Amy Court Petition for Residential Parking Permit District
INTRODUCTION
This is in response to a December 6, 2000 petition to establish a Residential
Parking Permit District (RPPD) on Amy Court.
BACKGROUND
In 1985, the City adopted an ordinance providing for the establishment of
Residential Parking Permit Districts. The purpose of such districts is to
reduce traffic congestion resulting from the use of parking within residential
districts by persons not residing within the district, to protect the residents
of these districts from an unreasonable burden in gaining access to their
residences, to preserve the character of such districts as residential districts,
and other various purposes. A Residential Parking Permit District designation
can be made only after a petition of residents representing 60 percent (60%)
of the dwelling units in a proposed area is received, a parking study is
conducted by the City Engineer, and a public hearing is held by the City
Council,
To be eligible for an RPPD designation, the proposed district must include at
least four (4) block faces or contain 50 parking spaces, must have at least
80 percent (80%) of the curbside parking utilized during peak periods, and
must have at least 25 percent (25%) of such utilization by non-residents of
the area. A petition may be considered for an area which contains less than
four (4) adjacent block faces or fifty (50) curb parking spaces if there are
extenuating conditions that render such requirement unreasonable. Upon the
recommendation of the City Manager, such requirement may be waived by
the City Council if it finds that the proposed residential district is isolated or
separated from other residential areas by topographical features or by
commercial area. Upon designation as an RPPD, no one can park curbside in
the district during the restricted hours without a residential or guest parking
permit.
DISCUSSION
The petition which was submitted on December 6, 2000, represents in
excess of 60 percent (60%) of the dwelling units along Amy Court, as is
required under the ordinance. The petition requests that the parking
restriction be effective between the hours of 7 a.m, and 3 p.m. daily, except
Saturdays, Sundays, and holidays.
The City's parking study of this area indicates that during the requested time
period, at least 80 percent (80%) of the curbside spaces were utilized, and
at least 25 percent (25%) of such curbside parking spaces were utilized by
non-resident parkers. The petition, therefore, meets the requirements of the
RPPD ordinance.
City staff met with the Dubuque Community School District staff and the
principal of Hempstead High School to discuss the petition. School staff has
indicated that they intend to construct additional parking on campus and
would not oppose the petition.
RECOMMENDATION
Since the parking study indicates that the parking conditions on Amy Court
meet the criteria necessary for the establishment of a Residential Parking
Permit District, I would recommend that Amy Court be designated as a
RPPD. I would recommend that the district parking regulations be from 7
a.m. to 3 p.m. daily, except Saturdays, Sundays, and holidays.
I would further recommend that the City Council set a public hearing on the
designation of Amy Court as a Residential Parking Permit District between
the hours of 7 a.m. and 3 p.m. daily, except Saturdays, Sundays, and
holidays. After the public hearing, the City Council may reject the petition,
adopt an ordinance designating the proposed area as a Residential Parking
Permit, or adopt an ordinance modifying the proposed district. The City
Council may also adopt alternate hours other than the 7 a.m. to 3 p.m.
parking restriction daily except Saturdays, Sundays, and holidays. If,
however, the hours or days are modified the City Council must create a new
parking district.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution setting a
public hearing on May 21 on the proposed Residential Parking Permit District
on Amy Court.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF DUBUQUE, IOWA, BY MODIFYING SUBSECTION (a) OF
SECTION 32-397 THEREOF PROVIDING FOR THE DESIGNATION OF
AMY COURT FROM MARJORIE CIRCLE TO THE NORTHERLY END
AS A RESIDENTIAL PARKING PERMIT DISTRICT
Whereas, Sections 32-381 through 32-393 of the Code of Ordinances of
the City of Dubuque, Iowa, empowers the City Council to establish a Residential
Parking Permit District upon receipt of a valid petition and the finding of certain
conditions; and
Whereas, a valid petition has been received to declare an area described
as follows as a Residential Parking Permit District.
Amy Court, from Marjorie Circle to the northerly end; and
Whereas, the City Manger has caused a parking study of the above
identified area to be conducted, and which study has established that the area
meets the cdteria as established in Section 32-383 of the Code of Ordinances of
the City of Dubuque, Iowa;
At least 80 percent (80%) of the curbside parking spaces in the
proposed Parking Permit District were utilized during peak periods;
and
2. At least 25 percent (25%) of the curbside parking spaces in the
proposed Parking Permit District were utilized by nonresident
parkers; and
Whereas, the City Manager, based upon the petition and the results of the
parking study, recommends to the City Council that the area be designated as a
Residential Parking Permit District during the hours of 7 a.m. to 3 p.m. daily,
except SaturdaYs, Sundays, and holidays; and
Whereas the City Council, pursuant to public notice on May 11th
., 2001, in the City of Dubuque Telegraph Herald, a
newspaper of general circulation, met in session on the 21st of May
2001, at 6:30 p.m. at the Carnegie Stout Public Library for the purpose of hearing
all interested persons and representatives of organizations and to consider any
and all objections which have been filed to the proposed designation of the
above area as a Residential Parking Permit District during the hours of 7 a.m. to
3 p.m., daily except Saturdays, Sundays, and holidays; and
Whereas, all interested parties have been given an opportunity to be
heard and all objections have been duly considered.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That a petition containing the required number of signatures
and meeting the intent and purpose of Section 32-381 through 32-393 of the
Code of Ordinances of the City of Dubuque, Iowa, has been received by the City
of Dubuque.
Section 2. That any and all objections to the designation of the area as
a Residential Parking Permit District during the hours of 7 a.m. to 3 p.m. daily,
except Saturdays, Sundays, and holidays be and same are overruled.
Section 3. That the recommendation of the City Manager based upon
the petition and the parking study to designate the area as a Residential Parking
Permit District during the hours of 7 a.m. to 3 p.m. daily, except Saturdays,
Sundays, and holidays, is hereby approved and accepted.
Section 4. That the Code of Ordinances of the City of Dubuque, Iowa,
be amended by deleting from Subsection (a) of Section 32-397 as follows:
"Sec. 32-397.
Residential Parkinq Permit Distdct "D".
a)
The following described area constitutes a Residential Parking
Permit District designated as Residential Parking Permit District
Lucy Drive, from Pennsylvania Avenue to Welu Drive
Section 5. That the Code of Ordinances of the City of Dubuque, Iowa,
be amended by adding to Subsection (a) of Section 32-397' as follows:

The following described area constitutes a Residential Parking
Permit Distdct designated as Residential Parking Permit District

This petition concerns the adoption of a Residential Parking Permit Designation on Amy Court,
Dubuque, Iowa.
Students from Hempstead High School have consistently shown d/srespect with reckless dr/ring
and parking habits on our street. Often many of the Amy Court ms/dents haven't received mail
because of students parking in front of mailboxes. Trespassing and littering are both issues along
with obnox/ous behavior among the students parking in our neighborhood.
Amy Court Cul-de-sac has had quite a turnover in residents in the last three years. Could you
please make Amy Court a residential parking permit designation area once again.
Eighty three percent (83%) of the residents on our street approve of this idea. You will find the
map below and signed petition following:
