Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicants, Steve and Kristin Vaassen, spoke in favor of the request. Steve and
Kristin went through a PowerPoint "picture walk" which showed the barn layout and
discussed its layout and the property's history. They noted they would like the barn on
its own lot for utility billing, estate planning, and safety purposes as first responders do
not know whether to arrive at the barn or the house further down the lane.
Rob Koelker, Buesing Associates, 1212 Locust Street, spoke in favor of the request
noting that Lot 1 would contain the barn structure and Lot 2 would contain everything
else on the property including existing house.
Staff reviewed the staff report, providing a history of the subject property as a mobile
home park and outlining the timeline of when the existing single-family residence, pump
house and barn -style accessory structure were developed on the site. Staff outlined the
previous Zoning Board of Adjustment approvals that allowed for the barn -style
accessory structure construction. They further explained that the barn -style accessory
structure is currently considered an accessory structure per the code, but the proposed
plat would allow the structure to function as a single-family residence. Staff provided an
overview of the submitted Plat of Survey of Annabel Lee Barn Lot, noting the plat meets
all other bulk regulations aside from the requested waiver of the required 50 feet of
frontage along a public or private street. Staff noted that access to the lot would be via
an existing easement and private driveway that is shared with their nearest neighbor.
There were no public comments.

The Zoning Advisory Commission discussed the request, and recommended approval
of the Plat of Survey of Annabel Lee Barn Lot as submitted, waiving the street frontage
requirement for Lot 1.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

A RESOLUTION APPROVING THE PLAT OF SURVEY OF: ANNABEL LEE BARN
LOT, IN THE CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey of: Annabel
Lee Barn Lot, in the City of Dubuque, Dubuque County, Iowa; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 1 on a public or
approved private street, where street frontage is required by Section 11-14 of Title 16 of
the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they
find that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage for Lot 1
on a public street or an approved private street.
Section 2. That the Plat of Survey of: Annabel Lee Barn Lot, in the City of
Dubuque, Dubuque County, Iowa is hereby approved, and the Mayor and City Clerk are
hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa
upon said Plat of Survey.

INTRODUCTION
The Plat of Survey of Annabel Lee Barn Lot proposes to subdivide an approximately 12-
acre existing lot located at the western terminus of Manson Road. The proposed Simple
Subdivision would create two lots on the property, Lot 1 and Lot 2. Lot 2 is approximately
11.23 acres and will continue to have the minimum required 50 feet of street frontage
along the Manson Road cul-de-sac. Lot 1 will be approximately .64 acres and will be
accessed from Manson Road via a 20-foot-wide paved access easement that runs down
the existing private driveway. Pursuant to the Unified Development Code (UDC) Chapter
5-2.7, a minimum 50 feet of frontage along a platted private or public street is required for
a lot within the R-1 Single -Family Residential zoning district. Because Lot 1 will not have
the required 50 feet of street frontage, the applicant is requesting a waiver of this bulk
regulation requirement.
DISCUSSION
The subject property is a long and narrow approximately 12-acre parcel located in the
Catfish Creek Valley at the end of Manson Road and is improved with a single-family
residence, a barn accessory structure, and a pump house accessory structure. The
property is bordered by a 12-acre parcel to the north which is under common ownership
as the subject parcel. The two parcels are buffered from adjacent residential and
agricultural properties by Catfish Creek and wooded hillsides. The subject parcel is
accessed by an 1,800-foot-long driveway from the end of the Manson Road cul-de-sac.
The closest neighboring single-family residence (2333 Manson Road) is located to the
southwest. There are two single-family homes (1720 & 1722 Creek Wood Drive) located
to the north within the Catfish Creek Valley, the nearest of which is approximately 675
from the newly proposed Lot 1.
The property was first subdivided circa 1900 as a mineral lot. The property was originally
developed as a county mobile home park circa 1950 that accommodated up to 43 trailers,
an office, and outbuildings. The property was annexed into the City of Dubuque in 1979.
The property was redeveloped circa 2000 and all the trailers were removed by 2011, the
open sewage lagoon was replaced with City sanitary sewer, and the existing single-family
residence was built on the lot in 2015. The barn -style accessory structure was constructed
in 2018. To date, the property owner has obtained the necessary permits and inspections
for the construction of the barn -style accessory structure and attached deck and patio.
Staff Memo — Plat of Survey of Annabel Lee Barn Lot - Dubuque, IA
As proposed, subdividing the existing approximately 12-acre lot will not modify the
residential zoning status of the proposed lots or surrounding properties, and will enable
the property owner to utilize the existing barn -style accessory structure on Lot 1 as a
single-family residence. As proposed, Lot 1 would be approximately .64 acres which is
consistent is with other residential lots in the surrounding area that generally range from
approximately.6 acres to over 2 acres. Lot 1 would be accessed from the Manson Road
cul-de-sac via a 20-foot-wide access easement that runs down the existing private
driveway. Emergency services access, city water and sanitary sewer, and fire hydrants
are adequate for both lots. The proposed Plat of Survey of Annabel Lee Barn Lot complies
with all other requirements of the City of Dubuque's subdivision regulations contained in
the Unified Development Code, with the exception of required 50 feet of street frontage
for Lot 1.
The UDC categorizes the proposed plat as a Simple Subdivision'. The Zoning Advisory
Commission and City Council are the reviewing authorities for a Simple Subdivision that
requires a waiver of bulk regulations. The Zoning Advisory Commission shall review the
plat to determine whether it is in substantial conformance with the Unified Development
Code and has the authority to waive bulk regulations.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Plat of Survey
of Annabel Lee Barn Lot and recommends approval as submitted subject to waiving the
50-foot street frontage requirement for Lot 1.
Enclosure
UDC Chapter 16-11-6 defines a Simple Subdivision as "Any subdivision or consolidation of property
in which no new streets, public or private, are proposed, which does not require the construction of
any public improvements, and which creates fewer than three lots."

property'~ does not include a unit that is used for any retail,
restaurant, banquet space, event center, or other similar use.
b. A county shall not adopt or enforce any regulation,
restriction, or other ordinance, including a conditional use
permit requirement, relating to short-term rental properties
within the county. A short-term rental property shall be
classified as a residential land use for zoning purposes.
c. Notwithstanding paragraph '"b ', a county may enact or
enforce an ordinance that regulates, prohibits, or otherwise

Our Community Standards prohibit members of the Airbnb Community from creating a
nuisance that disturbs the surrounding neighborhood. Hosts and guests can meet this
standard by making sure they clearly align on expectations for gatherings at listings.
While we believe most guests are respectful, we've created our Parties and Events
policy to provide clear guidance on what is expected from everyone. Until further notic
the policy prohibits:
• Gatherings of more than 16 people
• All disruptive parties and events
Guests who are reported for throwing a disruptive party or violating our rules on
gatherings of more than 16 people are subject to suspension or removal from Airbnb's
platform_ In some cases, guest reviews left after such parties may be removed. We may
also remove listings if we determine that a Host has authorized a party that violates this
policy.
Large gatherings
Until further notice, gatherings of more than 16 people —including both overnight guests
and visitors --are not allowed, regardless of Host authorization.
