ZONING ADVISORY COMMISSION
REGULAR SESSION

PRESENT:
Chairperson Eugene Bird; Commissioners Ron Smith, Stephen Hardie,
Martha Christ, Jeff Stiles, Dick Schlitz and Bob Nagle; Staff Members Kyle
Kritz and Kay Munson.
AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying that
the meeting was being held in compliance with the Iowa Open Meetings Law.
MINUTES: The minutes of the Apdl 4, 2001 meeting were approved with one change.
ACTION ITEM~SITE PLAN REVlEW~JOHNSON: Application of Marty Johnson, Straka
Johnson Architects, to review a site plan of a new medical office in Hansel's Planned
Commercial District, located at the southeast corner of Starlite Drive and Lake Ridge
Drive.
Marty Johnson, Straka Johnson Architects, spoke on behalf of Dr. Pat Sterrett regarding a
new medical office in Hansel's Planned Commercial District. He discussed that the
building will be approximately 6,200 square feet brick and limestone building with 30 off-
street parking spaces. He mentioned that an MRI trailer will be parked at the office
building once per week. Commissioner Hardie asked whether the sidewalks will connect
between the new street and Starlite Drive. Staff Member Kritz indicated that the developer
of Woodland Ridge Subdivision will construct sidewalk link between the new street and
Starlite Ddve.
Staff Member Kritz reviewed the site plan. He stated that the Zoning Ordinance requires
that both the Zoning Advisory Commission and the City Council review the site plan prior
to construction. The site plan is in compliance with the PUD Planned Unit Development.
Commissioner Schittz asked about the lot where the subdivision sign is being installed.
Kritz indicated that Lot 2 was a remnant parcel of Woodland Ridge Subdivision.
Motion by Christ, seconded by Nagle, to approve the site plan. Motion carried by the
following vote: Aye - Smith, Hardie, Christ, Bird, Stiles, Schlitz and Nagle; Nay - None.
ACTION ITEMtPLAT OF SURVEY~KRESS: Application of Toby Kress to replat three
existing substandard lots creating two new substandard lots at 637-649 W. 8th Street.
Jim Kress, 22612 Finley's Landing Road, spoke on behalf of the applicant, Toby Kress,
reviewed the request stating that two houses were demolished at this location and would
like to build 5 units.

Staff Member Kritz reviewed the request noting that the previous lOts are substandard and
this new plat will create at least one conforming lot. Access will be from W. 8th Street and
they will include enough off-street parking spaces for 5 units.
Commissioner Stiles asked why these lots cannot be consolidated into one lot: Staff
Member Kritz indicated that in order to build a duplex and a triplex, 2 lOts are necessary.
Kritz also indicated that this project meets the off-street parking requirements.
Motion by Hardie, seconded by Stiles, to approve the plat subject to waiving lot frontage
requirements for Lot 2 of Kress Place. Motion carried by the following vote: Aye - smith,
Hardie, Christ, Bird, Stiles, Schlitz and Nagle; Nay - None.
ACTION ITEM FINAL PLAT RUBLOFF DEVELOPMENT GROUP, INC.: Application of
Rubloff Development Group, Inc. for the final plat of Asbury Plaza No. 3 located north of
the Northwest Arterial. ~
David Schneider, Schneider Land Surveying, reviewed the proposed final plat. He
indicated that Rubloff is preparing to plat off this part of the property to sell to another
developer. Neither lot will have frontage on a public street.
The Commission discussed the plat reviewing the PUD approved for Corey Development
in 1996. The Commission reviewed planned access from subject lots tothe Northwest
Arterial and proposed schedule of improvements for Asbury Plaza.
Motion by Hardie, seconded by Christ, to approve the final plat subject to lot frontage
requirement for Lot 1 and Lot 2 of Asbury Plaza No. 3. Motion carried by the following
vote: Aye - Smith, Hardie, Christ, Bird, Stiles, Schlitz and Nagle; Nay - None~
ACTION ITEMtSITE PLAN REVlEW~IIW ENGINEERS & SURVEYORS: Application of IIW
Engineers & Surveyors/Michael A. Jansen, to review a site plan for Phase II of Platinum
Plaza located on Associates Drive.
Mike Jansen, IIW Engineers & Surveyors, reviewed the site plan for Platinum Plaza, Phase
II, located north of the Golden Corral on Associates Drive, two-story office building with
parking and additional access.
Staff Member Kritz reviewed the staff report stating that the Commission reviewed Phase I
of this development in 1999.
Motion by Hardie, seconded by Smith, to approve the site plan for Phase II of Platinum
Plaza. Motion carded by the following vote: Aye - Smith, Hardie, Christ, Bird, Stiles,
Schlitz and Nagle; Nay - None.

PUBLIC HEARING~REZONING~STOVER: Application of Greg and Peggy Stover to
rezone property located at 1145 Locust Street from OR Office Residential District to OC
Office Commercial District.
Greg Stover, 1145 Locust St., reviewed his request noting he needs to have a restaurant
license in order to run his bed and breakfast and serve food for private parties and
progressive dinners. He indicated that this use will be far less intense than the previous
funeral home use. He indicated there is parking on the comer of 12~h Street at the rear of
the property.
Staff Member Kritz reviewed the staff report indicating that this request does not fit into any
established zoning districts. The Zoning Board of Adjustment approved a conditional use
permit with the condition that the pamel is rezoned to OC Office Commercial. He said the
neighborhood is a mixed use with the library, Stout House, Masonic Temple and
residential uses in the area. He agreed that the funeral home use is a more intense use of
the property than the requested use and will have less demand for on-street parking.
No one spoke in opposition to the request.
Chairperson Bird commented that this request is similar to the recent razoning of Calvary
Baptist Church property on Asbury Road. Both restaurants and bars/taverns are
conditional uses in the OC Office Commercial District. The request for a conditional use
has been approved by the Zoning Board of Adjustment pending rezoning approval.
Motion by Stiles, seconded by Smith, to approve the rezoning request. Motion carried by
the following vote: 'Aye - Smith, Hardie, Christ, Bird, Stiles, Schlitz and Nagle; Nay -
None.
PUBLIC HEARING[REZONING~MCNAMER: Application of Martin McNamer/Harvest
Development Group, Ltd., to rezone property located at 4100 Asbury Road from AG
Agricultural District, R-3 Multi-Family Residential Distdct and C-2 Neighborhood
Commercial District to R-2 Two-Family Residential District, R-3 Multi-Family Residential
District and C-2 Neighborhood Commercial District.
Marty McNamer, 1199 Hunters Ridge, representing Harvest Development Group, Ltd..
reviewed the rezoning request of the former Hilby property along Asbury Road.
Commissioner Hardie voiced concern regarding the proposed C-2 zoning north of the
existing C-2 zoning. He spoke in support of downsizing the amount of C-2 zoning in the
subdivision, but wants to see a PUD-like result on the proposed C-2 land.
Staff Member Kritz reviewed the staff report noting that the proposed C-2 zoning will
reduce the number of acres dedicated to commercial zoning, while the proposed for R-2
and R-3 zoning will allow a greater flexibility in residential development of housing types.

Mark Gremmels, 3662 Seville Drive, voiced concern regarding traffic along Asbury Road.
Virgil Blocker, 1850 Carter Road, representing Resurrection Church, voiced support of the
project.
Mr. McNamer noted that Asbury Road is designated as a minor arterial. He also noted
that Matthew John Drive will be a collector street and that there will be two accesses to
Asbury Road from the residential portion of the subdivision.
Commissioner Stiles spoke in favor of the request. Commissioner Hardie spoke in support
of the request especially with the reduction of C-2 zoning, but asked that the C-2 area be
designated as PUD or a C-2 with conditions. Commissioner Schlitz also spoke in support
of the request and indicated he supports C-2 zoning at the location requested. Discussion
followed concerning the request.
Motion by Christ, seconded by Smith, to approve the rezoning request. Motion carried by
the following vote: Aye - Smith, Hardie, Christ, Bird, Stiles, Schlitz and Nagle; Nay -
None.
PUBLIC HEARING~TEXT AMENDMEN'I3,CITY OF DUBUQUE: Application of the City of
Dubuque (tabled) to amend Section 2-8 Fences of the Zoning Ordinance to allow higher
fences on double frontage lots.
Motion by Hardie, seconded by Christ, to table this agenda item to the next Zoning
Advisory Commission meeting. Motion carried by the following vote: Aye- Smith, Hardie,
Christ, Bird, Stiles, Schlitz and Nagle; Nay - None.
