Backqround The City Council identified Historic Building Rehabilitation/Preservation as a top priority for 2021-2023. While staff made sure policy and procedures reflected this priority, additional barriers and challenges may need to be addressed by the City Council. This is the first work session on this topic since the Historic Building Rehabilitation/Preservation became a City Council top priority. Discussion The City of Dubuque has five local Historic Preservation Districts; Cathedral, Jackson Park, Langworthy, Old Main and W. 11t" Street, which are also listed on the National Register of Historic Places. Additionally, the city has 12 additional National Registered Districts. Dubuque also has nine Conservation Districts. A Conservation Districts is an area designated by City Council which encompasses areas of historically and architecturally significant buildings, sites, structures, objects, or districts, including potential national or local historic districts; and is important to maintain and preserve for its economic and social value to the neighborhood and community. Not all structures located in conservation districts have architectural or historical significance. Individual properties are also eligible for the National Register of Historic Places. The City of Dubuque has 64 properties on the National Register of Historic Places. The city has documented nearly 5,000 properties in Dubuque that have historical and architectural significance, to date. As lowa's oldest city, Dubuque has a unique opportunity to preserve the oldest buildings in lowa. The City of Dubuque has a strong commitment to identifying and conserving its cultural resources. We recognize that our historic, architectural, and archaeological resources are keys to Dubuque's heritage, our economic prosperity and quality of life. These resources, like the Mississippi River, help form Dubuque's unique identity. Dubuque has a lot of historic buildings, but how can we ensure they stay maintained and preserved? Dubuque has ordinances that require buildings to be maintained, and if they are historic, they may need to follow certain rules when rehabilitating the structure. Unfortunately, the historic buildings preceded these rules by many years. This has led to several historic buildings falling into disrepair or being repaired/maintained in ways that did not preserve the historic features of the building. Some historic buildings were demolished, prior to any review or assessment, to become parking lots, green space or to build a new structure. Luckily, over the past forty years the city has documented nearly 5,000 properties in Dubuque that have historical and architectural significance. The City of Dubuque now has a strong commitment to identifying and conserving its cultural resources. We recognize that our historic, architectural, and archaeological resources are keys to Dubuque's heritage, our economic prosperity and quality of life. These resources, like the Mississippi River, help form Dubuque's unique identity. Several barriers exist when trying to maintain or rehabilitate historic buildings when it comes to enforcement. These structures are owned privately, so if the ordinances in place are not followed, enforcement is the only way to ensure the preservation of the historic building. Unfortunately, enforcement actions are slow. A municipal infraction needs to be issued and then heard before a magistrate. The court must then issue orders, which often give a reasonable timeline for repairs to occur. The owner is also allowed to appeal the courts decision. This appeal process can lead to years of time in court. Meanwhile, the property continues to deteriorate, often rapidly, with no remedy. For example, after many years in court, the City agreed to a settlement with a private property owner that allowed them the opportunity to pursue sale of two severely dilapidated, vacant buildings. After a year, if no sale occurred, the City would be awarded the two properties. Unfortunately, this led to one property deteriorating beyond repair and is now slated for demolition. The second property may be able to be saved. There are several properties in this same cycle of enforcement with no end in sight. Due to this significant barrier, city staff has focused on improving processes that require historic review when applying for a permit, or when a fire/catastrophic event occurs. The improvement of these processes has preserved the historic value of Dubuque homes significantly, one window replacement, roof replacement and siding replacement at a time. Additionally, all Federal Grants awarded to the Housing Department to rehab structures, require a Section 106 review with the State Historic Preservation Office. The Planning Department helps prepare those reviews to ensure maximum historic preservation methods are being proposed in those projects. However, in this process there is still a balance between affordability and historic value. It is not feasible to put a higher cost burden on a low-moderate income person by choosing historic value over affordable maintenance. City staff works hard to balance these two competing needs in the community. To make the largest impact in historic building preservation, a significant amount of investment is required. For example, the Historic Millwork District required $94.3 million in investment (as of 2017) and is still undergoing significant changes. The result is not measurable in dollars, but in terms of value the restoration of the historic buildings brings to the community. A vibrant neighborhood, booming retail and restaurant offerings, and a sense of place for residents. Those projects also brought a much needed 164 housing units to the market. For the future, the rehabilitation and preservation of historic building efforts can be strengthened with a greater focus on the reuse of vacant/abandoned buildings, additional access to funding for low-moderate income families living in historic structures, and stronger ordinances that allow for abatement if catastrophic deterioration is present in a historic building.
