Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
Mike Weber, Weber Surveying, 26789 46t" Ave, Bernard, Iowa spoke on behalf of the
property owners. He noted that this property is in Dubuque County, but it's within the
city's two-mile extraterritorial jurisdiction (ETJ), so it requires the commission's review.
He explained that four lots are being consolidated into three, with Lot 1 being the
balance of the farmland, and Lots 2 and 3 having homes and being enlarged to one
acre each to meet the county's requirement.
Planning Staff detailed the staff report and the submitted Plat of Survey of Adams Acres
noting that the property is within the city's ETJ and therefore subject to city
requirements since it's a minor subdivision involving three parcels. Staff explained that
all parcels within this subdivision are under common ownership and the proposed plat
would enlarge two of the residential parcels and consolidate the primarily agricultural
parcels. Staff noted that this is in keeping with city's comprehensive plan and no public
input was received.
There were no public comments.
The Zoning Advisory Commission discussed the request finding it appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.

RESOLUTION NO. 188-22
A RESOLUTION APPROVING THE FINAL PLAT
ADAMS ACRES, DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Adams Acres,
Dubuque County, Iowa that is within the City's 2-mile extraterritorial jurisdiction; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Final Plat of Adams Acres, Dubuque County, Iowa is hereby
approved, and the Mayor and City Clerk are hereby authorized and directed to endorse
the approval of the City of Dubuque, Iowa upon said Plat of Survey.

INTRODUCTION
The submitted Final Plat of Adams Acres is a minor subdivision' plat located on Airview
Drive within Dubuque County. Because the proposed plat is located within the 2-mile
extraterritorial jurisdiction of the City of Dubuque, the plat is subject to City review. The
proposed final plat is comprised of four existing lots. Two of the existing lots are currently
improved with single-family homes and accessory structures. The southernmost lot is
improved with a single-family home, accessory structures, and the majority of the site is
utilized as crop land. The northernmost lot is utilized primarily for agricultural crop land.
The proposed Final Plat of Adams Acres would reconfigure the existing four lots with the
intention of increasing the size of the two smaller lots and consolidating the two larger
lots. The applicant has indicated this reconfiguration would result in the demolition of one
single-family residence; however, the overall use and zoning of all lots will remain
unchanged.

The attached subdivision plat provides a more detailed depiction of the proposed minor
subdivision.

The Unified Development Code Chapter 11 defines a Minor Subdivision as `Any subdivision or
consolidation of property in which no new streets, public or private, are proposed and which does not require
the construction of any public improvements, and which creates three or more lots. "

DISCUSSION
The proposed Final Plat of Adams Acres would reconfigure four existing lots located in
Dubuque County, within the City of Dubuque's 2-mile extraterritorial jurisdiction. The four
lots are held under common ownership through two family trusts, the Illa Kay Adams Farm
Trust and the Garry & Illa Adams Revocable Trust.
The proposed owner is proposing to reconfigure the four existing lots which would
increase the size of the two small lots, Lot 2 and Lot 3, which are both currently improved
with single-family residences, and would consolidate the two large lots into Lot 1. The
proposed plat would not affect access to the subject lots as they would all retain access
from Airview Drive.
The proposed Lot 1, Lot 2, and Lot 3 are located in the Dubuque County R-2 Single -
Family Residential zoning district. Lot 1 is primarily agricultural fields and Lot 2 and Lot 3
are improvement with single-family residences. The proposed subdivision is not
anticipated to have an impact on the land use for the lots.
The City's Comprehensive Plan identifies the future land use for the subject site as Single -
Family Residential which includes low -density, single-family homes, and related
recreational, religious, and educational facilities that typical service a neighborhood
population. The subject lots are currently utilized as residential and agricultural uses and
the proposed minor subdivision will not result in a change of those uses.
As requested, the proposed subdivision will have little effect on the status of the subject
lots or surrounding properties, and the proposed subdivision will be in compliance with all
aspects of the City of Dubuque's subdivision regulations contained in the Unified
Development Code and the land use goals within the City's Comprehensive Plan.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Final Plat of
Adams Acres and recommends approval as submitted of the Minor Subdivision.
