The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.

Stephan Alt, attorney on behalf of Andrew and Debi Butler, who are looking to purchase
Lot 2 of the proposed subdivision plat, stated they are requesting the approval of the
proposed Plat of Survey of Y-Camp with the waiver of the 50-foot street frontage
requirements.
Staff reviewed the staff report, noting the submitted Plat of Survey of Y-Camp is located
north of the City owned Marshall Park and Arboretum property. Staff stated that the
proposed plat is a Simple Subdivision per the Unified Development Code, and the plat
would subdivide an existing parcel into two lots, noting the size of each lot. Staff noted
that Lot 1 would continue to be accessed from John F. Kennedy Road and Lot 2 would
not have frontage along a private or public street, thus requiring a waiver. Staff further
noted the applicant is seeking to gain access through the City owned Marshall Park and
Arboretum property. Staff stated that the applicant team is currently working with City
staff to establish an access easement that is acceptable for all parties.
There were no public comments.
The Zoning Advisory Commission discussed the request, and recommended approval
of the Plat of Survey of Y-Camp Place No. 2 as submitted subject to waiver of the 50-
foot street frontage requirement for Lot 2 upon receipt of an approved and finalized
access agreement with the City of Dubuque and the applicable entity(ies).

Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
conditionally approve the request.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION NO. 269-22
A RESOLUTION APPROVING THE FINAL PLAT OF SURVEY OF Y-CAMP PLACE
NO. 2, DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Survey of Y-Camp
Place No. 2, Dubuque County, Iowa that is within the City's 2-mile extraterritorial
jurisdiction; and
Whereas, the intention of platting the property is to sell Lot 2 of Y-Camp Place No.
2 Dubuque County, Iowa from the Young Men's Christian Association of Dubuque, Iowa
to The Butler Children's Garden Foundation, Inc.
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; with the condition that a waiver
of the 50-foot street frontage requirement for Lot 2 will only occur upon receipt of an
approved and finalized access agreement with the City of Dubuque and the applicable
entity(ies); and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto; and
Whereas, the City Council concurs in the condition of approval established by the
Zoning Advisory Commission.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage for Lot 2 on
a public street or an approved private street.
Section 2. That the Plat of Survey: Y-Camp Place No. 2, Dubuque County, Iowa is
hereby conditionally approved, and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa, upon said Plat of Survey
provided the Young Men's Christian Association of Dubuque, Iowa and The Butler
Children's Garden Foundation, Inc. shall execute theirwritten acceptance of the condition
hereto attached, acknowledging and agreeing:
(a) To secure an approved and finalized access agreement with the City
of Dubuque and the applicable entity(ies).
Section 3. That in the event the Young Men's Christian Association of Dubuque,
Iowa and The Butler Children's Garden Foundation, Inc. fail to execute the Acceptance
provided for in Section 2 herein within forty-five (45) days after the date of this Resolution,
the provisions herein shall be null and void and the approval of the plat shall not be
effective.

INTRODUCTION
The Plat of Survey of Y-Camp Place No. 2 proposes to subdivide an approximately 34.1-
acre existing located off John F. Kennedy Road within Dubuque County, just north of the
existing the City of Dubuque's Marshall Park and Arboretum property. The Simple
Subdivision' plat would create two lots on the property, Lot 1 and Lot 2. Lot 1 is an
approximately 15.4 acres and will continue to be accessed from John F. Kennedy Road
to the north. Lot 2 is approximately 18.7 acres that would not have frontage along a
private or public street. Pursuant to the Unified Development Code (UDC) Chapter 5-2.7,
a minimum 50 feet of frontage along a platted private or public street is required. Because
Lot 1 will not have the required street frontage, the applicant is requesting a waiver of this
bulk regulation requirement. The applicant intends to gain access to Lot 2 via an access
agreement with the City of Dubuque by which access would be granted through Marshall
Park/Arboretum. The City and applicant are currently working together to produce an
access agreement that is acceptable to both parties.
DISCUSSION
The subject property is an approximately 34.1-acre parcel that is irregular in shape. The
property is currently owned by the Y-Camp and is accessed from John F. Kennedy Road
along which the property has approximately 80 feet of street frontage. The proposed Plat
of Survey of Y-Camp Place No. 2 would subdivide the existing parcel into two lots, Lot 1
and Lot 2. Lot 1 would consist of approximately the northern half of the existing site,
would maintain the approximately 80 feet of street frontage, and would be approximately
15.4 acres in area. Lot 2 would consist of approximately the southern half of the existing
site and would be approximately 18.7 acres in area. As proposed Lot 2 would not have
frontage along a platted private or public street and therefore a waiver of the street
frontage requirement is being requested.
As proposed, the Plat of Survey of Y-Camp Place No. 2 does not identify how access to
Lot 2 will be provided. To address the matter of access, the applicant has been in working
to secure an access easement to Lot 2 through the City owned Marshall Park/Arboretum.
UDC Chapter 16-11-6 defines a Simple Subdivision as "Any subdivision or consolidation of property in
which no new streets, public or private, are proposed, which does not require the construction of any public
improvements, and which creates fewer than three lots."

If approved, the proposed Plat of Survey of Y-Camp Place No. 2 would not be released
for recordation until the matter of access has been resolved with all interested parties.
The UDC categorizes the proposed plat as a Simple Subdivision. The Zoning Advisory
Commission and City Council are the reviewing authorities for a Simple Subdivision that
requires a waiver of bulk regulations. The Zoning Advisory Commission shall review the
plat to determine whether it is in substantial conformance with the Unified Development
Code and has the authority to waive bulk regulations.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Plat of Survey
of Y-Camp Place No. 2 and recommends approval as submitted subject to waiver of the
50-foot street frontage requirement for Lot 2 upon receipt of an approved and finalized
access agreement with the City of Dubuque and the applicable entity(ies).
