Resilient Community Advisory Commission One, 3-Year term through July 1, 2025 (Expiring term of Kohlhaas) Applicant: Sandra Evans, 1276 South Grandview Avenue Title 2 Chapter 8 ARTS AND CULTURAL AFFAIRS ADVISORY COMMISSION Amended 10-6-14 Amended 5-18-15 Amended 12-16-19 2-8-1: COMMISSION CREATED: There is hereby created the Arts and Cultural Affairs Advisory Commission. 2-8-2: PURPOSE: The purpose of the commission is to build the community through arts and cultural programs by developing visibility, funding, audiences, information, and partnerships. The commission plans, promotes, and encourages programs to further public awareness of, accessibility to, participation in, and support for the artistic and cultural development of the city and makes recommendations to the city council regarding the establishment of arts and cultural policies and programs, the expenditure of budgeted funds on arts and cultural activities, and the implementation of programs. 2-8-3: INTERNAL ORGANIZATION AND RULES: The commission may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with this Code of Ordinances or the Iowa Code. 2-8-4: PROCEDURES FOR OPERATION: All administrative, personnel, accounting, budgetary, and procurement policies of the city govern the commission in all its operations. 2-8-5: MEMBERSHIP: A. The commission comprises seven (7) residents of the city, appointed by the city council. B. Special Qualifications: 1. Four (4) members must have significant knowledge and demonstrate interest in one or more areas of the arts including music, dance, literature, visual arts, theater, folk arts, media arts, design, or arts education. 2. Two (2) members must be from the business and professional community, one (1) of whom lives or works in the cultural and entertainment district. 3. One (1) member must be at -large who lives or works outside the cultural and entertainment district. 2-8-6: OATH: Each person, upon appointment or reappointment to the commission, must execute an oath of office at the first meeting of the commission following the appointment or reappointment or at the city clerk's office any time prior to the first meeting of the commission. 2-8-7: TERMS: The term of office for commissioners is three (3) years or until such commissioner's successor is appointed and qualified. 2-8-8: VACANCIES: Vacancies must be filled in the same manner as original appointments. 2-8-9: OFFICERS/ORGANIZATION: The commissioners must choose annually a chairperson and vice -chairperson, each to serve a term of one (1) year. The chairperson must appoint a secretary, who need not be a member of the commission. The commissioners must fill a vacancy among its officers for the remainder of the officer's unexpired term. 2-8-10: MEETINGS: A. Regular Meetings: The commission must meet monthly. B. Special Meetings: Special meetings may be called by the chairperson or at the written request of a majority of the commissioners. C. Open Meetings: All meetings must be called and held in conformance with the Iowa Open Meetings Law. D. Attendance: 1. In the event a commissioner has been absent for three (3) or more consecutive meetings of the commission, without being excused by the chairperson, such absence will be grounds for the commission to recommend to the city council that the position be declared vacant and a replacement appointed. 2. Attendance must be entered upon the minutes of all meetings. E. Minutes: A copy of the minutes of all regular and special meetings of the commission must be filed with the city council within ten (10) working days after each meeting, or by the next regularly scheduled city council meeting, whichever is later. F. Quorum: Four (4) commissioners constitute a quorum for the transaction of business. The affirmative vote of a majority of the commissioners present and voting is necessary for the adoption of any motion or resolution. 2-8-11: COMPENSATION: Commissioners serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official commission business within the limits established in the city administrative policies and budget. 2-8-12: REMOVAL: Except as provided in 2-8-10(D)(1), the city council may remove any commissioner for good cause. 2-8-13: POWERS: The commission has the following powers, duties, and responsibilities: A. To promote, educate, and create awareness for arts and cultural activities; B. To develop and increase the market for arts and cultural activities; C. To facilitate and convene partnerships for arts and cultural activities; D. To develop funding options and allocate budgeted funding for arts and cultural activities; E. To act in an advisory capacity to the city council in all matters pertaining to the arts and cultural environment; F. To make recommendations to the city council on the allocation of budgeted city funding for arts programs and services; G. To recommend applications and solicitations for grants, gifts, and donations from individuals, groups, organizations, and agencies, both private and public, for any purpose consistent with the purposes of the commission; H. To make recommendations regarding city sponsorship of public programs to further the development of public awareness of and accessibility to arts and culture programs and activities; I. To work with area organizations on broad community issues in which a cultural perspective is relevant and desirable; and J. To engage in comprehensive planning for the cultural development of the city. 2-8-14: COOPERATION WITH OTHER AGENCIES: The commission cooperates with other arts and culture groups interested in the promotion and implementation of arts and cultural activities which are in the best interest of the city. 2-8-15: SOLICITATION AND ACCEPTANCE OF DONATIONS: The commission may solicit and otherwise accept donations and gifts of money, personal and real property, and personal services on behalf of the city. Through the years I and my wife have received the Alisa Darling Award for Contributions to the Cultural Life of Dubuque, a 365 Impact Award and during the cities' Sesquicentennial celebration in 1995 were included in a traveling display titled Dubuque Gallery of Artists based on the city's 50 most influential artists throughout its history. Since I came to Dubuque in 1979, 1 have seen and experienced tremendous growth in the arts at the local level. My wish is to help continue and expand on that growth. Over time I have worked with many of the art groups in town; including The Dubuque Museum of Art, The National Mississippi River Museum and Aquarium, The Julien Dubuque International Film Festival, The Dubuque Symphony, The Grand Opera House, The Fine Arts Players, The Dubuque Historical Society, and many others, which obviously includes Fly -By -Night Productions. For me it has been about collaboration between the different artistic groups, different individual artists and myself. Theatre is based on collaboration, where a community of different artists come together to create an event with a single cohesive vision. Theatre is an environment where a variety of ideas, opinions and life experiences are welcomed; even when they differ from one another — at some point you have to come together, you have to work together and reach an agreement about the artistic vision for the good of the production. In addition to my experience, I believe collaboration is a strength I will bring to the commission. I hope to further develop this collaboration in order to spur future growth within the varied arts organization and in the individual artists active in our community. My goal is to help the arts to continue to move forward. Describe your experience It begins in high school where my classmates and circle of working in diverse close friends at Westwood High School (Mesa, Arizona) were a environments: very diverse group in terms of race, color and nationality, especially in the Arts community. But this type of environment really exploded for me when I attended graduate school at the University of Iowa. My first -year teaching assistantship was to serve as the technical director for, what was then on campus called, the Black Action Theatre Company — yes, at the time this program was separate from the main stage productions; even being staged in the old armory and not on the main stage. So, I spent my first year in this environment working almost totally with people of color. It was a year of growing, a year of making some really close friends and a year of discovering new theatre. I would say that during the second semester I got one of the highest compliments I have ever gotten when members of the company asked me to direct one of their shows. I became the first Caucasian to direct a production when I staged Sister Son/ji. This then led to a change in how I cast future productions. For example, when I directed So Far From China, a play about a small family farm outside China, Kentucky; I cast the four family members based solely on talent. Therefore, the family was composed of two white actors, a black actor and a Latino actor. This viewpoint and philosophy continued when I moved to Dubuque. One of the first plays Fly - By -Night produced was an original script titled In the Matter of Ralph, a Black Man; the script told the stories of Ralph, a slave from Missouri who had come to Dubuque to earn his freedom, and Nat Morgan, the subject of current efforts to establish a memorial in town. Back in 1987 for many individuals in Dubuque this was the first time they became familiar with their stories. To this day Fly -By -Night continues to work to give voice to marginalized communities with many of our productions, but work still needs to be done in this area as we continue to work to build community. At Loras College I worked to increase the involvement of minority students in the theatre program and I believe I was highly successful in making LGBTQ+ students feel they had a safe creative home in the theatre. I also make a personal effort to engage a diverse community of artists by attending art events throughout the city, many involving minority artists and partaking in the Creative Cafes that have recently been started. But when we talk about diverse communities, we sometimes leave some communities out of the conversation. Recently I have begun to explore how to make play performances more accessible to the deaf and blind communities. In the first case finding a qualified ASL interpreter has proved challenging. Signing a play performance is very difficult and takes one to two interpreters with specialized skills. Local availability and cost are also factors. But I want to see if there is any possibility of at least having one or two performances signed; and eventually expanded to other art events; opening them to a new audience. The second group would be the blind. My thoughts here are based on my time at the Ice House Theatre where the following process was implemented. It starts with private time on stage when they are allowed to explore and feel the set so as to form a mental image of the play's environment. Next you do a sounding. The blind individual sits in their assigned seats in the house as another individual walks the stage announcing where they are on the set. In this manner, as audience, they learn to "see" where each character is by where their voice is being projected from on stage. Lastly, you make arrangements for them to hear what each character sounds like so they may recognize them by the sound of their voice. I am not sure if there is an audience for this in Dubuque but, it is a way of opening the Arts to other communities we don't often think about. Describe your experience Theatre covers a wide range of topics and subjects, far too engaging other community many for any one person to be an expert in all of them. So, as members to gather their a director, you are often seeking outside advice, input, input and opinions: information, and feedback. The following examples are once again highly selective. When I directed, I Never Saw Another Butterfly I brought in a historian to make sure I was accurate in depicting World War II concentration camps and to answer questions from the cast and crew. I also contacted the local synagogue so someone again could make sure we understood their beliefs and ceremonies correctly; and that we were not doing anything that might offend a member of their religion. This led to what I believe was a meaningful and important change to the script. In one section there was a prayer said in English, but we were informed that that would never be done, that the prayer would only be said in Hebrew. So, she taught us the prayer in Hebrew, and it became one of the more moving moments in the play. And also proved to be a valuable lesson to my students. When I staged a production of JB, a play based on the book of Job from the Bible I had a group of religious leaders I would often discuss the play with as I began to form my interpretation and vision for the script. In performance we had a talk back for the audience where we brought these individuals to discuss their perspectives on the story; bringing us (performers and audience) closer to understanding each other. We also had on display in the lobby a large painting a local artist had created based on the book of Job and he was at the talk back to give his artistic — and I note atheist — viewpoint. But the most common dialogue I have in modern theatre centers on the use of historical language and/or imagery. cannot count the number of times I have contacted someone whose experience or background are different from mine to get their reaction to the use of specific language, or imagery, in a play. Together we look at who is saying it, why it is being said and does the idea being expressed carry enough meaning to outweigh the effect of the language being used. As an example, there is always the question, if I change the language of a racist so as not to offend someone, do I make the racist more acceptable by make them less offensive? I would note that this is the same struggle our local school board is currently experiencing. At this point I can say I have always leaned to the point -of -view put forth by the person whose advice I seek, for it is not up to me to tell them how they should feel about, or react to, such language that has negative meanings within their personal heritage. The commission will issue subpoenas for witnesses in the same manner and for the same purpose on behalf of the respondent upon the respondent's request. As a dietitian at Mercy, I would often be consulted on Marshallese patients due to their diabetic history. Many understood and spoke little to no English, but fortunately we were able to translate with younger family members or through a language line app. I'm familiar with the upsetting history the US has with the Marshallese population and I'm familiar with many values and the culture of the Marshallese. Title 16 Chapter 10 HISTORIC PRESERVATION COMMISSION Amended 6-1-15 A. Commission Created: There is hereby created the Historic Preservation Commission. B. Purpose: The purpose of the commission is to: 1. Promote the educational, cultural, economic, and general welfare of the public through the protection, enhancement, and perpetuation of districts, individually designated historic properties, landmarks, and landmark sites of prehistoric, historic, architectural, archeological, and cultural significance; 2. C. Internal Organization and Rules: The commission may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with this Code of Ordinances or the Iowa Code. D. Procedures for Operation: All administrative, personnel, accounting, budgetary, and procurement policies of the city govern the commission in all its operations. E. Membership: 1. The Commission comprises nine (9) residents of the city, appointed by the city council. 2. Age Requirement. Residents must be eighteen (18) years of age or older. 3. Special Qualifications. a. One (1) resident from each designated historic preservation district, including historic districts hereinafter established. b. Four (4) at -large members. c. Each member must possess qualifications evidencing expertise or interest in architecture, history, archeology, law, construction, building rehabilitation, city planning, or conservation in general. d. Membership on the commission must comply with the provisions of Iowa Code §69.16A, relating to gender balance, and Iowa Code §303.34, subsection 3, relating to establishment of a commission to deal with matters involving areas of historical significance. F. Oath: Each person, upon appointment or reappointment to the commission, must execute an oath of office at the first meeting of the commission following the appointment or reappointment or at the city clerk's office any time prior to the first meeting of the commission. G. Terms: The term of office for a commissioner is three (3) years or until such commissioner's successor is appointed and qualified. H. Vacancies: Vacancies must be filled in the same manner as original appointments. In the event that a vacancy occurs in a seat which requires that the appointee be a resident of a historic preservation district and for which there is no application from a qualified resident, the city council must appoint a tenth commissioner, which appointment is temporary, and upon appointment of a qualified resident to the vacancy, the temporary appointment terminates. I. Officers/Organization: The commissioners must elect from its membership a chairperson and vice chairperson, whose terms of office are fixed by bylaws adopted by the commission. The chairperson presides over the meetings of the commission and has the right to vote. The vice chairperson, in cases of absence or disability of the chairperson, may perform the duties of the chairperson. The city manager must designate a city employee to serve as secretary to the commission. The secretary must keep a record of all resolutions, proceedings, and actions of the commission. J. Meetings: 1. Regular Meetings. The commission must meet at least three (3) times in a calendar year to maintain Certified Local Government status. 2. Special Meetings. Special meetings may be called by the chairperson or at the written request of a majority of the commissioners. 3. Open Meetings. All meetings must be called and held in conformance with the Iowa Open Meetings Law. 4. Attendance. a. In the event a commissioner has been absent for three (3) or more consecutive meetings of the commission, without being excused by the chairperson, such absence will be grounds for the commission to recommend to the city council that the position be declared vacant and a replacement appointed. b. Attendance must be entered upon the minutes of all meetings. 5. Minutes. A copy of the minutes of all regular and special meetings of the commission must be filed with the city council within ten (10) working days after each meeting, or by the next regularly scheduled city council meeting, whichever is later. 6. Quorum. Five (5) commissioners constitute a quorum for the transaction of business. The affirmative vote of a majority of the commissioners present and voting is necessary for the adoption of any motion or resolution. K. Compensation: Commissioners serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official commission business within the limits established in the city administrative policies and budget. L. Removal: The city council may remove any commissioner for cause upon written charges and after a public hearing. M. TITLE 2 CHAPTER 6 RESILIENT COMMUNITY ADVISORY COMMISSION Established 7-1-16 Amended 1-3-17 2-6-1: COMMISSION CREATED: There is hereby created the Resilient Community Advisory Commission. 2-6-2: PURPOSE: The purpose of the commission is to advise on city policies and practices to assure resilient outcomes; facilitate the ability to adapt to factors influencing the social/cultural, economic and environmental wellbeing of the community; prevent, prepare for, and recover from adverse vulnerabilities and change through coordination, data analysis, evaluation and citizen engagement; and to create a viable, livable and equitable community. 2-6-3: INTERNAL ORGANIZATION AND RULES: The commission may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with this Code of Ordinances or the Iowa Code. 2-6-4: PROCEDURES FOR OPERATION: All administrative, personnel, accounting, budgetary, and procurement policies of the city govern the commission in all its operations. 2-6-5: MEMBERSHIP: A. In other words, bodies cities are required to have under Iowa code when they provide certain functions or services, such as the planning and zoning commission, library boards and the board of adjustment, with appointed (not elected) members, must be gender balanced. Q: What does `gender balanced' mean? A: Gender balance means if the body has an even number of ap- pointees, it must be evenly made up of men and women. For exam- ple, three women and three men must serve on a six member board. If the body has an odd number of appointees, it must be "one half plus one" of either gender. For instance, if there are five members, three could be men and the other two women, or vice versa. Q: When do the changes go into effect? A: Cities must have gender balanced boards, commissions, com- mittees and councils by January 1, 2012. Making a chart of existing boards and upcoming vacancies, and/ or keeping track of current appointments and necessary recruit- ing periods would be a good start to ensuring your city is tracking gender balance, and is prepared for the January 1, 2012 implementa- tion date. Q: Is there any option if my city simply cannot find a person to serve on the board or commission of the needed gender? A: Yes. Under the new code section, cities that make a good faith effort to find a qualified person of the necessary gender to fill the position for a period of three months and are unable to do so may appoint a person to the position regardless of the gender balance requirement. Q: What constitutes a "good faith effort"? A: There is no hard and fast definition, but cities should be able to demonstrate a legitimate effort during the three month time period to recruit qualified members of the necessary gender, before appointing a member that creates gender imbalance. In addition, the legislation requires that cities must always "utilize a fair and unbiased method of selecting the best qualified applicants," regard- less of gender.
