SUBJECT: Acceptance of Subdivision Improvements in Stone Brook Center Third
Addition
INTRODUCTION
The enclosed material provides for City Council acceptance of the public subdivision
improvements that the developers, NEZTROP LLC, have recently completed in Stone
Brook Center Third Addition.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 279-21, the
developer of Stone Brook Center Third Addition was required to install certain public
improvements including street paving with curb, sanitary sewer main, watermain, storm
sewers and catch basins, street lighting, and fiber optic conduit and vaults and to
dedicate said improvements to the City upon completion. This commercial subdivision
includes three lots just northwest of the current Portzen Construction office property.
The lots are served by a single cul-de-sac street known as South Boulder Brook Court.
This street is an extension of the existing Boulder Brook Court which intersects Stone
Valley Drive.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On August 5, 2022, the owners requested City's acceptance of the public improvements
in Stone Brook Center Third Addition. Upon inspection by the City, it has been
determined that the public improvements required by Resolution 279-21 have been
completed in accordance with plans approved by the City Council and in conformance
with City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements as
described above. Maintenance guarantees for said public improvements shall be
provided by the owners, NEZTROP LLC, for a period of two (2) years from the date of
acceptance by City Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements in Stone Brook Center Third Addition.

RESOLUTION NO. 273-22
ACCEPTING PUBLIC IMPROVEMENTS IN STONE BROOK CENTER THIRD
ADDITION, IN THE CITY OF DUBUQUE, IOWA
Whereas, pursuant to Resolution 279-21, certain public improvements including
street paving with curb, sanitary sewer main, water main, storm sewers and catch basins,
street lighting, and fiber optic conduit and vaults were installed by the developer of Stone
Brook Center Third Addition, in the City of Dubuque, Iowa; and
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that
said public improvements in Stone Brook Center Third Addition be and the same are
hereby accepted.
Section 2. That a maintenance guarantee covering said public improvements
shall be provided by the owners, NEZTROP LLC, for a period of two (2) years from the
date of this resolution.
Passed, approved, and adopted this 15th day of August, 2022.
