Council approve the first amendment to the Subrecipient Agreement with the Dubuque
Community School District and authorize the Mayor to execute the amendment on
behalf of the City.

BACKGROUND
The City of Dubuque entered into a Community Development Block Grant (CDBG)
Subrecipient Agreement with the Dubuque Community School District on March 21,
2022, to hire an Archaeological Firm to complete the required Phase I Survey requested
by the State Historic Preservation Office (SHPO) as part of the Environmental Review
for the redevelopment of the playground at Lincoln School, which also serves as a
public park during non -school hours. Due to the scope of this survey, it is necessary to
have preliminary plans drawn up for the playground to inform the archeological survey
process.
DISCUSSION
The original Subrecipient Agreement specified the funding amount to be $25,000, based
on the scope of work and level of detail that was to be provided for the Phase I
Archeological Survey.
The playground at Lincoln School has an area covered in asphalt that was conceptually
to be converted to green space. To adequately survey this area would require breaking
up the asphalt and use an auger to core to an adequate depth. The asphalt area would
then need to be returned to its original state until the construction can be completed. An
alternative is to have an engineering survey and preliminary design completed to narrow
the scope of the area for the Archaeological Survey; the amended total of this
agreement is $35,000 to cover the engineering survey, preliminary design, and Phase I
Intensive Archaeological Survey.
The CDBG Annual Action Plan has adequate funds allocated to the Lincoln Outdoor
Wellness Project to cover these expenses.
RECOMMENDED ACTION
I recommend the City Council approve the first amendment to the Subrecipient
Agreement with the Dubuque Community School District and authorize the Mayor to
execute the amendment on behalf of the City.
RESOLUTION NO. 229-22
RESOLUTION AUTHORIZING THE FIRST AMENDMENT TO THE CDBG
SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF DUBUQUE AND DUBUQUE
COMMUNITY SCHOOL DISTRICT
Whereas, the City of Dubuque and Dubuque Rescue Mission entered into a CDBG
Subrecipient Agreement dated March 21, 2022 with respect to the matters specified
therein for the archaeological survey and planning costs; and
Whereas, the parties desire to modify the Subrecipient Agreement as set out in the
First Amendment to the Subrecipient Agreement attached hereto; and
Whereas, the Dubuque Community School District Lincoln Wellness Project
provides services to low- to moderate -income areas.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the First Amendment to the CDBG Subrecipient Agreement be
approved.
Section 2. That the Mayor of the City of Dubuque is hereby authorized and directed
to execute said Amendment on behalf of the City of Dubuque, Iowa.

FIRST AMENDMENT
TO
SUBRECIPEINT AGREEMENT BETWEEN
THE CITY OF DUBUQUE
AND
DUBUQUE COMMUNITY SCHOOL DISTRICT
This First Amendment to Subrecipient Agreement, dated for reference purposes the 16th day
of May , 2022, is made and entered into by the City of Dubuque, Iowa, a Responsible Entity
administering Community Development Block Grant funds (City), and the Dubuque Community School
District (Subrecipient).
WHEREAS, City and Subrecipient entered into a Subrecipient Agreement dated March 21, 2022
(the Subrecipient Agreement); and
herein.
WHEREAS, City and Subrecipient desire to amend the Subrecipient Agreement as set forth
NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL TERMS AND COVENANTS CONTAINED
HEREIN, CITY AND SUBRECIPIENT AGREE AS FOLLOWS:
Section 1. Section A.3 of the Subrecipient Agreement is hereby amended to read as follows:
A.3 Protect Budget
The City agrees, subject to the terms and conditions of this Agreement, to compensate the
Subrecipient for the Statement of Work outlined in Exhibit A, not to exceed $35,Q0, OQ
Section 2. Exhibit A of the Subrecipient Agreement is hereby amended to read as follows:
Exhibit A — Statement of Work
This contract covers soft costs related to planning and administration for the Lincoln Wellness
Project. Activities under this agreement may include:
• Under the consultation of the City of Dubuque's Planning Department, procurement of
an Archaeological Firm to perform a Phase I Intensive archaeological survey as
requested by the State Historic Preservation Office for the purposes of Section 106
Review. All archaeological work should be completed by a Secretary of Interior qualified
archaeological consultant and follow the Association of Iowa Archaeologists Guidelines
for Archaeological Investigation (2021).
• Expenses for Architectural and Engineering consultation forpla� development.
The National Objective that is met by these activities is Low -Mod Area Benefit.
This project benefits all residents in the neighborhoods surrounding Lincoln School, 555 Nevada
St., Dubuque, IA 52001, in which at least 51% of the residents are LMI persons.
Section 3. Except as modified herein, the Subrecipient Agreement shall remain in full force and
effect.
