Present: Mayor Cavanagh; Council Members Farber, Jones, Resnick, Roussell, Sprank; City Manager Van Milligen. Vacancy: Ward 4 Mayor Cavanagh read the call and stated this is a special session of the City Council called for the purpose of adopting the City of Dubuque Annual Budget for Fiscal Year 2023. PUBLIC HEARINGS 1. Amended Fiscal Year 2023 Budget Recommendation: Proof of publication on notice of public hearing to consider City Council approval of the Amended Fiscal Year 2023 Budget Recommendation, and City Manager recommended approval. Motion by Jones to receive and file the documents and adopt Resolution No. 101-22 Adopting the City of Dubuque Fiscal Year 2023 Annual Budget; and Resolution No. 102-22 Adopting the City of Dubuque Five Year Capital Improvement Program. Seconded by Farber. City Manager Van Milligen made a presentation. City Clerk Breitfelder stated that public input was submitted by Kathy Gukeisen, 566 Saint George St. City Council Members expressed their support for the recommended budget and thanked city staff for their work on the budget. Motion carried 6-0. ACTION ITEMS 1. Code of Ordinances Amendments - Title 13 Public Utilities - Chapter 1 Water Use and Service: Motion by Jones to receive and file the documents and that the requirement that a proposed ordinance be considered and voted on for passage at two Council meetings prior to the meeting at which it is to be passed be suspended. Seconded by Sprank. Motion carried 6-0. Motion by Jones for final consideration and passage of Ordinance No. 10-22 Establishing City of Dubuque Code of Ordinances Title 13 Public Utilities, Chapter 1 Water Use and Service, Article C Rates, Section 13-1C-1(A) Fixing Water Rates for Residential, Commercial, Industrial, and all other uses; and Ordinance No. 11-22 Establishing the City of Dubuque Code of Ordinances Title 13 Public Utilities Chapter 1 Water Use and Service, Article C Rates Section 13-1C-2 Fixing Water Rates for Fire Sprinkler Service. Seconded by Sprank. Motion carried 6-0. 2. Code of Ordinances Amendments - Title 13 Public Utilities - Chapter 2 Sewers and Sewage Disposal: Motion by Roussell to receive and file the documents and that the requirement that a proposed ordinance be considered and voted on for passage at two Council meetings prior to the meeting at which it is to be passed be suspended. Seconded by Farber. Motion carried 6-0. Motion by Roussell for final consideration and passage of Ordinance No. 12-22 City of Dubuque Code of Ordinances Title 13 Public Utilities, Chapter 2 Sewers and Sewage Disposal, Article C Rates, Section 13-2C-3 Rates Established for Fiscal Year 2023. Seconded by Farber. Motion carried 6-0. 3. Code of Ordinances Amendments - Title 13 Public Utilities - Chapter 4 Stormwater Management: Motion by Jones to receive and file the documents and that the requirement that a proposed ordinance be considered and voted on for passage at two Council meetings prior to the meeting at which it is to be passed be suspended. Seconded by Roussell. Motion carried 6-0. Motion by Jones for final consideration and passage of Ordinance No. 13-22 Amending City of Dubuque Code of Ordinances Section 13-4-5 (D) SFU Rate, Charges; Utility Revenues. Seconded by Roussell. Motion carried 6-0. 4. Code of Ordinances Amendment - Title 13 Public Utilities - Chapter 6 Solid Waste: Motion by Jones to receive and file the documents and that the requirement that a proposed ordinance be considered and voted on for passage at two Council meetings prior to the meeting at which it is to be passed be suspended. Seconded by Sprank. Motion carried 6-0. Motion by Jones for final consideration and passage of Ordinance No. 14-22 Amending City of Dubuque Code of Ordinances Title 13 Public Utilities, Chapter 6 Solid Waste, Section 13-6-3 Container Requirements; Collection Restrictions; Article A City or Private Collection Service, Section 13-6A-6 Rates and Charges Established; Exceptions; and Section 13-6A-8 Yard Waste and Food Scraps. Seconded by Sprank. Motion carried 6-0. 5. Five -Year Street Construction Program for Fiscal Years 2023 2027: Motion by Farber to receive and file the documents and adopt Resolution No. 103-22 Adopting the Five -Year Street Construction Program for Fiscal Years 2023 - 2027.
