubuque, Iowa
and Real Property Investments, LLC, a copy of which is attached hereto, is hereby approved.
Section 2. That the Mayor is hereby authorized and directed to execute the First Amendment
to Grant Agreement on behalf of the City of Dubuque and the City Clerk is authorized and di-
rected to attest to his signature.
Section 3. That the City Manager is authorized to take such actions as are neces sary to
comply with the terms of the First Amendment to Grant Agreement as herein approved.

8. Stumps / Sidewalks Project Three: Upon motion the documents were received and filed,
and Resolution No. 84-22 Awarding Public Improvement Contract for the Stumps / Sidewalks
Project Three was adopted.

AWARDING PUBLIC IMPROVEMENT CONTRACT FOR THE STUMPS / SIDEWALKS PRO-
JECT THREE
Whereas, sealed proposals have been submitted by contractors for the Stumps / Sidewalks
Project Three, (the Project) pursuant to Resolution No. 63 -22 and Notice to Bidders published
on the City of Dubuque, Iowa website and plan room service with statewide circulation on the
24th day of February 2022; and
Whereas, said sealed proposals were opened and read on the 10 th day of March 2022 and it
has been determined that Quality Concrete of Dubuque, IA submitted the low bid in the amount
of $144,172.19, and is the lowest responsive, responsible bidder for the Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
That a Public Improvement Contract for the Project is hereby awarded to Quality Concrete and
the City Manager is hereby directed to execute a Public Improvement Contract on behalf of the
City of Dubuque for the Project.

9. 2022 Asphalt Overlay Curb Ramp Project 1: Upon motion the documents were received,
filed, and made a Matter of Record.
10. Iowa Department of Transportation Title VI Documents: Upon motion the documents were
received, filed, and approved.
11. Southwest Arterial / US52 Project Corridor Right-of-Way Replat Survey: AECOM - Con-
sultant Professional Services Agreement: Upon motion the documents were received, filed, and
approved.
12. Central Avenue (9th - 21st) HMA Pavement Resurfacing Project: Acceptance of Public
Improvement Project: Upon motion the documents were received and filed, and Resolution No.
85-22 Accepting the HMA Pavement Milling and Resurfacing Project on Central Avenue (For-
merly US52) from 9th to 21st Street and authorizing final payment to the contractor was adopted.

ACCEPTING THE HMA PAVEMENT MILLING AND RESURFACING PROJECT ON CEN-
TRAL AVENUE (FORMERLY US52) FROM 9TH TO 21ST STREET AND AUTHORIZING FI-
NAL PAYMENT TO THE CONTRACTOR
Whereas, the public improvement contract for the HMA Pavement Milling and Resurfacing
Project on Central Avenue (formerly US52) from 9th to 21st Street, (the Project) has been com-
pleted by the Contractor, River City Paving of Kieler, Wisconsin (Contractor), the City Engineer
has examined the work and recommends that the Project be accepted; and
Whereas, the final contract amount for the Project is $1,192,149.96; and
Whereas, the Contractor has previously been paid $1,229,884.27, leaving a credit refund
balance of $37,734.31; and
Whereas, the City Council finds that the recommendation of the City Engineer should be
accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is here by
accepted.
Section 2. The Finance Director is hereby directed to receive and deposit the refund payment
from the Contractor for the credit balance of $37,734.31 as provided in Iowa Code chapter 573,
and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that he has
inspected the HMA Pavement Milling and Resurfacing Project on Central Avenue from 9 th to
21st Street has been performed in compliance with the terms of the Public Improvement Con-
tract, and that the total project cost of the completed work is $1,414,740.85.

13. Downtown City Facilities Capacity & Reorganization Study - Request to Distribute RFP
and Create an RFQ Review Committee: Upon motion the documents were received, filed, and
approved.
14. Community Development Block Grant Subrecipient Agreement – Lincoln Outdoor Well-
ness Project Environmental Survey: Upon motion the documents were received and filed, and
Resolution No. 86-22 Authorizing the execution of the Lincoln Outdoor Wellness Project Envi-
ronmental Survey CDBG Subrecipient Agreement was adopted.

AUTHORIZING THE EXECUTION OF THE LINCOLN OUTDOOR WELLNESS PROJECT EN-
VIRONMENTAL SURVEY CDBG SUBRECIPIENT AGREEMENT
Whereas, the Dubuque Community School District submitted an application for CDBG fund-
ing to redevelop their outdoor playground, greenspace, and amenities; and
Whereas, an Environmental Assessment is required to be completed before construction can
begin on this project. To reach compliance with Historic Preservation requirements under 36
CFR Part 800, the Iowa State Historic Preservation Office has requested a Phase I Intensive
Archaeological Survey to determine concurrence with the proposed project; and
Whereas, the City Council adopted the FY22 Budget, which includes Community Develop-
ment Block Grant funding; and
Whereas, the submission has been approved by the Community Development Advisory
Commission on August 18th, 2021, and an environmental review has been co mpleted for costs
related to this survey in accordance with 24 CFR Part 58; and
Whereas, this service will benefit a minimum of 51% low/moderate income residents.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Subrecipient Agreement, authorized by the Community Development Ad-
visory Commission beginning March 14, 2022, for the Lincoln Outdoor Wellness Project Envi-
ronmental Survey be approved.
Section 2. That the Mayor of the City of Dubuque is hereby authorized and directed to execute
said Agreement and related documents on behalf of the City of Dubuque, Iowa.

15. Lease Agreement Between the City of Dubuque and Hodge Company: Assignment of
Lease Agreement and Amendment: Upon motion the documents were received and filed, and
Resolution No. 87-22 Approving the Assignment of a Lease Agreement between the City of
Dubuque, Iowa and Hodge Company to MacHom Windows LLC and an Amendment to the
Lease Agreement Substituting MacHom Windows LLC as Lessee in the Lease Agreement was

APPROVING THE ASSIGNMENT OF A LEASE AGREEMENT BETWEEN THE CITY OF
DUBUQUE, IOWA AND HODGE COMPANY TO MACHOM WINDOWS LLC AND AN
AMENDMENT TO THE LEASE AGREEMENT SUBSTITUTING MACHOM WINDOWS LLC
AS LESSEE IN THE LEASE AGREEMENT
Whereas, the City of Dubuque and Hodge Company entered into a Lease Agreement dated
June 20, 2016 for real estate on Purina Drive in the City of Dubuque, Iowa legally described as
follows:
Lot 11 and Lots 1 and 2 of Lot 10 of Block 4 in Riverfront Sub. No. 2 in the City of Dubuque,
Iowa (the Property); and
Whereas, Hodge Company owns the improvements located on the Property; and
Whereas, Hodge Company has entered into a purchase agreement with MacHom Windows
LLC for the purchase of the improvements; and
Whereas, Hodge Company has requested that the City consent to the assignment of the
Lease Agreement to MacHom Windows LLC and that once the sale is closed, the Lease Agree-
ment be amended to substitute MacHom Windows LLC as the Lessee; and
Whereas, the City Council finds that it is in the best interests of the City of Dubuque to ap-
prove the Assignment and Amendment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE AS FOLLOWS:
Section 1. The Assignment of the Lease Agreement Between the City of Dubuque and Hodge
Company to MacHom Windows LLC attached hereto and the Amendment to the Lease Agree-
ment attached hereto substituting MacHom Windows LLC as the Lessee are hereby approved
subject to the closing of the MacHom Windows LLC purchase.
Section 2. The Mayor is hereby authorized and directed to sign the Consent to Assignment
and Amendment to be held until the closing of the MacHom Windows LLC purchase.
Section 3. The City Manager and City Attorney are hereby authorized to take such further
action as may be necessary to complete the transactions herein.

16. National League of Cities Census and Democracy Grant Report: Upon motion the docu-
ments were received and filed.
17. Resilient Community Advisory Commission Letters on Fiscal Year 2023 Budget Recom-
mendations: Mr. Schultz stated that the city should establish a plan for expanding it’s tipper cart
program and expressed concern about a potential increase in recyclables placed in tipper carts.

18. Historic Bluffs Neighborhood Petition for No Parking Signs: Upon motion the documents
were received, filed, and referred to the City Manager.

20. Signed Contract(s): City of Asbury for an extension of the 2021 Memorandum of Under-
standing for summer programming; Harris Golf Carts for a lease extension for golf carts for the
Bunker Hill Golf Course. Upon motion the documents were received and filed.
21. Mediacom Communications Corporation Letter on Programming Changes and Rate Ad-
justments: Upon motion the documents were received and filed.
22. Abstract of Votes for the 2022 Special Ward 4 Primary Election: City Clerk transmitted
the Abstract of Votes for the March 1, 2022, Special Ward 4 Primary Election as certified by the
Dubuque County Board of Supervisors. Upon motion the documents were received and filed.
23. Adoption of Code of Ordinances Supplement No. 2022 S-6: Upon motion the documents
were received and filed, and Resolution No 88-22 Adopting Supplement No. 2022 S-6 to the
Code of Ordinances of the City of Dubuque, Iowa was adopted.

ADOPTING SUPPLEMENT NO. 2022 S-6 TO THE CODE OF ORDINANCES OF THE CITY
OF DUBUQUE, IOWA
Whereas, under date of August 17, 2009, the City Council, pursuant to Ordinance No. 43 -09,
readopted the Code of Ordinances of the City of Dubuque, Iowa in its entirety; and
Whereas, since August 17, 2009, the City Council of the City of Dubuque, Iowa has adopted
certain ordinances amending the Code of Ordinances and said amendments have been printed
as supplements to the Code of Ordinances; and
Whereas, Section 380.8 of the Code of Iowa provides that supplements, by resolution, be-
come part of the Code of Ordinances; and
Whereas, Code Supplements are prepared by the American Legal Publishing of Cincinnati,
Ohio and filed in the Office of the City Clerk of the City of Dubuque, Iowa.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. That Supplement No. 2022 S-6 to the City of Dubuque Code of Ordinances, which
codifies Ordinance Nos. 37-21 through 6-22 as approved by the City Council through February
7, 2022, is hereby adopted, and becomes part of the Code of Ordinances of the City of Dubuque,
Iowa.

There is on file in the office of the City Clerk an estimated total cost of the work, and a pre-
liminary plat and schedule showing the amount proposed to be assessed to each lot for the
improvement.
The date, time, and place the council will hear property owners subject to the assessment
and interested parties for or against the improvement, its cost, the assessment, or the bounda-
ries of the district.
That the City Council deems it advisable and necessary for the public welfare to make the
herein mentioned improvements.
Unless a property owner files objections with the City Clerk at the time of hearing on the
resolution of necessity, the property owner is deemed to have waived all objections pertaining
to the regularity of the proceeding and the legality of using the special assessment procedure.
Said improvements shall be constructed in accordance with the plans and specifications
which have been approved by the City Council and are now on file in the Office of the City Clerk.
The cost of making such improvement will be assessed against property lying with the assess-

Council Member Resnick thanked the Dubuque Area Chamber of Commerce for recently
hosting their Dubuque Night in Des Moines event.
Council Member Farber reported on serving as a guest lecturer at the University of Dubuque
as part of International Women’s Day on March 10th.
Mayor Cavanagh reported on attending the National League of Cities Conference in Wash-
ington D.C., and having the opportunity to speak with Iowa’s Senators and Congresswoman
while in Washington D.C.
Council Member Jones stated that the Ward 4 Special Election is taking place on March 29 th.
