The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request.
The application, staff report and related materials are attached for your review.
Discussion
Terry Koelker, Buesing & Associates, 1212 Locust Street, spoke on behalf of the property
owner, GT Development, LLC. He explained that they are planning to divide an existing
four -unit apartment building into 4 townhouses. He noted there are already common walls
between the units along which the property dividing lines will run. He explained that the
parcels would be substandard for street frontage, so they are seeking to waive that
requirement.
Staff Member Moon detailed the staff report. She noted that this is a minor subdivision of
three or more parcels. Moon explained that the applicant is planning to divide the property
into four parcels, each of which would have less than the required 16' of street frontage,
so the applicant is seeking to waive that bulk standard.
No public input was provided for this item.
The Zoning Advisory Commission discussed the request finding it appropriate.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the minor subdivision as submitted subject to waiving minimum lot frontage.
A simple majority vote is needed for the City Council to approve the request.

A RESOLUTION APPROVING THE MINOR SUBDIVISION PLAT: JACKSON PARK
TOWNHOUSE, DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Minor Subdivision Plat
Jackson Park Townhouse, Dubuque, Iowa; and
Whereas, said Minor Subdivision Plat has been examined by the Zoning
Advisory Commission and its approval has been endorsed thereon; and
Whereas, said Minor Subdivision Plat has been examined by the City Council
and they find that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 5-6 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow less than the minimum lot frontage for a
townhouse in the R-4 Multi -Family Residential zoning district.
Section 2. That the Minor Subdivision Plat Jackson Park Townhouse, Dubuque,
Iowa is hereby approved, and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa upon said Plat of Survey.

INTRODUCTION
The submitted Jackson Park Townhouse minor subdivision' plat is located at 1659 Iowa
Street within the City limits. The lot is currently improved with one structure containing
four side -by -side residential units with frontage along Iowa Street and access to onsite
parking from the alley along the rear/west side of the site. The existing site configuration
is shown in the image below.

The Unified Development Code Chapter 11 defines a Minor Subdivision as `Any subdivision or
consolidation of property in which no new streets, public or private, are proposed and which does not require
the construction of any public improvements, and which creates three or more lots."

The proposed plat would subdivide the existing property into a total of four separate lots
which would each contain one of the existing townhomes. Each lot would extend the full
length of the existing parcel and would have frontage along Iowa Street and along the
alley to the west. The image below shows an approximate breakdown of the four new
lots. The attached subdivision plat provides a detailed depiction of the proposed minor
subdivision.

DISCUSSION
The property owner is proposing to the subdivide the existing 7,296 square foot (.2 acres)
property in order to create a separate lot for each existing townhome on the site. The four
new lots would each have frontage along Iowa Street and along the alley to the west. The
proposed lots are located within the R-4 Multiple -Family Residential zoning district within
the City of Dubuque.
The Zoning Advisory Commission and City Council are the reviewing authorities for a
minor subdivision. The Zoning Advisory Commission shall review the plat to determine
whether it is in substantial conformance with the Unified Development Code and has the
authority to waive bulk regulations.
The Unified Development Code outlines bulk regulations for townhouse development
within the R-4 zoning district. These regulations specifically require that a lot must have
a minimum of 16 lineal feet of street frontage for each townhome dwelling unit on the site.

The existing site is legally non -conforming with respect to this requirement as the average
lot frontage per townhome currently is approximately 14.3 lineal feet. The proposed minor
subdivision would maintain this non -conforming condition overall as the proposed lots
would have varying street frontages less than 16 lineal feet. The proposed minimum lot
frontage for each new lot is provided in the chart below.

The City's Comprehensive Plan identifies the future land use for the subject site as Mixed
Use which includes a mix of land uses such as residential and commercial, and a mix of
housing types from single-family homes to multi -family units. The subject property is
currently utilized as four residential units and the proposed minor subdivision will not result
in a change of the residential use.
As requested, the proposed subdivision will have little effect on the status of the subject
lots or surrounding properties. Except for the creation of non -conforming street frontages
for all four lots, the Jackson Park Townhouse Plat will comply with all aspects of the City
of Dubuque's subdivision regulations contained in the Unified Development Code and the
land use goals within the City's Comprehensive Plan.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Jackson Park
Townhouse Plat and recommends approval as submitted of the Minor Subdivision
subject to waiving the minimum lot frontage requirement for Lots 1, 2, 3, and 4.
