Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion Jim Kress, representing the applicant, spoke in favor of the request, noting that the new plat consolidates three existing lots into two, and will allow construction of affordable housing. Staff reviewed the submitted simple plat, noting that Lot 2 is 753 square feet short of the required 5,000 square feet required for a duplex. Staff stated that the plat in all other respects complies with the Subdivision Regulations. The Zoning Advisory Commission discussed the request, noting that the plat consolidates three lots into two, and will not adversely impact adjacent properties by waiving the lot area requirement. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Respectfully submitted, Eugene Bird, Jr., Chairperson Zoning Advisory Commission Attachments Service People Integrity Responsibility Innovation Teamwork RESOLUTION NO. 201-01 RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1 AND LOT 2 OF KRESS PLACE Whereas, there has been filed with the City Clerk a plat of survey of Lot 1 and Lot 2 of Kress Place; and Whereas, said plat provides Lot 2 with 4,247 square foot of lot area, where 5,000 square feet is required by Section 42-19(b) of the Subdivision Regulations; and Whereas, said survey plat has been examined by the Zoning Advisory Commission and had its approval endorsed thereon; and Whereas, said survey plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 2 to have 4,247 square feet of lot area, where 5,000 square feet is required. Section 2. That the plat of survey of Lot 1 and Lot 2 of Kress Place is hereby approved, and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said final plat. Kritz, Associate Planner ~'~- 7, ~' Plat of Survey of Lot 1 and Lot 2 of Kress Place INTRODUCTION The submitted simple plat creates two new lots along W. 8th Street. The property is being resubdivided to allow the placement of a tri-plex on Lot 1 and a duplex on Lot 2. The plat is coming before the Zoning Advisory Commission, as Lot 2 does not have sufficient lot area for a duplex. DISCUSSION The plat of survey of Lot 1 and Lot 2 of Kress Place resubdivides existing property to allow for the construction of a new duplex and tri-plex. The Zoning Advisory Commission is being asked to waive the lot area requirement for Lot 2, as the Ordinance requires a 5,000 square foot lot for a duplex, where the proposal only creates a 4,247 square foot lot. The two lots in all other respects are compliant with the Subdivision Regulations for the City of Dubuque. The two buildings will share parking and have reciprocal access easements. Access to the property will be from W. 8th Street only. Staff does not anticiPate any adverse impact to the adjacent property resulting from approval of the submitted plat of survey: RECOMMENDATION Planning staff recommends that the submitted plat of survey of Lot 1 and Lot 2 of Kress Place be approved subject to the waiving of the lot area requirement for Lot 2~ KLK/mkr
