ARTS AND CULTURAL AFFAIRS ADVISORY COMMISSION

2-8-1: COMMISSION CREATED:
There is hereby created the Arts and Cultural Affairs Advisory Commission.
2-8-2: PURPOSE:
The purpose of the commission is to build the community through arts and cultural programs by
developing visibility, funding, audiences, information, and partnerships. The commission plans,
promotes, and encourages programs to further public awareness of, accessibility to,
participation in, and support for the artistic and cultural development of the city and makes
recommendations to the city council regarding the establishment of arts and cultural policies and
programs, the expenditure of budgeted funds on arts and cultural activities, and the
implementation of programs.
2-8-3: INTERNAL ORGANIZATION AND RULES:
The commission may adopt rules and regulations to govern its organizational procedures as
may be necessary and which are not in conflict with this Code of Ordinances or the Iowa Code.
2-8-4: PROCEDURES FOR OPERATION:
All administrative, personnel, accounting, budgetary, and procurement policies of the city govern
the commission in all its operations.
2-8-5: MEMBERSHIP:
A. The commission comprises seven (7) residents of the city, appointed by the city council.
B. Special Qualifications:
1. Four (4) members must have significant knowledge and demonstrate interest in one
or more areas of the arts including music, dance, literature, visual arts, theater, folk arts,
media arts, design, or arts education.
2. Two (2) members must be from the business and professional community, one (1) of
whom lives or works in the cultural and entertainment district.
3. One (1) member must be at-large who lives or works outside the cultural and
entertainment district.
2-8-6: OATH:
Each person, upon appointment or reappointment to the commission, must execute an oath of
office at the first meeting of the commission following the appointment or reappointment or at
the city clerk's office any time prior to the first meeting of the commission.
2-8-7: TERMS:
The term of office for commissioners is three (3) years or until such commissioner's successor is
appointed and qualified.
2-8-8: VACANCIES:
Vacancies must be filled in the same manner as original appointments.
2-8-9: OFFICERS/ORGANIZATION:
The commissioners must choose annually a chairperson and vice-chairperson, each to serve a
term of one (1) year. The chairperson must appoint a secretary, who need not be a member of
the commission. The commissioners must fill a vacancy among its officers for the remainder of
the officer's unexpired term.
2-8-10: MEETINGS:
A. Regular Meetings: The commission must meet monthly.
B. Special Meetings: Special meetings may be called by the chairperson or at the written
request of a majority of the commissioners.
C. Open Meetings: All meetings must be called and held in conformance with the Iowa
Open Meetings Law.
D. Attendance:
1. In the event a commissioner has been absent for three (3) or more consecutive
meetings of the commission, without being excused by the chairperson, such absence
will be grounds for the commission to recommend to the city council that the position be
declared vacant and a replacement appointed.
2. Attendance must be entered upon the minutes of all meetings.
E. Minutes: A copy of the minutes of all regular and special meetings of the commission
must be filed with the city council within ten (10) working days after each meeting, or by the
next regularly scheduled city council meeting, whichever is later.
F. Quorum: Four (4) commissioners constitute a quorum for the transaction of business. The
affirmative vote of a majority of the commissioners present and voting is necessary for the
adoption of any motion or resolution.
2-8-11: COMPENSATION:
Commissioners serve without compensation, provided that they may receive reimbursement for
necessary travel and other expenses while on official commission business within the limits
established in the city administrative policies and budget.
2-8-12: REMOVAL:
Except as provided in 2-8-10(D)(1), the city council may remove any commissioner for good
cause.
2-8-13: POWERS:
The commission has the following powers, duties, and responsibilities:
A. To promote, educate, and create awareness for arts and cultural activities;
B. To develop and increase the market for arts and cultural activities;
C. To facilitate and convene partnerships for arts and cultural activities;
D. To develop funding options and allocate budgeted funding for arts and cultural activities;
E. To act in an advisory capacity to the city council in all matters pertaining to the arts and
cultural environment;
F. To make recommendations to the city council on the allocation of budgeted city funding
for arts programs and services;
G. To recommend applications and solicitations for grants, gifts, and donations from
individuals, groups, organizations, and agencies, both private and public, for any purpose
consistent with the purposes of the commission;
H. To make recommendations regarding city sponsorship of public programs to further the
development of public awareness of and accessibility to arts and culture programs and
activities;
I. To work with area organizations on broad community issues in which a cultural
perspective is relevant and desirable; and
J. To engage in comprehensive planning for the cultural development of the city.
2-8-14: COOPERATION WITH OTHER AGENCIES:
The commission cooperates with other arts and culture groups interested in the promotion and
implementation of arts and cultural activities which are in the best interest of the city.
2-8-15: SOLICITATION AND ACCEPTANCE OF DONATIONS:
The commission may solicit and otherwise accept donations and gifts of money, personal and
real property, and personal services on behalf of the city. All such donations and gifts received
become the property of the city for the general use or support of arts and cultural programs as
determined by the city council unless such items have been designated by the donor for specific
purposes.

Please list your experience, I received my degree in theatre from Truman University and my
skills and or education that MFA in Directing for Theatre from the University of Iowa. My
have prepared you for experience covers all three levels of the arts: professional,
service on this educational and community. Pease note that the following is
board/commission: highly selective. Professionally I have directed and acted for
The Ice House Theatre, Old Creamery Theatre, Timber Lake
Playhouse, and Five Flags Theatre Company, among others.
This experience also includes two years as the Production
Stage Manager for Jack Daniels Original Silver Cornet Band as
we toured the U.S. in a variety of venues; from being on CBS
as we played in New York's Central Park to performing at the
Pabst Theatre in Milwaukee; and performing Mark Twain for
various events, conventions and on the Delta Queen. Within
education I have taught theatre at the grade school, high
school and college levels. This includes teaching in the
talented and gifted program for East Dubuque schools,
directing for Western Dubuque High School, teaching and

directing at Divine Word College and Grand View College in
Des Moines, and eighteen years as Director of Theatre at
Loras College. In the community arena I and my wife formed
Fly-By-Night Productions in 1982 and the company will soon
enter its 40th season, having staged over 70 productions while
I served as Artistic Director—that number is now over 140
productions. At the current time I am still actively involved with
the company and serve on the Board of Directors. I have also
worked for other community groups such as the Grand Opera
House, The Fine Arts Players, Trainwreck Productions and
Main Street Players. I have also conducted many workshops at
the educational and community levels. For example, I
conducted a workshop on creativity for the Loras College
faculty, a workshop on producing live radio plays for the Iowa
Community Theater Association state convention and a
workshop on using theatre to present history for the Iowa
Library Association State Convention. Through the years I and
my wife have received the Alisa Darling Award for
Contributions to the Cultural Life of Dubuque, a 365 Impact
Award and during the cities' Sesquicentennial celebration in
1995 were included in a traveling display titled Dubuque
Gallery of Artists based on the city's 50 most influential artists
throughout its history. Honor organizations I belong to are
Alpha Psi Omega (honor society for theatre artists) and Delta
Epsilon Sigma (honor society for teaching professionals).
Professional organizations I belong to are; Mid-America
Theatre Conference, Theatre Communication Group, and the
Society of American Fight Directors.
What contributions can you Just before the pandemic ran over us all I retired from Loras

Dubuque in 1979, I have seen and experienced tremendous
growth in the arts at the local level. My wish is to help continue
and expand on that growth. Over time I have worked with many
of the art groups in town; including The Dubuque Museum of
Art, The National Mississippi River Museum and Aquarium,
The Julien Dubuque International Film Festival, The Dubuque
Symphony, The Grand Opera House, The Fine Arts Players,
The Dubuque Historical Society, and many others, which
obviously includes Fly-By-Night Productions. For me it has
been about collaboration between the different artistic groups,
different individual artists and myself. Theatre is based on
collaboration, where a community of different artists come
together to create an event with a single cohesive vision.
Theatre is an environment where a variety of ideas, opinions
and life experiences are welcomed; even when they differ from
one another—at some point you have to come together, you

have to work together and reach an agreement about the
artistic vision for the good of the production. In addition to my
experience, I believe collaboration is a strength I will bring to
the commission. I hope to further develop this collaboration in
order to spur future growth within the varied arts organization
and in the individual artists active in our community. My goal is
to help the arts to continue to move forward.
Describe your experience It begins in high school where my classmates and circle of
working in diverse close friends at Westwood High School (Mesa, Arizona)were a
environments: very diverse group in terms of race, color and nationality,
especially in the Arts community. But this type of environment
really exploded for me when I attended graduate school at the
University of Iowa. My first-year teaching assistantship was to
serve as the technical director for, what was then on campus
called, the Black Action Theatre Company—yes, at the time
this program was separate from the main stage productions;
even being staged in the old armory and not on the main stage.
So, I spent my first year in this environment working almost
totally with people of color. It was a year of growing, a year of
making some really close friends and a year of discovering new
theatre. I would say that during the second semester I got one
of the highest compliments I have ever gotten when members
of the company asked me to direct one of their shows. I
became the first Caucasian to direct a production when I
staged Sister Son/ji. This then led to a change in how I cast
future productions. For example, when I directed So Far From
China, a play about a small family farm outside China,
Kentucky; I cast the four family members based solely on
talent. Therefore, the family was composed of two white actors,
a black actor and a Latino actor. This viewpoint and philosophy
continued when I moved to Dubuque. One of the first plays Fly-
By-Night produced was an original script titled In the Matter of
Ralph, a Black Man; the script told the stories of Ralph, a slave
from Missouri who had come to Dubuque to earn his freedom,
and Nat Morgan, the subject of current efforts to establish a
memorial in town. Back in 1987 for many individuals in
Dubuque this was the first time they became familiar with their
stories. To this day Fly-By-Night continues to work to give voice
to marginalized communities with many of our productions, but
work still needs to be done in this area as we continue to work
to build community. At Loras College I worked to increase the
involvement of minority students in the theatre program and I
believe I was highly successful in making LGBTQ+ students
feel they had a safe creative home in the theatre. I also make a
personal effort to engage a diverse community of artists by
attending art events throughout the city, many involving
minority artists and partaking in the Creative Cafes that have

recently been started.
But when we talk about diverse communities, we sometimes
leave some communities out of the conversation. Recently I
have begun to explore how to make play performances more
accessible to the deaf and blind communities. In the first case
finding a qualified ASL interpreter has proved challenging.
Signing a play performance is very difficult and takes one to
two interpreters with specialized skills. Local availability and
cost are also factors. But I want to see if there is any possibility
of at least having one or two performances signed; and
eventually expanded to other art events; opening them to a
new audience. The second group would be the blind. My
thoughts here are based on my time at the Ice House Theatre
where the following process was implemented. It starts with
private time on stage when they are allowed to explore and feel
the set so as to form a mental image of the play's environment.
Next you do a sounding. The blind individual sits in their
assigned seats in the house as another individual walks the
stage announcing where they are on the set. In this manner, as
audience, they learn to "see"where each character is by where
their voice is being projected from on stage. Lastly, you make
arrangements for them to hear what each character sounds like
so they may recognize them by the sound of their voice. I am
not sure if there is an audience for this in Dubuque but, it is a
way of opening the Arts to other communities we don't often
think about.
Describe your experience Theatre covers a wide range of topics and subjects, far too
engaging other community many for any one person to be an expert in all of them. So, as
members to gather their a director, you are often seeking outside advice, input,
input and opinions: information, and feedback. The following examples are once
again highly selective. When I directed, I Never Saw Another
Butterfly I brought in a historian to make sure I was accurate in
depicting World War II concentration camps and to answer
questions from the cast and crew. I also contacted the local
synagogue so someone again could make sure we understood
their beliefs and ceremonies correctly; and that we were not
doing anything that might offend a member of their religion.
This led to what I believe was a meaningful and important
change to the script. In one section there was a prayer said in
English, but we were informed that that would never be done,
that the prayer would only be said in Hebrew. So, she taught us
the prayer in Hebrew, and it became one of the more moving
moments in the play. And also proved to be a valuable lesson
to my students. When I staged a production of JB, a play based
on the book of Job from the Bible I had a group of religious
leaders I would often discuss the play with as I began to form
my interpretation and vision for the script. In performance we

had a talk back for the audience where we brought these
individuals to discuss their perspectives on the story; bringing
us (performers and audience)closer to understanding each
other. We also had on display in the lobby a large painting a
local artist had created based on the book of Job and he was at
the talk back to give his artistic—and I note atheist—viewpoint.
But the most common dialogue I have in modern theatre
centers on the use of historical language and/or imagery.
cannot count the number of times I have contacted someone
whose experience or background are different from mine to get
their reaction to the use of specific language, or imagery, in a
play. Together we look at who is saying it, why it is being said
and does the idea being expressed carry enough meaning to
outweigh the effect of the language being used. As an
example, there is always the question, if I change the language
of a racist so as not to offend someone, do I make the racist
more acceptable by make them less offensive? I would note
that this is the same struggle our local school board is currently
experiencing. At this point I can say I have always leaned to
the point-of-view put forth by the person whose advice I seek,
for it is not up to me to tell them how they should feel about, or
react to, such language that has negative meanings within their
personal heritage.

the Barn Community Theater. For the next 15 years I produced
plays and musicals that gave local performers, young and old,
the opportunities to show off their talents and gave local
audiences thousands of hours of enjoyment. In 1986 I oversaw
the company's move to the Grand Opera House and spent
another 15 years directing and producing plays and musicals
for Dubuque and the surrounding area. Then, in 2003 I became
Artistic Director and Theater Manager of the brand new Bell
Tower Theater, which is now celebrating its 20th season and is

one of our city's most popular live theaters. Simultaneously,
taught communications, speech and theater at Hempstead
High School from 1974 to 2012.
What contributions can you Since graduating from Clarke, I have always been an advocate

throughout the State of Iowa. I have served as a member of the
Iowa Arts Council Board of Directors, the Iowa Film
Commission and have been on the Dubuque Arts and Cultural

a member of the Film Commission, I responded to a request
from Universal Studios for a location for a new movie. I spent
several weekends driving throughout Dubuque County and
taking photographs of farm houses. It was because of one of
these photographs that the Academy Award-winning movie
"Field of Dreams"was filmed in Dubuque County.
I have a strong desire to continue to serve on the commission
at this crucial point in time. Not only is it important that we
sustain the valuable programming that we have developed but
there is still much work to be done in implementing the Cultural
Arts Master Plan.
Describe your experience I have spent my entire career in diverse environments.

In addition my 54 years of directing plays and musicals means

Describe your experience My experience with community engagement began as a
engaging other community teenager through my work with the Davenport Children's
members to gather their Theatre. I brought that passion for the arts and their importance
input and opinions: to a community with me when I moved to Dubuque in the
1960s. As Fine Arts Coordinator for the City's Recreation
Department it was my job to bring the community together
using the arts. This mission lead me to create partnerships,
many of which still exist today. I was a founding member of the
Dubuque Arts Council. I was founder of the Barn Community
Theater and instrumental in the buying of the Grand Opera
House when the Barn Community Theater moved there in
1986. I spearheaded a massive renovation of that space, and
the Grand Opera House has grown into a historic

entertainment landmark that is enjoyed by thousands of
Dubuque residents and tourists each year. I brought the Arts
Council, the Dubuque County Historical Society, the Barn
Community Theater, Dubuque Symphony Orchestra, the
Dubuque Museum of Art and Clarke College together to create
the ArtsTrek program, which still brings arts and artists in direct
contact with elementary school students.
My former work with the Iowa Arts Council Board of Directors
and the Iowa Film Commission along with my current work on
the Dubuque Arts and Cultural Commission and at the Bell
Tower Theater have all put me a position to advocate for the

Chapter 7
BOARD OF LIBRARY TRUSTEES
Amended 8-1-16
2-7-1: Board Created:
There is hereby created the Board of Library Trustees.
2-7-2: Purpose:
The purpose of the board is to control and direct the Carnegie-Stout Public Library.
2-7-3: Internal Organization and Rules:
The board may adopt rules and regulations to govern its organizational procedures as
outlined in the Board of Trustees by-laws, which are not in conflict with this Code of
Ordinances or the Iowa Code.
2-7-4: Procedures for Operation:
Except where the board's operations are governed by the Iowa Code, the board may
adopt policies to govern its operation.
2-7-5: Membership:
A. The board comprises seven (7) residents of the city, appointed by the mayor with
the concurrence of the city council.
B. Residents must be eighteen (18) years of age or older.
C. Membership on the board must comply with the provisions of Iowa Code §69.16A,
relating to gender balance. No person can be appointed or reappointed to the
board if that appointment or reappointment would cause the number of members
of one gender to be greater than one-half (1/2) of the membership of the board plus
one (1). If the city has made a good faith effort to appoint a qualified person to fill a
vacancy on the board for a period of three (3) months but has been unable to
make a compliant appointment, the city must utilize a fair and unbiased method of
selecting the best qualified applicants.
2-7-6: Oath:
Each person, upon appointment or reappointment to the board, must execute an oath of
office at the first meeting of the board following the appointment or reappointment or at
the city clerk's office any time prior to the first meeting of the board.
2-7-7: Terms:
The term of office for members of the board is four (4) years or until such member's
successor is appointed and qualified.
2-7-8: Vacancies:
Vacancies must be filled in the same manner as original appointments.
2-7-9: Officers/Organization:
The board must choose annually a chairperson and vice-chairperson, each to serve a
term of one (1) year. The chairperson must appoint a secretary. The board must fill a
vacancy among its officers for the remainder of the officer's unexpired term.
2-7-10: Meetings:
A. Regular Meetings. The board must meet not less than what is required by the
State Library of Iowa standards for accreditation.
B. Special Meetings. Special meetings may be called by the chairperson or at the
written request of a majority of the members.
C. Open Meetings. All meetings must be called and held in conformance with the
Iowa Open Meetings Law.
D. Attendance.
1. The board must declare the office of a trustee vacant when the trustee is
removed from the library board or the unexcused absence from six (6)
consecutive regular meetings.
2. Attendance must be entered upon the minutes of all meetings.
E. Minutes. A copy of the minutes of all regular and special meetings of the board
must be filed with the city clerk within ten (10) working days after approval.
F. Quorum. Four (4) members of the board constitute a quorum for the transaction of
business. The affirmative vote of a majority of the members present and voting is
necessary for the adoption of any motion or resolution.
2-7-11: Compensation:
Members serve without compensation, provided that they may receive reimbursement
for necessary travel and other expenses while on official board business within the limits
established in the city administrative policies and budget.
2-7-12: Removal:
The mayor may remove any member for cause upon written charges and after a public
hearing.
2-7-13: Powers:
The board has the following powers, duties, and responsibilities:
A. To have charge, control, and supervision of the public library, its appurtenances
and fixtures, and rooms containing the same, directing and controlling all the
affairs of such library;
B. To employ a librarian, such assistants, and employees as may be necessary for
the proper management of said library, and fix their compensation; but, prior to
such employment, the compensation of such librarian, assistants, and employees
shall be fixed for the term of employment by a majority of the members of said
board voting in favor thereof;
C. To remove such librarian, assistants, or employees by a vote of two-thirds (2/3) of
such board for good cause;
D. To select and make purchases of print and non-print materials for the collection,
furniture, fixtures, stationery, and supplies for such library;
E. To authorize the use of such library by non-residents of the city and to fix charges
therefor;
F. To make, adopt, amend, modify, or repeal bylaws, rules, and regulations not
inconsistent with law, for the care, use, government, and management of such
library and the business of said board, fixing and enforcing penalties for the
violation thereof;
G. To have exclusive control of the expenditures of all taxes levied for library
purposes as provided by law, and of the expenditure of all monies available by gift
or otherwise, for the erection of library buildings and of all other monies belonging
to the library fund; and,
H. To contract with the trustees of the township or the Dubuque County Board of
Supervisors or of adjacent townships or counties, or with the trustees or governing
bodies of neighboring towns or cities not having library facilities for the public, to
loan the books of said library, either singly or in groups, upon such terms as may
be agreed upon in such contract.
2-7-14: CHARGE OF BUILDING, DONATIONS:
The board has charge and control of the Carnegie-Stout Public Library building and all
gifts and donations to the city for library purposes, and sees that the same are properly
preserved for public use.
2-7-15: ANNUAL REPORTS:
The board must each year make a report to the city council for the year ending
December 31, giving a statement of the condition of the library, the number of books
added thereto, the number circulated, the number not returned or lost, the amount of
fines collected, and the amount of money expended in the maintenance thereof during
such year, together with such other information as may deemed important.

me, you never know someone's story until you take time out to

Toddler Tales and the summer reading program. I saw the
inception of new materials into the database, checked in and
shelved said materials, and assisted patrons with checkout.
Later on, I was able to secure an internship with the Southwest
Wisconsin Library System which serves five counties in the
southwest region of the state. This allowed me a more hands
on approach in cataloging materials, analyzing the van's route
in circulating materials between libraries, and being responsible
for the Teen Summer Reading Program at my local library.
After I graduated college and ended employment with the
library, I continued my involvement by serving as a board
member and working with the selected trustees.
Since becoming a resident of Dubuque ten years ago, my
young family and I have become frequent visitors to Carnegie
Stout. We enjoy participating in the diverse programs it offers
to all age groups and borrow materials quite often. Reading
and developing my knowledge base has always been at the
crux of who I am, so much so, that I currently partake in two
book clubs. I've enjoyed expanding my reading selections and
listening to others' perspectives on our monthly book reads. I
believe having an open mind set is crucial to becoming a
mindful citizen -we can develop a better understanding of
those around us and appreciate the uniqueness of each
individual.
What contributions can you Because I've had extensive experience in a library setting and

Describe your experience Currently, I work as a Senior Trainer for a payroll company
working in diverse ensuring development of our new hires from all across the
environments: country. I have to be attuned to the needs of each employee
and consistently gauge my communication methods to match
the comfort of each new hire. In a previous payroll role in
Milwaukee, WI, I worked at a staffing agency that worked
diligently to secure employment for refugees and recent
immigrants. I worked with these employees often to ensure
they were able to retrieve funds from pay cards and complete
income verification forms.
Furthermore, having school aged children, I've grown
accustomed to that specific population and partaking in
programs of their interest levels. Volunteering with the
Eisenhower PTO has allowed me to witness outreach to school
families and develop events that garner students' support.
Describe your experience I've participated with a number of different organizations both
engaging other community within the community and workplace. I assist with the Asbury
members to gather their Juliens 4-H club at the local monthly meetings and work with
input and opinions: leaders to determine best projects, fair ideas, and community
events. I've led a number of different volunteer efforts for
employers and sought feedback from coworkers on fundraising
and event ideas including Relay for Life , Area Residential Care
games, and local nonprofits While serving on my company's
Wellness Committee, I aimed to increase participation from
fellow staff and solicited feedback via surveys, promotions, and
enhanced discussions. From this, we were able to create a well
-rounded program involving monthly wellness challenges and a
company 5k.

CIVIC CENTER ADVISORY COMMISSION
Amendment Adopted 10-19-15
2-4-1: COMMISSION CREATED:
There is hereby created the Civic Center Advisory Commission.
2-4-2: PURPOSE:
The purpose of the commission is to advise the Leisure Services Department, the city
manager, and the city council and to make recommendations to the optimum utilization
of the Civic Center facility by the widest possible range of users and uses to respond to
community needs and demands at the least possible cost to the city.
2-4-3: INTERNAL ORGANIZATION AND RULES:
The commission may adopt rules and regulations to govern its organizational
procedures as may be necessary and which are not in conflict with this Code of
Ordinances or the Iowa Code.
2-4-4: PROCEDURES FOR OPERATION:
All administrative, personnel, accounting, budgetary, and procurement policies of the
city govern the commission in all its operations.
2-4-5: MEMBERSHIP:
A. The commission comprises five (5) residents of the city, appointed by the city
council.
B. Residents must be eighteen (18) years of age or older.
2-4-6: OATH:
Each person, upon appointment or reappointment to the commission, must execute an
oath of office at the first meeting of the commission following the appointment or
reappointment or at the city clerk's office any time prior to the first meeting of the
commission.
2-4-7: TERMS:
The term of office for commissioners is three (3) years or until such commissioner's
successor is appointed and qualified.
2-4-8: VACANCIES:
Vacancies must be filled in the same manner as original appointments.
2-4-9: OFFICERS/ORGANIZATION:
The commissioners must choose annually a chairperson and vice-chairperson, each to
serve a term of one (1) year. The chairperson must appoint a secretary, who need not
be a member of the commission. The commissioners must fill a vacancy among its
officers for the remainder of the officer's unexpired term.
2-4-10: MEETINGS:
A. Regular Meetings. The commission must meet quarterly.
B. Special Meetings. Special meetings may be called by the chairperson or at the
written request of a majority of the commissioners.
C. Open Meetings. All meetings must be called and held in conformance with the
Iowa Open Meetings Law.
D. Attendance.
1. In the event a commissioner has been absent for three (3) or more
consecutive meetings of the commission, without being excused by the
chairperson, such absence will be grounds for the commission to recommend to
the city council that the position be declared vacant and a replacement
appointed.
2. Attendance must be entered upon the minutes of all meetings.
E. Minutes. A copy of the minutes of all regular and special meetings of the
commission must be filed with the city council within ten (10) working days after
each meeting, or by the next regularly scheduled city council meeting, whichever
is later.
F. Quorum. Three (3) commissioners constitute a quorum for the transaction of
business. The affirmative vote of a majority of the commissioners present and
voting is necessary for the adoption of any motion or resolution.
2-4-11: COMPENSATION:
Commissioners serve without compensation, provided that they may receive
reimbursement for necessary travel and other expenses while on official commission
business within the limits established in the city administrative policies and budget.
2-4-12: REMOVAL:
Except as provided in 2-4-10(D)(1), the city council may remove any commissioner for
good cause.
2-4-13: POWERS:
The commission has the following powers, duties, and responsibilities:
A. Provide the city council with recommendations that further the general and
specific purposes of the commission.
B. Recommend the development of financial and other resources to support the
short- and long-term capital needs of the Civic Center facility and its programs.
C. Recommend programs to provide a variety of year round intellectual, cultural,
enjoyable, and attractive leisure time activities which contribute to the physical
and mental well being of residents and visitors.
D. Recommend programs which contribute to the economic base of the
community by encouraging business use of the Civic Center facility.
E. Recommend schedules of fees and charges for special building services,
equipment, special building features, and rental rates.
F. Recommend informational and promotional programs to secure the full
support and participation of the community.
G. Recommend the annual operating budget and an ongoing capital
improvements budget that provides a safe, secure, sanitary, clean, and attractive
facility.
H. Recommend development of community partnerships related to tourism for
optimum utilization of the Civic Center facility.
2-4-14: SOLICITATION AND ACCEPTANCE OF DONATIONS:
The commission may solicit donations and gifts of money, personal and real property,
and personal services, which must be donated or gifted to the City of Dubuque, for the
general support of the Civic Center unless such donations or gifts are designated by the
donor for a specific purpose.

8-2-2: PURPOSE:
The purpose of the commission is to hold hearings, compel the production of evidence, and
determine the merits of complaints alleging unfair or discriminatory practices in housing,
employment, education, credit, or places of public accommodation; to investigate and study the
existence, character, causes, and extent of inequity and discrimination and to attempt to
eliminate inequity and discrimination by educating the public and promoting equity and human
rights in the community; and to take action in the community to promote equitable and inclusive
behavior and to eliminate discrimination and advance equity based on age, race, creed, color,
sex, national origin, religion, ancestry, disability, marital status, familial status, sexual
orientation, or gender identity.

Each person, upon appointment or reappointment to the commission, must execute an oath of
office at the first meeting of the commission following the appointment or reappointment or at
the city clerk's office any time prior to the first meeting of the commission.
8-2-7: TERMS:
The term of office for commissioners is three (3) years or until such commissioner's successor is
appointed and qualified.
8-2-8: VACANCIES:
Vacancies must be filled in the same manner as original appointments.
8-2-9: OFFICERS/ORGANIZATION:
The commissioners must choose annually a chairperson and vice-chairperson, each to serve a
term of one (1) year. The chairperson must appoint a secretary, who need not be a member of
the commission. The commissioners must fill a vacancy among its officers for the remainder of
the officer's unexpired term.
8-2-10: MEETINGS:
A. Regular Meetings. The commission must meet monthly.
B. Special Meetings. Special meetings may be called by the chairperson or at the written
request of a majority of the commissioners.
C. Open Meetings. All meetings must be called and held in conformance with the Iowa
Open Meetings Law.
D. Attendance.
1. In the event a commissioner has been absent for three (3) or more consecutive
meetings of the commission, without being excused by the chairperson, such absence
will be grounds for the commission to recommend to the city council that the position be
declared vacant and a replacement appointed.
2. Attendance must be entered upon the minutes of all meetings.
E. Minutes. A copy of the minutes of all regular and special meetings of the commission
must be filed with the city council within ten (10) working days after each meeting, or by the
next regularly scheduled city council meeting, whichever is later.
F. Quorum. Five (5) commissioners constitute a quorum for the transaction of business. The
affirmative vote of a majority of the commissioners present and voting is necessary for the
adoption of any motion or resolution.
8-2-11: COMPENSATION:
Commissioners serve without compensation, provided that they may receive reimbursement for
necessary travel and other expenses while on official commission business within the limits
established in the city administrative policies and budget.
8-2-12: REMOVAL:
The city council may remove any commissioner for cause upon written charges and after public
hearing.
8-2-13: POWERS:
The commission serves in an advisory capacity to the City Council and has the following
powers, duties, and responsibilities:
A. To investigate and study the existence, character, causes, and extent of inequity and
discrimination in public accommodations, employment, apprenticeship programs, on the
job training programs, vocational schools, other educational institutions, and housing in
the city and to attempt the elimination of such inequity and discrimination through
education, conciliation, and recommended changes to policy and practice.
B. To hold hearings upon any complaint made against a person, an employer, an
employment agency, a labor organization, or the employees or members thereof, to
subpoena witnesses and compel their attendance at such hearings, to administer oaths
and take the testimony of any person under oath and to compel such person, employer,
employment agency, labor organization, or employees or members thereof, to produce
for examination any books and papers relating to any matter involved in such complaint.
The commission will issue subpoenas for witnesses in the same manner and for the
same purpose on behalf of the respondent upon the respondent's request. Such hearings
may be held by the commission, by any commissioner, or by any hearing examiner
appointed by the commission. If a witness either fails or refuses to obey a subpoena
issued by the commission, the commission may petition the district court having
jurisdiction for issuance of a subpoena and the court must, in a proper case, issue the
subpoena. Refusal to obey such subpoena is subject to punishment for contempt.
C. To develop recommendations for actions to strengthen policies, practices, services,
and programs that will, in the judgment of the commission, promote equitable and
inclusive behavior that tends to eliminate inequity and discrimination.
D. To prepare and transmit to the mayor and city council from time to time, but not less
often than once each year, reports describing its proceedings, hearings conducted, and
the outcome thereof, decisions rendered, and the other work performed by the
commission.
E. To make recommendations to the city council concerning advancing equity, promoting
inclusion, and addressing discrimination in order to improve quality of life, livability and
equity for all residents.
F. To cooperate, within the limits of any appropriations made for its operation, with other
agencies or organizations, both public and private, whose purposes are consistent with
those of this chapter, in the planning and conducting of programs designed to advance
equity or eliminate discrimination or cultural and intergroup tensions.
G. To adopt, publish, amend, and rescind regulations consistent with and necessary for
the civil rights enforcement provisions of this chapter.
H. To receive, administer, dispense, and account for any restricted funds that may be
voluntarily contributed to the commission and any grants that may be awarded the
commission for furthering the purposes of this title. No disbursements will be made of any
restricted funds without authority from the city council.
I. To delegate any of its functions, duties, and powers to its staff including functions,
duties, and powers with respect to investigating, conciliating, determining, certifying,
reporting, or otherwise acting as to any work, business, or matter under this Title.
J. To receive, administer, dispense, and account for any restricted funds that may be
voluntarily contributed to the commission and any grants that may be awarded the
commission for furthering the purposes of this Title. No disbursements will be made of
any restricted funds without authority from the city council.
8-2-14: RECORDS TO BE PUBLIC; EXCEPTIONS:
All records of the commission are public except charges, complaints, reports of investigations,
statements, and other documents or records obtained in investigation of any charges.
8-2-15: CONFIDENTIALITY OF COMPLAINTS:
No member of the commission or its staff will disclose the filing of a charge, the information
gathered during the investigation, or the endeavors to eliminate such discriminatory or unfair
practice by conference, conciliation, or persuasion unless such disclosure is made in connection
with the conduct of such investigation or after the commission has held a public hearing upon a
complaint filed in connection with such charge. This Section does not prevent any complainant,
witness, or other person from publicizing the filing of a charge or complaint or the matter therein
complained of.
8-2-16: SUBPOENAS:
The commission may issue subpoenas and order discovery in aid of investigations under this
Title. Such subpoenas and discovery may be ordered to the same extent and subject to the
same limitations as would apply for county attorney subpoenas.

out of college was at Kendall Hunt Publishing. There, I found
myself traveling and working everywhere from Bronx, NYC, to
Brigham Young University in Salt Lake. The diversity I was
exposed to was staggering. It opened up my entire world.
Wanting to expand and push myself, I took advantage of
Kendall Hunt's tuition reimbursement program and was a part
of the first cohort of their MBA— Data Analytics degree. My
daughter was in 5th grade at this point, and I wanted to create
more opportunities for our future— I felt an MBA would be a
nice round out combined with my liberal arts background. From
there, I took a position as a Benefits Account Manager at
Cottingham and Butler, where I learned even more about data
and analytics than I had in my college program.

What I found? My journey has led me to a place where I'm able
to meaningfully contribute to my commumity.
What contributions can you I am a white, middle-class, privileged woman. There are certain

understand issues of child care, and being a single parent. I do
understand pushing to get a college degree as a first-
generation college graduate. My training is all about analyzing
things from a different perspective- both from what I studied in

both really see and really listen -and I am great at doing both. I
have the educational background, the heart, and the life
experience to be a great contributor to the commission.
Describe your experience Throughout my working experience, I've worked in fast food,
working in diverse gas stations, factories, restaurants, marinas, accounting firms,
environments: publishing, and insurance. With (academic) publishing
specifically, I spent 2-4 weeks annually in the New Jersey/NYC
area, where I traveled to schools such as Bronx Community
College, meeting with professors with ethnic backgrounds
ranging from Egyptian to Indian to being born and raised in the
Bronx. I spent another 2-4 weeks annually working in the west
in places such as Utah and Montana, where I worked heavily
with the Mormon community.
My two brothers as well as my two stepchildren are also part of
the LGBTQ community. With them, I rally for continued
education and acceptance in our community.
Describe your experience My husband has always kept up on local politics- he's gotten

input and opinions: our community with him, I've learned a lot- I've learned how
low voter turnout is for local elections. I've learned that
affordable housing and child care are still as limited as they

money, but bringing those who are "other" into your immediate
circle. As my awareness of these topics has increased, so have
the conversations regarding these topics with my neighbors,
friends, and family. What I've found is many people either don't
have the time or don't create the time to think on these topics.
Change starts with conversations about tough subjects with the
people in your own circle- if we all start tackling the hard stuff
with those in our immediate surroundings, we will generate
change.

I was no longer in classrooms made up of a majority of white
classmates. I was also naive when meeting peers and
classmates from other religious backgrounds that were not
Catholic. This was great expose for me and was a stepping
stone into realizing my own unintentional biases and beginning
of my journey to learn more about diverse populations.
As a graduate student at Loras I took a culture and diversity
class which included local speakers from Dubuque community.
These speakers offered a glimpse in the life of Black lives in
Dubuque, LGBTQ, Marshallese, immigrants, and the working
poor in Dubuque.
As a dietitian at Mercy, I would often be consulted on
Marshallese patients due to their diabetic history. Many
understood and spoke little to no English, but fortunately we
were able to translate with younger family members or through
a language line app. I'm familiar with the upsetting history the
US has with the Marshallese population and I'm familiar with
many values and the culture of the Marshallese.
Describe your experience Growing up in Dubuque, I have many connections personally
engaging other community and professionally in Dubuque. As a future school counselor in

HISTORIC PRESERVATION COMMISSION

A. Commission Created:
There is hereby created the Historic Preservation Commission.
B. Purpose:
The purpose of the commission is to:
1. Promote the educational, cultural, economic, and general welfare of the public through
the protection, enhancement, and perpetuation of districts, individually designated historic
properties, landmarks, and landmark sites of prehistoric, historic, architectural,
archeological, and cultural significance;
2. Safeguard the city's prehistoric, historic, aesthetic, architectural, archeological, and
cultural heritage by preserving historic properties, districts, landmarks, and landmark sites of
historical, architectural, and cultural significance;
3. Stabilize and improve property values;
4. Foster civil pride in the legacy of beauty and achievements of the past;
5. Protect and enhance the city's attractions to tourists and visitors and the support and
stimulus to the business thereby provided;
6. Strengthen the economy of the city; and
7. Promote the use of properties, districts, landmarks, and landmark sites of prehistoric,
historic, architectural, archeological, and cultural significance as sites for the education,
pleasure, and welfare of the people of the city.
C. Internal Organization and Rules:
The commission may adopt rules and regulations to govern its organizational procedures as
may be necessary and which are not in conflict with this Code of Ordinances or the Iowa Code.
D. Procedures for Operation:
All administrative, personnel, accounting, budgetary, and procurement policies of the city govern
the commission in all its operations.
E. Membership:
1. The Commission comprises nine (9) residents of the city, appointed by the city council.
2. Age Requirement. Residents must be eighteen (18) years of age or older.
3. Special Qualifications.
a. One (1) resident from each designated historic preservation district, including historic
districts hereinafter established.
b. Four (4) at-large members.
c. Each member must possess qualifications evidencing expertise or interest in
architecture, history, archeology, law, construction, building rehabilitation, city planning,
or conservation in general.
d. One (1) member must be a licensed architect.
4. Membership on the commission must comply with the provisions of Iowa Code §69.16A,
relating to gender balance, and Iowa Code §303.34, subsection 3, relating to establishment
of a commission to deal with matters involving areas of historical significance.
F. Oath:
Each person, upon appointment or reappointment to the commission, must execute an oath of
office at the first meeting of the commission following the appointment or reappointment or at
the city clerk's office any time prior to the first meeting of the commission.
G. Terms:
The term of office for a commissioner is three (3) years or until such commissioner's successor
is appointed and qualified.
H. Vacancies:
Vacancies must be filled in the same manner as original appointments. In the event that a
vacancy occurs in a seat which requires that the appointee be a resident of a historic
preservation district and for which there is no application from a qualified resident, the city
council must appoint a tenth commissioner, which appointment is temporary, and upon
appointment of a qualified resident to the vacancy, the temporary appointment terminates.
I. Officers/Organization:
The commissioners must elect from its membership a chairperson and vice chairperson, whose
terms of office are fixed by bylaws adopted by the commission. The chairperson presides over
the meetings of the commission and has the right to vote. The vice chairperson, in cases of
absence or disability of the chairperson, may perform the duties of the chairperson. The city
manager must designate a city employee to serve as secretary to the commission. The
secretary must keep a record of all resolutions, proceedings, and actions of the commission.
J. Meetings:
1. Regular Meetings. The commission must meet at least three (3) times in a calendar year
to maintain Certified Local Government status.
2. Special Meetings. Special meetings may be called by the chairperson or at the written
request of a majority of the commissioners.
3. Open Meetings. All meetings must be called and held in conformance with the Iowa Open
Meetings Law.
4. Attendance.
a. In the event a commissioner has been absent for three (3) or more consecutive
meetings of the commission, without being excused by the chairperson, such absence
will be grounds for the commission to recommend to the city council that the position be
declared vacant and a replacement appointed.
b. Attendance must be entered upon the minutes of all meetings.
5. Minutes. A copy of the minutes of all regular and special meetings of the commission
must be filed with the city council within ten (10) working days after each meeting, or by the
next regularly scheduled city council meeting, whichever is later.
6. Quorum. Five (5) commissioners constitute a quorum for the transaction of business. The
affirmative vote of a majority of the commissioners present and voting is necessary for the
adoption of any motion or resolution.
K. Compensation:
Commissioners serve without compensation, provided that they may receive reimbursement for
necessary travel and other expenses while on official commission business within the limits
established in the city administrative policies and budget.
L. Removal:
The city council may remove any commissioner for cause upon written charges and after a
public hearing.
M. Powers:
The commission has the following powers, duties, and responsibilities:
1. To promote and conduct educational and interpretive programs on historic properties
within its jurisdiction.
2. To develop and adopt specific standards for review and design guidelines, in addition to
those set forth in section 16-10-7 of this chapter, for the alteration of landmarks, landmark
sites, individually designated historic properties and property and structures within historic
districts.
3. To adopt its own bylaws.
4. To identify, evaluate, register, manage and protect significant prehistoric and historic
archeological sites.
5. To conduct an ongoing survey to identify historically, archaeologically and architecturally
significant properties, structures and areas that exemplify the cultural, social, economic,
political, archeological or architectural history of the nation, state or city.
6. To research and recommend to the city council the adoption of ordinances designating
areas as having historic, architectural, archeological or cultural value or significance as
historic districts.
7. To research and recommend to the city council the adoption of ordinances designating
properties or structures having historic, architectural, archeological or cultural value or
significance as landmarks or landmark sites.
8. To research and recommend to the city council the adoption of ordinances designating
properties as having historic, architectural, archeological or cultural value or significance as
individually designated historic properties.
9. To research and recommend to the city council the adoption of ordinances designating
areas as having historic, architectural, archeological or cultural value as "conservation
districts".
10. To research and recommend to the city council the adoption of ordinances designating
areas as having historic, architectural, archeological or cultural value as "conservation
planning areas".
11. To maintain a register of all properties and structures which have been designated as
landmarks, landmark sites or historic districts, including all information required for each
designation.
12. To assist and encourage the nomination of landmarks, landmark sites and historic
districts to the national register of historic places, and review and comment at a public
hearing on any national register nomination submitted to the commission upon the request
of the mayor, city council or the state historic preservation office.
13. To confer recognition upon the owners of landmarks, individually designated historic
properties or of property or structures within historic districts.
14. To review in progress or completed work to determine compliance with specific
certificates of appropriateness or certificates of economic non-viability.
15. To serve as an advisory design review body to the city council for review of public works
projects which have historic preservation implications in historic districts, individually
designated historic properties, or for alteration of landmarks, landmark sites or structures,
that would result in a material change in appearance or be visible from the public way.
16. To serve as an advisory review body to the city council for the review of public planning,
design, construction, and maintenance needs in conservation planning areas upon request

each meeting, or by the next regularly scheduled city council meeting, whichever is
later.
6. Quorum: Four (4) commissioners constitute a quorum for the transaction of
business. The affirmative vote of a majority of the commissioners present and voting
is necessary for the adoption of any motion or resolution.
K. Compensation: Commissioners serve without compensation, provided that they may
receive reimbursement for necessary travel and other expenses while on official
commission business within the limits established in the city administrative policies and
budget.
L. Removal: Except as provided in 10-5A-2(J)(4)(a), the city council may remove any
commissioner for good cause.
M. Powers: The commission has the following powers, duties, and responsibilities:
1. Provide the city council with recommendations that further the general and
specific purposes of the commission.
2. Recommend the annual operating budgets and ongoing capital improvements
budgets.
3. Recommend establishment of or changes to fees, user fees, or rental fees.
4. Recommend issuance of permits, rental or special use agreements for public use
of all park and recreation facilities for activities outside of the Special Events permit
process.
5. Recommend development of community partnerships, agreement, leases and/or
plans specific to the Department.
6. Recommend the establishment of policies, rules and regulations or ordinance
changes governing the use of all grounds and facilities that have been or may be
set aside as public parks, trails, open spaces, playgrounds, and other such park and
recreation facilities. Such recommendations include but are not limited to opening
and closing hours for the use of all park and recreation facilities by the general
public.
7. Recommend the establishment of general rules and regulations for all park and
recreational programs provided by the city, including fees for league participation,
facility usage and rentals by the public.
8. Recommend agreements, leases, and other methods to cooperate with the
Dubuque Community School District, Holy Family school system, non-profits and
other groups interested in the promotion and implementation of recreational
activities which are in the best interest of the city.
9. Recommend conceptual and/or final park and recreational area related
development plans.
N. Solicitation and Acceptance of Donations: The commission may solicit donations and
gifts of money, personal and real property, and personal services. All such donations and
gifts will become the property of the city for the general support of park and recreation
programs unless such items have been designated by the donors for specific purposes.

CHAPTER 6
RESILIENT COMMUNITY ADVISORY COMMISSION

2-6-1: COMMISSION CREATED:
There is hereby created the Resilient Community Advisory Commission.
2-6-2: PURPOSE:
The purpose of the commission is to advise on city policies and practices to assure
resilient outcomes; facilitate the ability to adapt to factors influencing the social/cultural,
economic and environmental wellbeing of the community; prevent, prepare for, and
recover from adverse vulnerabilities and change through coordination, data analysis,
evaluation and citizen engagement; and to create a viable, livable and equitable
community.
2-6-3: INTERNAL ORGANIZATION AND RULES:
The commission may adopt rules and regulations to govern its organizational
procedures as may be necessary and which are not in conflict with this Code of
Ordinances or the Iowa Code.
2-6-4: PROCEDURES FOR OPERATION:
All administrative, personnel, accounting, budgetary, and procurement policies of the
city govern the commission in all its operations.
2-6-5: MEMBERSHIP:
A. The commission comprises nine (9) residents of the city, appointed by the city
council.
B. Qualifications. Efforts should be taken to balance the composition of the
commission as follows:
1. Members must be able to think systemically and analyze data in order to
meet the stated purpose of the commission.
2. Members' interest and/or expertise must represent the three pillars of the
Sustainable Dubuque model: economic prosperity, environmental integrity,
and social/cultural vibrancy.
3. Members should represent a wide range of sectors within the community,
including business, neighborhoods, non-profit, and educational institutions.
4. Three (3) or more members should also hold positions on one of the
following commissions: Arts & Culture Advisory Commission, Catfish Creek
Watershed Management Authority, Community Development Advisory
Commission, Historic Preservation Commission, Housing Commission,
Human Rights Commission, Long Range Planning Advisory Commission,
Parks & Recreation Advisory Commission, Transit Advisory Commission,
and/or Zoning Advisory Commission.
5. Members should represent the socio-economic, geographic, and
demographic diversity of the community, including youth representation.
2-6-6: OATH:
Each person, upon appointment or reappointment to the commission, must execute an
oath of office at the first meeting of the commission following the appointment or
reappointment or at the city clerk's office any time prior to the first meeting of the
commission.
2-6-7: TERMS:
The initial terms shall be as follows:
A. Two (2) at-large members appointed until July 1, 2018;
B. Two (2) at-large members appointed until July 1, 2019; and
C. Two (2) at-large members appointed until July 1 , 2020.
D. Three (3) cross representative members appointed until the expiration of their
terms on the cross represented board or commission.
Following the initial terms, the term of office for commissioners is three (3) years or until
such commissioner's successor is appointed and qualified.
The terms of the cross representatives appointed from the Arts & Culture Advisory
Commission, Catfish Creek Watershed Management Authority, Community
Development Advisory Commission, Historic Preservation Commission, Housing
Commission, Human Rights Commission, Long Range Planning Advisory Commission,
Parks & Recreation Advisory Commission, Transit Advisory Commission, and/or Zoning
Advisory Commission must coincide with their terms on the Resilient Community
Advisory Commission.
2-6-8: VACANCIES:
Vacancies must be filled in the same manner as original appointments.
2-6-9: OFFICERS/ORGANIZATION:
The commissioners must choose annually a chairperson and vice-chairperson, each to
serve a term of one (1) year. The chairperson must appoint a secretary, who need not
be a member of the commission. The commissioners must fill a vacancy among its
officers for the remainder of the officer's unexpired term.
2-6-10: MEETINGS:
A. Regular Meetings. The commission must meet monthly.
B. Special Meetings. Special meetings may be called by the chairperson or at the
written request of a majority of the commissioners.
C. Open Meetings. All meetings must be called and held in conformance with the
Iowa Open Meetings Law.
D. Attendance.
1. In the event a commissioner has been absent for three (3) or more
consecutive meetings of the commission, without being excused by the
chairperson, such absence will be grounds for the commission to
recommend to the city council that the position be declared vacant and a
replacement appointed.
2. Attendance must be entered upon the minutes of all meetings.
E. Minutes. A copy of the minutes of all regular and special meetings of the
commission must be filed with the city council within ten (10) working days after
each meeting, or by the next regularly scheduled city council meeting,
whichever is later.

collaboration with city staff, other city commissions and community partners.
G. To review and make recommendations regarding Sustainable Dubuque
Community Grant allocations.
H. To respect the policy making authority of the city council, the city manager's
responsibilities to implement the goals and priorities the council establishes
(council manager form of government) and the responsibility of city staff to
report to the city manager.

1 VACANCIES —REMOVAL —TERMS, §69.16A
69.16A Gender balance.
1. All appointive boards, commissions, committees, and councils of the state established
by the Code, if not otherwise provided by law, shall be gender balanced. No person shall
be appointed or reappointed to any board, commission, committee, or council established
by the Code if that appointment or reappointment would cause the number of members of
the board, commission, committee, or council of one gender to be greater than one-half
the membership of the board, commission, committee, or council plus one if the board,

2. All appointive boards,commissions,committees,and councils of a political subdivision
of the state that are established by the Code, if not otherwise provided by law, shall be
gender balanced as provided by subsection 1 unless the political subdivision has made a
good faith effort to appoint a qualified person to fill a vacancy on a board, commission,
committee, or council in compliance with subsection 1 for a period of three months but
has been unable to make a compliant appointment. In complying with the requirements of
this subsection, political subdivisions shall utilize a fair and unbiased method of selecting
the best qualified applicants. This subsection shall not prohibit an individual whose term
expires prior to January 1, 2012, from being reappointed even though the reappointment
continues an inequity in gender balance.
