Present: Mayor Cavanagh; Council Members Farber, Jones, Resnick, Roussell, Sprank, Wethal; City Manager Van Milligen, City Attorney Brumwell. City Clerk Breitfelder announced the voting order for the meeting as: Farber, Cavanagh, Sprank, Jones, Roussell, Wethal, Resnick. PLEDGE OF ALLEGIANCE SWEARING IN 1. Swearing -In of Ward Four Council Member -Elect: Ward Four Council Member -Elect Katy A. Wethal was sworn -in by Mayor Cavanagh. PRESENTATION(S) 1. COVID-19 Update: Public Health Specialist Mary Rose Corrigan provided an update on the COVID-19 pandemic and response activities. PROCLAMATION(S) 1. Sexual Assault Awareness Month (April 2022) was accepted by Sarah McKenzie and Elisa Componado on behalf of the Riverview Center. 2. Week of the Young Child (April 2-8, 2022) was accepted by Abbey Degenhardt on behalf of Dubuque County Early Childhood (DCEC). 3. National Public Health Week (April 4-10, 2022) was accepted by Environmental Sanitarian Tim Link on behalf of the City of Dubuque Health Services Department. 4. Junior Achievement Day (April 7, 2022) was accepted by Scott Ellerbach on behalf of Junior Achievement of the Heartland. 5. National Public Safety Telecom municators Week (April 10-16, 2022) was accepted by Lead Dispatcher Abbi Ryan on behalf of the City of Dubuque Emergency Communications Center. 6. Disposition of Claims: City Attorney advised that the following claims have been referred to Public Entity Risk Services of Iowa, the agent for the Iowa Communities Assurance Pool: BNK Properties/ Dubuque Dental Associates PC for property damage; Frank O'Connor for vehicle damage; Ron Vaughn for property damage. Upon motion the documents were received, filed, and concurred. 4. Approval of City Expenditures: Upon motion the documents were received and filed, and Resolution No. 104-22 Authorizing the Director of Finance and Budget/City Treasurer to make certain payments of bills that must be paid and approved for payment in accordance with City procedures was adopted. 5. First Amendment to Grant Agreement between the City of Dubuque, Iowa and Dub Jones Real Estate, LLC for the Redevelopment of 2900 Central Avenue: Upon motion the documents were received and filed, and Resolution No. 105-22 Approving the First Amendment to Grant Agreement between the City of Dubuque, Iowa and Dub Jones Real Estate, LLC was adopted. 6. Transmission of Application Guidelines for Fiscal Year 2023 Arts & Culture Operating Support Grant Program: Upon motion the documents were received and filed. 7. Transmission of Application Guidelines for Fiscal Year 2023 Arts & Culture Special Projects Grant Program: Upon motion the documents were received and filed. 8. Application, Notice of Award and Receipt of SBA Shuttered Venue Operators Grant and Expenditure Recommendations: Upon motion the documents were received and filed, and Resolution No. 106-22 Authorizing the Mayor to execute an application for the SBA Shuttered Venue Operators Grant and authorizing the Leisure Services Manager and the City Manager to approve the application was adopted. 14. Community Development Block Grant (CDBG) Subrecipient Agreement — Affordable Housing Network, Inc. 90 Main Street HVAC Replacement: Upon motion the documents were received and filed, and Resolution No. 107-22 Authorizing execution of CDBG Subrecipient Agreement with Affordable Housing Network, Inc. was adopted. 15. Community Development Block Grant (CDBG) Subrecipient Agreement — Four Mounds Foundation Build Dubuque Vocational Training: Upon motion the documents were received and filed, and Resolution No. 108-22 Authorizing execution of CDBG Subrecipient Agreement with Four Mounds Foundation was adopted. 16. U.S. Department of Housing & Urban Development (HUD) Environmental review Monitoring Finding Clearance: Upon motion the documents were received and filed. 17. Iowa Department of Transportation Bridge Repair Project Notification: Correspondence from Jesse Tibodeau, Assistant District Engineer for the Iowa Department of Transportation, notifying the City Council of a bridge repair project on US 61 over Mt. Carmel Rd. and Huff St. Upon motion the documents were received and filed. 18. Improvement Contracts / Performance, Payment and Maintenance Bonds: Tschiggfrie Excavating Co. for the 2022 Asphalt Overlay Ramp Project One. Upon motion the documents were received, filed, and approved. 19. Civil Service Commission - Certified List: Civil Service Commission submitting the certified list for the position of Fire Chief. Upon motion the documents were received, filed, and made a Matter of Record. 20. City Council Meeting Public Input Brochure: Upon motion the documents were received and filed. 21. Approval of 2021 City Council Official Proceedings: Upon motion the documents were received, filed, and approved. 22. Liquor License Renewals: Upon motion the documents were received and filed, and 3 Resolution No. 109-22 Approving applications for beer, liquor, and/or wine permits, as required by City of Dubuque Code of Ordinances Title 4 Business and License Regulations, Chapter 2 Liquor Control, Article B Liquor, Beer and Wine Licenses and Permits was adopted. Resolution Setting a Public Hearing on a Proposed Development Agreement by and among the City of Dubuque, Iowa, Scherr Real Estate, LLC, and Dubuque Screw Products, Inc. for the Issuance of Urban Renewal Tax Increment Revenue Grant Obligations Pursuant to the Development Agreement: Upon motion the documents were received and filed and Resolution No. 110-22 Fixing the date for a public hearing of the City Council of the City of Dubuque, Iowa on the proposed Development Agreement by and among the City of Dubuque, Scherr Real Estate, LLC, and Dubuque Screw Products, Inc., including the proposed issuance of urban renewal tax increment revenue grant obligations to Dubuque Screw Products, Inc., and providing for the publication of notice thereof was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on April 18, 2022 in the Historic Federal Building. 2. Set Public Hearing for Radford Road Amended Urban Revitalization Area Plan: Upon motion the documents were received and filed and Resolution No. 111-22 Setting a public hearing for the proposed amendment to the Radford Road Urban Revitalization District Area Plan was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on April 18, 2022 in the Historic Federal Building. 3. 2022 Pavement Marking Project: Upon motion the documents were received and filed and Resolution No. 112-22 2022 Pavement Marking Project: preliminary approval of plans, specifications, form of contract, and estimated cost; setting date of public hearing on plans, specifications, form of contract, and estimated cost; and ordering the advertisement for bids was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on April 18, 2022 in the Historic Federal Building. 4. Mystique Community Ice Center Settlement Remediation Project: Initiate Public Improvement Bidding Process: Upon motion the documents were received and filed and Resolution No. 113-22 Mystique Community Ice Center Settlement Remediation Project: preliminary approval of plans, specifications, form of contract, and estimated cost; setting date of public hearing on plans, specifications, form of contract, and estimated cost was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on April 18, 2022in the Historic Federal Building. 5. Kennedy Road: Iowa DOT Project No. STBG-SWAP-2100 (702)--SG-31: preliminary approval of plans, specifications, form of contract, and estimated cost; setting date of public hearing on plans, specifications, form of contract, and estimated cost was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on April 18, 2022 in the Historic Federal Building. 7. Proceedings to Set Public Hearing on the Issuance of Not to Exceed $10,165,000 General Obligation Bonds, Series 2022AB: Upon motion the documents were received and filed and Resolution No. 116-22 Fixing date for a meeting on the proposition of the issuance of not to exceed $1,990,000 General Obligation Bonds of the City of Dubuque, State of Iowa (for essential corporate purposes), and providing for publication of notice thereof; Resolution No. 117-22 Fixing date for a meeting on the proposition of the issuance of not to exceed $700,000 General Obligation Bonds of the City of Dubuque, State of Iowa (for general corporate purposes), and providing for publication of notice thereof; Resolution No. 118-22 Fixing date for a meeting on the proposition of the issuance of not to exceed $700,000 General Obligation Bonds of the City of Dubuque, State of Iowa (for general corporate purposes), and providing for publication of notice thereof; Resolution No. 119-22 Fixing date for a meeting on the proposition of the issuance of not to exceed $975,000 General Obligation Urban Renewal Bonds of the City of Dubuque, State of Iowa (for essential corporate urban renewal purposes), and providing for publication of notice thereof; and Resolution No. 120-22 Fixing date for a meeting on the proposition of the issuance of not to exceed $5,800,000 General Obligation Urban Renewal Bonds of the City of Dubuque, State of Iowa (for essential corporate urban renewal purposes), and providing for publication of notice thereof were adopted setting a public hearing for a meeting to commence at 6:30 p.m. on April 18, 2022 in the Historic Federal Building. 8. Resolution of Necessity for the Proposed Amended and Restated Urban Renewal Plan for the Greater Downtown Urban Renewal District, Version 2022.3: Upon motion the documents were received and filed and Resolution No. 121-22 Authorizing and directing the City Manager to prepare an Amended and Restated Urban Renewal Plan, Version 2022.3 for the Greater Downtown Urban Renewal District and setting the date for a public hearing and consultation on the proposed Amended and Restated Urban Renewal Plan, Version 2022.3 for said district was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on May 2, 2022 in the Historic Federal Building. 9. Resolution of Necessity for the Amendment of the Dubuque Industrial Center Economic Development District Urban Renewal Plan, Version 2022.1: Upon motion the documents were received and filed and Resolution No. 122-22 Authorizing and directing the City Manager to prepare an Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center Economic Development District and setting dates for the public hearing and consultation process was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on May 16, 2022 in the Historic Federal Building. BOARDS/COMMISSIONS Applications were reviewed for the following Boards and Commissions. Applicants were 461 invited to address the City Council regarding their desire to serve on the following Boards/Commissions. i. Housing Appeals and Mediation Board: One, 3-Year term through January 1, 2024 (Vacant term of Lenhart). Applicants: Carroll Schuety, 2435 Roosevelt St.; Marrichelle Glover, 1635 Catherine St. ii. Housing Commission: One, 3-Year term through August 17, 2023 (Vacant term of Craddieth). Applicant: Yindra Dixon, 251 Hidden Oaks Ct. Appointments were made to the following boards/commissions. i. Civil Service Commission: One, 4-Year term through April 6, 2026 (Expiring term of Baskerville). Applicant: Phil Baskerville, 2945 Van Buren St. This commission is subject to the State of Iowa Gender Balance Law. 3 Commissioners total; currently 1 male/1 female/1 opening. Upon City Council concurrence, Mayor Cavanagh appointed Mr. Baskerville to the four-year term through April 6, 2026. PUBLIC HEARINGS 1. 2022 Asphalt Overlay Ramp Project 2: Motion by Resnick to receive and file the documents and adopt Resolution No. 123-22 Approval of plans, specifications, form of contract, and estimated cost for the 2022 Asphalt Overlay Ramp Project 2. Seconded by Sprank. Motion carried 7-0. 2. Wilbricht Lane Detention Basin Project: Motion by Roussell to receive and file the documents and adopt Resolution No. 124-22 Approval of plans, specifications, form of contract, and estimated cost for the Wilbricht Lane Detention Basin Project. Seconded by Farber. Responding to a question from the City Council regarding the funding source of the project, City Engineer Gus Psihoyos stated that stormwater utility balances will fund the project. City Council Members stated that residents of Glendale Ct. expressed appreciation for the project, hoping that it will reduce flooding issues. Motion carried 7-0. PUBLIC INPUT City Clerk Breitfelder stated that written public input was received by Stephanie Kramer, 2721 Balboa Dr.; Eric Lucy 2736 Tiffany Ct.; and Marvin Cocayne, 2297 Graham Circle. ACTION ITEMS 1. Request for Proposal for Historic Millwork District Master Plan Update: Motion by Farber to receive and file the documents and approve the request for proposal (RFP). Seconded by Jones. Responding to a question from the City Council, Economic Development Director Jill Connors stated that the updated RFP includes additional verbiage on the city's expectations for the master plan and that the selection panel for the RFP will include city staff, private sector partners and non-profit partners. Motion carried 7-0. 2. Police Department Recruitment Video: Motion by Roussell to receive and file the information and view the video. Seconded by Jones. COUNCIL MEMBER REPORTS Council Member Jones congratulated Council Member Farber and City Attorney Brumwell on their nominations for the Women's Leadership Network Women of Achievement Awards. Council Member Farber reported on her and Council Member Roussell's visit to 41" grade classes at St. Columbkille Elementary School. Mayor Cavanagh reported on volunteering with Meals on Wheels. Mayor Cavanagh also commended the first-time occasion of having more women seated at the dais than men. CLOSED SESSION Motion by Jones to convene in closed session at 7:33 p.m. to discuss Purchase or Sale of Real Estate — Chapter 21.5(1)(j) Code of Iowa. Seconded by Roussell. Mayor Cavanagh stated for the record that the attorney who will consult with City Council on the issues to be discussed in the closed session is City Attorney Brumwell. Motion carried 7-0. The City Council reconvened in open session at 8:45 p.m. stating that staff had been given proper direction.
