Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report, and related materials are attached for your review. Discussion Patrick Norton, Buesing & Associates, spoke on behalf of the property owner, Collins Community Credit Union, and Frew Development. He stated that Collins has purchased the subdivided parcel that formerly had most of the footprint of the Shopko building. Mr. Norton noted that they are planning a three-story building with a smaller footprint than Shopko with on -site parking and a drive-thru. The planned building is taller than the 40' allowed by the current PUD ordinance, so they are seeking an allowance for a maximum 50' height. He provided a plan detailing the height of the proposed structure, highlighting the sloping ground elevation from John F. Kennedy Road toward the south end of the site and the building setback distance from the John F. Kennedy Road frontage. Mr. Norton stated the second revision to the PUD ordinance is for signage, explaining that while Collins will occupy one floor and lease two floors to other tenants, there won't be wall signs on the building for other tenants. Chair Mulligan noted the height of the building relative to the curb line would be about 40'. Mr. Norton concurred and shared that credit unions desire to have a visible presence to adjacent roadways and they specifically hope to have visibility from US Highway 20. Staff Member Moon detailed the staff report, noting the two requested amendments dealing with maximum height and signage. She pointed out that this PUD was established in 1989 for a department store, and now the use is changing. Moon noted that the former property has been subdivided into three parcels, and the height revision would apply to all property located within the PUD boundaries. She further noted that the PUD signage regulations would be divided into two zones as identified on the Signage Overlay Map. Property located in Zone A would defer to the C-3 signage regulations and Zone B would follow the modified wall signage regulations intended to accommodate the current Service People Integrity Responsibility Innovation Teamwork The Honorable Mayor and City Council Members Page 2 development. Staff member Moon noted that Collins is seeking two wall signs of nearly 250 square feet each and do not intend to allow any tenants to install wall signs. Under the current ordinance, each tenant would be allowed one 100-square foot wall sign. Moon noted that this development would be in keeping with the other development in the area. The Commission discussed the height allowance and applicability to the entire Planned Unit Development. They discussed the location of the existing and proposed freestanding signs and proposed wall -mounted signage. There were no public comments. The Zoning Advisory Commission discussed the request finding it appropriate Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. That Title 16, the Unified Development Code of the City of Dubuque Code of Ordinances is hereby amended by rescinding Ordinance 25-18, which established regulations for the Shopko Planned Unit Development District with a Planned Commercial District designation, and now being amended to allow for the redevelopment of the zoning district, to wit: Lot 1 Yiannias Place No. 6, Lot 1 Yiannias Place No. 7, and a portion of Lot 2 Yiannias Place No. 7 as shown in the attached Exhibit 1, all in the City of Dubuque, Iowa. Section 2. PUD Development Regulations A. Use Reaulations PUD Ordinance 15-22 Page 2 of 5 The following regulations shall apply to all uses made of land in the above -described Planned Unit Development. Principal permitted uses: The following uses are permitted in the this Planned Unit Development: All principal permitted, accessory, conditional, and temporary uses allowed in the C-3 General Commercial District as established in Section 16-5-13 of the Unified Development Code B. Lot and Bulk Regulations The following bulk regulations shall apply in this Unit Planned Unit Development subject to the provisions of the Unified Development Code. All buildings and structures located within the Planned Unit Development shall be developed in compliance with the bulk regulations of the C-3 General Commercial district as established in Section 16-5-13 of the Unified Development Code, shall apply unless further regulated by this section. All principal buildings shall be limited to a maximum height of 50 feet. C. Sian Reaulations The following Signage Regulations shall apply for all development within this Planned Unit Development and as specifically identified for zones as shown in the attached Signage Overlay Map. Zone A a. Wall -mounted signs for the principal building shall be a maximum of 500 aggregate square feet or less, with no single sign being larger than 250 square feet. 3. Off -Premise signs: Off -premise signs shall be prohibited for all development within the Collins Community Credit Union PUD. 4. Variances: For all signage requirements outline herein, variances from the sign requirements for size, number, and height may be requested. Such variances shall be reviewed by the Zoning Board of Adjustment in accordance with Article 8-6 of the Unified Development Code. D. Parkina Reaulations Parking requirements for all businesses located within this Planned Unit Development shall comply with the provisions of Section 16- 14 Parking of the Unified Development Code. E. Site Lighting Exterior illumination of site features and the location and design of site lighting shall be in accordance with Section 16-13 Site Design Standards of the Unified Development Code. F. Exterior Trash Collection Areas Exterior Trash Collection Areas shall be constructed in accordance with Section 16-13 Site Design Standards of the Unified Development Code. G. Landscaping Regulations Landscaping requirements for all development within this Planned Unit Development shall be in accordance with Section 16-13 Site Design Standards of the Unified Development Code. H. Performance Standards The development and maintenance of uses in this Planned Unit Development shall be established in conformance with the following standards. 1. Platting: Subdivision plats shall be submitted in accordance PUD Ordinance 15-22 Page 4 of 5 with Section 16-11 Land Subdivision of the City of Dubuque Unified Development Code. 2. Site Plans: Final site development plans shall be submitted in accordance with Section 16-12 Site Plans and Section 16- 13 Site Design Standards of the City of Dubuque Unified Development Code prior to construction of each building and vehicle -related feature unless otherwise exempted by Article 12. Storm Water Conveyance: The developer of each lot shall be responsible for providing surface or subsurface conveyance(s) of storm water from the lot to existing storm sewers or to the flow line of open drainage ways outside the lot in a means that is satisfactory to the Engineering Department of the City of Dubuque. Other applicable regulations enforced by the City of Dubuque relative to storm water management and drainage shall apply to properties in the Planned Unit Development. Other Codes and Reaulations Service Lines. All electric, telephone, cable, or other similar utility lines serving the building and other site features shall be located underground, wherefeasible. 2. These regulations do not relieve the owner from other applicable city, county, state or federal codes, regulations, laws, and other controls relative to the planning, construction, operation and management of property within the city of Dubuque. Transfer of Ownership Transfer of ownership or lease of property in the PUD shall include in the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of the District PUD. Modifications Any modifications to this Ordinance must be approved by the City Council in accordance with the Zoning Reclassification proceedings of Section 16-9 of the Unified Development Code. M. Recording A copy of this PUD Ordinance shall be recorded, at the expense of the property owner, with the Dubuque County Recorder as a permanent record of the conditions accepted as part of this reclassification approval. This ordinance shall be binding upon the undersigned and his/her heirs, successors and assigns. Section 3. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4. INTRODUCTION The applicant, Patrick Norton of Buesing & Associates, is requesting to amend the existing Planned Unit Development (PUD) to allow for a greater maximum building height and to revise the signage regulations. BACKGROUND The PUD district was established in 1989 and allowed for a department store development. Amendments to the PUD were approved in 1999 and 2018 to allow for freestanding signage and the development of an out -lot, respectively. The property was most recently occupied by Shopko up until its closure in 2019. At that time, the PUD covered one parcel, but that parcel has since been subdivided thereby resulting in the PUD lying over two full parcels and a portion of a third. The center parcel (identified by the red hatching in the image below) has been sold to Collins Community Credit Union who is planning to develop the site. Memo to Zoning Advisory Commission Page 2 DISCUSSION Collins Community Credit Union is preparing for the construction of a new three-story general office building. During the conceptual site plan review with City staff, it was identified that the proposed building height and proposed wall mounted signage would exceed the maximum height and allotted signage square footage permitted in the PUD. Consequently, the applicant is requesting to amend Ordinance 25-18 to allow for a maximum height of up to 50 feet and up to a maximum of 500 aggregate square feet of wall mounted signage for the principal buildings'. The PUD encompasses an area that was previously one contiguous parcel and was home to Shopko. Since Shopko closed its doors in 2019, the property owner has subdivided the site and a portion of the property was purchased by Collins Community Credit Union. Collins Community Credit Union is requesting to amend the existing PUD Ordinance to allow a maximum height of 50 feet for principal buildings within the PUD area, where 40 feet is currently allowed by the PUD and is consistent with the maximum height permitted in the C-3 General Commercial zoning district. The second amendment requested is to allow up to a maximum of 500 aggregate square feet of wall mounted signage, with no single sign being larger than 250 square feet. The current PUD and the C-3 General Commercial zoning district would allow up to a maximum of 100 square feet of signage per business located within a multi -tenant building. Collins Community Credit Union will be the primary tenant of the new multi - tenant building and intends to prohibit wall signage for other tenants. As the primary tenant and property owner, they desire to be permitted wall signage up to a maximum of 500 aggregate square feet in -lieu of allowing wall signage for multiple tenants. Planning staff believes that the proposed amendment to allow a maximum height of 50 feet for all principal buildings and allowing up to a maximum of 500 aggregate square feet of wall mounted signage for the Collins Community Credit Union site will not have a substantial impact on development within the area because it would not prohibit other development in the area. Furthermore, a site plan review will be required for the Collins Community Credit Union and future development within the PUD which will take into consideration development regulations such as lot coverage, landscaping, signage, traffic, and stormwater. RECOMMENDATION City staff recommends that the Zoning Advisory Commission review the enclosed materials and make a recommendation regarding the amendment to the PUD to allow for a maximum height of 50 feet for principal buildings and up to a maximum of 500 aggregate square feet of wall mounted signage for the Collins Community Credit Union site. Attachments The Unified Development Code defines Principal Building as "a building within which the main or principal use of the lot or premises is located." Principal Use is defined as "the main use of land or structure, as distinguished from an accessory use." That Title 16, the Unified Development Code of the City of Dubuque Code of Ordinances is hereby amended by rescinding Ordinance 61-89 and 14-99, which established regulations for the Shopko Planned Unit Development District with a Planned Commercial District designation, and now being amended to allow the development of an out -lot building, to wit: A. Use Regulations The following regulations shall apply to all uses made of land in the above -described Planned Unit Development: Principal permitted uses: The following uses are permitted in the this Planned Unit Development: All principal permitted, accessory, conditional and temporary uses allowed in the C-3 General Commercial District as established in Section 16-5-13 of the Unified Development Code. B. Lot and Bulk Regulations. Shopko PUD Ordinance Page 2 The following bulk regulations shall apply in the Shopko Planned Unit Development, subject to the provisions of the Unified Development Code. 1, All shopping center buildings and structures shall be limited to a maximum height of 40 feet. 2. All buildings and structures located on out lots shall be developed in compliance with the bulk regulations of the C-3 General Commercial district as established in Section 16-5-13 of the Unified Development Code. C. Sign Regulations. The provisions of the City of Dubuque Unified Development Code, Section 15 Signs shall apply unless further regulated by this section. 2. That the freestanding sign for the principal retail building shall be a maximum of 350 square feet in area and a maximum of 40 feet in height. 3. Off -premise signs: Off -premise signs shall be prohibited. 4. Variances: Variances from sign requirements for size, number, and height may be requested. Such variances shall be reviewed by the Zoning Board of Adjustment in accordance with Article 8-6 of the Unified Development Code. D. Parking Regulations Parking requirements for the principle retail building shall be one space per 250 square feet of retail space accessible to the general public. 2. All vehicle -related features shall be surfaced with standard or permeable asphalt, concrete, or pavers. 3. Curbing and proper surface drainage of storm water shall be provided. 4. All parking and loading spaces shall be delineated on the surfacing material by painted stripes or other permanent means. 5. The size and design of parking spaces shall be governed by applicable provisions of the Unified Development Code enforced at the time of development of the lot. Shopko PUD Ordinance Page 3 6. The number, size, design, and location of parking spaces designated for persons with disabilities shall be according to the local, state, or federal requirements in effect at the time of development. 7. Parking requirements for businesses located on out lots shall comply with the provisions of Section 14 of the Unified Development Code. E. Site Lighting 1. Exterior illumination of site features shall be limited to the illumination of the following: a. Parking areas, driveways and loading facilities. b. Pedestrian walkway surfaces and entrances to building. C. Building exterior. 2. Location and Design a. All exterior lighting luminaries shall be designed and installed to shield light from the luminaries at angles above 72-degrees from vertical. b. Fixtures mounted on a building shall not be positioned higher than the roofline of the building. C. All electrical service lines to posts and fixtures shall be underground and concealed inside the posts. F. Exterior Trash Collection Areas 1. The storage of trash and debris shall be limited to that produced by the principal permitted use and accessory uses of the lot. 2. All exterior trash collection areas and the materials contained therein shall be visually screened from view. The screening shall be completely opaque fence, wall or other feature not exceeding a height of 10 feet measured from the ground level outside the lino of the screen. Screens built on sloping grades shall be stepped so that their top line shall be horizontal. All exterior entrances to a screened trash area shall be provided with a gate or door of similar design to that of the screen. G. Performance Standards Shopko PUD Ordinance Page 4 The development and maintenance of uses in this Planned Unit Development shall be established in conformance with the following standards. Platting: Subdivision plats shall be submitted in accordance with Section 11 Land Subdivision of the City of Dubuque Unified Development Code. 2. Site Plans: Final site development plans shall be submitted in accordance with Section 12 Site Plans and Section 13 Site Design Standards of the City of Dubuque Unified Development Code prior to construction of each building and vehicle -related feature unless otherwise exempted by Article 12. 3. Storm Water Conveyance: The developer of each lot shall be responsible for providing surface or subsurface conveyance(s) of storm water from the lot to existing storm sewers or to the flow line of open drainage ways outside the lot in a means that is satisfactory to the Engineering Department of the City of Dubuque. Other applicable regulations enforced by the City of Dubuque relative to storm water management and drainage shall apply to properties in the Planned Unit Development. H. Other Codes and Regulations Service Lines. All electric, telephone, cable, or other similar utility lines serving the building and other site features shall be located underground, where feasible. 2. These regulations do not relieve the owner from other applicable city, county, state or federal codes, regulations, laws and other controls relative to the planning, construction, operation and management of property within the city of Dubuque. Transfer of Ownership Transfer of ownership or lease of property in the Shopko PUD shall include in the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of the District PUD. Recording A copy of this PUD Ordinance shall be recorded, at the expense of the property owner, with the Dubuque County Recorder as a permanent record of the conditions accepted as part of this reclassification approval. This ordinance shall be binding upon the undersigned and his/her heirs, successors and assigns. Shopko PUD Ordinance Page 5 Section 2. That Title 16, the Unified Development Code of the City of Dubuque Code of Ordinances is hereby amended by rescinding Ordinance 25-18, which established regulations for the Shopko Planned Unit Development District with a Planned Commercial District designation, and now being amended to allow for the redevelopment of the zoning district, to wit: Lot I Yiannias Place No. 6, Lot I Yiannias Place No. 7, and a portion of Lot 2 Yiannias Place No. 7 as shown in the attached Exhibit 1, all in the City of Dubuque, Iowa. Section 2. PUD Development Regulations A.^Use Regulations The following regulations shall apply to all uses made of land in the above -described Planned Unit Development. Principal permitted uses: The following uses are permitted in the this Planned Unit Development: 1.^All principal permitted, accessory, conditional, and temporary uses allowed in the C-3 General Commercial District as established in Section 16-5-13 of the Unified Development Code B. ^Lot and Bulk Regulations The following bulk regulations shall apply in this Unit Planned Unit Development subject to the provisions of the Unified Development Code. 1.^All buildings and structures located within the Planned Unit Development shall be developed in compliance with the bulk regulations of the C-3 General Commercial district as established in Section 16-5-13 of the Unified Development Code, shall apply unless further regulated by this section. 2. "All principal buildings shall be limited to a maximum height of 50 feet. C.^Sign Regulations The following Signage Regulations shall apply for all development within this Planned Unit Development and as specifically identified for zones as shown in the attached Signage Overlay Map. 1. ^ Zone A a.^The provisions of the City of Dubuque Unified Development Code Section 16-15 Signs shall apply generally and the bulk standards for signage in a C-3 General Commercial District (15-11.8) shall apply unless further regulated by this section. b. ^Freestanding signage for a shopping center shall be a maximum of 350 square feet in area and a maximum of 40 feet in height. 2. ^Zone B a. "The provisions of the City of Dubuque Unified Development Code Section 16-15 Signs shall apply generally and the bulk standards for signage in a C-3 General Commercial District (15-11.8) shall apply unless further regulated by this section. b. "Wall -mounted signs for the principal building shall be a maximum of 500 aggregate square feet or less, with no single sign being larger than 250 square feet. 3. "Off -Premise signs: Off -premise signs shall be prohibited for all development within the Collins Community Credit Union PUD. 4."Variances: For all signage requirements outline herein, variances from the sign requirements for size, number, and height may be requested. Such variances shall be reviewed by the Zoning Board of Adjustment in accordance with Article 8-6 of the Unified Development Code. Recording Section 3. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4.
